Alwaysfavour: Thank you for your response, yes i do,v i even sent them complaint. I collected my passport on 13/10/2022 and the enrollment ended on 14/10/2022. The school sent me mail not to come since i didn't meet the enrollment.
So you know, I did bio aug 20, call and issue was escalated on the 12 of sept., another escalation on 4 of October. All this while, i didn't receive any NSF mail. Please how did you got this resolved, I fall into the same category with you. I submitted my application 12th of January, biometric was done 20th of January, decision was made 23rd of January 2023. Could you believe till now UKVI are yet to return my passport back after several paid mails, they responded that there was an error on my application from there side but the error has been corrected that I will receive my passport back by 13th of march 2023. meanwhile my enrollment deadline was 12th of February 2023. My school keep telling me not to bother coming that I should defer my admission to September intake, Note the application was a priority, no nsf mail, Now how do I get my ihs refund back from UKVI? Maybe there were issues with international mail but who knows? Why would they refuse to return your passport after giving you a VISA? That is difficult one.

Arrange with your school to push your admission to Sept, you will not be able to get IHS refunded because your application was successful What led to the delay is IOM results, IOM delayed the TB test certificate for more than 10 weeks before they release it and school was aware of all this delay. The same week the IOM TB certificate was released is the week I applied for the Visa. My issue is priority is usually 5 working days to get the decision and also return the passport back to TLS, so why was the passport delayed even till now it has not been return back to me. Can I sue UKVI for this? |

Truth is most of the schools don't understand what it takes to apply for visas and because they saw your BRP, they probably believed you are the one stalling on resuming. Can I ask what steps you took to contact UKVI/TLS besides going their physically and asking for your passport
If you intend to sue you have to have enough trail as evidence to show you have chased this
2.can you appeal with your Uni to allow you resume online pending when this is resolved
3. Because a decision was made/ visa granted you won't be getting your IHS back, again this will depend on the evidence you have and how far you are willing to take this up legally
An immigration lawyer might be of help
Cheers I have done several paid mails, have been to UK embassy in Walter Carrington, have written to them, my school have also write them. The paid mail keep extending the date for me, and right now my school told me not to bother coming again. Right now I am so tired and all hope has been lost. Hafeez6948: I was trying to watch a movie on my phone just to distract myself from IRCC delay when i suddenly fell asleep with one side of my face on the pillow. Awhile later i woke suddenly to hear my heart pounding as if it was located at the back of my ear. I rushed to my dad's room to use his Bp machine to check and behold my Bp don rise. I am a 25 years old guy i no deserve all this mental stress wey IRCC dey give me ooh. mimilyrics: Pardon the confusion. Must here is relative - it was used to convey the importance of the situation. I should have typed "should ideally" since this is advisory.
The dependant won't have access to "free" (subsidised) NHS services since IHS is not paid for visas that are 6 months or less. What if something happens and your dependant needs healthcare? The bill might be crippling and end up being more than the yearly IHS.
Also, coming too close to when the main applicant puts in an application for the graduate visa might raise flags as to the timing. You need to have lived together for some time before the application - this shows genuineness and doesn't come across as arranged. Coming few weeks to the visa end date might raise some doubts around being genuinely married except there are genuine reasons for this.
If you plan to arrive less than 6 months to the end of the main applicant's visa and for some reason, UKVI delays your application or other circumstances beyond your control happen, it means that you might not arrive before your partner has to put in an application for the graduate visa which may see you living without your partner for the better part of 2 years, in the absence of a work visa. If you're not in the UK as a dependant prior to the application, you won't be able to apply as a dependant.
Some HRs also don't have a strong grip of immigration rules and it might be difficult to get a job (if you want one as a dependant) because 1. You don't have a BRP (even with BRP, some of them still errorneously delay employment checks because it's not a situation that they are used to and 2. The short duration on the visa might deter some employers (the ones who will employ you will do so irrespective of the hurdles).
So to avoid stress and plenty "explanations" or last minute issues, better to join earlier.
Please note that each application is different and is subject to the ECO's discretion. My question is, can your dependants go together with you and enter UK together with you, or you will first go and they will come and join you? |
