Nigeria’s President-elect, Asiwaju Bola Ahmed Tinubu is scheduled to inaugurate the iconic Rumuola-Rumuokwuta flyover and Magistrates Court building in Port Harcourt on the 3rd and 4th of May, 2023. The 1007.5 metres Rumuola-Rumuokwuta flyover which connects Rumuola road to Ikwerre road is the 12th flyover built by the Rivers State governor, Nyesom Ezenwo Wike’s administration since 2019. Governor Wike during an inspection tour of the Rumuola-Rumuokwuta flyover and Magistrates Court building in Port Harcourt on Wednesday, disclosed that the President-elect will pay two days visit to Rivers State next week. “To God be the glory. We are expecting the President-elect on the 3rd and 4th of next month to commission the 12th flyover and the Magistrates Court building. You can see the Magistrates Court building and how amazing it is. We commend the contractor too who has done this job, and quite on time. I don't think you can find this in anywhere in this part of the country.” Governor Wike explained that the President-elect was told when he came to campaign in Rivers State and paid a courtesy call in Government House , Port Harcourt in February, 2023 that he would be invited to commission some of the landmark projects of his administration. “We had invited presidential candidates of other parties like Labour, NNPP (New Nigeria Peoples Party), they all came and commissioned projects, and we did say to him (President-elect) that we believe that after the election we are going to invite him to commission projects too. And luckily, these two very important projects are ready.” The Rivers State governor said it is gratifying that his administration was able to commence and finish the construction of 12 flyovers within the last four years. According to him, Rivers people will attest to the fact that his administration has conscientiously delivered on the promises made to them. “Rivers people will of course attest to the fact that we have given our best and we thank God and give Him the glory that it has turned out this way. We are extremely happy and we can beat our chest, we can go home satisfied that we have not disappointed our people. “ Governor Wike explained that as of part of the activities to mark the inauguration of the incoming administration in Rivers State, several projects like the Intelligence Centre in Rumueprikom, remodelled Prof. Kesley Harrison and Dental and Maxillofacial hospitals among other projects have been earmarked for inauguration. “In fact, part of the activities to mark the inauguration of the new governor for the people of the State will be commissioning of other impactful projects. Remember when the IGP (Inspector General of Police) came last time to commission the Intelligence Centre (Port Harcourt), we did promise him that we are going to build another Intelligence Centre. GOV WIKE CALLS FOR ACCELERATED HEARING ON THE RIVERS VAT CAS[b][/b]E AS CJN DECLARES THE 2021 NBA ANNUAL GENERAL CONFERENCE OPEN Governor Nyesom Wike of Rivers State has stated that the case to determine the constitutionally empowered authority to impose and collect Value Added Tax (VAT) is a Nationally sensitive issue which Nigerians are eagerly waiting for its final outcome. He called on the Supreme Court to give the VAT case accelerated hearing in the interest of the country. Speaking on the role the NBA should play while giving a special address at the opening of the NBA Annual General Conference holding in Port Harcourt, the Governor said "never in our political history has Nigeria been so badly governed and denied of good governance with the Federal government woefully failing in its basic duties to provide for the wellbeing and security of its own citizens as we have experienced in the last six years." He went on to call on the NBA to resolve against the easy path of pasitivity but find the courage and inspiration through positive activism to fight for good governance, democracy, judicial independence and the rule of law. He pointed out that the NBA becomes part of the problem when it remains discomfortingly indifferent and cowardly voiceless to the many issues and challenges plaguing the country. The Conference with the theme Taking The Lead, had Rev. Explains the case was instituted in 2020 but in July 2021 the Chairman of FIRS tried to ammend the Constitution through the back door to transfer VAT collection to the exclusive legislative. "In June N15.1bn was collected as taxes in Rivers State but 4.7bn was given to Rivers State, 46.4bn was collected from Lagos State and but Lagos was given N9.3bn. Kano generated 2.8bn and got 2.8bn. STATEWIDE BROADCAST BY GOVERNOR NYESOM EZENWO WIKE ON 6th SEPTEMBER 2021 My dear people of Rivers State As we all know, following the recent judgement of the Federal High Court, Port Harcourt, which upheld the constitutional right and authority of State Governments to impose, collect and utilize value added taxes (VAT) within their respective territorial jurisdictions, the Rivers State Government enacted the Rivers State Value Added Tax Law 2021 to regulate the effective administration of VAT in Rivers State. 2. As expected, the Federal Government, through the Federal Inland Revenue Service (FIRS), disagreed and filed an appeal coupled with a request for stay-of-execution of the judgment before the Federal High Court. 3. While the appeal was pending and without any stay-of-execution of the subsisting judgement, the FIRS went about to bully corporate bodies and business entities from paying the VAT to the Rivers State Government even when they knew that an appeal does not serve as a stay neither was there anything to stay in a declaratory judgement. 4. As a mere agency of the Federal Government without any political authority the effrontery and impunity exhibited by the FIRS against the Rivers State Government was ill-advised and highly provocative. 5. However, being a government that believes in the rule of law we decided on our own to suspend the enforcement of the Rivers State VAT Law 2021 pending the outcome of the FIRS’s application for stay-of-execution. 6. Today, the FIRS has failed in its attempt to frustrate the enforcement of the State’s Law on VAT with the Federal High Court’s dismissal of its application for stay-of-execution of the judgement. 7. It is important to reiterate the fact that we did no wrong in exercising our legal right under our constitutional democracy to stop the continuing breach, denial and curtailment of the constitutional right of States to lawfully impose and collect value added and other related taxes within jurisdiction to the exclusion of the Federal Government. 8. And in doing so our singular and progressive objective was to contribute to the advancement of fiscal federalism by enabling the federating States to explore and exploit their potential and capacity for generating greater internal revenues with which to fund their development goals and reduce the outdated over-reliance on pitiable Federal allocation and other handouts. 9. Naturally, some States with presently low economic activities and ethically restrictive social policies with economic implications may be adversely affected for now. 10. But, this is not our own making. Like the right to derivation, this is also a constitutional prescription, which we all swore as political leaders to respect and defend as the supreme law of the land. 11. Above all, fiscal federalism remains the right path to economic self-reliance and sustainability for all our States and the benefits derivable from this case by all the States in the long run far outweigh the immediate revenue loss that some States may presently suffer. 12. All that is required is for all of us to wear our thinking caps as elected Governors to collectively fight for the greater devolution of resources, responsibilities and powers to the federating States. 12. It is therefore very unfortunate that some State Governors led by that of Katsina State are vainly conspiring to truncate this progressive reality in favour of the inequitable status quo so that the Federal Government can continue to rob Peter to pay Paul as the nation’s self-imposed tax master-general. 13. For us in Rivers State, we will continue to ensure and project our constitutional rights to access all possible resources we can take hold both within and outside our geographical boundaries to advance the progress of our State. 14. And with today’s judgement the way is now clear for the administration and enforcement of the Rivers State Value Added Tax Law 2021 across the entire State until otherwise decided and set aside by the Superior Courts. 15. Consequently, I hereby direct the Rivers State Revenue Service (RSRS) to ensure the full and total implementation and enforcement of this law against all corporate bodies, business entities and individuals with immediate effect. 16. All corporate bodies, business entities and individuals are advised to willingly, truthfully and promptly comply with their tax obligations under this law to avoid the full weight of the stipulated sanctions, including having their business premises sealed-up. 17. Let me warn that the Rivers State Government is fully in charge of the State and will not tolerate any further attempt by the FIRS to sabotage or undermine our authority to freely administer our tax and other related laws in our own State. Those who play with fire risks having their fingers burnt. Enough of the shenanigans. 18. I wish to further assure every resident that we shall as usual make effective use of the expected proceeds from this tax to accelerate the development of our State and improve the wellbeing of everyone. 19. Fellow citizens, let me also draw your attention to the alarming rate of transmission of the COVID-19 pandemic in our State. 20. The daily figures released form the NCDC show that both the transmission and death rates in the last two weeks have consistently been on a rising spiral because residents and visitors to the State have largely abandoned their responsibility to comply with the existing COVID-19 Protocols. 21. Clearly, we are headed for a serious health disaster of profound consequences if residents and visitors continue to behave as if the pandemic no longer exists or impotent in Rivers State. 22. This is a big lie and we cannot afford to continue to close our eyes to the dangers such irresponsible behaviour poses to the health, lives and livelihood of everyone. 23. Accordingly, I wish to remind residents of the subsisting protocols on regular washing of hands and use of alcohol-based sanitizer; maintaining social distancing; wearing of face masks at all public places, including transport vehicles and going for immediate testing and treatment whenever you notice any of the symptoms. 24. Furthermore, it has been proven that vaccinations are saving lives here and across the world and those refusing to take the vaccines for no certified medical reasons should know that they are endangering the rest of the citizens. 25. I therefore appeal to all residents to help protect yourself, your loved ones and the rest of the citizens by getting your jab at the designated health centres in the 23 Local Government Areas of the State as they become available. 26. I also appeal to religious leaders and churches to convince and encourage their followers and members to please go out and take the vaccines and comply with the covid-19 protocols in addition. 27. Although it remains our desire to keep the State open and allow citizens to go about their social, religious and economic activities unimpeded. 28. But we may be constrained to re-imposed the suspended COVID-19 lockdown measures across the State if the transmission of the disease continues to increase beyond tolerable limits. 29. Finally, we wish to reiterate that the ongoing demolition of shanties was borne out of the compelling need to safeguard lives and property across the State. 30. Our objective, which is gradually achieving is to deny the criminals these sanctuaries and hideouts from which they embark on their criminal activities and safely return to. 31. We therefore refuse to be blackmailed by those unpatriotic elements who are trying to stir false ethnic, religious or tribal sentiments around our patriotic commitment to advance the safety and security of residents. 32. Furthermore, we refuse to be intimidated by such baseless pranks. Rather, we will not rest until we clear the State of all shanties wherever they are located and restore sanity to our environment and achieve a better sense of comfort and security for everyone. 33. Once again, thank you all for your support, prayer and understanding as we continue to work together to advance our collective security, peace and progress. 34. Rivers State High Court has restrained Uche Secondus from parading himself as the National Chairman of the party. The order was given by a State High Court sitting in Degema local government area of Rivers while granting the experte order brought before it by some aggrieved members of the party. Justice O. Gbasam who granted the order also approved the suspension of Secondus as a member of the party pending the hearing and determination of motion on notice for interlocutory injunction. The development followed a suit No: PHC/2183/CS/2021 filed by Ibeawuchi Ernest Alex, Dennis Nna Amadi, Emmanuel Stephen and Umezirike Onucha against Uche Secondus (1st defendant) and the PDP (2nd defendant). The judge, after reading the affidavit in support of the motion of ex parte as well as the written address, and after hearing the submission of H.A. Bello, Counsel to the Applicants, granted the interim injunction barring Secondus from parading as the National Chairman, PDP. The order read: “An order restraining the 1st Defendant from parading himself as member of the 2nd Defendant or the National Chairman of the Defendant or performing the functions of national chairman of the 2nd defendant or calling, attending or presiding over any meeting of the 2nd defendant or any committee of the 2nd defendant at the Ward, Local Government or State level or calling for any Ward, Local Government or State Congress of the 2nd defendant or setting up committees for such Congresses or participating in any activity of the 2nd defendant whatsoever whilst on suspension as a member of the 2nd defendant pending the hearing and determination of the motion on notice for interlocutory injunction.” The judge further granted leave to serve, by substituted, means the originating summons, motion on notice, all orders made by the court and all subsequent processes on the respondent by pasting same on his gate at No.1 William Jumbo Street, Old G.R.A Port Harcourt. PROPOSAL FOR BILL ON BAN TO OPEN GRAZING IN RIVERS GETS APPROVAL *Rivers State Executive Council endorses mandatory registration of residents. Rivers State Executive Council has approved the proposed bill that will give legal backing to the ban on open rearing and grazing of livestock in the State. The endorsement was made at its meeting at Government House, Port Harcourt, which was presided over by Governor Nyesom Ezenwo Wike on Wednesday. Briefing journalists after the meeting on Wednesday, the Attorney General of the State and Commissioner for Justice, Prof. Zacchaeus Adangor (SAN) said it was impossible for the State to enforce the resolution of the Southern Nigeria Governors Forum on the ban on open rearing and grazing of livestock without an enabling law. According to him, the office of the Attorney General of the State did a draft of the legal instrument, which has been adopted by the council. “You will all recall that on the 11 May 2021, the Southern Nigeria Governors Forum meet in Asaba and in that crucial meeting adopted series of resolution, most critical of it was that open rearing and grazing of cattle will remain ban throughout Southern Nigeria. His excellency, Governor of Rivers State was part of that meeting. “But we realised that we don’t have any extant law criminalising or prohibiting open grazing. And so it has become necessary for the office of the Attorney General of Rivers state to propose a bill for consideration by the State Executive Council. “That bill came up before council for deliberation. And after exhaustive deliberation and discussion of the highlights of that bill, the same was approved by council for onwards transmission to the Rivers State House of Assembly for necessary legislative action.” Prof. Adangor said when the bill is passed into and assented to by the State governor, open grazing of livestock will be criminalised and prohibited in any part of the State. “Now, when that bill is passed into law, it will criminalise, prohibit open rearing or grazing of livestock in Rivers state. If you look at that bill, it is divided into four parts. “The first part deals with the objectives of the bill; that is what the bill intends to achieve and then also deals with the establishment of the state and local government livestock and ranch administration and control committees.” Prof. Adangor explained that livestock rearing activities will only be permitted within the precinct of a ranch and such ranch would have been certified by the State government. “The second part of the bill deals with establishment of ranches and issuance of ranching permit. Third parts deals with prohibition of open rearing and grazing of livestock offences and penalties therefor. “The final part of the bill deals with miscellaneous provisions including power to arrest, detain and impound trespassing livestock and the jurisdiction of the court to try offences. “In summary, once that bill is passed, no person will be allowed to openly graze livestock in Rivers State, except within the confines of a ranch. And to establish a ranch you must apply to the state committee for approval. And that committee having regard to the guidelines it is going to issue, may or may not issue approval to establish a ranch.” He also said that council approved proposed Rivers State Residence Registration Agency Bill that will make it mandatory for residents of the State to be registered, including any visitor staying in the state beyond two weeks. “We thought that it is necessary for Rivers State government to have a bill that will require mandatory registration of all residents in Rivers State. In other words, that bill makes provision for mandatory registration by every person who lives and does business in Rivers State. “That bill is going to establish an agency that will superintendent the implementation of that bill. So if you come to Rivers state and you are going to stay in the state for a period of more than 2 weeks, you will be bound to register. “Of course, you can register in person or register electronically. And if you fail to register, that constitute an offence under the bill when passed into law.” The Commissioner for Agriculture, Dr. Fred Kpakol also addressed the journalists and said that council approved the construction of a modern abattoir at Mgbuosimini in Rumuolumeni of Obio-Akpor Local Government area of the State. According to him, the new abattoir will be an integrated facility sitting on a 21 plot of land by the seashore and provide healthier beef for Rivers residents.
