jpphilips:Well, in this situation, we can not conclude that "our prosecutors are not tough enough" until the matter is concluded. We should give them kudos, for bringing the matter to this stage. It is not easy for a criminal to request for plea bargain. Number one, it is an admission of guilt and secondly, it means that the prosecution has built a solid case with almost irrefutable evidence. It takes a lot of investigative work to arrive at where they are now. |

It does not mean that you will not be punished for the offence committed, it only means that by saving the courts time and prosecutors time and money through a lengthy court process, you get something in return, in addition to you forfeiting everything you loot. She blew thousands of dollars at highbrow stores. The cash came from $11,849,069.03, which the Economic and Financial Crimes Commission (EFCC) said 31 individuals and companies paid into her two domiciliary accounts. The accounts, which are Skye Bank (2110001712) and First Bank (2022648664) had “questionable deposits” between 2013 and 2017. The Skye Bank account had about $7,452,319.32 lodged in it. Detectives found $4,036,750.00 in the second account with First Bank. The ex-First Lady allegedly spent the cash at TFS stores, Selfridges, John Lewis, Kingsgate, Sainsbury’s, Harrods, Marks and Spencer, Dolce and Gabbana, and Gina. She went on a shopping spree in expensive outlets in the United States, Britain, Germany, Hong Kong, UAE, Italy and China. The highest shopping was at Goyard Beijing in Beijing CN on January 28, 2014 where Mrs. Jonathan shelled out $28,388.72. On the same day at Hulian Xinguang Beijing CN, she blew $13, 069.68 on some luxury items. There were transactions traced to Oakham School, Natwest Bank and $26, 228. 18 spent at Hotel Nassaeur HOF Wishbaden DE on November 20, 2015. Perhaps overwhelmed by the EFCC probe and its likely consequences, the ex-First Lady has applied for an out-of-court settlement with the EFCC. In “a major breakthrough by EFCC with international collaboration” detectives found that about $7,452,319.32 suspicious funds were deposited in the ex-First Lady’s account with number 2110001712 between 8th February 2013 and 7th April 2015. The account was opened on September 12, 2013 by a former Special Assistant on Domestic Affairs to ex-President Goodluck Jonathan Hon. Dudafa Waripamo Owei depositing $1,948,400.00. The second account was opened on February 22, 2013 at First Bank. Cash deposits were made into the account between 26th February 2013 and 30th April, 2017 which altogether was $4,036,750. Apart from the ex-First Lady who deposited $2,037,650 in nine tranches, other lodgments ranged from $98,900 to $400,000. The former SA Domestic, Dudafa Waripamo Owei, led the pack of depositors on 27th February 2013 with a deposit of $400,000. Other depositors are: Germaine ($100,000); Dudafa ($400,000); Germani ($200,000); Ade Suleiman ($200,000); Mohammed Adamu ($300,000); Francis Muhd ($300,000); Kunle Peter ($200,000); Suleiman Ade ($299,900,00) and Jonathan Patience ($2,037,650). “Detectives traced the transactions pattern placed the card holder in various countries to United States, Great Britain, Germany, Hong Kong, UAE and Italy. The card was allegedly used in highbrow shops, such as Marks and Spencer, Kingsgate, Natwest Bank, Gina stores and Harrods. “ The balance in this account as at 9th September 2016 was $3,691,145.48.” A source in EFCC said: “We have gone far in our investigation of the ex-First Lady to prove that it is not a case of witch-hunt in any manner whatsoever. We are already trying to verify the names of the depositors if they really existed or they are fake. “ Since we have uncovered all these suspicious deposits, we only need her to account in court on how she came about them. Our crack teams worked day and night to trace these funds. “With international collaboration, there is no hiding place for Politically Exposed Persons (PEPs) because some of these malls sometimes report suspicious transactions or spending. They marvelled at where top Nigerian political office holders and their spouses got the cash being lavished.” The former First Lady, however, seems to be tired of litigation over her fortune. In a January 30, 2018 letter, titled “Proposal for out-of-Court Settlement of all cases related to Dame (Mrs.) Ibifaka Patience Jonathan,” she told the EFCC of her intention to settle the matter. The letter, which was written by her counsel, Chief Ifedayo Adedipe (SAN), is being considered by the EFCC. The letter said: “As senior counsel, representing Dame (Mrs.) Patience Jonathan (former First Lady) and companies linked to her and some family members, associates, companies and NGOs, we have thought it fit to engage your commission in a discussion over all issues involving her and the commission with a view to having amicable resolution of all cases as stated above. “This will enable both sides create an atmosphere for mutual understanding and peaceful coexistence. We will therefore appreciate it, if you can give us an appointment at your earliest convenience to have a discussion over all matters involving her and members of her family. “We believe that an amicable settlement will be in the best interest of both your commission and our client. “We assure you of our utmost commitment and sincerity of purpose in this connection, and we solicit your cooperation in this regard. Please, accept the assurances of our warm regards.” Another EFCC source said: “We have received a letter from the ex-First Lady, we are studying it on whether or not to accept the out-of-court settlement or allow justice to take its course.” Apart from the cash, the ex-First Lady is linked to 12 choice properties and a plot of land on which a building is being built. The investigative team had recommended that Section 7 of the EFCC Establishment Act 2004 be invoked on the properties after due verification. The assets linked to Mrs. Jonathan in Port Harcourt are: Former Customs Service officers mess; two duplexes at 2/3 Bauchi Street; landed property with blocks at Ambowei Street; 3 Luxury apartments of 4-bedroom each at Ambowei Street; and Grand View Hotel along airport road. Funds diversion: Ex-NAF chief holds plea bargain talks with EFCC Posted By: Ahmed February 12, 2018 A former Chief of Air Staff, Air Marshal Adesola Amosu, on Monday told the Federal High Court in Lagos that he was holding plea bargain talks with the Economic and Financial Crimes Commission (EFCC). An investigation officer, Tosin Owobo, had earlier testified that Amosu and two other former Nigeria Air Force (NAF) chiefs allegedly diverted N21billion to their personal accounts from NAF. He said they diverted the sum through several companies which they personally incorporated and none of which had any transaction or contract with NAF. Owobo was testifying in the trial of Amosu, former NAF Chief of Accounts and Budgeting, Air Vice Marshal Jacob Adigun and a former Director of Finance and Budget, Air Commodore Olugbenga Gbadebo. They were arraigned before Justice Mohammed Idris but pleaded not guilty to the charges filed against them. An initial plea bargain talks with EFCC broke down after they reportedly refunded about N2billion to the Federal Government. EFCC accused them of converting N21billion from NAF through various companies – Delfina Oil and Gas Limited, Mcallan Oil and Gas Limited, Hebron Housing and Properties Company Limited, Trapezites BDC, Fonds and Pricey Limited, Deegee Oil and Gas Limited, Timsegg Investment Limited and Solomon Health Care Limited. On Monday, EFCC’s lawyer, Nnaemeka Omewa, told the court that the defence team was currently in talks with the Commission towards reaching a plea bargain agreement. “My lord, the defence team met with the prosecution and has proposed terms of settlement. We are still on it, but we are also ready to go on with the trial of the accused persons,” Omewa said. Amosu’s lawyer, Chief Bolaji Ayorinde (SAN), confirmed that talks were ongoing, but he sought an adjournment to allow parties conclude with discussions. “It is true that parties have met. It is also true that terms have not been fully perfected. Therefore, parties will be willing to come back before the court to report the outcome of our discussions,” he said. Daily Trust learnt that the turbines were bought during the Shehu Shagari administration in 1982 from a German company and have been abandoned at the dam since then. The turbines were expected to produce electricity that would benefit several host communities in Oke-Ogun area of the state. Some of these communities still battle with erratic power supply while some don’t even have access to power supply till date. When this reporter went to the dam site last weekend, it was observed that the turbines now rot away in a shed erected over 36 years ago. The dam’s Project Manager, Engineer Akingbade Sunday Isaac, told Daily Trust that the dam, presently being managed by the Ogun-Osun River Basin Development Authority, was built when Olusegun Obasanjo was military head of state to, among other functions, produce not less than six megawatts of electricity. He, however, said the electricity components of the dam were only brought to the dam in 1982 during the Shehu Shagari era. Our reporter observed that the turbines, said to have cost the then government millions of naira, as far back as over three decades ago, were still laying waste where they were kept since then. Engineer Akingbade told Daily Trust that the turbines were now obsolete and could not be used for the purpose they were procured again. One of the reasons he gave was that there are numerous new developments in hydro technology that have rendered the old turbines useless. He added that aside from that, the company that manufactured the turbines in Germany had since packed up so even if the equipment were installed, getting its parts would pose a serious problem. The project manager insisted that the turbines are a waste at the moment, adding that for the project to become a reality, new sets of turbines have to be imported for the dam. Residents of Iseyin, the town that hosts the dam in Iseyin LGA of Oyo State, decried successive government’s attitude to the optimal functioning of the dam, which experts said is one of the biggest in the country. Malam Ganiyu Isah, a resident of one of the settlements near the dam, said the dam environment itself is in total darkness while the turbines that are meant to generate electricity for the host communities are rotting away where they were dumped over 30 years ago. “I really don’t understand how we behave in this country. We bought equipment for a large amount of money but installing the equipment for the purpose they were meant for has been a problem for over three decades. It is unfortunate,’’ he said. Malam Ganiyu said apart from the failed power aspect of the dam, there is no portable water from the dam to the host communities. “Let me tell you, apart from the fishing aspect of the dam, the project is a total failure as far as we are concerned here,” he added. The dam’s project manager, however, disagreed with that position, saying only the power aspect of the dam project could be said to be a failure so far. He agreed, thought, that the host communities don’t have access to portable water but blamed the development on the Oyo State government, which he claimed failed to reticulate water from the dam to the various communities in the Oke-Ogun area of the state. The Minister of Agriculture and Rural Development, Chief Audu Ogbeh, who reportedly visited the dam shortly after the turbines were shipped to the site in 1982, was said to have been moved to tear when he re-visited the dam late last year and saw the turbines still lying where they were kept 36 years ago. Ogbeh recalled that as the then Minister of Communication, he was at the dam in 1982 when the Federal Government bought the equipment to complete the project but regretted that over three decades on, the turbines were yet to be installed. According to Ogbeh during the visit: “I remember that we visited the dam in 1982 and brought the required turbines to complete the project, I almost wept when I visited the dam in Iseyin and still met the turbines lying fallow without being fixed. “It is very sad that the dam has been idle since 1982. This is how we have been wasting our various resources that landed us in the present economic woos.’’ When Daily Trust inquired from the project manager why the turbines were not installed after over three decades, he attributed the ugly situation to the political instability in the country as well as paucity of funds. But an expert in the hydro power sector, Engineer Ahmed Afolayan, disagreed with the project manager for blaming paucity of funds, wondering why government that spent such amount to procure the turbines from Germany would complain of funds for installing them. He blamed the situation to frequent changes in government since then as well as government officials’ attitude towards completing projects not started by them. On how the project can be brought back on track, the expert suggested that the Federal Government involves private investors and buys new turbines for the project since the old ones may no longer meet the present technological demands. The project manager of the dam had also earlier identified private sector involvement as the only realistic way that the project can be fixed. “Government cannot do everything alone. It must invite the private sector and non-governmental organisations to render a helping hand if the project is to be fixed any time soon,” he suggested. On what the present government is doing to fix the project, the project manager said the Federal Government has identified the dam as among five in the country earmarked to generate hydro power. He said a government delegation from Abuja recently visited the dam for a survey with a view to fixing the hydro project. The Minister of Water Resources, Engineer Suleiman Adamu, had earlier lamented the proliferation of abandoned projects under the ministry by previous administrations including the bad state of the country’s dams. He has vowed not to embark on new projects during his tenure until the abandoned projects, including the dams, are attended to. Nigerians who own property in UK panic over new law ON FEBRUARY 11, 2018 Nigerians, who own properties in the United Kingdom, have inundated the Federal Ministry of Finance’s Voluntary Assets and Income Declaration Scheme (VAIDS) hotlines with calls, causing the lines to crash on Friday. A source at the VAIDs office, told newsmen that the unprecedented level of calls was not unconnected with the new UK regulation on Unexplained Wealth Orders (UWOs). UK housing estate The source disclosed that the VAIDs office have been receiving massive calls and frantic requests from tax payers based in the UK, in the last 72 hours, asking for extension of time to enable them complete their VAIDS declaration forms. The UK Government had last week introduced a new law that requires foreigners who own properties in the country to explain the source of their funds or risk forfeiting them to the government. According to the new law, the UWOs could be obtained on any property or combination of properties valued at 50,000 pounds ( N25 million) or more, for which the owner is unable to explain a legal source of its funding. The source said that the data already in the possession of the VAIDS office in the Federal Ministry of Finance revealed that many UK property owners had under paid their taxes before transferring funds overseas to buy properties. “Concerted efforts are ongoing to restore the hotlines following the crash on Friday. “Most of the calls received are from high net worth individuals, including company executives, bankers and even a governor. “All seem to be in panic over the prospect of losing their investments,” said a source within the VAIDS Office. The official said that some of the apprehensive Nigerian property investors in UK had even visited the Federal Ministry of Finance requesting to see the Minister and also the Head of the VAIDS Office. The source explained that most of the enquiries were about seeking assurance from the Nigerian government that the VAIDs programme could protect them from potential asset forfeiture to the UK Government. Others requested to know if their names had appeared on the lists the VAIDS office had obtained from overseas. The UWO law, coupled with the revelation that many foreign governments are automatically sharing bank and property information with Nigeria, has resulted in an upsurge in enquiries about VAIDs. VAIDS allows Nigerian tax payers to restate their income and assets without limit and thus could potentially allow those who own properties that cannot be explained by their previously declared income to regularise by declaring and paying the correct taxes. FG charges Melaye for false information Posted By: Eric Ikhilae On: February 11, 2018 • Accuses him of making false claim against Kogi governor’s aide The federal government has filed a two-count charge against Senator Dino Melaye for allegedly giving false information to the police in relation to claim in April 17 of an attempt on his life. The charge marked: CR/106/18 was filed on January 31 this year before the High Court of the Federal Capital Territory in Maitama by the office of the Attorney General of the Federation (AGF). Melaye is, in the charge, accused of falsely incriminating the Chief of Staff to Governor Yahaya Bello of Kogi State, Edward Onoja David, in his assassination attempt claim. Melaye, who is the Senator representing Kogi East Senatorial District, was accused, in count one, of deliberately giving false information to the police to frame Governor Bello’s Chief of Staff as the mastermind of the assassination attempt on him at his hometown in Ayetoro-Gbede in Kogi State in April last year. According to the charge, the police discovered the alleged falsehood in Melaye’s claim while investigating the Senator’s allegation that some individuals attempted to assassinate him. In the second count, Melaye was accused of making false statement of facts in a phone conversation with Mr. Mohammed Abudu Abubakar, a son of the late former governor of Kogi State Abubakar Audu, with the intention of harming the reputation of David. In the charge, Melaye’s alleged offences are said to be punishable under sections 140 and 393 of the Peal Code Law, Cap. 89, Laws of Northern Nigeria, 1963. The first of the two counts read, “That you, Senator Dino Melaye, male, of the Senate, National Assembly, Three Arms Zone, Abuja, on or about the month of April 2017 at the Police Force Headquarters, Abuja, within the jurisdiction of this honourable court in the cause of an investigation into the alleged assassination attempt on you, sometimes in April 2017, you gave information to the police stating that one Mr. Edward Onoja David (Chief of Staff to the Governor of Kogi State) did mastermind the attack with intent to convict him for the offence which statement you either knew or believe to be false and you thereby committed an offence punishable under section 140 of the Penal Code Law, Cap. 89, Laws of Northern Nigeria, 1963.” Melaye was said to have told Abubakar, son of a former Kogi State Governor, in a telephone conversation how he framed Edward Onoja David in the assassination attempt. He was also said to have made the false claim in the statement he made to the police on April 17, 2017 during police’s investigation into the alleged attempt to assassinate him. Turmoil in PDP over Tambuwal Jonathan, associates kick •Obasanjo schemes to impose crony on CNM A fresh crisis is looming in the opposition Peoples Democratic Party (PDP) ahead of the 2019 elections. The threat to party peace stems from alleged plan by some powerful forces to hand over the PDP presidential ticket to Governor Aminu Waziri Tambuwal of Sokoto State. Tambuwal is currently in the All Progressives Congress (APC) but he is being wooed by Governor Nyesom Wike of Rivers State and some other PDP governors to return to the party he dumped ahead of the 2015 elections. Also pushing for the Sokoto governor’s candidature is a prominent traditional ruler in the North, party sources told The Nation yesterday. Simultaneously, the Coalition for Nigeria Movement (CNM) appears to be narrowing its choice of presidential candidate in next year’s election to one of the three ex-governors it is currently wooing as a possible replacement for President Muhammadu Buhari. Ex-governors Rabiu Kwankwaso (Kano), Sule Lamido (Jigawa), and Ibrahim Shekarau (Kano) like Buhari, are all from the North-West geo-political zone. The Nation gathered authoritatively that their names feature prominently in ongoing consultations by CNM bigwigs. But there is a condition: any of them seeking the Olusegun Obasanjo-inspired coalition’s support must first identify with it publicly. Wike, fresh from installing Prince Uche Secondus as party chairman despite vehement opposition from the likes of former Military President Ibrahim Babangida and ex-President Goodluck Jonathan, is said to have drawn the ire of Jonathan and many of his supporters for promoting Tambuwal’s presidential ambition in PDP. Party sources said the anti-Tambuwal elements are uncomfortable with him in view of the role he played in the loss of power by the PDP in 2015, especially the defeat of Jonathan. The Jonathan associates and some PDP governors have vowed to stop Tambuwal’s bid to secure the PDP presidential ticket. Tambuwal was Speaker of the House of Representatives under Jonathan and his defection from the PDP to the then newly formed APC laid the foundation for the defeat of the PDP in the 2015 polls. Party sources also said he might return to the party on the basis of an alleged unwritten agreement between him and Wike. He is the only APC governor that has not yet identified with the 2019 re-election bid of President Muhammadu Buhari. A source conversant with the ongoing intrigues said: “Jonathan’s associates and some PDP governors are not comfortable with Tambuwal for betraying the party to pave the way for the victory of APC and President Muhammadu Buhari in 2015 “They believe that, as the Speaker of the House of Representatives, he was used by the defunct Action Congress of Nigeria (ACN ) to destabilize the PDP, giving the ACN control of the House from 2011 to 2015 “They accused Tambuwal of working for ACN and later joining APC to fight Jonathan. Jonathan’s kinsmen and his associates have not forgotten the role he played in bringing down their man. To that extent, the ex-president’s camp sees Tambuwal as a hard sell in the South-South, particularly in Bayelsa, Delta and Rivers states. “Some PDP governors and leaders believe he will also be difficult to sell in the South-West because of the role he played in the defeat of Hon. Femi Gbajabiamila in the Speakership race in 2015. Whereas the South-West supported him to become the Speaker by defeating Hon. Mulikat Adeola from Oyo State in 2015, he was implicated in working against Gbajabiamila, who was the zone’s choice for Speaker in 2015. “Some PDP governors also believe that Tambuwal will be no match for Buhari in the north since his major political platform belongs to ex-Governor Aliyu Wammako who APC and strategists of Buhari are lobbying to remain in the ruling party. “Wammakko, politically known as ‘Alu’, may prefer to return to the Senate on the ticket of APC as long as he can be allowed to single-handedly pick a successor to Tambuwal to consolidate his political base.” But a PDP source said: “With Wike’s backing, Tambuwal may get the ticket. I think those making a strong case for Tambuwal have gone far on this project to be underrated. “If Jonathan and his associates can be cut to size during the National Convention of PDP, Wike and others can have their way on Tambuwal. “The aftermath in PDP might affect the chances of the party in 2019 because those in favour of the former Interim National Chairman of the party, Sen. Ahmed Makarfi as the preferred candidate for the party’s presidential mandate may cause an upset. Adopting Tambuwal will amount to abandoning the agreement with Makarfi by PDP governors to make him the party’s presidential candidate. “I think a member of the Interim Caretaker Committee saw this coming when he advised Makarfi to seek a firm commitment from Wike and others. Makarfi preferred to have trust in these governors. “Whatever it is, it is just a matter of when Tambuwal, who pulled the strings behind the scene during PDP convention, will move to PDP. “Realising the danger of APC plot against him, Tambuwal has gone on the fast lane by winning prominent Emirs to his side and reconciling with the likes of ex-Governor Attahiru Bafarawa. This was what accounted for the enlargement of his cabinet to 25 on February 5. He also pulled the rug from under Wammako’s feet by appointing his younger brother, Ahmed Barade Wamakko as Commissioner for Social Welfare. “Also, the anti-Tambuwal elements in PDP and APC are not relenting. For instance, the alleged hounding of Prince Kassim Afegbua, who is the spokesman of Babangida, by security agencies might have been more about his role as a political strategist of Tambuwal than the ex-Military President.” Notwithstanding, it was learnt that some PDP governors are considering Governor Ibrahim Dankwambo. A third source said: “These governors say Dankwambo is young, well educated, urbane, cosmopolitan with less baggage. He was in Asaba last week when the governors met with the Secondus-led executives. He is also very close to Governor Ayo Fayose “Their worry is whether or not he has the stature to defeat Buhari.” Another PDP source added: “Dankwambo is too close to Governor Nasir el-Rufai for comfort. We are suspecting that APC is propping him up as a weak candidate to make it an easy ride for Buhari. We know their game plan.” Investigation by our correspondent on Obasanjo’s CNM revealed that contrary to claims by the former president that he has no preferred candidate for the 2019 presidential race, the coalition may make strong recommendations on some candidates for Nigerians to vote for. A source in the group however said that whatever action taken by it will be guided by utmost caution to avoid acts capable of derailing its plans to “ease out Buhari” at all cost. “Whatever may be the pretence by ex-President Obasanjo, the ultimate target of CNM is to get a replacement for Buhari in 2019,” the source said. “The group may recommend any of the three former governors from the North-West as being capable of replacing Buhari. “The three leaders are Rabiu Kwankwaso, Sule Lamido, and Ibrahim Shekarau who are all from the North-West like Buhari. “I think a major challenge of CNM is how to work to the answer in 2019 on any of these three presidential aspirants. “This is why CNM, through Obasanjo, is opening talks with top politicians from the six geopolitical zones.” But the group is still working on the platform it will use to actualize its plan to replace Buhari. “The choice of platform is a challenge,” the source explained. He added: “PDP is the strongest opposition party which Obasanjo does not want to associate with in order not to return to his vomit having torn his membership card. “The CNM is trying to recommend a merger of PDP and other parties with a new name to be able to push its agenda for any of Kwankwaso, Lamido and Shekarau.” The CNM believes it has made a substantial inroad into the National Assembly as one of the institutions to promote the anti-Buhari agenda. Continuing, the source said: “The CNM has been implicated in a romance with some Senators and members of the House of Representatives which led to the reversal of INEC’s Order of Elections in 2019. “Nigerians should expect more radical resolutions from the National Assembly which can promote the coalition’s plans against Buhari and the All Progressives Congress (APC).” Analysts however see Obasanjo’s motive as selfish and playing gambling with Nigerians. One analyst asked: is it his birth right to choose president for us? He imposed Yar’Adua, Jonathan, now he is scheming to impose on us the next President. He must be stopped. “On Wednesday, Obasanjo insisted that CNM would remain a socio-political movement. “He said he would cease to be a member if the coalition becomes partisan. “He said: ‘In the year 2015, I said I would no longer participate in partisan politics. And I still stand by my decision. Everybody, irrespective of his or her political affiliation is free to come here for advice, I will gladly do that.
