Agreement can either be in written or oral form, both are admissible. The only issue us proving beyond reasonable doubt that that oral agreement did happen, in this case transactions between them can be used to substantiate that.

It is always advisable to have agreement in written form but oral agreement is also admissible but harder to prove.

There has been plethora of precedence relating to this, The guy can recover his money, the only problem is that he may spend more than the money he intend to recover.
