Former military President General Ibrahim Babamosi Babangida yesterday advised Nigerians to emulate former vice President Atiku Abubakar who has refused to resort to any other means to seek redress when his rights are violated. IBB was speaking during the public presentation of a book entitled “Landmark Constitutional Law Cases in Nigeria 2004 -2007: the Atiku Abubakar cases. IBB who was the chairman of the occasion described Atiku as a true champion of Nigeria’s democracy and therefore called on Nigerians to emulate him by resorting to judicial process to seek redress where their rights have been violated. He noted that the book represents and tackled many of the naughty issues in Nigeria’s politics including the question of INEC’s powers via political party and the choice of candidates, the removal of elected persons from office and protecting the rights of Nigerians from impunity. What emerged from these cases according to IBB is that Nigeria is seriously developing into a democracy. In his remarks, Governor Aliyu Babangida described Atiku as dogged and the best president that we have not got yet. The Economic and Financial Crimes Commission (EFCC) Tuesday said about $129 billion (N20.6 trillion) was fraudulently transferred out of Nigeria in the last 10 years through various sources. The commission, quoting Global Financial Integrity, based in Washington D.C., cited some of the sources to include tax avoidance, corruption, tax evasions, illegal mining activities, drugs and human trafficking. In 2012 however, the commission collaborated with the Nigeria Customs Service (NCS) to address illicit financial flows out of the country and recovered about $13 million suspected to be proceeds of criminal activities. EFCC Chairman, Mr. Ibrahim Lamorde, made these disclosures in Abuja at the opening of a regional workshop on "Improving Cash Transactions Reporting Regime in the Designated Non-financial Businesses and Professions (DNFBPs) and cross border cash and bearer negotiable instruments movements for North and West African countries. The seminar was organised by the Swiss Confederation and the Inter- Governmental Action Group against Money Laundering in West Africa (GIABA), in conjunction with the federal Government of Nigeria. Lamorde also cited a report by the Nigerian Financial Intelligence Unit (NFIU), located within EFCC, as having estimated that $25.4 billion, comprising cash and financial instruments, were moved out of Nigeria through the borders between 2009 and 2013. "While these figures may not necessarily be indicative of the proceeds of crime, they do however show how the AML/CFT vulnerabilities associated with cash movements," he said. He narrated a recent incident which depicted some of the challenges faced by the commission. He said: “From one of our neighbouring countries, some people came into the country with a lot of cash in their vehicle. They were detected at the border and arrested. "Strangely, the governor of the state next to Nigeria, wrote to his counterpart on the Nigerian side, saying that the people should be released, they are traders, they are genuine traders and that the money is genuine, they know the origin. "That was ignored and we were trying to comply with our anti-money laundering regime here. The matter is in court. That did not deter the emir from the other side also to write. In fact, the ambassador of that country to Nigeria, has visited me twice. 22- year-old Catherine Emmanuel of Mutu Diya village in Agyaragu, the headquarters of Jenkwe development area of Nasarawa State allegedly gave birth to a tortoise at Agwan Tiv 11 at the weekend. The incident occurred in Agyaragu town about 24 kilometers away from the state capital about 12p.m. on Saturday morning Narrating her experiences to Daily Independent in an exclusive interview at her residence in Angwan Tiv 11, Catherine said: “During the pregnancy my stomach was growing up and after some time it will subside up till when the pregnancy got to seven months I did not see anything again. When I went to the hospital with my husband for scanning to find out whether the pregnancy was still there, the doctor informed us that there was no baby inside my womb. We proceeded to another nearby hospital in the same Agyaragu town where the doctor told us that the only alternative was to undergo surgery but my father refused, saying “it will be over his dead body and that there was no reason to undergo an operation. According to her, she got married to Emmanuel Abari three years ago and God has blessed them with a baby boy named Swando Emmanuel before the unfortunate pregnancy. Investigations by Daily Independent however revealed that she had been pregnant since March 2013, which was also confirmed by a pregnancy test carried out at the Agyarargu General Hospital. Daily Independent further gathered that when she went for antenatal check up few months into the pregnancy, she got the shock of her life when she was informed by the doctor that although her tummy was protruding as though she was pregnant, there was no baby in her womb. According to her, on receiving the information, they consulted with family members who agreed they should invite Samuel Kwaga, a renowned traditional herbalist from Daudu village in Makurdi, Benue State. She added that it was the traditional doctor that gave her some herbs resulting in her being delivered of a tortoise. Emmanue Abari, her 29 years old husband and a graduate of Christian Religious History from College of Education, Gidiri in Plateau State said he is full of appreciation to God for spearing the life of his wife despite bitter experience. “I felt bad and disappointed because the first pregnancy did not affect her like this but thank God for saving my wife,” he said. On his part, the traditional herbalist kwaga who spoke through an interpreter said: “One Mr. Emmanuel Abari came and called me that he was having a problem with his wife when I prepared the herbs for her and when she drank the thing just came out and surprisingly she gave birth to a tortoise we couldn’t believe it.” To this end, the traditional herbalist after due consultation with the relatives of the bride and groom decided to bury the tortoise at about 5:55pm on Saturday shortly after performing some traditional rites. http://dailyindependentnig.com/2013/11/woman-gives-birth-tortoise-nasarawa/ |

Maybe, he will now have to resort to defensive and withdrawal mechanism whenever the urge to 'perform' his lawful duties comes up. Common sense by both parties would have prevented this situation. |

The Police, on Thursday, in Abuja, aborted the protest organised by Stop Impunity Nigeria, SIN , and Citizens Wealth Platform, CWP, to raise awareness on the level of mismanagement in the public service. The two groups, in the morning, had assembled protesters at the Millennium Park, close to the Federal Secretariat, only to be ejected by armed policemen who arrived at the venue before it took off. The police officers, who arrived at about 9:14 a.m. in two vehicles with registration numbers NPF 6666 C and NPF 248, reportedly shot at a bus and fired two teargas canisters into one of the buses belonging to the Abuja Urban Mass Transportation Company, AUMTCO, which had been hired to convey the protesters. As soon as the teargas canisters were fired, the protesters ran for their lives and relocated to another take off point close to the initial venue, which was similarly invaded by the police officers with more teargas, forcing them to leave that venue. The officers were reportedly led by Bello Makwashi, an Assistant Commissioner of Police. The convener of the protest, Eze Onyenkpere, speaking with journalists, lamented the action of the police. He said that it offended every rule of civil interface with government, especially as Nigerians were fed up with mismanagement of public funds. He said the police did not have the powers under the law to stop the protest as they were duly informed of it, and had even promised to provide protection. “The police were supposed to escort us to the place where we were going to submit our petition,” he said. Stating that the Public Order Act, which the police usually refer to for disrupting protests, had been upturned by the Supreme Court, Mr. Onyenkpere hinted that he might sue the force for dispersing the protesters. He added, “For emphasis, that Act has been set aside by the Federal High Court and supported by the decision by the Court of Appeal and there is no decision from any other superior Court that has set aside this popular decision of the Court of Appeal. “That there is no fundamental right to movement, association, peaceful assembly until you get police order – there is no such thing.” On the subject of the protest, the activist lamented that the welfare of Nigerians and development of the country were never taken into consideration by the National Assembly, the Presidency and other arms of government. “We recall with regret the perennial sum of N150 billion allocated to the National Assembly, NASS, every year since 2010 and also projected 2016 under the Medium Term Expenditure Framework 2014-2016 (MTEF); the mind boggling provisions for foreign and local travel, bloated security, entertainment and welfare; votes year after year requests for vehicles and computers; and a Presidency that is fed on more than N2 million a day and enjoying a fleet of aircrafts but still wants more. “We further recall with deeper regret the trillions lost to oil subsidy thieves, which will not likely be recovered, the 45, 000 ghost workers that earned over N108 billion and vanished into thin air, and some pension thieves that are still at large. OWERRI — The 183 persons from Osun State arrested last Thursday by Imo State Police Command for alleged unlawful assembly and other electoral offences, were again arraigned, yesterday, before an Owerri Magistrate’s Court. The first drama that unfolded, was the appearance of two lawyers – one each from the office of the State Director of Public Prosecution, DPP, Mr. Nnamdi Akobundu and the Deputy Director, Legal Services, Independent National Electoral Commission, INEC, Mr. Emmanuel Ogbodu. Opposing the appearance of the State DPP in the matter, Ogbodu hinged his stand on Section 211 (3) of the Constitution and Section 150 of the Electoral Act. “Section 150 of the Electoral Act specifically empowered INEC to prosecute all electoral offences. The offences contained in the charge are federal offences. The State DPP does not therefore, have any business to prosecute the matter for INEC,” Ogbodu said. Continuing, the INEC lawyer told the court: “In view of the enormity of the offences, we would not like the DPP to be part of the prosecution.” However, the accused were granted bail in the sum of N50,000 each and two sureties in like sum.. Responding, the DPP told the court that the first three charges were drawn from the state laws, while the last two were electoral offences. “If we go by the democratic principles which INEC represents, we are in the majority, especially as we have three in our favour and two for INEC,” Akobundu said. In his own submission, counsel to the accused persons, Chief Uche Onyeagucha, pleaded with the court to settle the issue of the prosecution so that the matter could go on unhindered. After this initial legal battle, counsel on all sides agreed that the legal team from INEC and the DPP will sort themselves out before the next adjourned date. Another development was the withdrawal of the initial three count charges in suit OW/503c/2013 slammed on the 183 accused persons which were replaced with a five count charge, OW/520c/2013. Although the defence did not oppose the fresh charges, they however applied for bail, especially as they were bailable offences. Chief Onyagucha equally applied that all the buses impounded and the telephone handsets seized from the accused persons be returned to their owners. Ogbodu vehemently opposed the application, adding that the matter before the court was serious and should not be treated with kid gloves. “The nature of the case is very serious. There is also the issue of the number of the accused persons. It will be difficult, if no impossible together allow them back if granted bail”, Ogbodu said. He however submitted that if the court was favourably disposed to grant them bail, it must be on very stringent condition. Ruling on the application, the presiding Magistrate, Mrs. Maureen Onyewuotu, said she was mindful of the congestion in Owerri Federal Prisons. The All Progressives Congress has accused the Independent National Electoral Commission of being “economical with the truth” by saying only the courts can order the cancellation of last Saturday’s governorship election in Anambra State, in which about 1.3 million of the 1.7 million registered voters were unable to exercise their franchise. In a statement in Lagos on Tuesday by its Interim National Publicity Secretary, Alhaji Lai Mohammed, the party reminded INEC that it did not wait for a court order to cancel the National Assembly elections in 2011, when it was obvious that many voters across the country could not vote due to the late arrival or non-delivery of voting materials. ”In announcing the cancellation of the National Assembly election in 2011, INEC Chairman Attahiru Jega said, among others, that it was to ‘maintain the integrity of the elections and retain effective overall control of the process’,” it said. APC said the situation in Anambra last Saturday was even more serious because, in addition to the fact that voting materials were either late or not delivered at all, most voters were disenfranchised by an INEC official, who apparently tampered with the 2011 Voters’ Register for the state. ”Therefore, there are more compelling reasons now to cancel the Anambra governorship election than what led to the cancellation and rescheduling of the National Assembly election in 2011, unless of course, INEC is still acting out the script handed to it for the ill-fated election,” the party said. http://www.punchng.com/news/you-dont-need-court-to-cancel-anambra-poll-apc/ |
