A Federal High Court in Abuja has ordered the final forfeiture of N131.237,800.00 and multi-million Naira property bought with funds allegedly stolen from the Federal Ministry of Power by seven persons and two companies.

Justice Taiwo Taiwo made the order on Wednesday (December 18, 2019) following an application by the Economic and Financial Crimes Commission (EFCC).

The defendants are: Bilikisu Fatolu, Fatolu Shuaib Gbolahan, I. I. Ikwuegbu, Nwachukwu Ogbonna C., Elvic Hotel, Abdullahi Aminu Hamcheta, Shamia Exclusive International Ltd, Abdullahi Abubakar Danburam and Dada Matthew Olugbenga.

The properties are located in Abuja, Kaduna, Kogi and Nassarawa States.

They include: A unit of three bedrooms, two units of shops, a shop in an open space, a plot of land, Elvic Hotel with an events hall, generator house and appurtenances, a piece of land, eight units of shops and restroom.

Others are: A plot of land, one unit of two bedroom detached bungalow, two units of shops, two hectares of land and bank drafts and cheques bearing the sum of N131.237,800.00.

The sums and properties were first forfeited in the interim by Justice Dimgba J on October 19, 2018, pursuant to an ex parte application of September 28, 2018, filed by EFCC counsel O. O Adeola.

Granting his prayer, Justice Dimgba directed the EFCC to cause to be published in The Nation Newspaper so that any person or corporate body who may have interest in the properties and the sum of money, may within 14 days of the publication, show cause why the properties should not be forfeited to the Federal Government of Nigeria.

But, following Justice Dimgba’s transfer to another jurisdiction, the matter was assigned to Justice Taiwo.

At the hearing of the motion on notice on Dec 16, the EFCC informed the court that it had complied with the instruction and published the said order in The Nation of November 5, 2018 and that the EFCC had succeeded in personally serving all the defendants.

Granting the anti-graft agency’s prayer for final forfeiture, Justice Taiwo said he had established service of the processes against the defendants as can be seen from the records of the court.

He said: “It means that none of the defendants can deny that they are not aware of this suit which has to do with forfeiture of their interests in properties, the subject matter of this application, jointly or severally.

“I have gone through the affidavit before me which remain unchallenged and uncontroverted.

“I have stated above that the defendants are aware of this suit. They filed no counter affidavit to show that the properties and the huge sum of money found in the accounts of some of them are not proceeds of crime.

“These defendants are said to have stolen money from the Ministry of Power by fraudulent schemes and that they were arrested and they all volunteered written statements.

“They were said to have acquired properties with the stolen money, yet they filed no counter affidavit to these very weighty allegations of criminality. In any case they were said to have admitted during investigation to have stolen the funds from the Ministry of Power.”

The judge noted that he would be failing in his duty not to act according to the law and in line with judicial precedent if he did not grant the application for final forfeiture.

Justice Taiwo added: “I hereby order final forfeiture of the properties listed in the schedule of assets and properties attached to the motion on notice to the Federal Government of Nigeria. It means that this application is meritorious.

“All the orders sought vide the application on notice dated the 19th day of November 2018 are hereby granted as prayed. This is the judgement of the court.”

A Federal Capital Territory High, FCT, Court (No.3) Maitama, presided over by Hon Justice Baba H. Yusuf, ruled on an ex-parte application filed by the Independent Corrupt Practices and Other Related Offences Commission, ICPC granting it the final forfeiture order against the Shehu Yar’Adua Foundation (centre) and 24 other registered properties in Abuja.

The ICPC spokesman, Rasheedat Okoduwa, in a statement on Thursday, said that the forfeiture order was granted over alleged tax evasion by the owners of these properties for which the Federal Inland Revenue Service, FIRS, had to prepare a schedule of tax obligations against them.

According to her, the forfeited companies were among 29 entities that had been earlier approached with a net N8.6 billion tax liability.

The companies, she said, denied ownership of the properties.

“For this reason, a complaint was submitted to the office of the Vice President of the Federal Republic of Nigeria, which was forwarded to the Commission for further action,” Mrs Okoduwa said.

She explained that three companies — Frankdiowo Nigeria Limited, Kati Nigeria Limited and R.Timmermann & Co Nigeria Limited – appeared in court to explain why their properties should not be finally forfeited by urging the court to discharge them.

Mrs Okoduwa, however, said only Frankdiowo Nigeria Limited showed “good cause” and was discharged, while the other two will return to court for the hearing of their affidavits.

The bribe was not paid in cash. The payer of the bribe is known and electronic payments leave a trail. Otherwise nobody would even know any bribe of $1b was paid

Investment firm, Africa50, has announced its investment in the 461-megawatt Azura-Edo Independent Power Project (IPP) in Nigeria.

Head, Infrastructure Investments, Africa50, Raza Hasnani, said the company was committed to financially support African infrastructure assets.

The Azura-Edo IPP is a 461MW open cycle gas turbine power station and the first project to be developed by Azura Power Holdings. Africa50’s investment in Azura-Edo IPP is one of its many investments in Africa. The investment company has invested in various infrastructure projects in Africa, all of which represents 1,000 megawatts of capacity.



The latest investment, in a report by Punch, complements the earlier investment by Africa50 in the Senegalese Tobene Power Plant.

Speaking on the partnership, Hasnani, said, “We are excited to invest in a mission-critical asset within the Nigerian power market. We have a strong institutional commitment to mobilising capital for key African infrastructure assets, and look forward to creating value as a shareholder of the Azura-Edo IPP.”

Managing Director, Azura-Edo IPP, Edu Okeke, said, “We are delighted to have Africa50 as an investor in our Azura-Edo power plant. To have the governments of 28 sovereign African states invest in one’s business is a fantastic endorsement; and an incentive for us to keep doing better.”

Meanwhile, the majority shareholder in Azura Power Holdings, Actis, said the company was committed to the power supply of the continent and the contribution of Azura-Edo IPP to Nigeria’s economy.

The Economic and Financial Crimes Commission, EFCC, has picked up former Attorney General of the federation and Minister of Justice, Mohammed Adoke, after he arrived Nigeria from Dubai.


Igbere TV learnt that the ex-AGF left Dubai following pressure from EFCC.


In a statement made available to Igbere TV on Thursday, the commission said the EFCC boss, Ibrahim Magu, and Dubai authorities have held series of meeting in respect of the former Attorney General.


He was accompanied by INTERPOL officers on Emirates Airlines Flight 785. The aircraft departed the Emirati commercial capital at about 11am Dubai time (8am Nigerian time) and touched down at the Nnamdi Azikwe International Airport, Abuja at 3:45pm.

Officers of the EFCC were on ground at the airport when he arrived. The ex-AGF will surely have his days in court.

John Dingell was one of the longest-serving members of Congress, serving from 1955 until his retirement in 2015.
