A group, the Niger Delta Anti-Corruption Group, has said it is not comfortable with human rights lawyer, Festus Kayemo, being the prosecutor of the Economic and Financial Crimes Commission in the trial of former Niger Delta militant warlord, Chief Government Ekpemupolo, popularly known as Tompolo. EFCC had on Tuesday at the Federal High Court in Lagos filed a 40-count criminal charge of unlawful conversion against Tompolo and a former boss of the Nigerian Maritime Administration and Safety Agency, Patrick Akpobolokemi. In a suit, FHC/L/5539C/15, filed on behalf of the EFCC by Keyamo, the anti-graft agency said Tompolo and Akpobolokemi converted $108.7 million and N2.1 billion, being property of NIMASA, knowing that the said sum were proceeds of stealing. Charged along with them are three others as well as five limited liability companies. But reacting on Thursday, NDACG in a statement issued in Akure, Ondo State and signed by its National Coordinator, Comrade A. Effiong, and the Director of Publicity, Sylvester Ebiowei, said Keyamo, who once accused Tompolo of threat to his life, was not in a better position to stand as prosecutor for EFCC. The group said if the anti-graft agency wants to get results from the trial, Keyamo should be replaced with someone more courageous and dependable. The group said though he is very competent, he may not be able to handle the case effectively and satisfactorily. According to it, Kayemo has unsettled issues with Tompolo before now. It contended that though the group holds Kayemo in high esteem, using him to prosecute the case involving Tompolo could jeopardize the matter, alleging that Kayemo was capable of compromising in the case against the wishes of EFCC. “There have been speculations from the public that Keyamo is likely to be compromised in the trial which may frustrate the determination of the EFCC to make Tompolo face the law for whatever crime he had committed against the government. And we stand by that position. We are not comfortable with Keyamo handling this case,” the group said. It demanded that EFCC should get a prosecutor that can never compromise the trial of Tompolo for any inducement from any quarters. Besides, the group urged EFCC to thoroughly investigate the N13 billion allegedly paid to Tompolo for the acquisition of the Nigerian Maritime University at Okerenkoko, Delta State. Nigerians could be in for more surprises in the New Year as more high profile personalities might face trial in 2016. The Chairman of the Presidential Advisory Committee on Anti-Corruption, Professor Itsey Sagay, in an interview with Channels Television, said that the last set of looting of the nation’s wealth was in desperation to win elections at all cost. “What I saw from all I have put together is that this last set of looting arose out of determination for reelection. Money was being distributed recklessly and thoughtlessly in order to get back to power at any cost. “The evidence is still hot, the witnesses are present. The amounts are huge and unprecedented; amounts that have crippled the government from functioning effectively. “The only thing you can do is to go after those first and there is much. I can tell you that the corruption is at every level; from these prominent politicians to the lowliest civil servants and even private sector. “But the ones in the public sector, over which these high profile politicians are involved, I suspect, (would make up) probably over 90 percent in terms of assets that have been stolen. “Those are the things that have to be dealt with first because they are immediate. So it is not discriminatory, it just happened that the people in government are doing these things. We are all living witnesses of what happened in the NSA’s office. “You cannot overlook those things and say ‘oh they may suspect me of being selective’. If you leave it then you have left the substance,” he said. Professor Sagay gave the assurance that the present government remains committed to fighting corruption at all levels but acknowledged the need for caution. “My personal view, not the committee’s view and certainly not the government’s view, is that the position of the President is a sensitive one. If somebody has been a president before he should be very careful in thinking of any physical thing like incarceration and so on.” He added, “Efficient investigation, effective prosecution, speedy adjudication and effective sanctions. Fresh details have emerged on how members of the National Assembly Committee on the Review of the 1999 Constitution withdrew N7.75 billion purportedly to amend Nigerian constitution. PREMIUM TIMES had last week exposed how the federal lawmakers collected the money in tranches to purportedly alter the document between 2011 and 2015, but which former President Goodluck Jonathan refused to sign into law. While the 49-member Senate Committee on Constitution Review led by the Deputy Senate President, Ike Ekweremadu, withdrew a total N4,500,000.00 for the exercise, the 53-member House of Representatives Committee headed by the former Deputy Speaker, Emeka Ihedioha, spent N3,250,000,000.00. The documents, exclusively obtained by this newspaper, also showed that the Committee withdrew money from its account few days before the 2015 general elections. The presidential and National Assembly elections held on March 28. While on March 2, it withdrew N83.33m, it withdrew the same amount 21 days later, precisely on March 23. Yet, on April 13, two days after the governorship election, it withdrew another N83.33m. The fresh documents exclusively obtained by this newspaper which exposed bank transactions showed that the two committees transferred various sums of money from two National Assembly accounts – 321/212/606/1/1/0 and 321/212/606/1/1/3 domiciled in Guarantee Trust Bank to their own accounts in different banks. While the House Committee transferred funds to its account in Zenith Bank, its counterpart in the Senate transferred monies to its three accounts domiciled in Bank PHB (now Keystone Bank), Oceanic Bank (now EcoBank) and United Bank for Africa. According to the documents, the House Committee transferred to its Zenith Bank account N500m on December 16, 2011; N500m on May 17, 2012; N250m on August 6, 2013; and N250m on November 11, 2013; N250m on February 20, 2014; N250m on May 27, 2014; N250m on August 21, 2014; N166.5m on a date not specified; N83.5m on December 5, 2014; and N83.33 on March 2, 2015. The committee, on different occasions, also withdrew huge amounts in cash, serially violating Nigerian money laundering law. Part 1, Subsection 1 of the Money Laundering Act 2011 provides that “No person or body corporate shall, except in a transaction through a financial institution, make or accept cash payment of a sum exceeding- (a) N5,000,000.00 or its equivalent, in the case of an individual; or (b)N10,000,000.00 or its equivalent in the case of a body corporate.” It withdrew N250m on October 29, 2012; N250m on May 8, 2013; N83.33m on March 23, 2015 and another N83.33m on April 13, 2015. The Senate Committee, the documents revealed, transferred the sum of N125m on April 21, 2010 to Bank PHB; N250m on June 10, 2010 to Oceanic Bank; N125m on a date not specified; to Oceanic Bank and N250m on October 13, 2010 to Bank PHB. The transactions were made before the Committee was inaugurated in the 7th Assembly in 2011 It also transferred N250m on a date not specified to Oceanic Bank; N250m on February 9, 2011to Bank PHB; N500m on December 16, 2011 to Bank PHB; N250m on May 17, 2012 to Bank PHB; N250m on July 23, 2013 to Keystone Bank, N250m on November 5, 2013 to Keystone Bank; N250m on February 5, 2014 to Keystone; N250m on May 22, 2014 to Keystone; N250m on August 18, 2014 to Keystone; N166.6m on November 25, 2014 to Keystone; N83.4 on December 5, 2014 to Keystone; and N83.33m on February 27, 2015 to Keystone. It further withdrew N250m on April 20, 2012; N250m on February 27, 2013; N250m on May 8, 2013; N83.33m on March 17, 2015; and N83.33 on a date not specified, in cash. This again was a clear violation of Nigeria’s money laundering law. PREMIUM TIMES could not reach Mr. Ekweremadu to speak on this story last week. He did not respond to calls to his mobile telephone nor replied a text message sent to him. Mr. Ihedioha directed this newspaper to the Clerk of the House, Sani Omolori, who did not respond to our enquiries by phone. The management staff of the National Assembly, including its Clerk, Salisu Maikasuwa, did not also respond to our enquiries. Uche Anichukwu, the media aide to Mr. Ekweremadu, however issued in a statement on Saturday, denying that members of the two committees judiciously spent the huge sum on the fourth alteration of the Constitution. “The Office wishes to state categorically that there was no “pocketing” of N8 billion by members of the Committee on Constitution Review in the 7th Senate chaired by Senator Ekweremadu,” the statement said. The statement also claimed members of the 7th National Assembly and the 36 state assemblies did not fail in their legislative duties towards the realization of the fourth amendment of the 1999 Constitution. Mr. Anichukwu said, “Members diligently and successfully piloted the most elaborate amendments to the 1999 Constitution through all the legislative due process. They were indeed amendments that held great promises for the nation’s democracy”. Close both of your eyes and you see black. Close only one eye and you see nothing. 3 What if rocks were actually soft but tense up when we touch them. 4. The amount if ancestors i have, and with no kids,that line stops at me. So many things would have happened in the past for me to exist. Its weird to think about it. 5 . Sleep. The fact that you basically go into a coma for eight hours every night is pretty crazy. 6. People insert other peoples genitals into their mouth as a sign of affection. 7. Trying to think of a color that doesnt exist. It tears me apart after a minute or two. 8. Pronunciation of the word 'colonel' 9. Words. Just random words. Like, thus. What does it actually mean? And sometimes i would think about a word it wont feel like a real word anymore. Sometimes i say my name over and over again and realize how ridiculous it sounds compared to how its spelled.
