The Office of the Accountant-General of the Federation says it will adhere to court orders regarding the disbursement of federal allocations to Rivers State, following recent legal controversies surrounding the state’s financial entitlements. Speaking to The PUNCH on Friday, the Director of Press and Public Relations at the OAGF, Bawa Mokwa, said, “We are going to obey court order. “Since there is a notice of appeal, the notice of appeal has overridden the earlier court judgment. So far, it is a court order that we will obey; if there is a notice of appeal, Rivers will be paid.” The assurance comes amid a Federal High Court ruling on October 30, 2024, which directed the Central Bank of Nigeria to withhold further monthly allocations to Rivers State. The court ruled that Governor Siminalayi Fubara’s presentation of the 2024 budget to a four-member House of Assembly was unconstitutional. Justice Joyce Abdulmalik, who delivered the judgment, stated that since January 2024, allocations received and spent by the state were based on an illegitimate budget, describing it as a “constitutional aberration.” The ruling raised questions over the legitimacy of the State House of Assembly’s composition and its authority to approve budgets. The judge contended that the governor’s actions ignored constitutional requirements for budget approval by a fully constituted House of Assembly. Delivering judgment in suit FHC/ABJ/CS/984/2024, Justice Abdulmalik declared that decisions made by the four-member Fubara-backed Assembly were void, referencing prior rulings by the Federal High Court and the Court of Appeal that had annulled its authority. The ruling also held that Fubara’s actions violated Sections 91 and 96 of the 1999 Constitution, and warned that any continued bypassing of legislative processes constituted an affront to the rule of law. The court’s decision followed a suit filed by the State House of Assembly faction led by Martin Amaewhule, challenging the legitimacy of the four-member faction loyal to Fubara. The Amaewhule-led Assembly had earlier declared in July that all state expenditures would be halted until the governor resubmitted his budget to the legitimate legislative body. Justice Abdulmalik denied a request to stay the proceedings, dismissing the application as “frivolous and vexatious.” She also refused to recuse herself from the case, rejecting the defence’s allegations of bias. The Rivers State chapter of the All Progressives Congress, APC, has condemned in very strong terms the destruction of public assets at the State Assembly complex. DAILY POST reported that there was an arson attack on the chambers of the state assembly on Sunday night. The APC, the opposition party in the state, described the development as a desecration of the legislature. A statement signed by Darlington Nwauju, spokesperson of the Rivers APC, warned political actors not to jeopardize the fragile security of the state because of their political greed. “We had warned Rivers people of the 3rd term ambition of the immediate past Governor, Nyesom Wike and the unpatriotic agenda to continue to emasculate the state and keep our people perpetually in poverty with the “consolidation of a convoluted economy powered by merchantile distribution of state resources”, the statement said. The Senate Majority Whip in the ninth Senate, Orji Kalu, has said that the President of the Senate, Godswill Akpabio, won the contest in a free, fair and credible manner. The former Governor of Abia State was reacting to media reports that some unnamed 22 Senators of the All Progressives Congress were planning to leave the party for another opposition party because of the outcome of the Senate election. Kalu, who spoke on a recorded video through his verified Facebook account, said, Let me be honest with you, the election in the Senate was very transparent. Senator Akpabio won the election. It was free, it was fair. ” I congratulate the Clerk of the National Assembly, I congratulate the Clerk and all the Staff of the Senate. You know I cannot lie against my conscience. Jude Chukwuemeka Idimogu, representing Oshodi/Isolo Constituency 2 in the Lagos State House of Assembly has assured south easterners of the presidency after Bola Tinubu’s two-term tenure as president. Idimogu, who was recently elevated as the Apex Leader of the Ndigbos in Lagos State, made this known in an interview with journalists recently held in Lagos. He told his fellow Easterners that power is not served to allocate; hence, they must all struggle to achieve it. By the time Tinubu is through with his two-term tenure, he would look at how he could support the South East. The People of the South-East should know that positions are not just given, they must struggle for it, and that they were not struggling enough. Also, South-East should know that they must work in tandem with other tribes, they must collaborate and that is the only way they can get it. Either they work with the South West or the North. The Ibos should fall in line with Asiwaju Bola Ahmed Tinubu and the APC in Lagos State and it shall be better for all of us.
