*New Plot to Assassinate Sheikh Zakzaky and Attack IMN Members Uncovered*

The Islamic Movement in Nigeria will like to draw the attention of the general public to a mischievous plot hatched by the enemies of peace in Nigeria. This latest plot, as disclosed to us by a reliable source, is a fresh attempt to kill our leader, Sheikh Ibraheem Zakzaky, who is currently in illegal detention in clear contempt of court judgment, and a simultaneous attack on members of IMN in several cities of Northern Nigeria.

According to the evil scheme, the operation against IMN will start immediately after a crucial and highly important "national announcement" is made in the next coming days or possibly weeks. Those who hatched the plan hope to cash on the political uncertainty they hope the national announcement will generate to finish off their genocidal plans they started years back that culminated in the December 2015 attacks. By carrying out their evil plan of killing our leader and spilling the blood of innocent civilians, they hope to exterminate the Movement once and for all.

We are also aware that troops have been strategically and massively stationed in the major cities this operation will be carried out; waiting for the day the "special announcement" will be made, so that they carry out the killing of innocent lives.

We will like to call on the international community to prevail upon the Federal Government to call its security agents to order, who it seems are still not satisfied with the over a thousand souls they massacred in Zaria in December, 2015. 

Assassination of our leader Sheikh Zakzaky and the murder of members of IMN, will in no way benefit Nigeria and Nigerians.  We therefore urge them to urgently terminate this genocidal scheme.

We will remain committed to the peaceful ways of getting justice done to the victims of Zaria massacre carried out by the Army in Zaria. We will therefore reiterate our demand for the immediate release of our Leader Sheikh Ibraheem Zakzaky as directed by a federal high court Abuja.

The Ummah has failed Nigeria's Sheikh Zakzaky: 18 months into his illegal imprisonment and still no justice in sight.

What do you call a man who has brought millions of Nigerians to Islam in the last 40 years; who wages a peaceful unarmed struggle against an oppressive regime; who opposes Zionism on a regional and global level and has instilled an understanding of it deep in the consciousness of his partisans; who opposes American ZOG; who opposes the British ZOG; who has exposed Boko Haram and other Takfiri terrorist groups as false flag black ops controlled by Western-Zionist powers; who has shredded Saudi Arabia and the other petrodollar monarchies; who has seen 6 of his sons become martyrs in the fight against Dajjal; who stands with Resistance anywhere and everywhere but whose plight is still ignored by the overwhelming majority of the so-called "Ummah"? You would call such a man SHEIKH IBRAHIM YAQOUB AL-ZAKZAKY. It has now been 18 months since Nigeria's revolutionary of revolutionaries--and the most important Mouqawamist figure in all of Africa bar none--was unjustly thrown into the Buhari regime's dungeons after 1,000+ followers of his were mercilessly murdered by the Nigerian army in the Zaria Massacre. The African Ashoura. 18 months of cruelty. 578 days of atrocities. 13,782 hours of injustice. Baseless charges. Worsening health. Routine torture. His wife Sayyeda Zeenat locked in the hellishness as well. His students and deputies languishing in horror near him. His Islamic Movement of Nigeria (IMN) continuously brutalized in his absence. WHERE IS THE OUTRAGE? WHERE ARE THE SCREAMS? WHERE IS THE HUMANITY. Nowhere... All of it... Is simply... Nowhere.

Ayatollah Sayyed Ali Khamenei saluted Zakzaky in his most recent speech, calling him "the most oppressed person" and demanding--not merely asking or even telling but DEMANDING--that Muslims stand up for the Sheikh, his martyred children and his movement for it is their duty to defend an individual of such stature and importance to Islam. Behind the scenes, everyday, the Islamic Republic of Iran is working overtime through diplomatic channels to secure the Sheikh's release and considering the Nigerian regime is a puppet of the US-'Israeli'-Saudi trifecta of terrible, no doubt this process requires the utmost patience and delicateness. At the International Al-Quds Day rallies this year, Zakzaky was featured in Pakistan (most prominently), occupied Kashmir and numerous places in America. But there needs to be more. Much more. There need to be actions which are global. Sustained. Militant. Massive. And uncompromising. Zakzaky has turned his voice into thunder for us for 2/3 of his life and given that which is most precious to him--i.e. his children--along with blood from his own flesh and never asked for anything other than ALLAH's (SWT) approval. The least we can do is turn our voices into thunder for him in his time of dire need.

Until then, we can say with unfortunate confidence and ever-growing heartbrokenness that "The Ummah" has failed the Sheikh. But at 18 months in, let's also say that this failure and gargantuan stain on our history have gone on long enough. As the example of General Hurr (R.A.) teaches us, what one DIDN'T do then is of no consequence when compared with what one DOES now. Khamenei demands that we fight for Zakzaky. Muslims need to absorb the Supreme Leader of the Islamic Revolution's call and run a mile with it. Let us take heed indeed and demand that there be justice for the Martyrs of Zaria; demand that the Sheikh, his Queen and all IMN political prisoners be freed IMMEDIATELY; demand the gallows for Buhari, Goodluck Jonathan, Governor Nasir Ahmad el-Rufai and every other Zionist proxy involved in the assault on the Zakzaky family; and demand that Nigerian Shi'a Muslims as well as all oppressed Nigerians be granted their rights in the face of a tyrannical, corrupt and collaborationist regime in Abuja. Zakzaky is the champion of the Moustazafeen. It's overdue... One thing you can hardly take away from the Shiites is their highest sense of Diplomacy and Brotherhood in all ramifications.

Sometime in December, 2016, I observed them fellowship with Christians in Kaduna State to felicitate with them for the Christmas and New year Celebration, right inside the Churches.

Nigeria: Buhari Murdered 3 Children of Sheikh Zakzaky & Dumped Their Dead Bodies in Mass Graves

On 12-14th December, 2015 President Buhari sent thousands of heavily-armed Soldiers to Zaria and they brutally murdered 1000+ Shia children, women, the aged and men. After that President Buhari ordered the Kaduna state Governor Elrufai and the genocidal Soldiers to dump the dead bodies of their victims in mass graves at night to bury the evidences. Among those killed were 3 young children of Sheikh Ibraheem Zakzaky, his young Nephew and his 70+ year old sister was burnt alive.

President Buhari after killing 3 children of Sheikh Zakzaky is still holding him and his wife in illegal detention incommunicado for more than 17 months. One eye of Sheikh Zakzaky was totally destroyed by the bullets of the Nigerian Army and the second eye need urgent medical attention but Buhari has refused to release Sheikh Zakzaky and his wife despite an order by a competent court.

To enforced his fundamental rights as enshrined in the Nigerian constitution and African charter of rights, Sheikh Zakzaky filed two cases against the oppressive and tyrannical Nigerian regime. In December last year a Federal High Court in Abuja under the judgeship of Justice Gabriel Kolawole granted all the wishes of Sheikh Zakzaky and declared his detention illegal. That historic judgement against gross injustice and impunity was celebrated by all Human Rights organizations around the world and all people of conscience. The evil, wicked and bloodthirsty Nigerian oppressors were unhappy about the judgment and Appealed against it but blatantly and unjustly refused to abide by the Court judgment.

The second case filled by Sheikh Zakzaky was against the Nigerian Army chief Buratai, Kaduna state government and the Nigerian Army for the inhuman murder of his 3 children and hundreds of his followers and the total destruction of his house. Unfortunately, the judge Salisu Shuaibu is a Wahhabi savage and gang member of the evil Northern oligarchy. He dismissed the case despite all the evidences presented to him. The Sun Newspaper reported about his judgement and the following is excerpt of the report:

"A Federal High Court sitting in Kaduna has ruled that the suit filed by the leader of the Islamic Movement of Nigeria, Ibrahim El-Zakzaky against the Nigerian Army, the Chief of Army Staff and two others for alleged violation of his fundamental rights is an abuse of court process.

But El-Zakzaky’s counsel, Mr. Festus Okoye, disagrees with the court, stating that the relief sought at the Federal High Court in Kaduna is different from the one that was filled at the Abuja High Court presided over by Justice Gabriel Kolawole.

He says the legal team will study the judgment and take a decision on whether to appeal or not."

It is important to understand the difference of character and disposition of Justice Gabriel Kolawole and Salisu Shuaibu. Gabriel Kolawole is a Christian from Southern Nigerian and from the Yoruba tribe which is the most tolerant tribe in Nigeria in issues of religion and sect. While Salisu Shuaibu is a Wahhabi from Northern Nigeria and member of the evil Northern oligarchy.

Despite Salisu Shuaibu abortion of justice and fairness, the fact remain that President Buhari, Elrufai, Buratai and gang of mass murderers brutally slaughtered 1000+ innocent Nigerian civilians in Zaria and wickedly dumped the dead bodies of their victims in mass graves at night to bury the evidences. BLOODSHEDDING:Is the Devil from the North?

Before colonization the Northern part of Nigeria was the most civilized region. The colonial masters did not teach the Northerners how to wear cloths, like they taught the Southerners. The North have a system of governance, clothes, chain of interaction and trading with Asian countries.... hundreds of years before the arrival of the colonial gods.

But all that is history now, the NORTH has gradually become a home for the most foolish and most ignorant people in Nigeria today. A place where the blood of a cow is more valuable than that of a human being.

We have many brainwashed ignorant and gullible who can be easily manipulated to carry weapons and kill their fellow people at a slightest provocation or by a simple incitement. We are living in a region where a long bearded Sheikh (Clergy) can easily incite the youths to unleash mayhem anytime he wishes.

A case study:These agents of Lucifer calling themselves Sheikhs are taking advantage of the ignorant Northerners using a false pretext that Shi'a are insulting the companions of the Holy Prophet(s). That the companions of the Holy Prophet(s) are like the Holy Prophet himself(s), so insulting them is same as insulting the Holy Prophet(s). (Which is a blatant lie) This is the main reason behind the extreme hatred towards the Shiites in the North.

If a Northerner because of mere ideological differences can be exterminated, then what more of a Southerner or a Christian? Ignorance begets the extreme hatred, and so humanity and common sense have become rare in the North. That is what become of my region now. Bloodthirsty creatures have taken over the land. Bloodshedding is becoming a normal way of life in my region today. Abundant human resources is wasting. What a pity.

These set of criminals lack every sense of humanity, they are mostly neither adding value to their family, nor the society, nor even being useful to themselves in any way. They are mostly looking for a slightest opportunity to vent out their life's frustration on anyone they can reach out to. Religious leaders that are supposed to guide them right, are the same persons using them negatively to fight their own selfish sectarian war as mentioned above.

Through the false campaign they incites extreme hatred towards Shi'a adherent in the heart of these ignorant youths who would not bother to verify what they were told. They only wait for a slightest opportunity to kill and loot Shiites properties thinking that they are fighting a Holy war.

Those Long bearded Sheikhs are threatened by the rapid growth of Shi'a in the North, because Shi'a ideology is snatching away their followers on a daily basis. No right thinking person will support bloodshed. Northern Muslims are embracing Shia ideology in mass because of its peaceful composition. Shi'a ideology does not support, encourage or approve violence in every way.

On the contrary, Shi'a ideology consider every human blood as sacred and must not be spilled outside the law. Shi'a believes in the brotherhood in humanity. Religion is for our Creator to Judge, and not Man. However, Shi'a encourages activism in a great way, opposing oppression in every legitimate manner, which is somehow alien to Northern norms of worshipping politicians. They accused Shi'a of carrying out peaceful protests frequently which many Northerners failed to understand that it is within the constitutional and human rights of every citizen.

The Northern politicians, just like those devil agents of disunity also considers Shi'a as a threat to their safe haven manner of looting and fooling the gullible. They are afraid that when the masses realizes the power of protest, that will be the end of corruption in Nigeria. So, they equally hide behind a false pretext of road blockade and killed over a thousand Shiites in Zaria unjustly and dumped their bodies in mass grave. Those Northerners who considers Shiites as infidels jubilate openly, they were happy that Buhari had done what they were looking for opportunity to do. (bloodshedding). That is why you see many northerners supporting this government despite the glaring failure, suffering and hunger that this regime has brought to Nigerians. The Devil is surely in full control of the Northern Nigeria.

For almost forty years of practice Sheikh Zakzaky and his followers have never take the life of any Nigerian. But some Northerners are hell-bent wickedly persecuting Shiites and satanically attributing violence to Sheikh Zakzaky and his followers without a single proof to support the allegations. This is as a result of the venomous hatred instilled in their minds about Shi'a followers. God is watching!

It is after realizing the lies and baseless allegations against Shiites that many of us embrace the peaceful path of righteousness. I pray to Allah to help me become a better Shi'a adherent who will continue spreading the word of truth, carrying the message of peace to all that care to listen. I don't want to die with a blood stains of any Man hanging on my neck.

What I'm sure about is that nobody can intimidate us into arms struggle no matter the persecution. We talk, we spread knowledge and not violence.

Public Interest Memo Seeking For Criminal Actions Against Gen Buratai And Other Perpetrators Of Heinous Crimes/Gross Rights Abuses In Nigeria And Allied Matters (2)

(Intersociety, Nigeria, 1st July 2017)-It is recalled that the leadership of our Organization (Int’l Society for Civil Liberties & the Rule of Law: www.intersociety-ng.org) had two days ago (29-6-2017) written and successfully submitted  a 17-page detailed memo to Prof Yemi Osibanjo, SAN, in his official capacity as the Acting President of Nigeria & Commander-in-Chief of the Armed Forces.

The memo seeks to draw his Government’s attention formally or officially to raging gross abuses of human rights in Nigeria and associated heinous crimes especially since 29th May 2015 when the sixth central civilian Government which he now heads in acting capacity came on board. For easy public reading, comprehension and analysis, the memo was segmented with its first part published same date. Thankfully, the special memo which was copied electronically to over 30 national and international institutions, bodies and respected personalities for their immediate attention and necessary diplomatic and int’l oversight actions have already generated prompt responses and acknowledgments particularly from international bodies and members of the diplomatic community copied. Among those that have responded or acknowledged are Office of the Prosecutor for Int’l Criminal Court in Hague, the Netherlands; the US Consulate in Abuja and the Right Hon Boris Johnson, MP and UK Secretary of State for Foreign & Commonwealth Affairs.

Below is a reply received from the ICC, dated 30th June 2017 at 11.17am:

The Court may only address the crimes of genocide, crimes against humanity, and war crimes as defined by Articles 6 to 8 of the Rome Statute that have occurred after 2002, and can only exercise jurisdiction in the countries that have ratified it. For more information on the Court’s jurisdiction and the full text of the Rome Statute, please refer to page 2 of the attached document and our website as well as our address, www.icc-cpi.int. We encourage you to carefully review this information.

If, after your careful review, you still believe the ICC is the correct place for your case and would like to submit a claim to the Court, then please follow the directions for how to do so on page 1 of the attached document. Nigeria’s regional and international obligations to its citizens in non-war situation or peacetime:

Nigeria as a State Party to UN and AU is strictly bound by numerous regional and international human rights treaties or conventions including the African Charter on Human & Peoples’ Rights (ACHPR) of 1981, ratified and domesticated in 1983; the UN Covenants on Civil & Political Rights (ICCPR); and Economic, Social & Cultural Rights of 1976 (ICESCR), ratified in 1993. Nigeria is also a State Party to UN’s anti Genocide and Torture Conventions of 1948 and 1985 respectively as well as the UN’s Women and Child’s Rights Conventions of 1984 and 1990 respectively, to name but a few.

Sir, Nigeria as a leading member of the UN and international community is also bound by the Basic Standards of International Law & Humanitarian Principles. Under this are the ten basic rulesor standards for  policing public and peaceful assemblies in any member-State; which expressly recognize the rights of the citizens of all Member-States of the UN including Nigeria, to peaceful assemblies and expressions other than armed conflict and strictly outline ways through which these assemblies shall be managed or policed by policing agencies excluding the army.

Under the ten basic standards of international law made mandatory for policing agencies of Member-States of the UN for management of civil assemblies and free speeches as well as arrest, detention and prosecution of citizens accused of commission of municipal crimes of relevant municipal code definitions; the following rules must be observed and strictly applied:

(1)everyone is entitled to equal protection of the law without discrimination on any grounds, especially against violence or threat..; (2) treat all victims of crime with compassion and respect, and in particular protect their safety and privacy; (3) do not use force except when strictly necessary and to the minimum extent required under the circumstances; (4) avoid using force when policing unlawful but nonviolent assemblies; (4) when dispersing violent assemblies, use force only to the minimum extent necessary (i.e. in line with proportionate use of force and avoidance of application of excessive force on unarmed but violent or aggressive assemblies).

Others are (5) lethal force should not be used when arresting nationals suspected of committing municipal or local crimes except when strictly unavoidable in order to protect your life or lives of others; peaceful or provoked violent assemblies do not amount to commission of municipal crimes other than insurrection, mutiny or armed struggle; (6) arrest no person unless there are legal wounds to do so and ensure that the arrest is carried out in accordance with lawful arrest procedures; (7) ensure that all detainees have access, promptly after arrest to their families and legal representatives and to any necessary medical assistance; ( all detainees must be treated humanely and avoid infliction, instigation or toleration of any act of torture in any circumstance and refuse to obey order to do so; (9) do not carry out, order or cover up extrajudicial executions or disappearances of the arrested or the detained and refuse to obey any order to do so; (10) report all breaches of these basic standards to your senior officers and to the office of the public prosecutor and do everything within your powers to ensure steps are taken to investigate these breaches.

In policing or managing such civil assemblies and free speeches, particularly if they become uncontrollable  and capable of breaching public peace and safety,  policing agencies and their officers must apply the following modern crowd control methods or kits and equipment:  tear gas, rubber bullets, pepper spray, electric tasers, batons, whips, water cannons, long range acoustic devices, aerial surveillance, police dogs, etc; and they must be bodily aided or protected by body protective devices such as anti crowd helmets, face visors, body armor (i.e. vests, neck protectors, knee pads, etc), gas masks and anti crowd shields. Sir, it is crystal clear from the above that these fundamental rules were observed in grave breach in the instant case.

Regional and international obligations of Nigeria to its citizens under armed conflict or war situation:

Under circumstances of war or situations of widespread or clustered internal conflict, Sir, the military and humanitarian handling or management of same are strictly regulated regionally and internationally. On humanitarian and use of force aspects, Nigeria is a party to UN Statute on Refuge of 1951 and allied treatments of IDPs. Nigeria is also a State Party to the Statute of the International Criminal Court of 1998. Nigerian armed forces and police are also strictly bound by the UN’s Code of Conduct for Law Enforcement Officials of 1979 and the UN Basic Principles on the Use of Force and Firearms by Law Enforcement Officials of 1990.

In the area of intra and inter-State armed conflicts, Nigeria is bound by the Geneva Conventions or Laws of War of 1949 and their Four Protocols including the doctrine of rules of engagement and its principles of use of force, self defence, and others already highlighted above. Nigeria is also a State Party to anti Genocide and anti Torture Conventions of 1948 and 1985 respectively.

Sir, as you may professorially be aware or unaware, the Rules of Engagement traditionally and universally associated with internal and inter -State violent or armed conflicts or wars are the integral part of the Geneva Conventions of 1949 or Laws of War and their Four Protocols of 1977. They originally came from the three war related doctrines of Jus Ad Bellum (justification and ground for going to war); Jus In Bellum (ethical rules of conduct during war, such as ethical standards expected of soldiers or combatants in wartime or rules of engagement); and Jus Post Bellum (regulations on how wars are ended and facilitation of transition from war to peace).

Another name for the Rules of Engagement is the Standard Rules for the People of the War. The People of the War here literally means parties in the conflict who occupy the conflict areas such as fighting parties, non-combatants or civilians or IDPs and Refugees as well as other third parties  directly or indirectly participating or affected by  the conflict.

Further, Sir, key features of the internationally standardized Rules of Engagement strictly applicable in war or conflict situations are (1) legitimate use of force, (2) proportionality of use of force, (3) legitimate self defense, (4) treatment of prisoners of war or conflict, (5) avoidance of attacks on non-military necessity or civilian targets or properties, (6) avoidance of attacks on civilians or non-combatants, (7) treatment of the wounded, ( avoidance of attacks on culture symbols or places of worship, (9) avoidance of attacks on humanitarian agencies and personnel/human rights activists; (10) treatment of other peoples of the war (i.e. spies and journalists).

Nigeria’s obligations to UN and its citizens under UN System:

Sir, the UN’s new concept of sovereignty as a responsibility or citizens’ sovereignty and maintenance of international peace and security as the core foundation of the Purposes of the 193-member Organization; is inviolably binding on Nigeria as a key Member-State. Nigeria is also bound by the Customary International Law under UN System particularly those that are inviolable by virtue of their doctrine of “substantial uniformity by substantial number of States” or “Opinio Juris”.

Example of UN and Int’l Law’s hallowed doctrine of Opinio Juris or substantial uniformity by substantial number of States is a general belief binding on all Member-States of UN that a non-treaty is legally binding on States. Also, Nigeria as a leading and one of the most populous UN Member-States is inexcusably bound by the principle of “Jus Cogens” (i.e. absolute rules of general international law binding on UN Member-States for which no derogation is permitted). These include use of crude, deadly or asymmetric force against vulnerable and unarmed populations; perpetration of genocide, war crimes, and crimes against humanity; massacre of unarmed and defenseless citizens in non war situations, slavery, torture, etc.

Reasons for Writing:

It shocks and saddens us; Sir that till date no single person in connection with these atrocious crimes above mentioned has been punished or arrested and prosecuted by the present Federal Government of Nigeria which you now head in acting capacity. The living victims or survivors and families and relatives of the slain have also been totally abandoned with several of them passing through post traumatic stresses and disorders. It is totally saddening that the present central Government now under your acting leadership has turned blind eyes; in addition to conspiracy of silence maintained by Nigeria’s leading human rights groups and activists particularly those concentrated in Lagos and environs.

There have been several researched and thoroughly investigated reports by leading international and local human rights groups especially by Amnesty Int’l, Human Rights Watch and Int’l Society for Civil Liberties & the Rule of Law and in spite of their several calls on the present central Government to fish out and bring the culprits to book and punish them accordingly and adequately compensate the living victims or survivors and dead victims through their families or relatives, nothing of such has happened till date. As a matter of fact, Sir, the perpetrators are still on the prowl with impunity.

For the avoidance of doubt Sir, there are special reports by Amnesty International and Human Rights Watch on Shiite Muslims’ massacre in Zaria as well as in-house investigations carried out by the authorities of the Shiite Muslims.

Till date, the leader of Shiite Muslims in Nigeria, Sheik Ibrahim Zaky El-Zaky and his wife-Malama Zeenatu are still being detained incommunicado or without trial or bail since 14th December 2015; a period of 18 months. While the Shiite leader got shot and battered with eighteen live bullets removed from his body, his wife had four live bullets removed from her body as well (source: IMN leadership 2016).

Human rights are not esoteric concepts removed from the reality of human existence. Rather, they are the anchors on which our common humanity can be assessed.
The framers of the Nigerian constitution imbibed the lessons of history on the importance and threshold of human rights in human existence and decided that the human rights of the Nigerian people must be entrenched in a written document and made “fundamental”.
The framers of the Constitution decided against leaving the question of human rights protection in scattered legislative instruments and the pronouncements of Superior Courts of Record. This is on account of their projection, belief and assumption that Nigeria is a dangerous mix of ethnic nationalities and religious persuasions and that it will be dangerous to leave the respect for human rights, its protection and enforcement in the hands of the new political leaders with shifty political, ethnic and religious alliances. It was on the basis of this and other reasons that prompted the entrenchment of human rights in the Nigerian constitution. The framers of the Nigerian constitution also created a separate chapter for what they christened “fundamental rights” and bundled them together in Chapter IV of the Constitution of the Federal Republic of Nigeria, 1999 (as amended).
The founding framers of the constitution went further to set out in clear terms the rights they regard as fundamental and the parameters of those rights and those that are entitled to enjoy them. Since society is dynamic and made up of people with diverse interests and orientations, the framers of the constitution also created and delineated conditions for the derogation and restriction from fundamental rights. In other words, the framers of the Constitution on their own determined under what condition or circumstances the rights of the individual can be derogated from and inserted the circumstances under which derogation can take place. Some of the derogatory exceptions include issues around defense, public safety, public order, public morality, or public health. They also made it possible for fundamental rights to be derogated from for the purpose of protecting the rights and freedom of other persons. However, any law that imposes restriction and derogates from the rights entrenched in chapter IV of the Constitution must be justifiable in a democratic society.
The framers of the constitution went further to make the process of alteration of chapter IV of the constitution difficult and to a certain extent cumbersome. They reasoned that a political party may come to power with a dubious ethnic, religious or ideological philosophy and with a contrived majority in the National and State Assemblies set out to change the fundamental rights landscape of Nigeria. Based on this, section 9 of the same constitution makes the process of altering chapter IV of the constitution very cumbersome. While other provisions of the constitution can be altered with two-thirds majority of members of the National Assembly and the concurrence of two-thirds of the members of the State Assemblies, altering Chapter IV of the constitution requires the votes of four-fifths of the members of the National Assembly (both dead and alive) and the concurrence of two-thirds of all the state assemblies.
The framers of the constitution also insisted that an individual must not wait for his or her rights to be infringed upon or violated before going to court to seek redress. They created three categories of violations. There is the anticipatory violation, the continued violation and the violation of rights. The implication is that anybody that anticipates that the state or any of its organs or agencies is planning to violates his or her rights or is creating the circumstances and scenario for the violation of his or her rights is free to approach the courts and seek redress. The same applies to any person that believes that his rights have been violated. In this regard, there is the possibility that the right has already been violated and the persons goes to court to seek for declaratory reliefs giving judicial stamp to the fact that what has taken place is a violation of rights. There is also the violated right that is still ongoing. This entails seeking the orders of the court to declare the ongoing violation as unconstitutional and seeking the protection of the courts against further violation.
Now, the Nigerian people and all those that fought for the entrenchment of fundamental rights in our constitution and those that inserted the rights in the constitution did not give the legislature and the executive branches of government interpretative and adjudicatory powers. Rather, the Nigerian people still insisted on separation of powers and gave the legislature the power of law-making and appropriation and the executive, the power of executing laws for the peace, order and good government of Nigeria.
While section 6 of the Nigerian Constitution domiciles and vests the judicial powers of the Federation in the courts, section 46 of the same Constitution goes further to provide that a High Court (and the Federal High Court) shall have original jurisdiction to hear and determine any application made to it pursuant to the provisions of Chapter IV of the Constitution and may make such orders, issue such writs and give such directions as it may consider appropriate for the purpose of enforcing or securing the enforcement within that State of any right which the person who makes the application may be entitled under Chapter IV of the Constitution.
Therefore, only the courts are empowered to determine whether the acts of the Executive or any of its organs or agencies are constitutional and have been exercised in accordance with the law and the constitution. Only the courts can make a determination that the detention or continued detention of a person has been done within the narrow derogatory parameters of defense, public safety, public order, public morality, or public health or for the purpose of protecting the rights and freedom of other persons.
It is not within the province of the executive or any of its organs or agencies or departments to insist that their interpretation of national defense imperatives is right and must override the clear pronouncement, orders and judgements of superior courts of record. Anarchy and lawlessness and descent to despotism will become the fate of the society the moment the executive branch of government takes over the mandate and power of exercising judicial powers and interpreting the provisions of the constitution and the law.
Even during the worst period of military dictatorship in Nigeria, the courts continued to exist. The military suspended some of the fundamental rights provisions and sought to make the courts muted trumpets, but the Nigerian people fought them and the courts continued to protect the fundamental rights of the citizens.
Under a civilian democratic dispensation, it is assumed that we can take it for granted that fundamental rights can be maintained and respected. Derogating from fundamental rights and allowing such derogation to become the norm is an invitation to creeping dictatorship and this must not be allowed in our country. Serial disobedience to the orders and judgements of courts of law has national security implications and scares away investors. It is a mark of strength and the growth of and sustenance of democracy for the executive branch of government to obey court orders. It is a sign of democratic weakness and deficit for the executive to cut corners with the rule of law and due process.
As pointed out by the Supreme Court of Nigeria in the case of Gov.; of Lagos State v. Ojukwu (1986)1 NWLR (Part 18)621. “The court system cannot be maintained without the willingness of parties to abide by the findings and orders of a competent court until reversed on appeal. This presupposes that no party and no court of subordinate or even coordinate jurisdiction can say:- “I do not like the order made and I will not obey it”.
“The Nigerian Constitution is founded on the rule of law; the primary meaning of which is that everything must be done according to law. It means also that government should be conducted within the framework of recognised rules and principles which restrict discretionary power which Coke colourfully spoke of as ‘golden and straight metwand of law as opposed to the uncertain and crooked cord of discretion’ (See 4 Inst.41).
