Executive orders by a governor can stop large gathering of people, if such gathering can lead to a spike in death cases.

Remember the primary role of a governor is to protect lives and properties of it's citizenry.

So in this case, large gathering of people might lead to spike of covid 19 which invariably will cause loss of lives...and as such, he as the governor is performing his primary job, which is protection of lives, by preventing such scenario.

This is actually the submission of a senior lawyer though..

You can't wine and dine with someone for close to four years and then ditch him for the 'enemy's' camp at the most crucial time, it's unfair.
