The Silverbird Galleria, Victoria Island, Lagos, was ablaze with infectious energy and unbridled excitement on Saturday, August 8th, 2015, at the unveiling of the Dance with Peter reality show. Globacom will be giving away N6m, a three cars to winners of the show. The winner of the competition will get a cash prize of N3m, a Toyota Rav 4, and a spot in P- Square’s next music video. The second runner-up will N2m, a Honda Civic, and a spot in a Glo ambassador’s music video, while the third place will be get N1m, a Kia Rio, and a spot in a Glo ambassador’s music video. Auditions for the show will be held in Lagos, Port Harcourt, Benin and Abuja as well as in Accra, Ghana. Six dancers will be selected by the judges from each location for the real battle in Lagos. At the unveiling were Peter, one of the P-Square twin, dance queen, Kaffy; P-Squares’ choreographer, Nonso aka Don Flex and MTV Base’s Video Jockey (VJ), Ehis Okoegule. According to Peter, he developed the idea five years ago, and it was borne out of the fact that there was a dearth of dance shows on TV. The event witnessed performances from various dance crews such as Hillary Jackson’s dance crew, winner of the 2013 Glo X-Factor, DJ Switch, and Beat 99.9 FM’s Jimmie. Peter also feeling very generous gave out N100,000 each to two groups of dancers who slugged it out in an impromptu dance competition. Dance with Peter will run for 13 weeks; the first two weeks will be on profiling and auditions, while the next 10 weeks would be for the elimination series. The grand finale will be in Lagos with international superstars. The show will be broadcast on Africa Magic, AIT in Nigeria, TV3 in Ghana and ORTV in Benin Republic. Registration for the competition has started and it is open to only Glo Subscribers in Nigeria and Ghana. Registration costs N100 for Nigeria and 0.5GHc for Ghana. A UK-based group has claimed that more than £400bn of looted Nigerian money is stashed away in Europe, Asia and America. President Muhammadu Buhari has recently commented on the steps being taken by his government regarding the stolen funds : “Some monies were paid to individual accounts. We are identifying the financial institutions and countries that are involved.” According to The Punch, in a fresh development, Africa Secretariat made serious disclosures and suggested direct ways of recovering the looted amounts. The group’s coordinator Ben Oguntala on Friday, August 7, spoke on the matter: “The image President Buhari is projecting is his promise to fight corruption. He cannot do this alone and it is for this reason that we have sent the president our proposal for addressing corruption. When we met with the president on his visit to London (earlier this year), he asked us to find out how Nigerians in the Diaspora can contribute to the development of Nigeria and we see fighting corruption as a cornerstone of that change that Nigeria is leading across Africa. “The perpetrators thought they got away from the Nigerian law but now, finally, the law can be extended to bring them to account.” The official also said that Buhari had been advised to have an anti-graft agency established in Britain. The body would operate under UK and European legislation, with the cooperation of experienced international agencies. The commission will also give a window for perpetrators to confess and return their loots or face the book being thrown at them. “As part of the confession they give, the commission will demand details of how they carried out the corruption and the information will be used to plug the loophole in the commensurate sources in Nigeria to ensure we prevent such graft from happening again.” Amid the active anti-corruption moves, the senators of the last government have accused Buhari and his team of leading a selective anti-corruption war targeted at the officials of Goodluck Jonathan’s administration. President Muhammadu Buhari’s anti-corruption is drawing support from unexpected quarters – the opposition Peoples Democratic Party (PDP). A senior member of the party and two-time governor of the defunct Bendel State, Dr. Samuel Ogbemudia, tells Buhari to jail those who may be indicted on the looting of the treasury under the regime of former President Goodluck Jonathan. Ogbemudia’s statement came on the heels of the President’s claim, last week, that his administration had uncovered some of the banks in which the treasury looters stashed the stolen funds. Effort to recover the funds was a key leg of Buhari’s recent visit to the United States (US) where he met President Barack Obama and senior American officials to solicit their cooperation, and told his guests that about $150 billion had been stolen from Nigeria over the last four years, especially from the oil industry where transparency is significantly lacking. Governor Adams Oshiomhole of Edo State, who was on the US trip, followed it up, quoting an unnamed official of the American government as saying a minister under the Jonathan administration stole $6 billion. “All the information we read in the papers, if it is correct that some people looted the treasury under Jonathan, then they should be brought to book. If they are convicted, they will, certainly, go to jail”, Ogbemudia, also a retired army general, told Sunday Vanguard in an interview. But he had a caveat: All the allegations of corruption against the Jonathan administration officials should be properly investigated, to ensure the innocent is not unduly labeled a thief. The PDP leader also spoke on the search for Oshiomhole’s successor, the National Assembly crisis and the war against Boko Haram, among other issues. Excerpts: How is the Edo Mass Movement you launched to search for a credible successor to Gov. Oshiomhole doing? Edo Mass Movement is in top form, it is in every ward, local government and senatorial district in the state. At the appropriate time, Edo Mass Movement will show what it is capable of doing at the 2016 gubernatorial election. We did say the other time that we will support any party that has a good candidate. And if a party produces a candidate that does not meet our standard, we will look elsewhere for a credible one. What we are going to do is that once a political party comes up with its own candidate, we will invite the candidate for a chat, but if in his wisdom he thinks he does not need us, no problem. If he comes, we will interview him and see what he is capable of doing, ensure that he has a good background, that he will not let the people down. This is because we don’t want anybody that comes after Oshiomhole to mess up the state. The media should help us make sure that when political parties are deciding their candidates, they should take into consideration some of the issues we have raised. Are you looking at the issue of zoning of the governorship to a particular district? We will not be zoning , we will only interview those that are available. The party has the responsibility of zoning, not EMM because we don’t have the mandate. For example, if ten people come to us and say they are interested in the governorship, we will sit down and chat; at the end of it all, we will make recommendation to the executive of EMM. But, are you still a member of the PDP? Yes I am. Supposing you find a credible candidate, may be from APGA or APC, will your group endorse that person as the candidate? If I find any credible candidate from any party, I will recommend to the executive of EMM to inform the people, our supporters and members to assist that party. But, won’t your party accuse you of anti-party? Well, we have not defined yet what is anti-party activity; once we define it, I will limit myself to it. The definition has not been brought to my knowledge. What kind of governor are you searching for? A remarkable man, a man who thinks of others, just like the current governor, Oshiomhole. One who sees himself as a servant and is prepared to justify his election. But there is this fear in some quarters that this group may be hijacked by rich guber aspirants? (Laughter) It is not impossible but it is going to be difficult. I alone don’t make up EMM but we will ensure that does not happen. Now that everybody knows that votes count, they have to defend their votes and give it to whoever they think will appreciate it and will do exactly what he says he is going to do. Do you have any arrangement with the governor on this issue? The governor is the leader of this state and, therefore, we will do nothing that will upset his own plans. So we will continue to keep in touch with him. So what are your expectations in the 2016 guber race in Edo? We want the election of next year to set a good example on how a state can conduct election without leaving emotional scars. Everybody has to ensure towards peace and we want a transparent election; we don’t want interference from outside, those who are not supposed to take part should not be involved. We are aware that your party, the PDP, has zoned their guber ticket to Edo South. We also learnt the APC is doing same thing. How will the EMM come into this situation? If it is true that the PDP zoned the governorship to Edo South and APC is likely to do same thing, the job of EMM is to see which of the two can represent the interest of the state better, then we will support it. If those two are not satisfactory, then we will put up our own candidate, using another political party. Many people have accused President Buhari’s administration of being slow. Do you feel the same way? My impression is that those who are saying it have my sympathy because they have never run government before. If they had been in government, they would have known how difficult it is to put together a sincere administration. Buhari is laying the foundation for a good take off. I know he has not appointed Ministers but Ministers are meant to help the President and, if the President wants to appoint a Minister, he does that for specific purpose. Those blaming him are aware that he said he was going to reduce the Ministries, he has to reduce them first and look for technocrats who can deliver the goods for him. So this issue that he is slow is rubbish because, tomorrow, if he fails to perform, the same people will blame him. And I know Buhari, he cannot afford to fail Nigerians; so let’s give him a chance. Some of the Ministers who served under the administration of President Goodluck Jonathan have been accused of looting the treasury. Are you comfortable with that, being a leader of the former ruling party? All the information we read in the papers, if it is correct that some people looted the national treasury under Jonathan, then they should be brought to book. If they are convicted they will certainly, go to jail. But you cannot do that unless you investigate properly; so the Buhari regime should spend time to investigate and not to announce first that a man is a thief only to find out that he is not guilty. That will not help. Jonathan once described bribery and corruption as petty thief; if that is the new definition, let us see. This is the first time APC is in government; therefore, all the theories that they have been propounding along the line, this is the time to test them and it will take them time to assemble sufficient evidence of their genuine readiness to govern. I give them one year to prepare and three years to execute. If at the end of four years they encourage the PDP to come back, that will be good. The EFCC suddenly started biting and we also heard that our refineries will soon start operating in full capacity. How come all these started happening during Buhari’s administration? Every society, the way the people behave is the evidence of the type of leadership it has. It is a reflection of the quality of the leadership in that nation. If under the last government, the EFCC did not have sufficient urge to act, then we should know why. Now, no body is urging them on and they are working. I think they will continue to do so until somebody stops them. We are waiting for evidence amid all the rumours; we are waiting to hear that so so person who stole N10billion, is in custody or he has returned N9billion. It is not sufficient to suspect, you must have concrete evidence because, for too long, people have been suspected and called bad names when in fact they didn’t know anything about what they were being accused of. Do you approve of the calibre of the Service Chiefs appointed by the President will end Boko Haram and his strategies to fight insurgency? The sequence of events that have taken place since they started is the right step in the right direction. But our prayer is that the officers assigned to be fighting should have sufficient pressure and sufficient understanding to be able to pursue the objective. Fighting Boko Haram is not a war; if it were a war, all you need to do is to drop bombs all over the place, but that is not allowed; so you have to go in and fetch the individuals out and deal with them. But what is more important is the job of the intelligence unit, the operatives; they should go out and identify the man who is supplying arms to Boko Haram. The Boko Haram people are using weapons, arms and ammunition and they waste the ammunition and replace them after they fire. So they must be buying it from somebody. Which bank is opening the LPO for them or Letter of Credit, or which port are they discharging the arms, or to which airport is the plane bringing the ammunition land. The intelligent unit should find out all these and, once they find the man who is paying the boys, who is supplying the arms, then the war will be over. But if they allow the man to be hiding, resting, then we are in trouble. There is also this information that when the Boko Haram boys have worked till the end of the month, the leaders organize them to be shot so that they will not get salaries. The person sponsoring these people is a human being, he is a Nigerian, he will be found. If the person is not found, when the source of the fund is exhausted, there will be nothing left. How optimistic are you that the Chibok girls will be found? I am very skeptical about that, but if they are found, they will never be the same again. A lot of transformation may have taken place. Some people also alleged that they could have turned them to suicide bombers, but it depends on the orientation. What people call suicide bombers is this: they hire a girl and wrap her with bombs and tell her to walk towards a particular place. They will not tell the girl she will die. The man who will detonate that bomb will be monitoring the girl, when he feels she has gotten to the centre of the crowd, then he detonates the bomb. The little girl does not know what they want her to do until she goes into flames. The people involved in such operations are the ones our intelligence people should be looking for. They are easy to reach if they go round Burukutu bars and restaurants; such people, when they are drunk, they will start vomiting things to people; that is how we used to arrest such people. I believe that our troops need to work harder, not necessarily fighting, but on intelligence. Girls are better in collecting such information. I know the army has its own intelligence, but the Department of State Security is the one saddled with this responsibility to fish out people planting bombs through information. The army does only military intelligence, but the DSS deals more with civilians who are perpetrating this evil. What is your take on the lingering leadership crisis in the Senate? The House of Reps has been able to resolve its own, but that of the Senate is still there. What is the way forward? First, I believe that the way they make their bed is how they will sleep on it. A political party of substance gives instructions to its members. Many years back, many people who were picked to contest elections where made to sign undated resignation letter; so if they misbehave, you just date it. By the time they start explaining that it was not yesterday they signed it, it is already too late. Because political parties don’t do it that way, then these people have the right to do what they like. They think they are supposed to be independent of the executive and the judiciary, but then the party which put them forward to contest the election must have a say on what they do. So it is wrong for the National Assembly members to think they are completely independent of the political parties that brought them in. In NPN days, I was a member and they put me forward to contest election. On a D-Day, the Chairman of the party called me to his office and gave me a run down of what I was going to meet and that these are the instructions of the party. The Commissioners, these are what they should do, the Permanent Secretaries, do this and so on. And I looked at it and said there was no problem. I signed it. When we won, I was reminded that this is what I should be doing and I kept to the instruction, there was no argument. But maybe if I had on that occasion started selecting people on my own, maybe the party would have called me to order. Then everybody respected the Chairman of the party, his words were regarded as the law. So I think the APC leadership should meet more regularly, allow the status quo right now to remain with some modifications. And the party should re-organize itself and get every member of the National Assembly under the APC to sign a document that they will obey the instructions of the party. North Korea is to switch to a new time zone to
mark its liberation from the Japanese at the end
of World War Two, says state media. North Korea is currently in the same time zone as South Korea and Japan, which are nine hours ahead of GMT. But Pyongyang Time will see the clocks put back by 30 minutes on 15 August. State news agency KCNA said "wicked Japanese imperialists" had "deprived Korea of even its standard time" by changing the clocks during occupation. The entire Korean peninsula - then one country - was 8.5 hours ahead of GMT until Japan colonised it in 1910. payment The naira yesterday could not sustain the gains recorded on Wednesday, as it depreciated against the US dollar in the parallel market, closing at N222 to a dollar. This represents a depreciation of N7 from Wednesday when a dollar exchanged for N215 in Lagos and Kano, and N220 to a dollar in Abuja. Also, the Central Bank of Nigeria, CBN yesterday directed that banks should pay for their dollar purchases 48 hours in advance. Sources from the Bureaux De Changes (BDCS) said that the gains recorded on Wednesday could not be sustained yesterday due to the fact that the dollar sold to them by the CBN was bought by people that felt that the naira would fall as the CBN may not be able to sustain the sale of more dollar to the parallel market. Meanwhile, CBN has directed commercial banks to pay for their dollar purchases 48 hours in advance, after banning them from accepting foreign currency cash deposits to curb dollar demand and stem illicit financial flows. Reacting to the *development, BDC operators said banks would struggle to buy dollar on behalf of customers, while the ban on dollar cash deposits would stem speculation. The CBN in June curbed access to the interbank currency market to preserve its foreign reserves. The move led to the diversion of dollar demand to the black market, weakening the local currency. “We are now required to deposit the naira equivalent of our total forex bids to the central bank 48 The measures led to a sharp increase in interest rates on the interbank market, traders said. “The new measure has taken out some huge naira liquidity in the market and putting pressure on the cost of funds among banks,” one dealer said. The overnight lending rate jumped to 50 percent on Thursday from 12 percent the previous day, amid low liquidity as some banks scrambled to stock up on the naira to back up their forex demand with the central bank. Ugo Okoroafor, communications adviser to the CBN Governor had explained that the ban on dollar cash deposits with commercial banks was aimed at curbing the “increasing dollarisation of the economy.” Meanwhile, on Wednesday , it was gathered that the CBN issued a circular to sell additional $30,000 to all licensed bureaux de change (BDCs) in the country on Friday, apart from the weekly sale of $30,000 that the apex banks normally makes to each BDC. Earlier in the day on Wednesday , naira exchanged for as high as 235 to a dollar, but a parallel market source noted that the news of the CBN circular prompted various firms to hurriedly sell off the dollars in their possession leading to increase in supply of dollars to the market and thus crashing the exchange rate. The hurried sale is in anticipation that the market would be flooded by dollars when the additional sale is made by the apex bank on Friday. The official exchange rate remains pegged by CBN at N197 to a dollar. Vanguard investigations on Tuesday had revealed that the naira depreciation was as a result of panic buying of the dollar in the hope that it would further depreciate. Sources said that there was hoarding of foreign currency going on at the unofficial market. They said that the appreciation of the naira last week was temporary and that the exchange rate was most likely to return to its previous level. President Muhammadu Buhari on Wednesday
commenced the process of implementing the
United Nations Environmental Programme’s
report on the environmental restoration of
Ogoniland.
According to a statement by his Special Adviser
on Media and Publicity, Mr. Femi Adesina, the
development is in keeping with Buhari’s avowed
commitment to working for the development and
well-being of all Nigerians.
Adesina said the President took the decision to
fast-track the implementation of this based on
recommendations to him by the Executive
Director of UNEP, the UNEP Special
Representative for Ogoniland, Permanent
Secretaries of the Federal Ministries of
Environment and Petroleum Resources and other
stakeholders.
The presidential spokesman said one of the steps
approved by the President for immediate
implementation was the amendment of the
Official Gazette establishing the Hydrocarbon
Pollution Restoration Project to reflect a new
governance framework comprising a Governing
Council, a Board of Trustees and the Project
Management.
He said Buhari further approved that the HYPREP
Governing Council should be composed of
Ministry of Petroleum Resources (one
representative), Ministry of Environment (one
representative), impacted states -Rivers (one
representative), oil companies and NNPC (four
representatives), Ogoniland (two representatives),
United Nations System (one representative) and
the secretariat headed by the project manager.
Adesina added that the President also approved
the composition of a Board of Trustees for the
HYPREP Trust Fund, to include one representative
each from the Federal Government, NNPC,
international oil companies, Ogoniland and the
United Nations System.
The statement added, “Following a meeting held
on the directive of President Buhari, it was also
agreed that a contribution deposit of $10m will be
made by stakeholders within 30 days of the
appointment of members of the Board of Trustees
for the Trust Fund who will be responsible for
collecting and managing funds from contributors
and donors.
“A new implementation template has also been
evolved at the instance of President Buhari and
the environmental clean-up of Ogoniland will
commence in earnest with the President’s
inauguration of the HYPREP Governing Council

Nigeria’s former chief of army staff, Lieutenant General Kenneth Minimah, on Wednesday, August 5, accused the country’s elite of using Boko Haram terrorists to advance their selfish interests. Leadership reports that the ex service chief also alleged that the authorities neglected the health and vitality of the army by not ensuring adequate funding. Minimah, who was sacked in July and replaced by Major General Tukur Buratai, made the claim when he was delivering a speech at a ceremony held to commemorate his retirement. “The insurgency snowballed into a graver dimension because these people exploited the security challenge to further sectional, religious and political interests.” Kenneth Minimah He stressed the importance for the country’s leadership to create adequate conditions for recruitment, training and equipping in the army, insisting that a nation can be strong as long as its military is strong. Awka—TWO persons were beheaded at Eziagulu Otu, near the embattled Orient Petroleum Resources Ltd in Anambra East Local Government Area yesterday by armed men suspected to be from Ibaji in Kogi State, who allegedly attacked the people in their farms. Four others, who sustained injuries have been admitted at a private hospital in Onitsha. The attack came barely 24 hours after members of Board of Directors of Orient Petroleum informed Governor Willie Obiano of Anambra State, during a visit, that the company had acquired two new wells in Aguleri and would increase its crude oil production to 3,000 barrels per day in September. Vanguard gathered that the attackers, who were armed to the teeth, took the farmers unawares and as many of them ran into the river, the attackers caught six of them, killing two and injuring four. As the news of the attack reached the people of Aguleri in the upland, all those whose relations went to farm became worried. Shortly after, the victims were brought him. At press time, it could not be ascertained if some people in the area were still missing. SOS One of the distress messages sent to Vanguard during the attack read: “Information reaching our town indicates that Kogi people are attacking Eziagulu Otu and Enugu Otu in several groups and are about to overrun the area and the oil field facilities there.” Another message from the President General of Aguleri read: “Eziagulu Otu is currently under siege by our Kogi neighbours. “I am informed that serious fighting is going on and casualties have been recorded. We are at a disadvantage under their superior fire power. The story by Nduka Chiejina, Assistant Editor, went on to point out that “Two weeks after sharing tax proceeds from the Nigerian Liquefied Natural Gas, NLNG, the three tiers of government yesterday shared a larger amount of cash from the Federation Account for the month of June than they did for the month of May 2015.” With all due respects to my colleagues in the media, this is a story for the front page of every newspaper and headline news on electronic media. For those who have lately rained maledictions on the governors of Nigeria in general, and inexplicably Ogbeni Rauf Aregbesola of Osun state in particular, it might give them a pause for reflection on the true state of the nation’s economy. Without defending the governors against charges of profligate spending, the published allocation for June goes a long way towards sustaining the point that the fault is not entirely their own – irrespective of political affiliation, APGA, APC or PDP. Incidentally, the fault does not belong entirely to the Federal Government under Jonathan either. A lot of what has happened could be traced to our faulty federal system, as will be explained later and to external factors which are totally out of their control. The majour source of our current problem lies in the federal government assuming sole responsibility for determining the benchmark of price and volume of crude exports on which the annual budget is based, exclusively reporting the revenue generated without verification by the two other tiers of government, states and Local Governments, and declaring whatever the FG wanted as gross revenue, distributable revenue and Excess Crude revenue. It was a “Father knows best” system which had landed us in trouble. The states, from the 1970s, when crude became the mainstay of the economy, not just now, had been administered by mentally lazy people – both as Governors and Commissioners of Finance—without exception. Otherwise, why should states which depend on revenue from crude for up to eighty (80) per cent or more of their revenue allow the FG alone to determine all the parameters mentioned above? Why should the FG alone determine the benchmark, export volume, gross revenue and distributable income without checks and verification by the states? The Governors of states, up till now, had managed their relationships like members of a religious group based on faith in which the leader is totally trusted. “Faith”, meanwhile, “is not belief without proof, but trust without reservation.” (Elton Trueblood, in VANGUARD BOOK OF QUOTATIONS, p 55). Unfortunately for the States and LGs, the trust had been totally misplaced as the current controversy over the disappearance of US$2bn from the Excess Crude Account, ECA, had demonstrated. That there is a dispute at all is clear proof that the states and LGs now have started to exercise doubt – which should have been there all along. That no small group of individuals can be trusted with funds belonging to others had been the verdict of history. That is why there are independent or external auditors to verify what those in charge declare. Politicians, who should know themselves better than others should have been the last people to allow the fraud-prone system foisted on us by the military since 1967 till today to continue. The result, which should take some, but not all, the heat from the governors, is shown below between the allocations to states in 2006 and today 2015. In July 2006, the aggregate to states was N196.26bn when the price of crude was under US$45 per barrel. In June 2015, nine years after crude oil at US$56-60 per barrel, “Mrs Anastatia Nwaobia, Permanent Secretary of the Federal Ministry of Finance, said the sum of N449.68 was shared…the states shared N111.04bn. For further reference the states’ allocations in July 2006, were as follows: Abia, N3.96bn; Adamawa, N3.53bn; A/Ibom, N14.44; Anambra, N3.61bn; Bauchi, N4.10; Bayelsa, 13.16bn; Benue, N3.8bn; Borno, N4.1bn; C/River, N3.98; Delta, N15.8bn; Ebonyi, N3.0bn; Edo, N4.2bn; Ekiti, N3.08bm; Enugu, N3.3.29; Gombe, N3.15bn; Imo, N4.37bn; Jigawa, N3.92bn; Kaduna, N4.29bn; Kano, N5.55bn; Katsina, N4.30bn; Kebbi, N3.3.59bn; Kogi, N3.5bn; N3.12bn; N5.49bn; Nass, N2.99bn; Niger, N3.90bn; Ogun, N3.45bn; Ondo N6.95bn; Osun, N3.33bn; Oyo, N4.19bn; Plateau, N3.0bn; Rivers, N23.25bn; Sokoto, N3.72bn; Taraba, N3.4bn; Yobe, N3.39bn; Zamfara, N3.53bn. No state will collect anything close to that now. The year 2006 was two years after Obasanjo and Okonjo-Iweala imposed the ECA on the states and the Federal Government commenced robbing the states blind. In 2006-7 US$13-16bn was withdrawn from ECA for POWER PROJECT which has not seen the light of day till now. Thus today, states are receiving less than they did in 2006 –long before the minimum wage reached N18,000 per month and exchange rate escalated from N150 to N220 per US$1. The first question we must answer is, how was it possible that states received N196bn in allocation in 2006, and a mere N111bn in 2015? The astonishing answer is: the Federal governments of Nigeria under Obasanjo, Yar’Adua and Jonathan had increasingly kept more than their own share of the revenue as a result of which the states are being pauperized. The theft of states and LGs share of aggregate revenue, which started under Obasanjo, reached its peak under Jonathan. Between 2004, when ECA started and today, the states and LGs might have been robbed of close to a trillion naira because they were careless enough to allow the FG to determine everything about crude oil. In his ex parte application, Gilbert Nnaji, the senator representing Enugu east senatorial district, sought to restrain the IGP and the attorney-general of the federation, who are the two respondents to the suit, from taking further steps on the investigation of the alleged forgery. Justice Gabriel Kolawole held that he could not grant the restraining order at the level of ex parte hearing, since it was the same issue the plaintiff canvassed in their substantive suit. He held that, before the the decision on the ex parte are made, the IG and the AGF must appear in court to give their reasons why the prayers sought by the plaintiff should not be granted. “The court is a bit wary on an ex parte proceeding to allow the plaintiff [Nnaji] to have his day in court because the courts are not created or established to supervise the National Assembly in the way and manner it will run its own constitutional duties, except where its acts border on a substantial infraction of the constitution, which goes beyond its own internal rules or procedure, or the application of its standing order,” Justice Kolawole said. “To do otherwise is to work to subvert the hallowed constitutional principles of separation of powers upon which the machinery of government is proposed to be run and to be operated. “My decision is not to make orders directing both parties to maintain status quo as it is often misinterpreted by both parties.
