samguru: The Court of Appeal, Lagos, on Tuesday reserved judgement in an appeal by former Managing Director of Intercontinental Bank, Erastus Akingbola, challenging revocation of the bank’s license by the Central Bank of Nigeria, CBN. Mr. Akingbola is asking the appellate court to set aside the earlier ruling of a Federal High Court, which dismissed his suit, challenging the planned sale of Intercontinental Bank to Access Bank. He wants the appellate court to restrain CBN from withdrawing InterContinental’s inter-bank guaranty, pending the determination of the appeal. Justice Okechuwku Okeke of the lower court had dismissed a suit by Mr. Akingbola and a former executive director of Intercontinental Bank, Bayo Dada. The suit was challenging a Memorandum of Understanding for business combination signed by their former bank and Access Bank. Dissatisfied, Messrs. Akingbola and Dada appealed and insisted that CBN was wrong to have masterminded the signing of the said MoU without recourse to them as shareholders and former directors. Arguing the appeal on Tuesday, counsel to Mr. Akingbola, Onyebuchi Aniakor, urged the appellate court to allow the appeal and set aside the judgement of the lower court. The appellants in their amended Notice of Appeal contended that the lower court erred in law when it adjudged the suit as an abuse of court process.
The appellants insisted that Justice Okeke made fundamental error in concluding that the letter in which Mr. Dada was removed as director, was not tendered, adding that the action occasioned substantial prejudice to them. He urged the court to hold that given the provision of section 36 of the 1999 constitution, the governor of Central Bank of Nigeria or any other body cannot validly direct the appellants to cease to serve as directors of the bank. The appellants urged the court to order the respondents jointly and severally to render account of their dealings in the affairs of the Bank. They also urged the court to nullify all steps, decisions taken by the respondents in the affairs of the bank from August 14, 2009 till date. After listening to parties in the matter, the 3-member panel, led by Justice Mohammed Lawal Garuba, reserved its judgement. The lower court had held that the suit was an abuse of court process, as there was a similar suit by other interested parties on the same subject matter. The lower court also held that the suit was status barred, as the suit was challenging an action carried out as far back as August 14, 2009, when Mr. Sanusi removed some bank chiefs. Meanwhile, the appellate court has reserved judgment till a date that will be communicated to parties.

winkmart: The House of Representatives on Wednesday asked the Economic and Financial Crimes Commission and the Central Bank of Nigeria to immediately go after the promoters Mavrodi Mondial Moneybox, otherwise known as ‘MMM’ in Nigeria.
Lawmakers strongly opposed the investment scheme, which lately gained popularity among Nigerians in the wake of the current economic recession in the country.
MMM promises 30 per cent return on investment for any money put into the scheme within 30 days.
The investment scheme has a Russian origin and “involves directing clients to make money available for an anonymous person with a promise of 30 per cent return within one month.”
But, members described the scheme as a “scam” and warned Nigerians not to be carried away by the “mouth-watering” returns on investments.
Lawmakers warned that the “trick” used by the operators was to attract as many Nigerians as possible to invest substantial amounts of money before the bubble would burst.
The House directed the EFCC, security agencies and the CBN to take urgent steps to halt the scheme before many Nigerians would become victims of the scam.
It also asked its Committees on Banking/Currency and Financial Crimes to investigate the activities of MMM Nigeria Scheme, “with a view to saving Nigerians participating in the scheme from you financial ruin.”
The Chairman, House Committee on Telecommunications, Mr. Saheed Fijabi, had in a motion, drawn the attention of the House to the growing popularity of the scheme among Nigerians.
Fijabi, an All Progressives Congress lawmaker from Oyo State, represents Ibadan-South/West Federal Constituency.
“The scheme entered the Nigerian circle in 2016, capitalising on the high level of unemployment and poverty to deceive unwary Nigerians into falling prey to their antics”, Fijabi stated.
He said the fact that MMM was not regulated by law or approved by the CBN as a secure business venture, made Nigerians more vulnerable.

RoyalMail: Justice Jude Okeke of an FCT High Court in Maitama, Abuja on Wednesday, slammed a fine of N5 million on Airtel Nig. Ltd for violation of customer’s right to privacy.
The plaintiff, Mr Emmanuel Anene on Dec. 21 filed a suit against Airtel for continue disturbances through unsolicited messages to his line. The judge held that the crucial issue that calls for determination here was whether or not that the plaintiff evidence made out a case to justify the claims in the reliefs he sought.
“One of the reliefs sought an order of the court seeks for the award of damages. A plaintiff who seeks for a violation of right is to succeed on the strength of his case and not on the weakness or absence of the defence.
“Though he can rely on the absence of the defence to support his case."
He said the burden of proof could shift from party to party until the issue in contention is resolved.
The court records showed that the plaintiff evidence of claims was served on the defendant and led evidence in the support of same.
“The defendant who was afforded the opportunity failed to file statement of defence contradicting the plaintiff’s statement of claim or fails to lead evidence in challenge to the claims; it means he had admitted the facts.
“Unless the court does not believe in the evidence or sees any reason in contrary in law it reserves a duty to act on such.
“The defendant failed to place any evidence on the other scale of balance there is nothing against in which the plaintiff’s evidence can be weighed.
Okeke held that the plaintiff complained about disturbances and distractions which he did solicit for, from the defendant but the defendant did not reply nor do anything about it.
“The plaintiff having purchase the defendant telephone number a contractual relationship is satisfied, the defendant is in violation of the right to the plaintiff privacy.
“The defendant, having received complaints from the plaintiff, but continued to disturb the plaintiff from quiet enjoyment of the line.
“In every wrong there must be a remedy, to vindicate the plaintiff’s right which has been violated in the forth going circumstance by the defendant; the plaintiff shall be awarded damages based on the discretion of the court.
“Against this background putting into consideration the obvious inconviencies, discomfort and the embarrassments the plaintiff had undeniably gone through.
“The defendant has been directed to pay to the plaintiff damages not the N200 million the plaintiff asked for but N5 million only.
