The suit by ex-Imo Governor, Rochas Okorocha, seeking an order to compel the Independent National Electoral Commission (INEC) issue him a certificate of return for Imo West senatorial seat has received a boost. This indication came as the Court of Appeal, Abuja, on Tuesday, ordered prompt hearing of the suit he (Okorocha) filed to that effect before the Federal High Court in Abuja. In the ruling published by The Nation on Wednesday, a three-man panel, led by Justice Stephen Adah, the court said: “since there is no opposition to the request for the withdrawal of the motion for stay filed on 17/5/2019, it is hereby struck out, having been withdrawn. “Under Rule 10(c) of the Practice Direction of this court 2013, this court is mandated to order accelerated hearing of the case at the lower court. “But, since we have been informed that the lower court has been hearing the case day to day, there is no need to order a fresh accelerated hearing. “The day-to-day hearing, as it is presently done by the lower court, is commendable and it should continue. That is the order of this court.” Other members of court’s three-man panel that gave the ruling were Justices Emmanuel Agim and Mohammed Idris. Justice Okon Abang of the Federal High Court, Abuja had, on May 22, 2019, adjourned further proceedings in the case filed by Okorocha to await the Court of Appeal’s decision in the motion for stay of proceedings filed by Osita Izunaso. Because no one wants to be associated with a MASTER RIGGER who may not be in power after the Supreme Court verdict on @Atiku’s petition.” The Peoples Democratic Party(PDP) and its presidential candidate in the last election, Atiku Abubakar had filed a petition against the President over his victory in the election. A Chief Magistrates’ Court in Kano, on Tuesday, ordered the arrest of three persons including: Mannir Sanusi, the Chief of Staff to the Emir of Kano, Muhammadu Sanusi II. NAN reports that the three were dragged before the court by the Kano State Public Complainant and Anti-corruption Commission for failing to honour its invitation in a N4 billion fraud investigation against the Emir of Kano. Chief Magistrate Mohammed Idris ordered the arrest of Sanusi, who holds the traditional title of Damburan Kano, Mujitaba Abba and the Accountant of Kano Emirate Council, Sani Muhammad-Kwaru, over their alleged refusal to honour the commission’s invitation. The commission wrote to the court seeking an order of arrest against the three palace officials. Idris consequently issued and signed the arrest warrant sequel to a motion by Salisu Tahir, Chief State counsel. Tahir had said that the request was based on the provision of Section 38 of the enabling Law establishing the Commission. According to NAN, the Commission had invited four people in connection with the allegation, of which only one person, Isa Bayero, alias Isa Pilot, who was a former Scribe to the Emirate Council, honoured the invitation. When contacted, the Chairman of the commission, Mr Muhiyi Magaji said the three persons that have arrest warrant on their heads are the principal suspects in the case. According to the News Agency of Nigeria (NAN) Oshoke was charged with conspiracy and obtaining money by false pretences. The defendant, who was not represented by a lawyer, pleaded not guilty to the two-count charge. Mrs Gladys Imegwu, the prosecutor, asked the court for a trial date to enable the prosecution present its case. She also asked the court to remand the defendant pending his trial. According to the charge, the defendant committed the offences in December 2017. Justices of the apex court validated the nomination of Comrade Moro as the authentic candidate of the PDP for the Benue South senatorial district. Hon Ojobo had gone to the court to challenge the declaration of Comrade Moro, winner of the primary election. In a unanimous decision, the five-member panel of judges led by Justice Bode Rhodes Vivour, dismissed the petition for lacking in substance and upheld the decisions the court of first instance and the appellate court. Justice Amina Augie, who read the judgement of the court went through the main points of the judgement from the High Court and held that the appellant was not declared winner after the primaries of October 4 because the margin of lead which stood at 50 votes was less than the number of delegates from the three local government areas that didn’t vote (358). She affirmed that INEC monitored both the inconclusive primaries of October 4th and the concluding part of October 7th which conferred legitimacy on them both. Justice Augie further stated that section 87 (4) (c) of the electoral act says, “at the end of voting” and so voting was not concluded on October 4th. She said there’s nowhere in the electoral act where it is stated that a primary election must be held in one full swoop. She dismissed the appeal and said details of the judgement will be made available on a later date.

The Speaker of the House of Representatives, Yakubu Dogara, on Tuesday has said President Muhammadu Buhari should be blamed and not the leadership of the National Assembly for the delay in the passage of the 2019 budgets. Buhari, who had on Monday signed the 2019 budget into law, had later at night passed a vote of no confidence on Dogara and the Senate President, Bukola Saraki. Buhari had blamed the delay in signing 2019 budget on the leadership of the National Assembly. However, Dogara said since President Buhari assumed office, he, “has been unable to present budget on time.” In a statement he signed, Dogara said: “His first budget was the 2016 budget, which was submitted on December 22, 2015, exactly nine days to the end of the fiscal year. “The minimum time the National Assembly requires to pass budget is three months. But he presented it just nine days to 2016’ and that ‘what Nigerians didn’t know and the President won’t say is that the Executive through the various ministries continued to propose additional projects to be included in the 2018 budget even as at April and May which further delayed the passage of the 2018 budget. These were communicated officially and if anyone is in doubt, the letters are there with the dates they were written and received. But here’s Buhari blaming the National Assembly.’ “President Muhammadu Buhari a few days ago, in his usual characteristics of self-righteousness, and buck-passing blamed tardiness in the passage of budgets by the National Assembly for the delay in the completion of projects across the country by his government. “To be precise, the president said, ‘If the National Assembly takes seven months to pass a budget, then we should be commended for the much that we have achieved, and can still achieve. I personally feel very disappointed. I spoke with the leaders of the National Assembly on the issue that seven months is a long time to work on a budget.” “Even though buck passing and blame game is not new to Buhari as it is now his stock in trade; in the past few days and weeks, there is no day that passes without the President blaming others in a desperate move to exonerate himself from any blame or failure of the Executive under his leadership to execute projects across the country. “In fact, very recently, Buhari blamed all his predecessors for failing to build infrastructure. And I wonder why? It was the general consensus that the former employees didn’t perform as expected and that was why Nigerians hired him for a job he has sought for four conservative time but here he is blaming the same people he replaced. If you are the boss of ” Nigeria limited”, what will you do this employee? “Some weeks ago, he even blamed the media for failing to showcase his achievements. “I’m very disappointed with the Nigerian press. This is was his greatest undoing and was principally responsible for plunging Nigeria into recession because activities in Ministries, Departments and Agencies of government were brought to a half for the period since civil servants could not take decisions due to absence of political heads in a country where public sector spending drives the economy. At a point, he even said he was happy working with civil servants because ministers or politicians were noisemakers because “they are only there to make a lot of noises”, he told a French television station in September 2015. “Now, after three years, with election in three months, the President is at it again, exonerating himself from apparent failure of his government thereby throwing the blame right at the doorstep of the legislature. But facts don’t lie and they could be stubborn and here are the facts: “Late budget presentation “Since his assuming office, the president has been unable to present budget on time. It was less than two months to the end of the year. “However, his ministers refused to appear before National Assembly committees to defend the budget for five months thereby delaying the passage. “It was after the leadership of the National Assembly sought the President’s intervention on March 16, 2018 that the ministers reluctantly appeared before the committees, an exercise that takes at least one month to complete. “In fact , some of them who felt they were super ministers sent in their permanent secretaries. “What Nigerians didn’t know and the President won’t say is that the Executive through the various ministries continued to propose additional projects to be included in the 2018 budget even as at April and May which further delayed the passage of the 2018 budget. These were communicated officially and if anyone is in doubt the letters are there with the dates they were written and received. But here’s Buhari blaming the National Assembly. “Violation of Fiscal Responsibility Act 2007 ‘Since the inception of the Buhari administration, it has been in constant violation of the Fiscal Responsibility Act which stipulates that budgets should be presented in early September. The wisdom or import of the FRA is that the National Assembly will have at least three full months to work on the budget bill. “Intact, the Executive admitted its failure and inability to abide by the law on August 24,2018 when former minister of Budget and National Planning, now minister of finance, Zainab Ahmed disclosed that the Federal government will present the 2019 budget in September in a bid to restore the budget circle from January to December but here we are in November without the budget estimates before the lawmakers. “Buhari’s Failure/Refusal to assent to budget submission Bill ‘In a bid to address the issue of late budget presentation and passage, the National Assembly passed a constitutional amendment bill that requires the President to submit the Appropriation Bill not later than 90 days to the end of the financial year but unfortunately, very unfortunately, the president has vetoed the bill. 1. The National Chairman of the All Progressives Congress (APC), Adams Oshiomhole, has claimed the party did not get justice in Zamfara State. Oshiomhole stated this on Monday, while speaking to journalists. Oshiomhole insisted the people voted the APC but the court imposed the PDP on them on the ground of technicalities. 2. Justice Tijjani Ringim, who delivered the judgment, ordered the Independent National Electoral Commission (INEC) to issue a Certificate of Return to Kingsley Echendu of the Peoples Democratic Party (PDP). 5. Hope Democratic Party, HDP, one of the parties that participated in the February 23 Presidential election has asked the Supreme Court to stop the inauguration of President Muhammadu Buhari slated for Wednesday. The party prayed the apex court to restrain the President-elect from presenting himself for swearing-in ceremony pending the final determination of petitions challenging the validity of his election. In a notice of appeal to Supreme Court, the party faulted the striking out of its motion on the notice by the Presidential Election Petition Tribunal on may 22, on the ground of lack of merit. The lawmakers are seeking to compel the clerk to abide by the Order of the House. The suit marked KWS /186/2019 was filed before an Ilorin High court on Sunday. It was beween the plaintiffs namely: Maroof Yusuf Olaniyi (Kwara Central), Abass Adeoti (Kwara South) and Usman Hussein (Kwara North) against the Clerk of Kwara State House of Assembly. The plaintiffs counsel, Barrister Seun Ijaodola, made this available to newsmen on Sunday. In the suit, the appellants are seeking for an order of the court, “mandating the defendant to abide by the Order 11 Rule 3 Sub 2 (A) of the Rules of Kwara state House of Assembly 2019, the determination of the sole question is whether or not the defendant can compromise the requirement for the appointment of the Speaker of Kwara state House of Assembly in favour of a member-elect who is not qualified by Order 11 Rule 3 Sub 2(A)of the Rules of Kwara state house of assembly. “That the only member elect with such qualification is Saheed Popoola, the serving Honourable member representing Ojomu constituency from Offa, Kwara South.” They are also seeking the order of the court, “that the appointment of principal members of the House of Assembly is the exclusive business of the House and not that of the political party.” They also claimed, “that because the Deputy governor-elect, the Minister of Information and Culture among other positions are from Kwara South, our party is trying to intervene in the selection of the Speaker of the Kwara state House of Assembly by ceding it to Kwara North but none of the member elect have the legislative experience required as a precondition for appointment as Speaker.”
