Ifakiland: Lemme try and explain the law around armed robbery to you. The penalty for robbery is 5-25years depending on its degree....but armed robbery is either life in jail or death depending on degree also. Robbery is stealing without a deadly weapon....eg pick pocket, breaking and entering, bulgary, etc all these you get less than 10yrs in jail....but if during the commission of the robbery you injured someone, you get 10yrs+.....if you kill its 25yrs+ could even be life in jail.
But armed robbery is stealing with a weapon dat can kill. If you have anything dat can kill with you while stealing it becomes armed robbery....even if the weapon is a nail, blade, knife, axe, gun etc....for that you get life in jail no questions asked....if you happen to kill or injure anybody during the commission of the crime....you get death straight.
That's the law.
Offenses that can get you life imprisonment or death in Nigeria are the following; Armed robbery (regardless of weapon used) Treason (coup plotting) Kidnapping Terrorism Etc Robbery and Burglary are not the same |

Besides, the judge was magnanimous enough not to have slammed them with a death sentence. The maximum punishment for armed robbery is a death penalty. |

Punishment for Robbery
The offence of robbery is punishable with 14 years imprisonment. Attempted robbery is punishable with not more than 20 years imprisonment and not less than 14 years imprisonment. See section 403 or the Criminal Coe Act.
Punishment Under The Penal Code Act
The Penal Code Act seems to have taken robbery and armed robbery on a lighter view. Section 298 of the Penal Code Act provides the punishment for robbery of which its punishment may extend to 10 years imprisonment and fine. Where the robbery is committed on the highway within the hours of sunset and sunrise or between sunset and sunrise on a person who has slept or has lain down to sleep in the open air, the punishment may extend to 14 years imprisonment and a fine. There is no sense in this judgement meted on these young people, stealing phone with armed cutlass is still a burglary case not fully armed robbery. Do you know what Burglary is? Breaking and entering into a dwelling house with an intent to commot a felony within the period of 6:30pm to 6:30am. With regards to Armed Robbery, it is immaterial whether the item has no value or has a trifling value. Another thing to take note of is, as long as the accused was armed with any weapon capable of causing grievous body injuries or harm, a case of armed robbery exists. In this case, a cutlass is a weapon capable of causing grievous body injuries. But what I do not understand is, since the Victim ( Mrs Akeredolu) was not around when the incident happened, who did the suspects use or threaten to use violence on? I feel they should have been charged with Burglary and not Armed Robbery |

Legally speaking, there is nothing like "Rape" between two legally married partners. This is so because the Law sees the marital vows made during the marriage between the man and the woman as subsisting all through the period of marriage.. The so called "CONSENT" of a legally married woman is by Law, taken away from her when it comes to sex with her husband, whether or not she gives outright consent or not, the man cannot be convicted of rape when it has to do with his legally married wife.. The only exception where a lady can lay claim of husband raping her is when the Court has made a decree for Judicial Separation, that is when the both of them are under a decree of Judicial Separation which could possibly lead to a divorce (in this case, they wont be cohabiting under the same roof), and the husband goes ahead to sleep with her without her consent. This is the only time a woman can lay a claim and succeed. Apart from that, any action for rape by a woman against her legally married husband is in futility, as it holds no water.. I'M A LAWYER... Rape is a topic to be discussed adequately, What many don't understand is that, either married or not, as long as the party you're having sexual act with doesn't concent to the act, it can be tagged rape. Sex is part of marital bliss but when your spouse says "no" but you still go ahead and use force on him/her, that's rape. Repeated denial doesn't mean you should force her, na one of the whys our forefathers consider multiple wives, if one says no to you, you move to the next one. Marital rape is not recognised under the Nigerian law. Get your facts right! |
