This wan not the only basis. The most serious is the unsigned ballot papers of about 136,000. So stop dwelling on the other one as the only basis for his removal.
It is not serious as well because here is what the electoral law says

(1) Subject to subsection (2), a ballot paper which does not bear

From what I read, about 165k of his votes were declared invalid on ground that the ballot papers were neither stamped nor signed by INEC. The question here is where did he get them from?
Secondly he was said not to be a member of his party as at time of the election as his name was not in the membership register of party as required by electoral act, and the judge clearly stated that Yusuf did not put ANY resistance against the allegation.
People should stop thinking that election is a place were people go to exercise emotions, it was a contest and your opponent will look for every careless move of yours to defeat you. It was carelessness on his and his party not to have his name on their register and fraudulent to smuggle results sheets not signed nor stamped by INEC

The Economic and Financial Crime Commission (EFCC) has narrated how it resisted move by some Air Force personnel to forcefully released some of their collegaues detained at its Kaduna Zonal Command.

Daily Trust gathered that, on Monday, operatives of the anti-Corruption agency arrested five suspects at a residential Inn and Disney Chicken Eatery, Barnawa, Kaduna, following credible intelligence about their alleged internet-related fraud activities.


The suspected fraudsters: Favour Itung, Rachael Ande, Zuleiman Haruna, Abubakar Ismaila, and Solomon Olobatoke were arrested without incident.

But after the sting operation, six military personnel who witnessed the operation at Disney Chicken Eatery stormed the Kaduna Command and attempted to forcibly release the arrested fraud suspects.

The military personnel were reportedly subdued and detained over the security breach, leading their colleagues to invade the EFCC command in an attempt to forcefully free them.

But Dele Oyewale, Head, Media & Publicity of the anti-graft agency, said the EFCC did not bow to pressure.


He identified the detained Air Force personnel as: Lawal Abdullahi, Chukwuma Chidi Christian, Alfa Suleiman, and Emmanuel Ekwozor, and two students of the Nigerian Air Force Institute of Technology, AFIT: Chidera Anuba and Joseph Tokula.

According to him, while the six personnel were in detention, there were inter-agency communication and discussions between the leadership of the EFCC and Air Force to resolve the issues, but the NAF personnel who invaded EFCC command, on Friday, broke the dialogue.

“Unfortunately, dialogue on the release of the combative Air Force personnel broke down on Friday, November 17, 2023, when some unruly NAF Officers stormed the Kaduna Command in a commando-style to forcefully release their detained colleagues.


“The EFCC exercised restraint in the face of the provocation and flagrant abuse of power. The Commission continued to engage with the leadership of the Nigeria Air Force and released the officers to the NAF Provost after they had been duly profiled,” he said.

In all these, the courts are overlooking the fact that Gawuna is not listed as one of the parties in the case yet he's the main beneficiary of the judgement.
I know they'll tell us it's parties that run for election but just let it be an opposition party that did this kind of thing and the court will remember you can't benefit from a case you weren't part of.
The obvious bias in the judgements coming out of our courts is nauseating.
EA2022 provides for usage of unsigned ballots. The courts are overlooking that provision.
Issues of primaries and eligibility of candidates are pre-election matters, the courts are also overlooking that.
I said it when the NNPP lost the appeal. APC online miscreants usually claim they won because their lawyers fought their cases well. By a stroke of luck, Olanipekun is Abba Yussuff's lawyer now and he's just lost at the Appeal. Shall we say he didn't argue the case well too?
The truth is that Tinubu, Gandollar and the APC are hell bent on snatching Kano state because of its strategic position as it concerns 2027 election. Governor Abba Kabir Yusuf of Kano State has vowed to reclaim his mandate at the Supreme Court.

On Friday, the Appeal Court sitting in Abuja upheld the ruling of the tribunal that sacked Governor Yusuf and declared Nasiru Yusuf Gawuna of the All Progressive Congress (APC) winner of the March 18 election.

In a broadcast on Friday, Yusuf said he had instructed his legal team to challenge the Appeal Court ruling at the Supreme Court.

Earlier, Abdullahi Ganduje, National Chairman of APC, said his party was waiting for Yusuf and the New Nigerian Peoples Party (NNPP) at the apex court.


“I thank Allah for this important judgement. We have to thank the judiciary for providing good administration of justice despite all the distractions that took place since the beginning of the case.

“We have to thank the judiciary. There is no doubt this is a victory for democracy. It is a victory for APC and a victory for Kano State. This is an indication that democracy has come to stay in Nigeria. Democracy we can say is matured in Nigeria. We have to thank all those stakeholders, the political parties, even the NNPP that took us to the Appeal Court.

“For Kano State, this victory is for all of us. We are fully aware, we know what happens during the election; a lot of malpractices and we took the issue to the tribunal and by the grace of God, we got a fair judgement in favour of our great party, APC.

“Now, the government in power, the NNPP decided to go the Court of Appeal and this morning , by the power of God, the Court of Appeal affirmed the judgement of the lower court. And by so doing, our gubernatorial candidate, Dr. Nasiru Gawuna is the duly elected governor of Kano State.

“But in all, probably, they will go to the Supreme Court which is part of democracy. There is nothing wrong for them to go to the Supreme Court. We too, we are ready to meet them in Supreme Court. And Insha Allah, we will win at the Supreme Court as well.”

Why do you keep saying thG it is about qualification only when the court clearly gave two rulings.

It is the responsibility of parties to ensure that their votes count. What this election hS shown is the importance of well motivated and knowledgeable agents. Only APC did thorough agent training before this election and only pdp and apc covered all polling units. This is what made the difference.

The tribunal invalidated over 165,663 ballots thumb printed in favour of NNPP. The court ruled that the votes were deducted because the ballot papers with which they were cast were not stamped or signed. This rendered the votes invalid, according to the tribunal.
