The Electoral Act from all indications implies two results, one transmitted from the polling unit and the other collated by the Returning officer. Such that one could be used for verification when announcing the result. The question is, did INEC has two results for verification whether transmitted manually or electronically? They don't. There was no transmission as required by the electoral act. It was just a one-way result which the electoral act is against. This is the crux of the matter.

I think you have explained it all. The INEC Guidelines is bound by the 1999 CFRN.

What the Supreme Court has said is that the guidelines itself cannot override the Electoral Act.

So where results transmitted electronically from polling units ? Yes... Did they eventually get transmitted to the portal? Yes.

You could argue that it took 48 hours or more... But it can also be argued that due process was followed, and glitches in the system slowed the process.

Just have in mind, Nigeria election will always be rigged and the constitution will always be used to defend it. My brother,what is in the electoral act is what is legal.as you can see, the electoral act made use of electronic accreditation clearly electronic by a tech device. it never did same for transmission and collation. Same thing happened to the card reader

Manual transmission is opened to fraud.

Electronic Transmission have greater accuracy than manual
