[quote author=Barryston post=73040315]Please elders or anybody with similar situation should come to my rescue. I have started filling my application but I saw a place "Have you been previously married or in a common law partnership or relationship" The thing is I applied for US visa in 2015 which i stated I was my married to my then fiancee...we have dated for 6years at the time and we have done our aqd nikkah in fact she was already living with me at the time....I was refused the visa...and after some months we broke up because of some irreconcilable In my case, I applied for a US Visa in 2013 as married when it was just a traditional marriage . There was no option to say it was a traditional marriage. I applied for my PR as single because my dowry has been returned. The marriage was never registered anywhere. I answered yes to the question "have you ever been married or in a common law relationship " I explained in my LOE that I applied as single because I was never married in church or court. I cannot say divorced as there is no certificate to prove it. I found out in my gcms notes that officer accepted me as single and mentioned PA has never been married or any indication of a previous spouse. No concerns. Just waiting for my security to be done. Unless there is a document to prove divorced or legally separated which in your case there is none. You are SINGLE. You can answer yes and then explain you did the traditional rites and lived together (if it's more than a year) and the relationship ended after some months. 11 Likes |

Nwachika678: Hi dear, unfortunately you will need his consent to be able to relocate with them. My best advice is for you to go to court and file for full custody of your girls based on abandonment. Are you divorced or legally separated? If not then start the process if you are sure that you are done. CiC will also ask for his medicals and PCC if you are still married on paper. 8 Likes |

They had the cheapest one way ticket when I used them but about 9 hours transit time in Istanbul. 5 Likes 3 Shares |

Flaj: I wonder why a " lot of students you know" are not able to get full time jobs. A lot of students I know including me were able to get good full time jobs after study and are applying under CEC stream which is a lot easier and less complicated. At least we dont have to provide any funds. I put in zero as proof of funds to Canada and still was eligible to apply. If your study period is 2 years and above, you will get 3 years work permit. You only need to work one year full time (52 weeks) and 1560 hours or 2 years part time and you become eligible to apply. 13 Likes 2 Shares |

SESE10: Is the fathers name on the birth certificate? If it is, then she will need him to sign form 5406 or submit full custody papers. Either of the 2. On another note, since the baby doesn't bear his name, she can do statutory declaration of sole parent and provide proofs that the father is not in the picture and she has been caring for the child. Go to canadavisa.com. Cases like this have scaled through. Am.also a single mother but with full custody. I can always help. I have applied and waiting. 8 Likes 1 Share |

Ropophen: My dear, if all your documents are original and not doctored you HAVE NOTHING TO FEAR. If I were you, I will be going through my documents now to make sure I can correlate any information I have on my application. Interview is not a bad thing. Atimes its randomly done. It's not about submitting too many documents. You should submit whatever documents that you feel that will boost your chances. I do not think you submitted a lot of documents. No two cases are the same. I am a single mum with full custody of my daughter. I went as far as submitting even hospital receipts and bank statements to show hospital payments and so many other things. I even added her birthday pictures from 1st to 4th birthday. These are all proof to show that I have been the one taking care of my daughter and the father has not been in the picture since birth. I did it when I applied for study permit. It worked. So I am doing it again. Some people will say the documents are too many. I have taken the seat of the VO and asked myself what he/she will be asking for when my application is being processed. and I have submitted any document to answer that. So please you did not submit too many documents. Look at it positively. To be frank, most of my friends here- CEC Inland all want an interview. They approve your application on the spot in Canada if you are called for an interview and it shortens the whole thing. I have not seen anyone get rejected and they all said they were asked basic questions about their jobs. I know the married ones, were interviewed separately and probably to know if both of them were on the same page. Please dont stress over this. Good luck. 12 Likes 1 Share |

@jonjon2017 It is not a grounds for disqualification. Dont add to your problem. Go on the website and read about it. Unfortunately if it doesn't come down, then you are hypertensive. Dont know how they diagnose in Nigeria but in Canada bp of 140 and above over 3 months I think is diagnosed as hypertension. So if it doesnt come down, consult with your doctor and start taking medication for it. Limit salt in your diet and start exercising. Life goes on. 3 Likes 1 Share |

JonJon2017: The doctor is not supposed to stop your medical examination because of high bp. He is required to complete it and submit his report to CIC. Go on CIC website and read on how panel physicians should handle a bp case. He is expected to have done it 3 times. Let's try and read up on medical requirements not just on your part but what the doctors are expected to do. I know we have a culture of believing what a professional says but they are also humans and can be wrong. I once went for a creatinine test and the doctor told me it was high. By the time I finished analyzing the result and how being a black alters the result because obviously they just calculated with the normal formal excluding my race. I am also a full African woman and a bit muscular which also affects creatinine level occasionally. She was shocked and ended the conversation. I went to see another doctor and he told me that I was fine that body mass and race are taken into account occasionally when my urinalysis and gfr were normal. 8 Likes |

JonJon2017: This is not a problem. Did the doctor do it 3x? Officially they are expected to do it 3x if the first is above 140. If its stays above 140 after the 3rd trial, the doctor is expected to include creatinine test in your urinalysis and blood test. If he doesnt then expect an email from CIC requesting for further test but it's basically the serum creatinine test.If its within the normal range, then you just have to get a letter from your person doctor stating your medications, the cost of it every year and your condition. It's really not a big deal. I checked mine a week before I went for medicals and it was 107. Test date, it was 145 the first time. The doctor turned off the light for me and asked me to relax. Tried a 2nd time and it was 138. Told me it was ok. 9 Likes 1 Share |

sunkyawz: I really don't see this as an issue. Just get your travel dates correct. Canada doesn't even stamp on passports anymore. I have travelled between Canada and US severally and don't have a single stamp from Canada. Only gets stamp when I am entering the US atimes. I don't know why. My mum visited with my daughter last year and both passports were not stamped( arrival and exit). I keep a diary of travel dates. I filled my travel history section with the dates I have. I choose to answer "NO", because my traditional/customary marriage was not recorded or registered in the government marriage registry, and as such may not meet the IRCC or Canadian government definition of marriage. vickyehi: Thank you. So its best I answer Yes then since I mentioned we were traditionally married when I applied for study visa. I cant even prove common law cos I cant prove we lived together cos my name wasn't on anything. No bank account but we have a child. I have also been taking care of my child from birth. paid for hospital bills and all myself. I will attach the dissolution letter and affidavit from dad. Thank you for taking out your time to respond. 4 Likes |

Hi All, I am new on this forum but have been silently reading from the first page. I am applying via CEC inland stream, I am a bit confused on how to answer this question " have you ever been married or been in a common law relationship?" Background- I came to Canada as a student. I was married traditionally under customary law in my country. I was never married legally in the registry or in the church. No change of name. No marriage certificate to present. As at the time I was applying for my study permit, I mentioned being traditionally married. Under customary law, a dowry or bride price is paid. In 2015, the bride price was returned to my ex. Under the law, once its returned, the relationship is dissolved. There is no divorce certificate to be issued just a letter and affidavit from my father to the man's father acknowledging return of bride price and dissolution of the customary marriage. Since I came to Canada I have been applying as single. I am now applying for my PR under a single status. My confusion- Should I answer yes to this question " have you ever been married or been in a common law relationship?" and then in the LOE explain that it was a traditional marriage including the dissolution letter from my dad? Should I answer No and also explain in the LOE that I was traditionally married but chose to answer NO because there is no marriage certificate or even a divorce certificate but also include the dissolution letter from my dad. The traditional marriage was never registered in a customary court or anywhere. |
