My mum petitioned for me and my brother and we are already at the NVC stage. We have paid all the necessary fees and we are filing our Visa forms and about to start uploading documents.

The place of birth on my brother's NPC birth certificate carries Owerri while the one on his passport carries Mbaise. We are confused as to whether to use the information on the passport or birth certificate to fill the form.

He would have requested for another birth certificate that would tally with the information on the passport but he already submitted this current birthday certificate to USCIS. And knowing that USCIS transferred the case to NVC, NVC might have this current birthday certificate already.

Won't we complicate issues if they discover that we uploaded a different certificate

Regarding your questions;

1. First, who’s filing for who; Is it that your brother is filing for you or you are filing for your brother or someone is filing for you and your brother?
• if the petitioner is the one that has different place of birth, then you the beneficiary should have no issue with that. Just follow the one on his passport.
• But if it’s the beneficiary, he should stick with the one on international passport. It’s more difficult to change details on government issued documents these days.


2. Your second question is simple as it is, if you’ve worked just fill the organization/company you’ve worked with. And state your educational level; like the name of your primary school, secondary school and tertiary institutions of any.

If you didn’t not have the privilege to go to school just state it. Be truthful in all your fillings, don’t complicate things for yourself.

2. I would have been truthful if I we weren't filed for under different names than the ones on our educational certificates.

I'm a WAEC and B.sc holder for instance, but the name on my certificates is different from the one my mum used to file for us.

Let's say in the form I fill that I have a degree or have worked under my field of study (computer science) before, won't I complicate things for my self should they ever ask to see my certificate or my place of work? And if they do, what would be my fate if they discover my certificates carry different names..

Yes upload W-2 for 2020 but it's always advisable to backup the W-2 with like 3 or 4 months paystub....

NVC has no issues with W-2 but note that embassy won't accept W-2.

Yes I will take the tax papers with me to the embassy. I believe it will be available by then.

Moreover W2 and IRS transcripts are easy to understand. Even NVS advised that that's preferable to for 1040.

I can't even locate the adjusted gross income on the form 1040.

May 15, 2021 is the deadline to file 2020 taxes, their 2020 Tax transcripts wouldn’t be ready by May 15, it may take more months, since IRS is the one who prepares the tax transcripts based on their submitted 2020 taxes and send it to them upon request or they can print it from IRS website.

However, they should have their filed tax 1040 forms & schedules by May 15, ask them to send those to you along with the W2s.

You are good, you did not need the 2020 tax documents to get DQ, because those taxes were not due when you submitted your documents to NVC.

However, just like you will need to get a new police report for your interview if the one you submitted to NVC have expired (more than one year), it will also advisable to also get updated tax documents for your interview, including the ones submitted to NVC.

Ok thanks again. I just called my joint sponsor he said form 1040 for 2020 is still not available that I should submit W-2 first.

He advised I would take it to the interview with me if available by then.

They have started filing tax since February 12th and 2020 tax seasons ends on May 15th.

I know they have started but my mum said that IRS tax transcript is not yet available..

That's why I'm asking if can upload the w-2 used for filing 2020 tax.. the adjusted gross income that would be on the IRS transcript is on the w-2 also.

Yes, you can but it is tricky as W2 do not give a complete picture....preferably to use IRS transcript.

However, I doubt they will insist on 2020 transcripts when for an interview date occurring in 2021 before official tax due date in the US for 2020 taxes which is May 15, 2021.

To be on the safer side, go with three years worth of IRS tax transcripts, plus the 2020 W2s ie transcripts for 2017, 2018, 2019 & 2020 W2s.

Also make sure to ask your sponsor to write a letter introducing themselves, how they know you and the fact that they understand the obligations and responsibilities in sponsoring you and they intend to dutifully carry out their responsibilities and obligations towards you.

Are you saying the tax papers would be ready by May 15, if so would you rather I just wait for my petitioner to get it since we are already in May.

Secondly, will I get DQ/CC without submitting all documents while I have the unsubmitted documents available for the interview.. I'm just being desperate because it's taking my petitioner and joint sponsor so much time to get these documents ready.

Absolutely, You have to verify and prove you are a citizen of Nigeria not only by passport but with a valid ID...

I will suggest you get a new DoB that Carry's same info with your passport...

And also apply for a new drivers license that Carry's same info...

Nothing to worry about other than the interview at US embassy. 65% of those who went for the interview at US embassy Lagos in the past were asked to do DNA.

USCIS asked for DNA but we couldn't do it because of covid-19 lockdown in Lagos then yet they approved it.

But I have nothing to worry about if they ask again. The supposed mother petitioning for me is my actual mother

All u need is enough info about what your mother does. Pictures etc. Actually the major thing is your mother's income. Must be above 125% of federal poverty level.

This can be a reason for rejection and you will be asked to get affidavit of support as back up.

But if all is don properly you have nothing to worry about. The interview does not even last up to 1 minute.

Will they also be asking for my bank statement here in Nigeria or any other proof of residency in Nigeria like NIN?

The only condition where this type of application will be denied is when USCIS doubts the relationship between mother and the child.

But this is what the US citizens need to do in case the application is denied.

Right a letter to USCIS that you want to do DNA to prove that you are the biological mother of the child.

She can do this by herself. She doesn’t need a lawyer. Talking from personal experience

Yes of course if the evidences provided are not convincing enough.

But the good thing about immigrant visa, there will specifically state the reason for refusal. You have the right to appeal or reapply.

So please gather enough proof.
