Truthera, from my latest response to you here in this thread, you will now appreciate why Kanu decided to sack his lawyers and notified the court that he will be defending himself. His legal team knew his argument on claiming that the 2020 ammended Terrorism law no longer applied to him was flawed and I am sure that this led to serious argument between Kanu and his lawyers forcing Kanu with his massive ego that is only matched to his massive arrogance and ignorance to sack his lawyers and foolishly represent himself. truthera:In legislative matters , there's what is referred to as the the repeal-and-re-enactment doctrine combined with a savings clause. This is exactly what the ammended 2022 Terrorism law is. The electoral law has been amended severally under this doctrine of repeal-and-re-enactment doctrine. If we are to go by your argument , that means every elected official sworn into office using the old electoral laws prior to the enactment of the latest ammended electoral bill are invalid and as such should be stripped of their titles as former elected officials The doctrine of repeal and re enactment exist in both legislative and legal matters because it makes provisions for preserving the tenets of a previous law while seeking to expand on it. The 2022 ammended Terrorism law even stated a clause upholding all provisions in the old law and it's applications . What you are blindly arguing against has several precedence in law. Section 33 of the Interpretation Act (Cap I20, Laws of the Federation of Nigeria 2004) explicitly states that the repeal of an Act does not: Revive anything not in force or existing at the time of repeal. Affect any right, privilege, obligation, or liability acquired, accrued, or incurred under the repealed Act. Affect any investigation, legal proceeding, or remedy in respect of any such right, privilege, obligation, liability, etc. This statutory provision means that even if a new law expands the scope, it cannot retroactively extinguish a conviction or pending case that was valid under the old law, provided the new law does not expressly say otherwise (which is rare in criminal law due to the ex post facto clause). Here is a case precedence for you: Attorney-General of the Federation v. Attorney-General of Abia State (2000) and similar federal cases have reinforced that the repeal of a statute does not destroy the liability incurred under it unless the repealing act explicitly says so. Also, a similar precedence has been set in Ogunleye v. The State (1990) and Uko v. The State (1999). In these cases, the Supreme Court of Nigeria held that: A repeal without a savings clause would abate pending prosecutions (the common law rule). And you keep referring to the 1999 Constitution in particular to Section 1(1)) and Section 34 (Right to dignity and fair hearing) which explicitly protect against retroactive criminal laws which by layman interpretation simply translate that: 1. You cannot be convicted under a new law for an act that was not a crime when committed. 2. You cannot be sentenced to a heavier penalty under a new law for a past act. But your Kanu wasn't standing trial for crimes committed retroactively. At the time of his arrest and arraignment in court, Kanu was charged under the existing 2013 legislation. In practice , any law passed under the doctrine of repeal and re enactment, is applicable as long as there is a saving clause that upholds the previous legislation that is being replaced. If the new law is silent, the court invokes the Interpretation Act (s. 33) to preserve the old liability. Meaning, the old law has now been abrogated and those facing court cases and convictions on the old are automatically free to go and no longer subject to trial and or legal sanctions and liability . These people are building an iron curtain around them. I say, let them build it. The only people who have tolerated their excesses in Nigeria are the Yorubas who are the only people to have let them thrive in their land. Anyone who is good to these people is seen as weak. Imagine one woman from their stock doing a video and posting it on SM telling the first lady to stop coming to their state (Imo) and all of them applauding it. The non profit organisation, Doctors without Borders is now the latest antisemitic and newest terrorist organisation on the block . Well, that's according to the genociders in the Israeli govt . Recall that a UN agency, UNRWA has been declared a terrorist organisation by the Israeli govt and their hospitals, staff and convoys deliberately targeted and bombed by the IDF. Other than aid workers and their organisations now being declared terrorists, the Israeli govt has been deliberately murdering journalists. Over 250 journalists have been murdered by the IDF . This is by far the highest number of journalists ever killed in a modern war. In comparison, only 69 journalists were recorded to have been killed throughout the entirety of the second world war and this covers several continents. Israel, on the other hand, has deliberately murdered upwards of 250 journalists in their ongoing genocide of Palestinians. It appears the Israelis are now labelling any aid organisation that is involved in Gaza as a terrorist group and are killing their volunteers and staff alongside journalists covering the ongoing genocide. The Israelis are murdering the people who have first hand account of their crimes against humanity and are doubling down by justifying their murders by labelling aid groups and journalists who are witnessing their atrocities and war crimes as terrorists. Anyone thinking Kwankwasso is interested in winning 2027 as VP to Obi is delusional. Kwankwaso is doing exactly what he did in 2023 towards getting Kano back and putting his own loyalists now running under NDC into power ahead of 2031. Kwankwaso is playing the long game and he is only in the NDC to build his structures ahead of 2031. I don't expect obidients with their highly myopic, reactive and lineal thought process to understand the game Kwankwasso is playing since their principal is also bereft in understanding that to clinch Aso Rock you need your people in strategic positions - something that Tinubu is a master of and is alien to Giringori . Now to the main gist, Kwankwasso will definitely be contesting as one of the leading northern candidates in 2031 when power returns back to the north. I for one don't see Kwankwaso picking Giringori as his running mate in 2031 . I even see a situation where Giringori will latch on to another mushroom party to get his usual free ticket to contest again in 2031 and also see Alhaji Atiku also running.. So we are bound to have a four way split contest involving the APC northern flag bearer Vs Atiku Vs Kwankwassai Vs Giringori. Where the problem will arise in the NDC (if Kwankwasso still remains with the party alongside Giringori), is over the issue of which zone is to go for the Presidential ticket. Kwankwaso will argue that obi contested in 2027 under the Southern turn and that now that the Presidency is zoned back to the north, he (Kwankwasso) is entitled to the ticket. This won't sit well with Giringori and he will port as usual after seeing that Kwankwasso won't be needing him(Giringori) as his running mate. So how will you obidients (what is left of you then) react to NDC zoning their ticket in 2031 to Kwankwasso and Kwankwasso refusing to pick Giringori . As long as Atiku is alive he will still contest every election. That one is sure. I even foresee Atiku causing a major disruption in a future Presidential election he will be contesting by dropping dead due to old age midway into campaigns , thereby forcing the election date to be postponed. As for, Giringori, his political future ends on January 17, 2026. Another 4ys of Tinubu will definitely see to him handing over to a northern candidate of Tinubu's choice from among the APC fold. That totally rules out Giringori out for the next 12ys. Giringori may however attempt a VP position in 2031 to a northerner, but that won't happen as Giringori is unelectable in the Muslim north. So that means Giringori's only opening slot is in 2039 when the Presidency rotates back to the south. If Giringori keeps up his divisiveness and attacks on the SW as can be seen with his followers, that region is totally ruled out for Giringori. The SS will be wanting a comeback and who best but Emperor Wike to seize the opportunity to be the flag bearer for the south. Wike will get the SW and SS support and the northern bloc . So 2039 will be between Wike SS Vs Giringori SE If IPOBidients sustain and continue their insults and self alienation , a Wike SS Presidency will be more than appealing than a Giringori. Of course Alhaji Atiku will be contesting in 2039 if God keeps him alive. So a 2039 Wike bid will look exactly like a Tinubu 2027 re-elecrion. SW, SS, NC and NE will definitely be for Wike. Giringori will be wasting SE voters again while Atiku is scrapping by in the NW. A Wike win in 2039 is more than feasible.
