It is my considered view that the woman's story has veracity in it...what was the husband going to do in the hotel in d first place?if the husband 's allegations that it was a set up,then why didn't he tell his wife that her friend is giving him 'body moves',instead he went to the hotel supposedly with enough condoms,thats infidelity. The court should order for separation but with an order too that the man should be providing for the children's upkeep. the custody of the kids should be kept with their mother.

This is why I don't even regard all these inferior courts as 'court',most especially customary courts,area courts. That is why even our constitution did not recognise them as courts..it's only the Interpretation Act that even to some extent included them as court,infact The Evidence Act expressly excluded them. Most of them carry out their judicial functions with laxity and without regard to what public policy demands,imagine! impregnating a woman. You can still find good ones among the 'magistrates ' though.

yes,everything rests on the discretion of the tribunal now. The matter will still linger on to the court of Appeal the way I see it. All these problems are manifest because the Electoral Act was not designed or drafted well enough in such a way as to fit into such circumstances when a guber candidate dies during election....well,let's see how the court will decide the matter.

INEC is the only body entrusted with the duty and power to conduct elections in Nigeria and anything it does that is within the confines of the legislation that established it in legal. There has not been any precedence or decided cases prior to Audu's scenario,so the court will have to decide this one on its merit.
