Governor Abdulaziz Yari of Zamfara state yesterday responded to the comments made by Emir Sanusi, insisting that the comments were half-truth. He maintained that the outbreak of the disease indeed has a spiritual connection. “I stand by my words that if people do not change, God will not change for them. Therefore, I will answer the Emir perfectly and give him the Quran content of the Hadith where I belong to and where I have my fact. Emir Sanusi and Gov. Yari “For instance, I made mention that in the past we have Type A, which vaccines have been brought and they have vaccinated over four million doses in 2011. “We are now having Type B and Type C which they don’t even know. At the Centre for Disease Control in Chicago where we get our vaccines from, they only have five million,” he said. Recall that the Emir of Kano had on Wednesday, at the opening of the Kaduna State Economic and Investment Summit, criticised the statement credited to the Zamfara State Governor on meningitis, saying they were horrendous and “Islamically incorrect”.

The Supreme Court has removed Sopuluchukwu Ezeonwuka of the Peoples Democratic Party from representing Orumba North/South, Anambra Federal Constituency in the House of Representatives.

Justice Kudirat Kekere-Ekun gave the ruling in an appeal filed against Ezeonwuka’s election by a member of the party, Chief Ben-Nwankwo, in Abuja on Friday.

Nwankwo’s name was wrongly substituted with the first respondent (Ezeonwuka) after he had obtained the nomination of the party to contest the National Assembly election.



Dissatisfied with the Feb. 20, 2015 judgment of the Federal High Court in Abuja and the decision of the Court Appeal to uphold it, Nwankwo approached the apex court.

“Conclusion: having resolved the key issues in favour of the appellant, the appeal succeeds and it is hereby allowed.

“The judgment of the Court of Appeal delivered on June 26, 2016, is hereby set aside for being a nullity having exceeded its jurisdiction by granting relief not sought by the parties before it.

“This follows that the judgment of the Federal High Court, Abuja, delivered on Feb.20, 2015 was delivered without jurisdiction and it’s a nullity. It is equally set aside.

“The Originating Summons filed on Dec.15, 2014 in FHC/Abj/CS/1013/2014 is hereby struck out’’, she said.

Justice Kekere-Ekun further held that: “the consequence of the above order is that the parties shall revert to the status quo ante.

“The existing position before the first respondent (Ezeonwuka) filed a suit at the trial court was that not only was the appellant’s name submitted to INEC for the March 28, 2015, election, he won the election.

“It was at the point of being issued the Certificate of Return that he was confronted by a letter conveying the order of the trial court stopping that action.

“In the circumstances, it is hereby ordered that the appellant, Chief Ben Nwankwo, being the candidate duly sponsored by the PDP in that election is entitled to be issued with the certificate of return.

“The second respondent is hereby ordered to issue Chief Nwankwo a certificate of return in respect of the National Assembly election held March 28, 2015, forthwith,” she said.

The judge also further said: “the first respondent (Ezeonwuka) is hereby ordered to vacate the seat of the Orumba North/South Federal Constituency of Anambra State in the National Assembly forthwith’’.

“It is further ordered that Ezeonwuka shall refund to the National Assembly all monies collected by him by way of salaries and allowances since he took the seat within 90 days.

“And finally, a fine of N500, 000 is awarded in favour of the appellant against the first respondent,” the judge held.

The appellant had asked the court to decide whether the lower court had jurisdiction to deliver judgment dated June 26, 2015, without considering and determining pending motion on notice dated June 18, 2015.

The appellant had in that motion sought permission of the court to appeal against the judgment of the trial court as an interested party.

He also urged the court to decide whether the court below was entitled to determine who should be the sponsored candidate of the party.

This is coming weeks after the police arrested Ms. Otobo on allegations of blackmail, threat to life, conspiracy, and intent to steal from the Apostle. Instituting a lawsuit against Otobo and the online medium, Apostle Suleman’s lawyer, Osa Director said the cleric is suing both defendants for the libelous statements made and published against him. The case with suit no: ID/ADR/374/2017 was filed at the Ikeja High Court in Lagos. Stephanie Otobo and Apostle Joshua Suleiman Apart from the 1bn damages against each parties, Apostle Suleman is also seeking “an interlocutory injunction restraining the Defendants, their agents, servants, privies, representatives or any person, whosoever, acting or carrying out their individual and/or collective instructions from further publishing or causing to be published any defamatory publication touching on or relating to the person of the Claimant and the subject matter until after the determination of the substantive suit”. According to his counsel, “Suleman decided to institute the action and put blackmailers out of business. Many Nigerians under similar circumstance will just allow the matter to slide into the inner recess of our memory, either due to ignorance, lack of resources or impatience with the judicial process”. “But, Apostle Suleman is a dogged fighter and principled man of God who does not take kindly to anything that will tarnish his image. Therefore, he is ready to pursue the matter until justice is done”. “To signpost his determination to get justice, apart from Director, he has lined up four other lawyers, led by a Senior Advocate of Nigeria, Chief Efe Akpofure, to prosecute the matter. The other lawyers in the team are Emmanuel Usoh, Victor Idiapho and Erhabor” Recall that Otobo is also facing a criminal trial by the IGP for blackmail, threat to life and conspiracy to obtain money by false pretences. Last month, Ms. Otobo, during a press conference, had accused Apostle Suleiman of adultery and ditching her after promising to marry her. She had also accused the cleric of threat to life and attempted murder. She and her lawyers, Keyamo & Co. Chambers, had therefore, promised to sue Suleiman for ‘breach of promise of marriage’. However, investigations have revealed that till date, the Festus Keyamo & Co. Chambers handling Otobo’s case are yet to file a law suit against Suleiman for breach of promise to marry.

The Federal Government on Thursday filed an appeal against the ruling of Justice Jude Okeke of the Federal Capital Territory (FCT) High Court which upheld the no case submission filed by Justice Adeniyi Ademola, Mrs. Olabowale Ademola and Mr. Joe Agi (SAN).

The trio were arraigned for corruption by the federal government.

Justice Okeke had on Wednesday upheld a no case submission filed by the defence in the case against the accused persons.

The judge struck out the 18-count charge proffered against the defendants after holding that the prosecution failed to prove any of the allegations despite the provisions of sections 53 and 60 of the Independent Corrupt Practices and Other Related Offences Act (ICPC Act).

A Presidential source, who does not want his name in print, said the federal government through the Ministry of Justice has also filed a fresh case in the Code of Conduct Tribunal (CCT) against Justice Ademola and his wife for living above their means and failure to declare their assets.



He said the government has been advised to appeal the case.

“A very strange outcome indeed considering the underlying facts. It is even more strange that the trial was not allowed to continue considering the applicable statutory provisions.

“Section 53(1) of the ICPC Act raises a presumption that any gratification accepted or obtained by an accused person must have been corruptly accepted or obtained until the contrary is proved. Section 60 of the Act does not apply to the case.

“Of interest is the decision of the learned trial judge that the offence of giving and receiving gratification was not made out by the prosecution against the defendants in the face of the evidence held in court. Prosecution witnesses gave testimony of the payment of N30 million in three tranches by Mr. Joe Agi (SAN) into the account of Mrs. Olabowale Ademola, the wife of Justice Ademola. Mr. Agi was a legal practitioner who actually had cases in the court of Justice Ademola,” the source stated.

There was confusion at the Anambra State House of Assembly on Thursday following a move to impeach the speaker, Mrs. Rita Maduagwu by members.

Noticing the move, the speaker absconded with the mace, the symbol of authority of the legislative house.

Before that, no fewer than 28 members of the house had assembled at the hallowed chamber for the business of the day.

Amid the confusion, the state governor, Chief Willie Obiano drove to the House of Assembly complex, apparently to intercede.

Our source said the governor addressed the 28 members of the house who were members of All Progressive Grand Alliance, pleading with them to persuade others not to carry out the impeachment.

The speaker noticing that her members were adamant in carrying out their mission absconded with the mace, unnoticed.

When the bell signifying her coming into the chambers rang severally the speaker was nowhere to be found.

This caused the majority leader, Victor Okoye to call for the adjournment of the house to Tuesday, April 11.

The 14 students‎ who were detained last week for protesting against the authorities of the University of Lagos, UNILAG, have been freed.

‎The students, who were remanded at the Kirikiri prison on Saturday on the order of a court, arrived the mobile court in Oshodi on Thursday morning.

The students arrived in a police convoy, Thursday, chanting solidarity songs.

The 14 students were taken into custody at Kikiri Prison on Saturday, on the orders of the Special Offences Mobile Court, Oshodi, where they were arraigned by the police for “riotous invasion” of Lagos-based Television Continental, TVC, Premium Times reports.

The management of the station has since denied the allegations, saying the students were peaceful in their conduct.

They had earlier been arrested on the university campus while protesting the suspension of a visually-impaired student and demanding
the reinstatement of all suspended student activists.

The UNILAG authorities had earlier denounced the students saying some of them had been rusticated from the school while others were not students of the institution.

Several groups including the National Association of Nigerian Students and Education Rights Campaign had condemned the detention of the students‎.

The counsel to the students, Inibihehe Effiong, said the release was subject to Section 211 of the Nigerian constitution.

“The trumped up charges have been struck out and we salute the Lagos State Government for this,” he said.

Aina Tomi, one of the 14 students, disclosed that the students would institute a legal suit against the Lagos state Commissioner of Police, Fatai Owoseni.

“We will institute legal action against the commissioner in the next couple of days”, he said.

ABUJA – A High Court of the Federal Capital Territory sitting at Maitama, on Wednesday, struck out the 18-count corruption charge the Federal Government preferred against Justice Adeniyi Ademola, his wife, Olabowale and a Senior Advocate of Nigeria, Mr. Joe Agi.



The court held that FG failed to prove any of the allegations it levelled against the embattled Judge who hitherto served at the Abuja Division of the Federal High Court.

Consequently, trial Justice Jude Okeke, in a ruling that lasted over five hours, terminated further hearing on the criminal case, even as he discharged and acquitted all the defendants.

Justice Okeke held that FG failed to establish that Ademola received gratifications from Agi to the tune of N38.5m, including a BMW Saloon 320i car gift.

FG had alleged that Justice Ademola got N30million from the senior lawyer through a Guarantee Trust Bank, GTB, account number 201/110160/1/1/0, operated by his wife who was the former Head of Service in Lagos State.

It alleged that Agi, SAN, had on January 5, 2015, purchased the car from Coscharis Motors Ltd on January 5, 2015, and handed it over to Ademola’s son, Ademide.

More so, the prosecution which closed its case against the defendants after it called a total of 19 witnesses, alleged that Justice Ademola was in possession of two prohibited firearms without valid licences.

However, all the defendants, through their respective lawyers, entered a no-case-submission, insisting that FG did not establish a prima-facie criminal case against them capable of persuading the court to compel them to enter their defence to the charge.

While upholding their no-case submission, Justice Okeke held that the prosecution could not link the N30million Mrs Ademola received from Agi, SAN, to any particular case being handled by her husband.

He also held that FG could not tender any evidence showing that the said N30m was at any time, transferred to any bank account that belongs to the 1st defendant (Ademola).

“None of the witnesses identified or tendered evidence to show that N30m was paid into any bank account of the 1st defendant either by the 2nd or the 3rd defendants”.

Though Justice Okeke took cognisance of a statement the 3rd defendant made before the DSS, where he admitted that it was two of his clients that directed him to pay the N30m to Mrs Ademola as gift during her daughters wedding in April, 2015.

The Judge however noted that the lead investigator, PW-16, in his evidence-in-chief, said he could not establish any link between the monetary gift and any case that was handled by the 1st defendant.

According to Justice Okeke, the PW-16, who was reminded that President Muhammadu Buhari’s lawyer, Mr. Kola Awodehin, SAN, equally gave Justice Ademola N.5m gift during his daughter’s wedding, at a time Buhari’s certificate case was pending before his court, had stated that misinterpreting such gesture as gratification would amount to speculation.

“This court totally agrees with the PW-16 that taking the N30m gift the 3rd defendant paid into the account of the 2nd defendant as bribe will be speculative and no court can convict based on speculation.

“A court of law reckons with hardcore evidence placed before it and not on speculations as to why the payments were made”, the Judge added.

He held that the prosecution failed to discharge the burden of proof placed upon it by the law.

It will be recalled that Justice Ademola who is a grandson to a former Chief Justice of Nigeria, was among seven superior court Judges that were arrested after a sting operation the Department of State Service, DSS, conducted between October 7 and 8, 2016.

The National Judicial Council, NJC, had asked him to temporarily step down from the bench pending determination of allegations FG raised against him.
