FriendNG:
But will they build their own prison service or they will be paying the federal government to use some of it facilities such as Prisons?
They have to amend constitution to all them to build their own prisons aswell. There's no reason prisons need to be on exclusive list. Any tier of government should be allowed to set up police force and prisons. You can just delete these items from the constitution and let federal law regulate it.
PoliticsRe: Malami Explains Why Amotekun Is Illegal by Blue3k(m):
Its time to amend the constitution. That's will settle the issue since ststes seem to want decentralized policing.

Amend these sections of the constitution.

Constitution exclusive list:

2. Arms, ammunition and explosives.
45. Police and other government security services established by law.
48. Prisons

Section 214. (1) There shall be a police force for Nigeria, which shall be known as the Nigeria Police Force, and subject to the provisions of this section no other police force shall be established for the Federation or any part thereof.

PoliticsRe: New Aljazeerah's Documentary On Nigeria's Rotten Situation by Blue3k(m): 7:30pm On Jan 15, 2020
Why aren't you asking NTA or NAN to do a documentary on these topics. Both are state back medis outlets like Al Jazeera. Im not aware of any interesting documentary they ever put out like the BBC Africa.

Rosskii:
Why doesn't Al Jazeera do a documentary on Nigeria's diversification efforts, say in the agro-allied industries?

Why don't they tour the rice processing industries being set up all over the country, showing a country moving to diversify from oil dependency, and create self-sufficiency in food?

Such a documentary will help attract investors and help the very people in poverty they love to show.

Why don't they do a documentary on the FG's school feeding programme - the largest school feeding programme in Africa - that's feeding millions of our kids for free in school?

Or what about the ongoing rail revolution? Rail infrastructure lowers business costs, which will help grow prosperity. The strides we are making in that sector are worth covering. For goodness sakes' we are setting up factories to BUILD the trains ourselves, as we speak. Why does Al Jazeera ignore that?

Why don't they do a documentary on Eko Atlantic - the largest single ongoing project in Africa today, the African Dubai, set to employ hundreds of thousands of Nigerians in the years ahead?

I guess all that would be far too 'positive' in their endless quest to air negative news about Nigeria.

The nation knew they did it 1999. Im not sure why you dont remember. Anyway why not worry about getting a constitutional amendment instead?

Wait o , if 2 / 3 must agree , how did southern states ever agree to hisbah and sharia
The constitution already allowed for sharia courts. The northern states voted to add sharia law to penal code. Hisbah is illegal and unchallenged in court just like any other state security agency.

And again i feel that South south , South West , South East and North Central have the numbers to press in NASS to ensure that states have their own state police inorder to put a stop to this fulani herdsmen madness.
Actually they're 1 state short. You need 2/3 of state assemblies to agree. South and North central only add up to 23. If the supreme court rules correctly and bans hisbah and other security agencies everyone will forced come to table. Plan b is to get one state to agree to decentralize police.

How many people.voted for the Sharia law ?

How many people voted for Hisbal , who also have the power to arrest federal police ??

How many people voted for the Herdsmen ??, All the arrested killer Herdsmen caught in Benue , where are they ,,?
How many people voted for the civilian JTF ??

We know Baba Buhari is only protecting the interest of the Herdsmen which aims are to take over some part of the southwest ...of which is why they have done in some forest ....that's was how they started in Pleatue state 20 years ago, and today , fulani are now indigenes of plateau state
writeprof:
Where do you situate the so-called Civilian JTF in the North and the so-called Hunters allegedly armed and paid by the govts there?
The supreme court may agree all these things are clearly illegal. Then you're back to needing a constitutional amendment. I really dont why people just avoid doing the hard work.

The northern states voted and got both shariah and hisbah. Everyone else slept not filing cases with the supreme court.
PoliticsRe: Amend constitution: Police Decentralization One Way Forward by Blue3k(op): 2:45pm On Jan 15, 2020
I notice alot of people asking why hisbah of CJTF is legal when it doesn't matter. The supreme court may agree all these things are clearly illegal. Then you're back to a need to amend the constitution. I really dont why people just avoid doing the hard work.

The sections of constitution to amend from the exclusive list are as follows.

2. Arms, ammunition and explosives.
45. Police and other government security services established by law.
48. Prisons

There is no sincerity from the federal government. Why favour a particular section? What the federal government fails to understand is that, tyranny and oppression of the south and middle belt may lead to rebellion.
If the south and north central wanted it they would 1 more state for the constitutional amendment. There's no need for any rebellion. Deleting items 2, 45 and 48 from exclusive list solves issue. I say item two because the federal government regulates who's allowed to hold guns. (Even the security forces)

You need 2/3 of NASS.
2/3 of all state assemblies to vote in favor of amendment.

Exclusive Legislative List Items:
2. Arms, ammunition and explosives.
45. Police and other government security services established by law.
48. Prisons
68. Any matter incidental or supplementary to any matter mentioned elsewhere in this list.

Lol they should ignore it and see if the police decide to arrest them. When will be landmark supreme court ruling. If the supreme court rules against Amotekun and other similar organizations amending is the only option. It's time everyone pick a side on this issue.

The funny thing to remember is there's no state prisons to bring suspects. The states have build their own detention facilities if they're serious. That also requires constitutional amendment.

Pardon my ignorance.

What's bad about the federal Govt policing us ?
The centralized policing is inefficient. Police power should be decentralized to for better policing. It make the police force more responsible to local citizens.

0monnak0da:
It is not as simple as that.

We will have to face the recurring problem of money funding.
How would the current police budget be shared if it I'd removed whether totally or partially from the FG?
On the basis of crime rate? Is that fair to all?
Reality is we cannot tackle the restructuring issue bit by bit
The federal government police probably wont be disbanded and the other security agencies will exist. Their focus will simply be shifted to other areas. If your state still needs them use them.

If your state has budgetary issues generate more tax revenue and cut the waste. Most states dont even generate up 2% in terms of tax to GDP. That issue doesn't require a constitutional amendment.

It's fair to all since it will reduce crime rate and engender more power locally. It's better for the prisoners and practical for the federal government. The FG prisons are over crowded the prioritize certain interstate crimes like banditry, drugs dealing, human trafficking, smuggling etc.
PoliticsRe: Amend constitution: Police Decentralization One Way Forward by Blue3k(op): 8:13pm On Jan 14, 2020
It's time we stop avoiding the core problem being the centralized police force. The constitution needs to be amended. The federal government just declared Amotekun illegal. It doesn't matter the government thst these guys wouldn't have guns. The fact is the Buhari administration has been again state police.

If this constitution amendment actually sailed it would answer an obvious question. Does the president need to assent to constitutional amendments. I believe its obviously no.

Now everyone should stop wasting time and just get ready to amend the constitution. Decentralize police and prisons. States and local governments should be ready to police themselves.

Please can you spell out this so-called ECOWAS protocols people keep quoting here. Let us see the points in the trade sections outlined in black and white. Movement of goods is not the same as trading of goods.
CSTR2:
Why should I do that for you?
Google it yourself and then come back and tell us if you see any discrepancy.
His response translates to I'm just spouting nonsense. The guy is silent about his own hypocritical import bans which actually break rules. The ECOWAS free trade protocol doesn't cover domestic employment laws. Free trade is regulated by ECOWAS trade liberalization scheme (ETLS). The free movement protocol is also different.

1979 Protocols of free movement of persons:

1. Any citizen of the Community who wishes to enter the territory of any other Member State shall be required to possess valid travel document and international health certificate.
2. A citizen of the Community visiting any Member State for a period not exceeding ninety (90) days shall enter the territory of that Member State through the official entry point free of visa requirements. Such citizen shall, however, be required to obtain permission for an extension of stay from the appropriate authority if after such entry that citizen has cause to stay for more than ninety (90) days.Source

CSTR2:
The law is a direct opposition to the ecowas movement of goods and people which they signed.

Movement of goods and people is not just in allowing big Nigerian banks to provide employment there .
It also covers the retail sector.

Free movement of goods and people. The Chinese and Lebanese are not ecowas citizens.

And the irony is that they want Nigeria to open the borders citing the ecowas policy.
The same policy they have been breaking for years.
Nigeria's hypocritical import ban list is the same thing. When does Nigeria plan on making an exception for ECOWAS members states? Nigeria never took Ghana to court over the matter.

Gwilym:
Thanks OP for creating the post.

The thing is, a lot of people are still very angry about the way Bakassi was handed over...so to speak, and in an atmosphere of anger, disinformation spreads.

For me, the miistake we made was going to the ICJ in 1994. We should have held out for a fresh referendum. (Most countries don't even go to icj to sort out legal disputes). Anyway, in fairness to Abacha, in 1994, things were tense...Cameroon and France were conducting millitary exercises nearby, and war was in the air. Going to the ICJ, even with a poor case , was a better alterantive...even though it came as a poisioned chalice.
Personally I'd rather resolve the situation with proxy warfare and propaganda campaign assuming we held out till 1999. We could've just said the people of bakassi cant be handed off a dictator. If Nigeria itself was a stable state I woukd glady fund secessionist in hopes the english speaking parts get annexed.

There's reportly soldiers in Nigeria giving them guns. Nothing state backed by NIA.
