The Supreme Court has ended the quest by the All Progressives Congress ( APC ) in Rivers State to reverse the October 10, 2018 judgment of the High Court of Rivers State, which barred it from holding primaries for the production of candidates for the next general elections.

A five-man panel of the court, headed by Justice Bode Rhodes-Vivour struck out the three remaining appeals filed by the APC, Ojukaye Flag Amachree and Tonye Patrick Cole, on the grounds that they were statute barred, the appeals having been filed outside the time allowed under Section 285(9) and (12) of the Constitution as amended by the 4th Alteration Act.

Justice Amina Augie, who read the lead ruling, which terminated the appeals, said the appellants, who were not parties to the original suit were not allowed by the Appeal Court in Port-Harcourt, the opportunity to appeal the October 10, 2018 judgment because they filed their appeal out of time.

Justice Augie said the appeals, which were, this morning, consolidated by the court – SC/81/2019 (another appeal filed by APC), SC/1332/2018 (by Ojukaye Flag-Amchree) and SC/1334/2018 (by Tonye Patrick Cole and others) – are statute barred.

The judge said the appellants have no leg to stand on, since the main appeal filed by the APC -SC/1333/2018, against the October 10 judgment, had earlier been struck out by the court in the judgment delivered on Tuesday morning by Justice Amiru Sanusi.

The All Progressives Congress (APC) has announced that Ibikunle Amosun, Governor of Ogun State, will not escape punishment for the embarrassment he caused the party during the presidential rally at the MKO Abiola Stadium, Kuto, Abeokuta, on Monday.

At the rally, Amosun had shocked everyone when he campaigned for both APC and the Allied People’s Movement (APM), the party of his anointed who did not get the APC governorship ticket.

But the high point was Adams Oshiomhole, National Chairman of the party and President Muhammadu Buhari being pelted by the crowd.

Bola Tinubu, National Leader of the party, was also videoed flinging the party’s flag away in annoyance.

The party has now announced that it intends to “review this gross misconduct of deliberately positioning thugs to attack and embarras the President and the party's leadership”, and take a decision on this matter “immediately after the elections”.

“The All Progressives Congress (APC) regrets Monday's premeditated attacks sponsored by Governor Ibikunle Amosun on President Muhammadu Buhari and other senior party leaders at the venue of the presidential campaign rally in Ogun State,” Mallam Lanre-Issa Onilu, National Publicity Secretary of the party, said in a statement.

“This is one act of indiscipline too many. The APC will not condone acts of indiscipline, indiscretion and anti-party activities from any party member no matter how highly placed.

“The party will review this gross misconduct of deliberately positioning thugs to attack and embarrass the President and the party's leadership. The party will take a decision on this matter immediately after the elections.

“It must be stated that party supremacy and discipline according to our constitution are not matters of choice but binding principles which must be adhered to by ALL party members.

“The APC is a party known for discipline, justice, fairness and equality hence any plan to destroy what this party stands for would be rejected. No single person will be allowed to put his personal and selfish interests ahead of the wishes of the people of Ogun state and elsewhere.

“Post primaries, the decision of the National Working Committee to uphold the wishes of party members is unbendable. Therefore, whatever means being presently deployed by persons intending to undermine the wishes of the people for personal gains will not be tolerated.

“We urge our teeming party supporters and members not to be disturbed by Monday's condemnable incident. We urge all to continue trooping out en masse for our remaining campaigns and vote massively for ALL and ONLY APC candidates in the forthcoming general elections.”

Pandemonium broke out on Monday at the venue of the presidential campaign rally of the All Progressives Congress (APC) in Ogun State following the arrest of some suspected thugs who engaged themselves in a bloody clash.

The rally was held at the Moshood Abiola International Stadium in Abeokuta, the state capital.

The face-off between suspected thugs came as thousands of APC supporters and those of the Allied Peoples Movement (APM) arrived at the venue.

Allies of the state governor, Ibikunle Amosun, who were denied tickets by the APC are running on the tickets of the APM and are being backed by the governor who himself is a senatorial candidate of the APC.

Both parties are, however, backing Mr Buhari for reelection.

The clash started as thousands of party faithful awaited the arrival of President Muhammed Buhari and other leaders of the APC who attending another rally in Ilorin, Kwara State.

The police arrested some of the suspected thugs with dangerous weapons, including axes, charms and guns.

Some journalists were also caught in the fracas as it spread outside the stadium. The publisher of News Direct newspaper, Samuel Ibiyemi, said he narrowly escaped death.

Narrating his ordeal to PREMIUM TIMES, Mr Ibiyemi said he lost a wristwatch and other valuables to the thugs. He said the thugs also seized and tore copies of the publications he brought to the venue.

The spokesperson of the state police command, Abimbola Oyeyemi, could not be reached at the time of this report.

The Minister of Finance, Mrs Zainab Ahmed, says the Federal Government will increase the Value Added Tax on some items in the course of the year.

Some of the items according to her, will include carbonated drinks as well as some luxury items.

She stated this on Wednesday at the launch of the Strategic Revenue Growth Initiative in Abuja, targeted at improving revenue sources for government.

Ahmed said the move had become imperative as a result of the fiscal challenges the government is confronted with in providing infrastructure for its people.

She, however, noted that the increment will only be done after due consultation with the National Assembly.

“There will be a VAT increase. During the course of 2019, we will have clarity as to which items and what the rate will be and we will have to take a request to the National Assembly for amendment before it takes effect.

“There is also going to be luxury tax.

Already, there is luxury tax imposed on things like jets, yachts and few exceptional items that are classified as luxury and the Chairman FIRS will speak to that but we are contemplating increasing excise duties on carbonated drinks just like we have excise duties now on Tobacco and alcohol.

“But this is going to be a subject of study because we have to identify which ones will be affected and the best way in which to apply the taxes.
