Refer to the process that brought Hope uzodimma into power and yes in a 100m race an athlete that came 3rd can be declared winner if the athletes that came first and second are found wanting either for breaking doping rules or general track rules.

36 states and a territory
(36X100)+(120)
(2/3 of 3600) +(2/3 of 120)
2400 + 80 = 2480
25/100 × 2480 = 620

Stop wasting your time.. No court will declare someone in distant third position winner when the person that took first and got required constitutional spread is there... What is so special about the FCT if I may ask? Are the residents in the FCT more Nigerian than those in Kwara, Osun and likes? Answer is capital NO.

In a 100m race for example.. have you ever seen the athlete that took third declared winner over the ones in first and second position? Never!
Such illegality will never happen in Nigeria. Asiwaju Tinubu is president-elect whether you like it or not.
The law is faulty kind of. So if a candidate win all the states and fail to win Abuja, then he did not win. That's unfair. That section needs amendment. Some states are more special than the others though. Just like saying why is Maths and English more important than others during admission. In USA, they are some states that if you don't win, forget the presidency

If 25% of vote in Abuja (FCT) is solely required to win presidential election in Nigeria, every candidate will just focus on winning more than 75% of FCT vote. Let’s look at it from this angle: if a candidate wins all the 36 states with majority votes but failed to secure 25% in Abuja, is the candidate a winner or not? During Obasanjo’s regime , it has been declared by the court and constitution that Abuja has the same status as other 36 states. The constitution is not ambiguous.

(A) To gain admission to UNIZIK, a candidate must score at least C in 6 subjects including Mathematics and English. Even if you scored As in 9 subjects but had Fs in English and Maths, you have failed automatically.

The Admissions board by this demand confers special status on Mathematics and English even though they are still "subjects.

By implication, same situation applies to the 25% requirement in my opinion.

The Constitution by that section granted Special Status to Abuja as the Federal Capital Territory.

As long as Tinubu did not score 25% in Abuja, he is an illegal President Elect. Reason most world leaders are not congratulating him.

I knew it that Tinubu is your problem.

The answer is very simple:

Let the States be S and the Territory be t.

Thus the requirement is: A quarter of two thirds of S AND a quarter of t

You have 36 States (from at least 24 of which appliers are chosen) as well as 1 territory where to recruit its quarter from. Here, the firm recruits 25 appliers from each of the 24 States, AND 30 appliers from the territory, which is a total of 630
appliers.

The formula here is [(23×36)×(14×100)]+(14×120)=[(24×25)]+30

=630 appliers. QED

The second question doesn't change my answer. This is because even if the Territory is considered a State. The AND in the requirement has it compulsory that 25% must be recruited from that "State".

One place the the Federal Territory 25 percenters are making huge mistake is their implicit assumption that the Constitution gave votes cast in the Federal Territory greater weight compare to votes cast anywhere else.

The simple maths is, since two-third of 25% is 16.67%, converting everything to a whole number, it simply means while any vote cast by citizens with equal rights anywhere other than the Federal Territory is worth 1 in weight, that same vote cast in the Federal Territory is worth 1.5 in weight.

The Constitution did not imply such an imbalance in the weight of any votes, all Nigerians votes irrespective of where it is cast is worth 1 in weight.

The law is not the problem but people with sinister agenda trying to twist the sentences to suit their narrative.

Abuja is not even a state to start with.. just a city where Federal Capital is, so what is the fuss about FCT and declaration of winner?.

To me, Tinubu won the election clear and clean.. Obi is totally out of the picture cos he didn't get the required constitutional spread and he lost in 5 out of 6 geopolitical zones that we have.How can such a person be declared winner? For what na.

How did u feel after posting this rubbish? The constitution says a person must win 25% of vote in the FCT. CONSTITUTIONALLY we don't have a president elect. You believe the results INEC declared? The original results will pop out soon. Obi won the election. INEC rigged but dey forgot to cover up their tracks very well... U know. Tinubu knows he did not win. He knows he rigged. Even if he won with out any irregularities. He still can't be president because of alot of reasons everyone know. He is not fit. To be president.. let a fresh election be conducted. Tinubu is not qualified to contest in the first place. So he is out.. u gerit?

I believe u brought this cos of the confused interpretation by some on what the electoral law stipulates. From what u posted, it is obvious the territory is not a state, if it were a state u would have have correctly said 37 states... Why do we allow simple English to get us confused?
For example, let's use a class of 9 boys and 1 girl. I may say for u to emerge the class-rep, two-thirds of the 9 boys and the girl must be willing to give u half portions of their daily meal. Now this does not mean that for anyone to emerge, they must get two-third of half the daily meals of the 9 boys and half the daily meal of the only girl. A girl is not a boy, so u don't expect me to say 10 boys, that is where the AND comes in. The right interpretation be same as if I assume the only girl is a boy and say two-third of 10 boys or two-thirds of the 10 students. In the case of our country, "AND" there shouldn't confuse anyone, it is only so cos FCT is not a state and that is the only way of accommodating the entity (FCT) into the grammatical expression.

Maths and English asides being just like any other subject were exclusively spelt out .. that bestows double honor on both maths & english

Your logic would have made sense if one of the 36states were the one exclusively singled out
e.g in 36 states including Rivers, that bestows double honor on Rivers

But Abuja did not meet the 1st requirement to count as a state, so it enjoys one honor like every other state.

If the constitution acknowledges Abuja as a state in the 1st place, including abuja would have being the appropriate conjunction

25% in 2/3 of 36 states and fct means 25 people in each of 24 states. Mathematically, its means 24x25 which gives you 600

The one with the "doping" record here is Peter Obi cos he bought the LP ticket with money as against the provisions of the amended electoral act 2022 which states that.. a candidate must be a card carrying party member for over a period of six (6) months at least before contesting under the political platform.
We all know Peter Obi was a PDP man till some weeks to election when he crossed to Labour Party to become presidential aspirant. Going by Section 77 of same act, Obi's candidacy under LP is illegal, thus all votes he got are null and void.

Simple math

Two thirds of 36 states
(36x2)/3=24

25% of 100=25

25x24=600

And FCT

25% of 120=30

Total 600+30=630

Even a sophomore Law student can tell you that the framers of the constitution had in mind that a president of Nigeria who also administers Abuja, must secure the approval of residents of Abuja, through scoring at least, 25% of the votes of Abuja residents, beforehand.

The argument that a presidential candidate doesn't need to score 25% of votes of Abuja residents, is mere academic exercise.

My solution:

Let's designate States as X and Territory as Y.

There are 36 X and 1 Y. Thus two-thirds of X is 24 and two-thirds of Y is 2/3Y.

Thus 25% will be 25% of (24X + 2/3Y)

But X = 100 and Y = 120. Therefore the answer becomes:
25% of [24 × 100 + 2/3 × 120]
= 0.25 [2400 + 80]
= 0.25 [2480]
= 620

However, the another school of thought believe the answer will be 630. And their solution would be thus:
Two thirds only applies to the States and not the Territory. Thus the answer becomes:
25% of [24 × 100 + 120]
= 0.25 [2400 + 120]
= 0.25 [2520]
= 630

Another school of thought believe the answer will be 625. And this is the answer Tinubu supporters will go with. Their solution is thus:

There are two possible scenarios: one where the Territory is part of the two-thirds OR one who it isn't.
First scenario: 25% of [24 × 100 + 120]
= 0.25 [2400 + 120]
= 0.25 [2520]
= 630

Second scenario: 25% of [25 × 100]
= 0.25 [2500]
= 625

Thus we have two possible answers but the least of them is 625. So the answer is 625.

This is simple. When you are asked in an exam hall to answer question no1 and any other three question out of over 10 questions,do you go ahead answering any four questions without giving to heed to the almighty no 1 question?
