NgeneUkwenu:You should know better than that; Courts determine cases based on THE EVIDENCE ADDUCED BEFORE THEM. No credible Court determines a case based on their personal knowledge of the facts of the matter. Allegations do not constitute evidence. Credible evidence has very strict Rules guiding it before any weight can be attached to it. Besides where the allegation is of rigging & malpractices which are mostly criminal in nature, the standard of proof becomes proof "beyond reasonable doubts"; I wish you knew how difficult that is to adduce but it is the same standard world wide not just in Nigeria. As an aside, it's always funny when the losing party in Nigerian elections shout rigging with a holier-than-thou attitude. Sometimes the party who lost rigged more & committed worse atrocities which may not have worked nonetheless so please give me a break; all parties rig; none are saints so no one should thumb up their nose at the Supreme Court who have been fairly consistent in their judgments. If Alex Otti wins today, I will take it in good faith and congratulate him |

It's 1.34am and I have just rounded up activities relating to preparations for today's legal tussle at the Supreme Court in respect of the Abia State Governorship Appeal filed at the Supreme Court by Okezie Victor Ikpeazu (Ph.D) against Mr. Alex Otti in Appeal No. SC/18/2016. I am going to sleep now but should be up around 7am and in the premises of the Supreme Court by 8am. I shall be bringing you a minute by minute, blow-by-blow detailed account of proceedings. sammyj:You are not really serious, are you? Arrested for what? You may not be a lawyer but even as a layman, some issues should be clear enough if only you would take the time to read the literature on it in detail. First of all, the Judgment of the Supreme Court ONLY recognized one of several competing factions of the Anambra PDP as the genuine State Exco; this has absolutely no implications as to who are the authentic candidates of the party. The SC did not mention the names of any of the competing candidates or the issue of their nomination even once in the entire Judgment. Neither Chris Ubah, Annie Okonkwo, Andy Ubah nor Stella Oduah were parties to the case in the Supreme Court & it is trite law that a Court cannot make a pronouncement or orders against persons who are not parties before it. Primaries are not conducted by PDP State Chapters but by a panel set up by the National Executive Committee of the party. So which ever faction is declared to be the genuine State Exco has no bearing on the authenticity or otherwise of the Primaries. Even more crucially, it is the National Execitive Committee of Parties that sign and submit to INEC it's lists/Nomination Forms of its candidates to contest elections on its platform in the entire country from House of Assembly, Reps, Senate, Governorship, Presidency. The only list of Candidates signed & submitted by State Excos are for Councilorship & LGA Chairmanship elections submitted to State Electoral Commissions, so again, who is or is not the authentic State Exco of the party as declared by the Supreme Court has no bearing on who the authentic candidates of PDP are. For the purpose of National elections (House of Assembly to President), there is only one party & it is the NEC of the party, not the State Exco (whether or not declared genuine by the SC) that determines the party's candidates & submits their names to INEC. In this case the PDP National Exco submitted the names of Andy Ubah & Stella Odua who then went on to contest & win the general elections. Finally, it is laughable to suggest that Chris Ubah & Annie Okonkwo should be given Certificates of Return when they never contested & were not on the ballot during the General Election. Section 141 of the Electoral Act is very clear on that: It provides that UNDER NO CIRCUMSTANCES should any Court declare as winner of an Election, any candidate who did not participate at ALL STAGES of the election; so while Chris Ubah & Annie Okonkwo purportedly participated in primaries, they never participated in the General Election. It's not like the learned Silk, Chris Uche does not know all these; who go comot sugar wey dem put for im mouth? ![]() |

Nigeria's Apex Court, the Supreme Court, will on Wednesday the 3rd day of February, 2016, hear Appeal No. SC/18/2016 & SC/19/2016 between Dr. Okezie Victor Ikpeazu & PDP respectively as Appellant's and against Alex Otti, APGA as respondents as well as the Cross Appeal filed by Alex Otti/APGA against part of the decision of the Court of Appeal, Owerri. It will be recalled that the Court of Appeal had reversed the decision of the Election Petition Tribunal which had earlier affirmed the election of Dr. Ikpeazu. The Court of Appeal annulled Governor Ikpeazu's election on the spurious & perverse grounds that there was over-voting in the three Ngwa LGAs where Ikpeazu hails from (Obingwa, Osisioma Ngwa & Isiala Ngwa North). The CA deducted all the votes massively cast for Dr. Ikpeazu by his kinsmen and pronounced Alex Otti winner of the election based on the results in the remaining 14 LGAs of Abia State. In coming to the unfounded conclusion that there was over-voting in those three LGAs, the Court of Appeal looked only at the figures of accreditation captured by the Card Reader machine while ignoring those captured manually by the ticking of the Voters' Register in respect of voters whose PVC details matched those in the Voters' Register but whose PVCs or finger prints could not be read by the Card Reader Machine. Thus the total number of votes recorded in the three LGAs was naturally higher than Card Reader Accreditation figures because the total votes was for both Card Reader accreditation and Voters' Register accreditation. In fact this was the case in ALL 17 LGAs of the State including Alex Otti's Arochukwu LGA & no one has explained why only the three said LGAs were singled out. The Court of Appeal therefore chose, in the case of these three LGAs, to rely on Card Reader accreditation which the Supreme Court has confirmed in the Zamfara Governorship and other cases, as not recognized by the Electoral Act while ignoring Voters' Register accreditation which is recognized by Section 49 of the Electoral Act as the legal mode of accreditation. More curiously, the Court of Appeal committed Constitutional "Hara Kiri" by declaring Otti winner of the election based only on the results of 14 out of the 17 LGAs of Abia State. When the result of one LGA was cancelled in Kogi, no results were declared until a supplementary election was conducted in that one LGA; the same in Bayelsa State, Akwa Ibom State and in every other State where elections have been faulted in one or more LGAs. This is because of the clear provisions of Section 179(2) of the 1999 Constitution by which a candidate cannot be declared winner of an election unless, apart from scoring majority of the lawful votes cast, he also scored at least one-quarter of the votes cast in at least two-thirds of ALL the LGAs in that State. For Abia therefore, as has been the case for all other States, the results for its 17 LGAs must be in the calculation and not just 14 LGAs. It will be an interesting date at the Supreme Court on Wednesday |

Yeyegist:Hahahahaha, Governor Ikpeazu's mother died over two months ago and is to be buried tomorrow, Friday the 29th January 2016. All this while Alex Otti never remembered to send condolence message to him. Then BOOM; on 27th January, the Supreme Court delivers a landmark Judgment in the Rivers' Governorship case which together with their reasoning in their earlier judgment some days ago in the Zamfara Governorship case, sign posts that Ikpeazu's election will surely be affirmed by the Apex Court; Otti seeing the hand writing on the wall quickly sends a condolence message after the Rivers Wike judgment. Anyway, better late than never. They are all brothers and it should be politics without bitterness |

resty4:Not Falake but Wada of PDP. APC had no validly nominated candidates at the election. Take five minutes off and read the clear provisions of S. 187(1) of the CONSTITUTION and S. 141 of the ELECTORAL ACT. The nomination form submitted by APC to INEC which had the names of Prince Audu & Faleke as Governorship & Deputy Governorship candidates was withdrawn by APC on the death of AUDU & substituted with another one which had the name of Yahaya Bello but contained no name of Deputy Governor thus invalidating the nomination & candidacy. Falake had no fresh nomination after the joint ticket with AUDU was withdrawn on the death of the later. More crucially, it is now settled law that you can only be declared winner of an election if you participated IN ALL STAGES of the election. Yahaya only participated in the supplementary election for just ONE LGA; he did not participate in the 11 April election in respect of TWENTY (20) LGAs. Faleke apart from having no valid subsisting nomination did not participate in the supplementary election as his name was not on the ballot. APC had no validly nominated candidates. All votes cast for them are "WASTED" votes which will be nullified. The candidate who was validly nominated, scored the highest number of "VALID" votes cast & met all other Constitutional requirements is Idris Wada of the PDP. If you think the Supreme Court shocked you with the Rivers Wike judgment, be prepared for more shocks when they send Yahaya Bello packing from Lord Lugard House very soon ![]() |
adrusa:You are wrong dear, it was a unanimous decision of ALL the seven Judges. It is really simple if you have a little knowledge of the law. The Supreme Court has always been VERY CONSISTENT and the last hope of the common man. Many issues are involved here and this is not really the place or forum for such conversations, but I will address very briefly just two points. Proving malpractices in election Petitions means getting witnesses in each Polling Unit in respect of which there are allegations to give evidence. Obviously, in Governorship & Presidential elections where there are thousands of Polling Units, it is difficult for a Petitioner to do this. Moreover, where the allegations involve criminal conduct, the standard of proof is higher: beyond reasonable doubts & this is not easy at all. The reason is simple: elections hold in Polling Units & not in Wards, LGAs or States & so a Petitoner who brings just one or two witnesses to testify as to what happened in an entire Ward or LGA will fail. The important thing is that these principles are the same for every Petitioner, whether PDP, APC, APGA or whoever. The second reason which has presented itself for the first time in the 2015 elections is the issue of Card Readers. Card Readers are not part of our electoral laws. There is no mention of it in the ELECTORAL ACT or THE CONSTITUTION. No doubt it is a commendable innovation that will reduce rigging but INEC blundered by not getting the National Assembly to legislate it into law by amending the Electoral Act to include it as a means of accreditation. For that reason, the only means of accreditation recognized by law is manually by use of Voter's Registers. Now the decisions by the Tribunal & Court of Appeal in the River's case was largely based on Card Reader data & I can bet my last naira that the SC would have held just as they also did in the Zamfara Governorship case, that you can't annul an election due to failure to use Card Readers or inconsistency in the data. Mind you also, the SC has expressly held in a long line of cases over many years that you cannot annul the election of a person declared winner because of actions he is not responsible for; Neither Wike nor PDP conducted the accreditation of voters; INEC did. If INEC decided to use manual accreditation instead of the Card Readers in some places according to their own guideline resulting in inconsistent accreditation figures against number of votes cast, you cannot blame Wike & nullify his election. Finally, you heard it here first: the Supreme Court will also affirm the election of Dr. Okezie Ikpeazu of Abia State annulled by the CA based only on spurious allegation of over-voting based on Card Reader data instead of Voters' Register data |

I see a young girl of about 13/14 yrs being forced to marry someone against her wish & you blame it on JONATHAN. The Buhari administration & its supporters such as you set a default position from the onset. You have a ready excuse for every failure; you will accept no blames for your failures; even if Buhari spends eight years & ends up a complete failure, you blame it on Jonathan. Buhari's military murdered hundreds of Shitte citizens in cold blood the other day & another fool in another forum blamed it on Jonathan who allegedly failed to take action against them all these years thus emboldening them. I guess if you fail to see you period this month you will blame it on Jonathan too. Strangely, no one blames Bokoharam anymore. No one blames those who claimed that an attack on Bokoharam is an attack on the North nor those who threatened to drag a former Igbo Chief of Army Staff to the ICC for attacking Boko Haram. We get it: Buhari & all APC members are saints while Jonathan & all PDP members are Devils. Even the current Chief of Army Staff who was Army Director of procurement in Jonathan's administration & largely oversaw billions of Naira worth of goods is also a saint because he is now serving in an APC Government. And please don't bother advising me that if I have any evidence of corruption against any APC apparatchik, I should send it to EFCC cos we also get it that the EFCC doesn't have to wait for Petitions against PDP people before commencing investigations but waits for Petitions when it is the turn of APC. |

After the initial attack which left scores dead, the soldiers left, reinforced/regrouped & in the middle of the night, they returned to the headquarters & home of Elzakzaky (I hope the spelling is correct) & massacred the hundreds of people who had ran there for safety after the initial attack earlier in the day at the expressway which was miles away. One harrowing account I read which left me trembling & my body shaking feverishly was from an ABU, Zaria University lecturer who was taking his three children to the Shia (Shitte) procession on the expressway when he learnt that soldiers were attacking them in the express; he then did a U-turn and took them instead to Elzakzaky's home/group headquarters & dropped them off there thinking they will be safe there only for his children to start calling him in the night that the soldiers had returned there & were shooting anything in sight. All three of his sons were murdered in cold blood in Elzakzaky's house which was miles away from where the initial incident of blockade of the road took place during the day. Anyway, why do I even bother responding to the likes of you who are sub-humans? |

He is only a human rights activist when his bread is buttered & it suits him. I have always had doubts about him but I lost all respect for him when he appeared with over fifteen other SANs in a team to defend Buhari in one of the cases challenging his lack of certificates & requisite constitutional qualification to assume the office of President. Ordinarily people like Falana should have been in the fore-front of the demand that Buhari proves he has the qualifications prescribed by our Constitution; instead, he accepted tens of millions of Naira to frustrate the cases so they won't be heard on the merit by filing technical objection after technical objection. Can you imagine Fawehinmi doing that? On this matter of the genocide of the Shias for allegedly blocking a road which should have been dealt with by tear-gas, water cannons, rubber bullets, etc, you won't see him stand to be counted. But it is not even Falana I am worried about; it is what we have become in Nigeria that makes me shudder. Most of us are now no better than animals. When you read comments in this site & others & see the cold-blooded nonchalant dismissal of the murder of hundreds of fellow citizens, you wonder if we are not really the animals the rest of the world considers Africans to be. We see right there on television & CNN when people throw rotten tomatoes, eggs, vegetables, etc on Prime Ministers & Presidents & nothing happens. A journalist once threw a shoe at President Bush & nothing happened. And yet just for the "nuisance" & inconvenience occassioned by the alleged blockade of a road, hundreds of fellow citizens are murdered in cold blood & we clap & go on with our lives as if it is all in a day's work. Make no mistake, the Shias are absolutely wrong to block roads, Harrass passers by & generally constitute themselves into a pain in the public neck but for a supposed disciplined Military to react by murdering the same citizens they are sworn to protect is shocking. Most Nigerian's no longer have a conscience which is the only thing that differentiates humans from other species of the animal kingdom. You think it doesn't concern you? Okayoooooooo. God dey |
