True, because a retired Chief of Naval Staff has zero official command authority over serving personnel. Everyone, including the Navy and Defence Minister know that the order did not come directly from the retired CNS to Yerima.

It came through a serving superior who was acting upon through informal influence.

That is why the probe is focusing on how a serving commander was made to deploy sailors to guard private property, not on Yerima personally obeying a direct order from a retired officer.

The duty was truly improper and irregular, but the average Navy lieutenant on the ground has no access to FCDA files to know that. All he knows is, "my commander posted me here" as the guard commander of the armed sailors posted there.

This is why the military is shielding him while investigating the chain of command that sent him there.

Yerima did not commit insubordination against the President. Insubordination in the military is refusing an order from a superior within the chain of command.

The FCT Minister, no matter how powerful, is not in that chain and has no authority to represent the president in the capacity of the military over an active personnel on duty. (legal or Illegal).

The President, as Commander-in-Chief, issues military orders through the Service Chiefs, never through a civilian.
Even Vice Admiral Ibas (retd.) during his six-month tenure as Sole Administrator of Rivers State could never command the military posted there during the tenure because he is civilian.

However, the order was not a lawful order and the Lieutenant was only doing eye service as he was not really under any obligation to follow the order because it is not a land owned by the military and the only thing the senior army officer that gave the order could have done was to go to court.

I am sure even the young officer would not be happy about the publicity he is getting as it can mar his career in the Navy.

Call it eye service, but refusal to perform it could result in an insubordination charge, since investigating the legality of the land is not his concern.

This issue can only be resolved in a court of law because:-
1) The Ex-CNS cannot give any order as his is now 100% civilian
2) The issue is not a military case and he cannot use military to resolve it as the constitution is very clear on it.
3) The Ex-CNS abused his privileges by using federal government time (using a serving military personnel) to pursue private issues
