rusher14:You getting it all wrong. The position of the law is that, the person alleging must prove first then the accused will now open his case and if he alleges otherwise then he proves. You can't bring someone to court and asked the person to prove ownership of money. Read the case of Wike v. Peterside where the Supreme court bashed the Court of appeal justices for moving the burden of proof to Wike. It is only the evidential burden that shifts. |

Yyeske:She is not under obligation to prove her innocence, the onus is on who who alleges fraud proceeds to prove same beyond reasonable doubt. The charge sheet must contain the owner of the alleged money (fg) , how it was stolen, the date or period. Then she will be asked to enter plea, anything short of the above means she will not enter plea, her lawyer will rather raise preliminary objection challenging the competency of court upon a frivolous charge sheet. The question is, can efcc prove fg's ownership of the said money? The position of the law is that, the money or thing alleged to have been stolen shall: 1. Ownership (show it belongs to fg in this case 2. It must be something capable of being stolen 3. Stolen by the accused. The question you should ask yourself Is, is there any account directly or Indirectly linked to the various accounts that belongs to federal government aside the fact that the money was deposited by Dudafa? The onus is on the fg or efcc to prove ownership of that money then she will be called upon to open her case. Anything short of that amounts waste of time |

No law in Nigeria requires the accused to explain or prove his innocence, the onus is on efcc to show that the money is a proceed of corruption and not the other way round. I refer you to section 35 and 36 of the Constitution. The only place she is expected to explain in this case is at the CCT and it has to be the husband who made the declaration and not she. CCB & CCT doesn't have the balls to invite Jonathan and you know that. Moreover, her lawyer had given her a leeway, that the money belongs to her late mother, she was holding the money in trust. The implication is that, she is not the owner, she was a mere trustee and such cannot be declared. Wise lawyer she got!!! |
If I insult Jonathan for bringing this disgrace to himself with his cowardice act some fools will insult me. Is nairaland CCB or CCT or FHC? If you think she is guilty charge her to court and if found guilty send her to Kirikiri gaol and not this media stunt. She said the money belongs to her later mother and she is only a trustee so how do u expect her to declare money she is holding in trust for the dependants of the deceased? EFCC cannot get this money because the mother is no more to testify and the onus is on efcc to prove her guilt by evidence showing that the money is a proceed of fraud and not on her to prove her innocence. Common Saraki matter has taken them approximately 2 years, Jonathan's wife case will take them 8years at the CCT. Mama peace is a very hard nut and cannot be cracked easily. |

If I should revert same I will be made the escape goat because that is why I think they are allowing such to happen in the forum. It's one's prerogative to express his or herself and in the process you might insult the other provided your insult is not defamatory. Not all insults amount to defamatory comments. If you want us to insult ourselves then do me a favour by asking the owner of the copyright to amend the rules and allow us to insult ourselves keeping civility aside and see if you can withstand me for the game of Insult. I for one will not entertain you henceforth with my time again or any of you who can't obey the rules governing this forum. He who can't obey simple rules of engagement in a forum (don't pelt insult on another member like missiles ) has actually a mind of a ten year old, so I will kill him or her with no response. I think Seun needs to do something about the incessant breach of the rules governing this forum. Take for instance, I have been insulted every now and then because I called Jonathan a "coward" of which I am still standing by it. The funny thing is, even those who hates Jonathan are now feigning loving Jonathan just to get at me. Some out of ignorance went as far as saying things like; you insulted Jonathan so why the complain. I think we need to get something clear here, the rules said don't insult a fellow nairalander and the last time I checked, Jonathan Goodluck is not part of us and if he is part of us, he is was my president and I have the prerogative to express my feelings regarding his person while he was the president. whilst I am waiting for Seun to ensure strict compliance with the rules governing this forum, I am making a passionate appeal that we as "nairalanders" should learn how to face the discourse at hand in a particular time and not be insulting others because you felt the other person was wrong. It behoves on us as members to differentiate the topic whether it is sound or not from emotions. Come to think of it, it is a common parlance that no matter how odious the disposition of the adverse party is, you don't allow your appetite to control your reasoning hence you become a fool.
