Can a Court stop the impeachment of Governor Fubara?

The ongoing impeachment moves against Governor Siminalayi Fubara of Rivers State have once again brought to the fore a recurring constitutional question in Nigeria’s democratic practice: Can the courts stop an impeachment process once the House of Assembly has invited the Chief Judge to constitute a panel to investigate allegations against a governor?

The simple answer is yes.

Impeachment in Nigeria is a constitutional process governed strictly by Section 188 of the 1999 Constitution (as amended). While it is often described as a political tool in the hands of legislators, the law is settled that impeachment is not beyond judicial scrutiny. What courts may not interrogate are the political reasons for impeachment; what they can and do examine is whether the procedure laid down by the Constitution has been faithfully followed.

Under Section 188, impeachment follows a sequence: a notice of allegation signed by not less than one-third of the members of the House, service of the notice on the governor, a resolution supported by two-thirds of members, and a request to the Chief Judge to constitute a seven-man panel to investigate the allegations. Only after the panel submits its report can the House take the final step of removal.

Once the House writes to the Chief Judge to set up a panel, the process has certainly advanced. However, it has not crossed the point of no return.

Nigerian courts have consistently held that they can intervene at any stage of impeachment proceedings where there is evidence of constitutional breach. This position was firmly established in landmark cases such as Inakoju v. Adeleke and Dapialong v. Dariye. The courts made it clear that while impeachment is political in nature, compliance with constitutional procedure is a legal obligation enforceable by the judiciary.

Therefore, a court order can lawfully stop impeachment proceedings, even after the request to the Chief Judge, if certain conditions exist. These include situations where the House of Assembly is not properly constituted, where there is no valid quorum, where lawmakers involved are themselves under legal dispute, or where the steps taken violate the clear provisions of Section 188. Similarly, denial of fair hearing, rushed timelines, or actions driven by bad faith can attract judicial intervention.

In such cases, courts may issue restraining orders, injunctions, or orders maintaining the status quo. These orders may prevent the Chief Judge from constituting a panel or halt the panel from continuing its work. Contrary to popular opinion, this does not amount to judicial interference in legislative affairs; rather, it is the enforcement of constitutional supremacy.

However, it must also be stated clearly that courts are generally reluctant to interfere with impeachment where due process is strictly followed. If the House of Assembly is lawfully constituted, the required numbers are met, and every procedural step is complied with, the judiciary will likely allow the process to run its course.

Applied to the Rivers State situation, the decisive factor is not the political tension or the personalities involved, but the legality of the process. If Governor Fubara can demonstrate that the House’s actions are constitutionally defective, illegitimate, procedurally flawed, or done in bad faith, the courts are empowered to intervene. If not, the impeachment process may proceed unhindered.

This distinction is critical for Nigeria’s democracy. Allowing courts to enforce due process prevents impeachment from becoming a tool of vendetta or political ambush.

In the final analysis, impeachment is neither above the law nor immune from abuse. The Constitution remains the ultimate referee, and the courts remain its faithful guardians. Whether the impeachment of Governor Fubara proceeds or stalls will depend, not on political noise, but on strict adherence to constitutional discipline.

That, ultimately, is the true test of democratic maturity.

Good question. Fubara got to that post by appointment, not actual promotion. Wike needed him to handle finances while he's governor. Besides his political cronies show me 1 civil servant in Rivers State that got promotion while Wike was governor?

Then, the race began in earnest for three years now, reaching a frenzy with the works of the two PDP committees on zoning. The first was the Gov Ifeanyi Ugwuanyi committee on the zoning of the PDP party offices. As the clamour for zoning of the presidential ticket of the PDP to South reached its crescendo, many had pointed out the fact that though the PDP Constitution had prescribed zoning of the office of the president to be between North and South since the South-west and South-south had taken their turns in producing the president and the vice in this current dispensation in the persons of Olusegun Obasanjo and Goodluck Jonathan, zoning this time around, should not just be to the South but the Southeast.

Atiku Abubakar went a step further by offering to step down from the race if it would be agreed that the touted zoning to the South would mean micro-zoning to the Southeast. Wike and the rest could not take the Atiku challenge maybe because Atiku would likely back Peter Obi, who was his vice-presidential running mate in 2019 and an ally. The prospects of Peter Obi picking the ticket if PDP zoned South was so real compelling Wike to go for an open contest, believing he could pick it up ahead of Atiku, Tambuwal and Bala Mohammed, given his large war chest.

Fubara has every right to go for the second term, no individual is bigger than the state, only people of Rivers State can say he should not go for the second term and not Wike. Wike shouldn't have signed such agreement in the first place if he is a smart politician. He should've pretended to be fine with all his steps and strike him hard toward the tale end of his term.

However, a serial betrayal like Fubara shouldn't have been fighting with at all. If I was to be Wike, I won't even argue with him, all I will do is to use option A4 primary like they did to Ambode in Lagos and denied him the ticket. By using option A4, he can't even bribe or entice Wike loyalists who are the majority, because everyone will openly queue behind his/her candidates. He seem to learn nothing from his boss Tinubu.

But now that he has scattered everything and insulted APC NWC, Fabura may even be giving automatic ticket withiout having to pass through party primary.
They can't give him automatic ticket exxept they are willing to take that chance of Fubara ensuring that he can appeal to Rivers State people to vote for PBAT.....
That is the hard part because Wike might just tell his people to fold hands and watch how the votes in Rivers State will go and how will Fubara go about it!!!!!


I see very very low turn out in Rivers State if ADC fields Atiku as their candidate.

At some point, Wike's work with Tinubu will be over but it will not be to discard Wike for a deceitful person like Fubara.

Most sensible persons are very wary of treacherous persons. When peace was brokered, Fubara is believed to have agreed to a one-term deal, only for him to want to play a fast one and go to join APC, thinking he can deceive the president. He thinks he is wise.

He is welcome to join APC, but when the time for primaries reach he will be reminded of the agreement, if he pretends not to remember, he will then have to go to the primaries to test his popularity.

He must really think low of Tinubu to think that he can deceive him very easily by decamping to his party.
You have it there.
The best bet for him which PBAT may likely grant is to test his popularity at the APC governorship primaries and I wonder how many delegates are on his side assuming that is the actual place he is planning to do such.....

All of not majority of the LGA chairmen, Councillors, and State Assembly members are on Wike's side to do his biding and tag along his preferred candidate.
