A legal luminary, Femi Falana (SAN) has called for the immediate release of Brig. Gen. Enitan Ransome-Kuti, from prison custody having completed the six months sentence imposed on him by a Special Court Martial set up to try him by the Nigerian Army on October 15, 2015.

Falana, who made the call in a statement he issued in Lagos yesterday and addressed to the Chief of Army Staff (COAS), Gen Tukur Buratai, said that if his request is not acceded to by the army authority he would approach the court to enforce his client’s right to liberty.

According to Falana, by virtue of Regulations 54 and 55 of the Prisons Regulations made pursuant to the Prisons Act (CAP. P29) Laws of the Federation of Nigeria, 2004 which provides that every convict is entitled to a remission of one third of the sentence imposed by a court, Ransome-Kuti ought to have been released on February 15, 2016.

He said, “It would be recalled that our client was unjustly convicted and sentenced to dismissal from the Nigerian Army and 6-month imprisonment by a Special Court Martial on October 15, 2015.

“As the findings of the Special Court Martial are subject to the confirmation of the appropriate authority we made a strong representation to the Army Council on behalf of our client.

“By letter dated October 19 2015 we also requested the Authorities of the Nigerian Army to release our our client from military custody pending the determination of the appeal.

which he intended to file against the unjust findings of the Special Court Martial which convicted him of war related crimes and sentenced him to 6-month imprisonment and dismissal from the Nigerian Army.

“For reasons best known to you the request for our client’s release pending appeal was turned down by your good self in flagrant violation of section 160 of the Armed Forces Act (Cap A20) Laws of the Federation of Nigeria, 2004.

“Thus, you caused our client to serve the 6-month prison term without the confirmation of the findings of the Special Court Martial by the Army Council.

As if that was not enough, you have ignored our demand for the release of our client since he completed the 6-month prison term on February 15, 2016. In our letter dated February 12, 2016 on the subject matter, we had pointed out that our client ought to have spent 4 calendar months in custody by virtue of Regulations 54 and 55 of the Prisons Regulations made pursuant to the Prisons Act (CAP. P29) Laws of the Federation of Nigeria, 2004 which provides that every convict is entitled to a remission of one third of the sentence imposed by a court.

“In view of the foregoing, you will agree with us that the continued detention of our client cannot be justified under the Armed Forces Act and the Constitution of the Federal Republic of Nigeria, 1999 as amended. We are therefore compelled to request you to use your good offices to ensure that our client is released from unjust and illegal incarceration forthwith.

“Take Notice that if you fail or refuse to accede to our request by ensuring the immediate release our client we shall not hesitate to seek redress in the Federal High Court with a view to securing the enforcement of his fundamental right to person liberty guaranteed by section 35 of the Constitution and article 6 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act (Cap A9) Laws of the Federation of Nigeria, 2004,” Falana stated.

Just when you have heard the worst of corruption and maltreatment in the Nigerian civil service, Federal Polytechnic Oko will surprise you with something worse.

Staff of the Polytechnic Staff Secondary of the Federal Polytechnic Oko recently made a shocking discovery: their managment have been paying them way below their government stipulated salary for over 12 years and they didn't know. And the difference, amounting to over N1 Billion has been consistently diverted every month to people in the managment of the Polytechnic. About 32 of the Staff school have been discovered to be victims of this thick web of deciet and stealing.

This is a summary of the situation written by the affected staff.



How could something like that happen, and for that long?

Like most people in the Federal service, they (the staff) were invited to apply for jobs, when they were employed, they were led to believe that they were employed by the Polytechnic, rather than by the Federal government. So the management convinced them that , since they were in the Staff Secondary section, the Polytechnic (instead of the Federal Government) is responsible for paying their salaries. Being grateful to have a job, they didn't question it. Using that as a covering over their eyes, the Management kept diverting up to 60% of their salaries and giving them a little piece of what rightly belongs to them. Frequently, even the little they get were withheld and delayed for up to 3 months. This means that their colleagues that are working in the Polytechnic will have received their salaries and they will be left waiting, sometimes, they will teach for a whole term and not get paid, even though the Government has released the salaries. But since they have been convinced that they were not Government employees, they didn't complain, and they didn't suspect any foul play until PENCOM came along.


ENTER PENCOM!

Sometime in 2006, 2 marketers from First Guarantee Pensions Limited (FGPL), a Pension Funds Administrator (PFA), came to them and told them asked them to register for a Retirement Savings Account (RSA). An RSA is an account where your pensions are deposited until you are ready to retire. Nigerian Pensions Commission allows people to choose a Pension Funds Administrator (PFA) that will manage your pension, just like you choose a bank to manage your money. This is to make it easy to withdraw your pension from your Retirement Savings Account (RSA) whenever you retire without delays. Most of them didn't really understand Pensions RSA when they created the account.

This is how it works. When they create the account, they get a PENCOM ID. When it is nearing payday, the woman in charge of pensions in the school (name withheld) sends the Nominal Roll of all the Staff of the Polytechnic being paid by the Federal Government to PENCOM, along with their PFA account, PENCOM ID Payslip, Passports and Appointment Letters. Then PENCOM can verify that they are Government employees, identify their employer, calculate their pensions and identify the PFA (in this case, First Guarantee) to pay it into. So whenever the government releases money for salaries, if PENCOM has recieved the Nominal Roll, they will send the pensions directly to the PFAs then the rest of the salary is sent to the school. Like every other bank account, as soon as money is deposited into the RSA, the staff get a credit alert. Periodically (sometimes, monthly), they got statement letters showing their monthly Pension contributions and the balance. And that was how suspicion started.

Now according to PENCOM act, pension is 15% of your gross salary, part of which is deducted from your salary every month and deposited into your RSA. The 15% is split between you and your employer, 7.5% each. So assuming your gross salary is N100, N7.5 is deducted from your salary, and your employer will bring the other N7.5 to make N15. So N92.5 is credited into your salary account, and N15 is credited into your RSA. So to get your gross salary from your pension, multiply the pension by 100 and divide by 15. PENCOM will specify in the RSA statement that the deposit came from your employer.

So when these people were getting the alert for the their RSA they kept wondering how they were contributing over N13,000 to an RSA when their salary is just over N50,000. When they became highly suspicious was when they kept getting RSA credit alerts when they haven't received received salary for that month. Sometimes they get RSA alert for 3 months and no credit alert from the Polytechnic. The staff, one of whom tragically died during one of those months in 2013, usually have no other source of income and have to endure long hardship when their salaries are denied them by the Polytechnic. It was baffling to them how they would be tucking away over N13,000 when they haven't received a kobo. That was what led to the investigations that uncovered this story. Over 30 staff, almost all of whom work with the Staff School division of the Polytechnic, discovered that this has been going on since they have been employed. In the case of one of them who has been employed there for 13 years, she has been receiving less than 60% of her entitlement since she was employed. The sum of all the monies that have been diverted from their salaries since all 33 (or so) of them have been employed is over N1 billion. Lecturers and other staff that work in the Polytechnic did not know about this injustice because they didn't experience it. They were paid fully when due. As at the time of this writing, they have only just received their June, 2015 salary. They haven't been paid for July 2015 to January 2016.

Various attempts have been made by the affected Staff to communicate with the management but they have been threatened with sack and reminded that they were employed by the Polytechnic and not Government. Any of one in the Senior level management that has tried to look into the matter has been cautioned till they backed off. Up till recently, the teachers, most of whom are elderly people were too scared to loose their jobs, and of long legal procedures that might leave them out of job and delay the remunerations they seek.

Two week ago, the SSS summoned the affected staff and the management of Polytechnic to Awka investigate the matter. Apparently, the management didn't know the staff were receiving RSA alerts. They denied knowing anything about the Pension deposits, insisting that they paid the correct salary. The claimed that the pension amount which they manually input on the payment sheet (see payment slip pic) was their real pension, but couldn't prove where it was deposited. After the meeting one of management reps was reported to have lamented the RSA alerts and claimed that he will stop the alerts.

The SSS said they will invite them to Abuja for further inquiry, but at this point, the staff involved are making frantic efforts to get the justice so they don't get victimized, the management is making frantic efforts to cover up their terrible injustice and hide the trails and we are making frantic efforts to make the public aware of the situations. Hopefully the EFCC and concerned Agencies will launch an investigation into the matter and make some arrest. Hopefully, justice will be served quickly and the staff will be refunded what is due them.

Notice their current salary they receive from the Polytechnic beside the confirmation year, their pension contribution which is 7.5% of their salary, and the actual government stipulated salary at the last column.

Picture 3 is payment slips used by the polytechnic to pay them in January, July, August and September 2009 . Notice that their gross pay is N60,218. Also Notice that January 2009 salary (first column) was paid on 3rd of March 2009. Notice also that there are multiple deductions from the gross pay, including NAT PENSION (written with a pen). None of those deductions are even legitimate. These deductions drop their net take home to N53,338

Picture 4 is the section of the RSA statement showing January, July, August and September 2009 Pension contributions (the months on the payslip in Picture 3). The contributions from employer and employee was N7375.58 respectively, each of which is 7.5% of the true salary. This puts the actual salary for those months at N98,341, but instead this teacher was paid N53,338 for each of those 3 months.
The feder polytechnic Oko Rector and management should b arrested and prosecuted with immediate effect,the staves salaries denied all duely paid them.

A growing number of politicians are making moves for a realignment of political power in Nigeria towards a new political party, THISDAY has learnt. This is amid crisis in the main opposition party, Peoples Democratic Party (PDP), and conflicting interests in the ruling All Progressives Congress (APC).

It was gathered that discussions among politicians from the two leading parties towards the floating of a new party started in earnest some months ago, and it was fast gathering momentum. Insiders said the new political move had the support of some serving governors from both the APC and PDP, key principal officers of the National Assembly, and some aggrieved political leaders across the six geo-political zones. A former senate president, Ken Nnamani, is being prevailed upon to act as the arrow-head of the emerging party, it is gathered.

Nnamani announced his resignation from PDP on February 6, saying, the party had abandoned “the path of its noble vision and values”. He was elected Senate President in 2003. In his statement titled, “PDP, the Burden and My Conscience,” Nnamani said he was fed up with the state of things in the party. But said he was quitting “without any iota of bitterness.”

He stated, “I do not believe I should continue to be a member of the PDP as it is defined today. This is certainly not the party I joined years ago to help change my country. I do not also believe that the PDP, as it is managed today, will provide an opportunity for me to continue to play the politics of principles and values, which I set for myself as a young man on leaving graduate school and working for a large multinational in the United States in the 70s and 80s.”

Nnamani did not announce an intention to join any political party, but he promised to remain politically active.
A former Senate Chief Whip, who chose not to be named, confirmed the emerging political moves. He said, “Go and talk to many political elites across the country today, you will hear and confirm huge frustration among them. Nobody seems to be happy with what is happening in the APC and the PDP. And some of us have come to a conclusion that there is urgent need to have a new and credible platform to save this country.

“You will be shocked to know that the agitation for a new political platform is more pronounced in the North, in spite of the fact that we currently have a sitting president from the North. It shows how frustrated people are in the country today.”

Another enthusiast of the emerging political grouping, who is a prominent leader of APC, also told THISDAY in confidence, “The hope that things will change for the better, with President Muhammadu Buhari in power, is being dashed by the day. As I speak with you today, the soul of the APC is gone. Go to the national secretariat of the party, they will tell you.”

It was learnt that some desperate efforts recently by concerned leaders of APC to iron out things among themselves were frustrated by the political hawks around Buhari, who are already strategising for 2019.

“What you are likely to have in the coming months is a congregation of old PDP members in the APC pulling out to form a formidable political party with some progressive-minded members of the present PDP,” the APC leader said last night in Abuja.

The special caucus meeting held last week by APC was said to be part of the measures to halt the tide of disenchantment, which promises to seriously threaten the ruling party. Very little was achieved by the meeting following the absence of President Muhammadu Buhari, who was unavoidably absent. But another meeting is being contemplated for this week, where aggrieved APC members would be expected to table their grievances before the party and the government.

Many APC members are said to be calling for the removal of the national chairman, John Odigie-Oyegun, citing poor leadership. It is suspected that the replacement for Odigie-Oyegun would come from the North as part of a grand plan to put the president in a position of comfort as far as party administration is concerned. But that is expected to meet with resistance, as party leaders from other parts of the country are likely to oppose the idea. Generally, many leaders of the party are said to be unhappy with the current status of the party and the government, having been shut out of the decision-making process, despite their commitment to the success of the party.

One of the problems believed to be delaying the manifestation of the idea of a new party, according to the promoters, is the question of the personality around which the party will be built. They want a personality that would sell, like Buhari did, for the APC.

Indications of how the politicians are readjusting towards the eventual formation of a new party are clearer in PDP. The party has lurched from one crisis to the next since it lost the general election to APC last year. The high turnover of PDP national chairmen since the election is symptomatic of the crisis within.

Adamu Muazu resigned under pressure as PDP national chairman on May 20 last year, accused of leading the former ruling party to a devastating defeat at the polls. He was replaced by Haliru Bello, who was appointed acting national chairman on May 25 last year and was sacked on February 10 this year. Bello was succeeded by the PDP deputy national chairman, Uche Secondus, who worked in acting capacity until February 16, when he handed over to the newly-appointed national chairman, Ali Modu Sheriff. Sheriff’s appointment has been enmeshed in controversy.

Though, PDP says it has resolved its leadership crisis following an agreement to let Sheriff run the affairs of the party for three months, until the national convention, when a new national leadership of the party would be elected. There are fears that PDP may come out of the national convention more divided than it went in. This is due to the very huge likelihood of a clash between the PDP governors, who were the main force behind Sheriff’s emergence as national chairman, and other groups and interests in the party that had opposed his choice.

In recent times, some prominent PDP members have resigned from the party without joining other parties, in what is seen as a strategic move to help nurture the expected new political platform. Besides Nnamani, Samuel Ogbemudia and Dalhatu Sarki Tafida have recently left PDP, but did not defect to other parties.

In APC, the National Assembly has been the main theatre of war. Senate President Bukola Saraki and House of Representatives Speaker Yakubu Dogara won their positions last June against the wish of the party, in connivance with PDP legislators. Sources say Saraki’s current trial by the Code of Conduct Bureau may prepare the ground for the consolidation of the moves towards a new party. Both Saraki and Dogara belong to a bloc within the party, the New PDP, which believed they needed to be compensated for their contributions to the victory of APC.

GOVERNOR OKOROCHA ACCUSES NDDC OF FRAUDULENTLY SHORT-CHANGING IMO STATE

-ASKS THE NEW MD TO CORRECT ANORMALY

 

Governor Rochas Okorocha has accused the Niger Delta Development Commission NDDC of fraudently short-changing Imo State and her people, adding that he was shocked to hear that billions of naira had been sent on the claimed 272 Projects in the state which are nowhere to be seen.

 

Governor Okorocha spoke when the new Managing Director of the Commission Mrs. Ibim Sememitari paid him courtesy call on Friday, February 26, 2016, in Owerri while on a two-day working visit to the state, with the Governor regretting that the NDDC that was established to serve member states was turned into ATM for some PDP parliamentarians and bigwigs from the state.

 

The Governor told the visiting MD, “I am shocked to hear that the NDDC has over 272 Projects in the state for which billions of naira were also said to have been spent on. I would like to have the list of the projects, the contractors handling them and where they are stited, because Imo people would also be shocked to hear this. Let us know the projects, their sites and the amounts paid on each of them.”

 

He continued, “the truth is that these projects could exist only on papers because the popular impression here is that the NDDC abandoned the state and her people, while releasing money meant for projects in the state to some PDP elements from the state in Abuja who shared the money with the contractors.”

 

His words “the NDDC isolated the state government. At times these wicked people behind all these fraud would ensure that both NDDC and Ministry of Niger Delta Affairs would award different contracts on one particular project and at the end of the day the job won’t be done. At times too, they would put NDDC sign board on state government project. So many funny things.”

 

He continued, “NDDC should not be partisan. People from the NDDC states should be provided with services required, despite their political affliations. Frankly speaking, the state has not benefited or felt the impacts of NDDC because no visible project has been put on ground for years. At a point, I thought about pulling the state out of the NDDC and demand that the money meant for the state should be remitted to her directly.”

 

The Governor noted, “the NDDC has remained a nightmare to Imo people. With the new MD, the state can now partner NDDC with the hope that things would begin to work out fine. And in the Commission’s budget, the management should look at the areas of power and rail lines linking the NDDC states. The Commission should not be constructing boreholes, renovation of schools and health centres. Let there be light at the NDDC now.”

 

He described the NDDC as an abode of corruption before now, and expressed the confidence that the new MD has all it takes to correct the plunders of the past administration, requesting that contract papers given to contractors should be copied to the government henceforth, to enable the government monitor the project effectively.

 

In her speech earlier, Mrs. Sememitari told Governor Okorocha that she was in the state to brief the governor on the activities of the Commission in the state, adding that Imo State is the first state she would be making such visit, and said the Commission has executed 272 projects in the state since inception going by the record available to her.

 

She said the Commission would partner the state government especially on the issue of identifying areas where the state is in dire need of certain projects to avoid duplications, commending the governor for his giant strides in the state.

The Presidency has disclosed that President Muhammadu Buhari has an economic management team. The Senior Special Assistant to the Vice President on Media and Publicity, Mr Laolu Akande, disclosed this in a telephone interview with our correspondent last light.

Akande was reacting to a media report that quoted some economic experts as urging the president to form his economic team. According to him, the economic team of President Buhari has been put in place since the inauguration of the Federal Executive Council (FEC) last November.


 Akande said the economic management team is headed by Vice President Yemi Osinbajo.  He listed the team’s key members as including the Minister of Budget and National Planning, Senator Udoma Udo Udoma; the Minister of Finance, Kemi Adeosun; the Minister of Trade, Industry and Investment, Okechukwu Enelamah; the Governor of the Central Bank of Nigeria (CBN), Godswin Emefiele; and the Director-General of the Debt Management Office (DMO). He said the composition of the team was not static as Agriculture Minister Audu Ogbe and Information Minister Lai Mohammed as well as relevant permanent secretaries have also been involved.

The vice president’s aide said the team had since been meeting and engaging representatives of the private sector.

He noted that unlike what obtained in the past, Buhari’s administration did not make anybody from the private sector a member of the economic management team.

The vice president’s spokesman also exclusively told our correspondent that President Buhari had appointed Dr. Oluyemi Dipeolu as his Special Adviser on Economic Matters.  He said the economic adviser, who was until his appointment in January a director in the United Nations Economic Commission for Africa (UNECA), has been working with the economic management team.
