A major event occured two days ago with the Houthis retaken an island on the ted sea from Saudi and US backed Yemeni forces .

This now has seen the Houthis controlling the straits in the Red Sea thereby blocking the Suez canal shipping route.

The Houthis didn't just stop there, they blew up the only artery used by the Saudis to export their crude in the form of the East-West pipeline that had come to replace Saudis eastern oil lifting platforms owing largely to the blockade of the Straits of Hormuz by Iran.

A large plume of smoke has been detected from space over the Saudi Red Sea port .

The Houthis have now not only secured the closure of the Red Sea and Suez canal similar to how Iran shut down the Persian Gulf and Strait of Hormuz but have destroyed a major Saudi gas pipeline and only means of exporting crude .

Get ready for $200 oil prices..

The only people heading to India are you developers going there just to do drugs .

Developers are now weighing the risk and are going to countries with lax sentencing guidelines for drug offenses.

This is why South Africa remains the most attractive to them but since they have over developed SA and those ones are more than grateful for their development and are begging them to take a break in developing their country, they are now moving to India.

India is perfect not only because of it's lax drug laws and low sentencing but because it is a huge drug market with over 1.3 billion potential Indians to supply drugs.

I wonder how Biafra will be then if the developers are running away from Nigeria to develop India.

Truthera, consider the following:

Assuming Nigeria repeals it's buggery laws and does not replace it with another set of buggery laws, automatically all who have been convicted for buggery and those standing trial for buggery automatically walk away free and their criminal records are wiped clean.

But if the old colonial buggery laws are ammended to include criminalising same sex marriages, the old convictions still stand.

That is what the 2022 ammended Terrorism act is doing.

It did not totally repeal the old law but only strengthened it.

Kanu can not base his appeal on this technicality as no sane lawyer will dare present such argument on risk of getting fined by the courts for bringing up a frivolous appeal case.

The argument by Kanu over this law during his trial was to waste the court's time by calling for a trial within a trial to determine if the charges he was standing before the court were still valid.

But this is futile as the ammended law made a special case for ongoing trials and convictions.

If justice Omotosho had agreed with Kanu, then every convicted terrorist would have been released automatically .

Does that sound normal to you?

My friend , the ammended law upheld ongoing cases and convictions based on the old law.

The laws are statements and the statement made on the 2022 law explicitly stated that the old law still stand for past convictions and cases undergoing trial and investigation.

It's a law and embedded in it is that clause that made Kanu's trial based on the old law valid.

Your argument is based on a very weak technical foundation which can not hold since the new law upheld the old law for cases pending and last convictions prior to it being signed into effect.

You have no argument.

Section 1 (3) of the Constitution states clearly that if any other law is inconsistent with the provisions of the constitution, the constitution shall prevail, and the other law shall, to the extent of the inconsistency, be void.....

You are simply being academic by trying to invalidate an ammended law duly passed by the National Assembly .

You should first go to the supreme court to argue firstly how the 2020 law contravenes the constitution .

The NASS are the only body empowered by law to make and pass laws and on passing this ammended law, they explicitly provided a caveat that all ongoing proceedings and convictions immediately ongoing before the passage of the new law stand as they are.

The 2022 law already took care of the constitutional provisions guiding criminal prosecutions .

Truthera, your Kanu was thinking Justice Omotosho will agree with his dense argument and had the temerity to be demanding from the judge to show him the law that he was standing trial for.

He even went as far as demanding from the prosecution to educate him as if they are his personal lawyers .

When you fail to understand the law, you will learn the hard way before a judge and that's the sad case of the arrogant ignorant Kanu.

Section 98(3) states:

"Any proceeding, prosecution, sentence, judgment, charge or cause of action pending or existing immediately before the commencement of this Act under any of the repealed Acts may be continued or commenced… as if this Act had not been made."

Kanu's prosecution was pending as of 12 May 2022, so Section 98(3) saves it — the trial can continue exactly as if the TPPA 2022 had never been enacted, i.e., under the old TPAA 2013.

Section 97 provides that any regulation, order, ongoing case in court, or thing done under the repealed Acts "shall, if in force at the commencement of this Act, continue to be in force and have effect as if made… under the corresponding provisions of this Act."

Section 98(3) states:

"Any proceeding, prosecution, sentence, judgment, charge or cause of action pending or existing immediately before the commencement of this Act under any of the repealed Acts may be continued or commenced… as if this Act had not been made."

My friend the law was not repealed.

The ammended law simply expanded on the last.

It was not an abrogation as you want it to appear .
Your argument is that the prosecution continued it's case on the old law when it is stared in the new law that all ongoing cases being tried or having been concluded with a conviction still stand .

That is the clause attached to that amended law which you are dubiously ignoring.

This is the gross ignorance you all keep clinging to.

The ammended law used to convict Kanu did not set aside the original law that Kanu was arraigned for.

The law states clearly that the new amended law will not halt any ongoing proceedings or set aside any convictions of the previous law which the amended terrorism and incitement law had come to replace.

The ammended law only broadened the net and explicitly stated that it upholds the previous tenets of the old law.

The amended terrorism and incitement law did not abrogate the previous law but only expanded it's definition.

Kanu was earlier arraigned on the old ruling which had been replaced by the new law.

The prosecution did not seek to amend the charges before the court because the new law explicitly stated that ongoing cases before a court can proceed on the old law and all previous convictions stand.

If someone is standing trial for raping a minor under ordinary rape charges prior to passage of laws that explicitly adds another severe penalty for raping a minor , does that invalidate the original rape ?
