Re:Osinbajo sets up judicial commission to probe human rights abuses by Nigerian military

A Nigerian human rights activist sent me the above news report on Premium Times website. Excerpt of the report stated:

“Acting President Yemi Osinbajo, SAN, has appointed a 7-man Judicial Commission, headed by Justice Biobele A. Georgewill, of the Court of Appeal, to review compliance of the Nigerian Armed Forces with human rights obligations and rules of engagement, especially in local conflict and insurgency situations,” a statement by Mr. Osinbajo’s spokesperson, Laolu Akande, said.

"Some of the allegations that have been levelled against the military by groups such as Amnesty International, Human Rights Watch, as well as several PREMIUM TIMES investigations, include extra-judicial killing of over 300 Shiite protesters in Kaduna in 2015, the extra-judicial killing of dozens of pro-Biafra protesters in the South-east, and that of suspected Boko Haram members in the North-east."

Members of the Osinbajo commission are:
1)Mr. Biobele A. Georgewill as Chairman;
2)Patrick Akem, army Major General
3)Wale Fapohunda,
4)Hauwa Ibrahim,
5)Jibrin Ibrahim,
6)Ifeoma Nwakama
7) a representative of the Office of the National Security Adviser.

None of the above names ring a bell in the Nigerian human rights struggles. These are submissive characters cleverly selected by the tyrannical regime to further it's evil agenda. There are credible Judges and Human Rights activists who should have been members of this commission if the government is honest and sincere.

The presidential committee appointed by Acting President Osinbajo is a tooth-less bulldog that does not have the powers to identify the murderous criminals who brutally murdered thousands of innocent Nigerians in the military. In his statement on Friday, Osinbajo's Spokesperson said the presidential committee “is empowered to review extant rules of engagement applicable in the Nigerian Armed Forces, and the extent of compliance thereto.”

This is another window-dressing by the oppressive and tyrannical Buhari regime that brutally slaughtered 1000+ Shia civilians in Zaria in December 2015 and wickedly dumped the dead bodies in mass graves at night to bury the evidences. The brutal and inhuman #ZariaMassacre shocked the world due to the extremity of savagery and barbarism on innocent and defenseless civilians. And it is on record that the wicked, evil and bloodthirsty Nigerian tyrant Buhari ordered the inhuman massacre to further the evil imperialist agenda that has the savage Saudi regime as front. President Buhari celebrated the inhuman massacre on phone with the King of Saudi Arabia four days after the massacre and toured Saudi Arabia, Qatar and UAE to be rewarded for the brutal slaughter of 1000+ Shia civilians and the total destruction of the Iconic Shia Husseiniyya in Zaria.

It is the peak of naivety to think that President Buhari's will prosecute the murderous executioners of thousands of Shiites and pro-Biafra activists. President Buhari personally ordered these inhuman massacres by the Nigerian Army of innocent and defenseless Nigerians. Did you hear them said anything about the mass graves they dug and buried thousands of innocent Nigerians they brutally murdered?

PRESS STATEMENT

*600 DAYS IN ILLEGAL DETENTION: OUR CALL IS UNEQUIVOCAL AGAINST CONTINUED DETENTION OF SHEIKH ZAKZAKY, OUR RESOLVE UNWAVERING!*

Today marks exactly 600 days since the illegal detention of our revered Leader, Sheikh Ibraheem Zakzaky despite a valid court order for his release. We continue to strongly voice our opposition to the lame excuses forwarded by the government for his continued incarceration, especially the most irrational of all - that of the so-called ‘protective custody’. The Federal High Court in Abuja has since declared as alien to all known laws of the land and indeed all laws known to man, the concept of protective custody. It therefore ordered the release of the revered Sheikh. However, to the consternation of all, especially the International Community, the Federal Government has continued to contemptuously defy the order.

In his considered judgement, the learned judge of the Abuja Federal High Court, Gabriel Kolawole said inter-alia: “the 1st and 3rd respondents have not been able to discharge the burden placed on them to prove either the legality of the Applicant’s detention in the 1st Respondent’s custody, or to prove that he consents to his being held in a “protective custody”.

Justice Kolawole continued, "When I reflected on all the issues and questions which I had raised in the course of reviewing the processes filed and exchanged by both parties, not only was I unable to set my eyes on the provision of any law or the Constitution by which the Applicant’s detention, albeit in a “protective custody” can be justified. I was unable to answer or resolve any of the questions or issues set down in the addresses filed and exchanged in favour of the 1st and 3rd respondents who as I had earlier remarked, in constitutional jurisprudence, bears the burden they need to discharge against the presumption of law that every act of detention is prima facie unlawful, illegal and unconstitutional until the State or any of its Agencies or Agents is able to show the legal justification for such infraction of fundamental rights to personal liberty, and it can only do so within the exceptions prescribed and recognized by the Constitution itself. This in essence, is the basic concept of constitutionalism and rule of law in very democratic State such as ours.”

Surprisingly, the Government continues to hide under this façade to deceive the public on the actual reasons it continues to breech Sheikh Zakzaky's freedom.

Undoubtedly, Sheikh Zakzaky is still languishing in jail for no other reasons than his religious views and call for the establishment of divine justice and for his daring comments on contemporary socio-political events locally and internationally.

Sheikh Zakzaky has been most consistent critic of the scam called "Boko Haram." He has maintained that the phantom group is a creation of the “oil-hungry west.” He pointed out that the terror group expanded exponentially due to a massive influx of personnel and arms from Libya after the French-led, U.S.-backed NATO regime change project. He was also quite vociferous against the injustices perpetrated by the United States against weaker nations, accusing Washington of spreading discord among Muslims. He remained the most consistent critic of the Israeli entity for its abysmal treatment of Palestinians. It seems fairly certain that both the U.S. and the Israeli entity approve of the indefinite detention of Sheikh Zakzaky. That is the only explanation for the deafening silence of the western media in spite of flagrant abuse of rights of the Sheikh and his supporters on a scale never before experienced anywhere else.

As the Sheikh clocks 600 days in illegal detention, we renew our unequivocal call for his immediate and unconditional release. We strengthen our individual and collective resolve, undeterred by continued brutal persecution, to campaign in all lawful and peaceful ways for his release as well as that of his wife and other IMN members also unjustifiably detained. We will leave no stone unturned in our lawful demand for justice for the over a thousand citizens killed extra judicially during the Zaria genocide of December, 2015.

Says Sheikh Saleh Lazare

A prominent Islamic Cleric from Niger Republic, Sheikh Saleh Ahmad Lazare has disclosed that Leader of the Islamic Revolution in Iran, Sayyid Khamenei informed him in the presence of other Ulama during a visit that they are also in need of prayers of Sheikh Zakzaky where he is being held incommunicado as much as he needs their prayer also.

Sheikh Lazare made the disclosure in an interview with Almizan newspaper recently, which was published in its Friday edition this week.
He said he went to Iran on the invitation of Almustafa International University, to attend a conference that involve almost 200 Ulama from over 80 countries.

“We paid a visit to the Leader in his home. When he came out, some of us were selected to make a brief address. When It was my turn I said I’m from Niger, but from Nigeria also as a follower of Sheikh Zakzaky, whom I believe is in dire need of the Leader’s prayers,” said Sheikh Lazare.

He continued, “When the Leader was addressing us, he didn’t forget what I said to him. And in response he said ‘we are aware of the condition Sheikh Zakzaky and spiritually we are with him. We are also in need of his prayers in as much as he needs ours.’”

Sheikh Lazare then promised to himself to deliver this message directly to Sheikh Zakzaky where he is being incarcerated, when he returns home.

When Almizan asked him whether he has fulfilled his pledge, he answered in the affirmative. “Praise be to Allah. I talked to him directly and told him the message of the Leader Sayyid Khamenei.”

Commenting on the import of what Sayyid Khamenei said of Sheikh Zakzaky, Sheikh Lazare said “This statement by the Leader called for introspection from we who live with the Sheikh. It seems we don’t know the value and personality of Sheikh Zakzaky. Sheikh Zakzaky is indeed among the most pious of believers of our generation.”

THE 3RD ANNUAL INTERNATIONAL QUDS CONFERENCE HELD IN ABUJA NIGERIA

The 3rd annual international Quds conference was held Saturday July 29th, 2017 at Merit house Abuja despite an attempt by the Nigerian
security agent attempt to stop the ongoing conference then.

This year’s conference theme “Reflections on Quds- Hard facts, tough questions” and with Sub-theme “Key challenges in enforcing and
protecting minority rights in Nigeria” had Shaikh Ya’aquob Yahya Katsina as the special guest of Honour, and Barrister Femi Falana,
Prof Chidi Odinkalu, Barrister Festus Okoye Esq, Alhaji Muktar Surajo, and Dr John DanFulani as its guest speakers and Mr Jude Ndukwe as the
reviewer of the book published and lunched “Compendium of a Social Struggle” Statements, Releases and Letters written by the Islamic
movement of Nigeria documenting the Zaria Pogrom.

Dignitaries that were present include Shaikh AbdulHameed Bello, Shaikh Adamu Tsoho Jos, Mal Badamasi Ya’aquob, Chief Ebenezer Onyetekin, Alh Tijjani Abdul Ra’uf, Mr Deji Adeyanju etc.

In his speech at the occasion Shaikh Ya’aquob showed concern on the state of Palestine and urge on all never to remain silent and wash the
people of Palestine oppressed, for our Creator have enjoyed us never remain silent and see people oppressed. On this Ayatullah Ruhullah
Khomeni (QS) have enjoyed us and strengthen our courage to say no to any oppression, and the Islamic Movement in Nigeria (IMN) have always participated in the international Quds day activities called by the revolutionary leader Ayatullah Khomeni (QS) in which in 2014, three
children of the leader of IMN Shaikh Ibraheem Zakzaky (H) and thirty–one others killed by the Nigerian army on their Quds Day protest march. He then called on all Muslims, Arab and conscious minded people to rally around the oppressed Palestinians and help emancipate them from all forms of oppression.

“In a democratic set up where the rule of law prevails, the court decides on any conflict between human rights and national security and the court order must be obeyed” was an important professional remark that came from the renowned solicitor and advocate of law in Nigeria, Barrister Festus Okoye during the course of his lecture in the 3rd Annual international Quds conference organized by the Islamic Movement in Nigeria, title “Balancing human rights and national security:
Ground realities in Nigeria”. Subsequently, he urged the Federal Government of Nigeria to obey without further delay, the court
judgement delivered by Justice Kolawole of the Federal High Court, to release the revered leader of the Islamic Movement in Nigeria Sheikh El Zakzaky and his wife Malama Zeenatuddeen Ibraheem.

In another session of the conference proceedings, Barrister Femi Falana (SAN) ably represented by Mr Ezenwa Nwagu, discussed on key challenges in enforcing and protecting minority rights in Nigeria. He observed that right from the colonial era, rules were entrenched to safeguard economic rights of imperialists. The bourgeoisie class now
oppresses the majority masses. Due to poverty, he lamented, social and political rights have been denied to masses. For example, without
access to education (due to poverty), freedom of expression cannot be exercised. He said that IMN has right to challenge its contemptuous
ban by El-rufa'i.

Speaking on the same topic, the renowned human rights activist Prof Chidi Odinkalu redefined the meaning of minority. He observed that those that are not in power, whoever they are, are the minority. In another development he said that the politicians are the great threat
to the Nigerian community. They want to divide us along sectarian lines, Muslims VS Christians, Shiites VS Sunni. North VS South, etc.

He asserted that Nigeria is bigger than all of us. All people are part of one community under God. If you are not a brother/ sister in faith
you are a brother/sister in humanity. He also lamented on our pathetic situation in Nigeria where politicians abuse power with impunity. A
thousand people were massacred in Zaria and 347 (from the account of the perpetrators) were mass buried and up to now No body accounts for this. What kind of nation is this? , he queried.

Dr John Dan Fulani, an academic and activist also had a presentation in the conference. He deliberated on the topic: prejudices and
stereotypes: debunking misconceived views on IMN - a Christian perspective. He observed that there is no better place than Nigeria where the adage "religion is the opium of the masses" apply. He said that the superb philosophy of the IMN and its peaceful evangelism made
it to gain the feat of gathering millions of followers in only 39 years. This unprecedented success, according to him, is the subject of
envy from other individuals and organizations. He urged the IMN to consciously engage in mass information to enlighten Nigerians on who we are, what we stand for and what we can do. He commended IMN on being firm, principled and resolute despite being provoked and even pushed to the wall.

Another presenter, Alh Mukhtar Zubair Sirajo, a veteran journalist and seasoned Kaduna public servant, discussed on the narratives and
realities of media coverage of the Zaria massacre. He noted that there was no need for El- rufa'i to put up the Judicial Commission of
enquiry into the Zaria massacre because he had already passed judgment. Alh Sirajo also brought out the fact that the coverage of
the Zaria massacre by the journalists was not in accordance with the professional ethics. He cited a lot of examples to buttress this
point. He faulted the current trend of Media ownership in Nigeria and called for redress.

Mr Deji Adeyanju in his comments after all the presentations lamented that the federal Government under this regime does not respect
peaceful people. It respects criminals and negotiate with Book Haram or so called herdsmen, who are killers of innocent citizens. He said IMN is innocent principled and peaceful but are pushed to the wall by
security operatives, yet they remain resolute.

Mr Jude Ndukwe reviewed the book “Compendium of a Social Struggle” published by the IMN with a lunch in which Shaikh AbdulHameed Bello lunch the book on behalf of the illegally detained leader of the IMN
his Eminence Shaikh Ibraheem Zakzaky (H), Ahlul Duthur of the IMN, Alh Gamawa, Hurras of the IMN and others.

Earlier Dr Shuaibu Musa on behalf of the organizing committee made an introductory speech expressing the concern of the IMN on the faith of Al Quds and Palestine.
In the 1st International Quds conference Illegally detained leader of the IMN Shaikh Ibraheem Zakzaky (H) was the chief host of the
conference with Brother Imam Muhammad Al-Asi, Hajiya Bilkisu Yusuf, Chief Ebenezer Onyetekin, Prof Dahiru Yahya among dignitaries that made Lectures, presentations and speeches at the conference.

He also prayed to the bereave families of Alh Mi’kail Abdullahi and Mal Haruna Yusuf Shelleng who died a year ago in an ghastly motor accident on their way back home after the 2nd International Quds conference, with himself, Brother Haruna El-Binawi, and Mal Ibrahim Muhammad Potiskum surviving with injuries.

A closing prayer by Shaikh Ya’aquob Yahya Katsina marked the end of the conference.
