President Muhammadu Buhari has said the rights of individuals in the society must always take a second place where national security and public interests are threatened. President Buhari said this today while declaring open the 58th Annual General Conference of the Nigerian Bar Association (NBA) in Abuja with the theme: “Transition, Transformation and Sustainable Institutions’’. He said although his administration subscribes to the rule of law as the foundation of the society, it is also guided by the belief that the rule of law must be subject to the supremacy of the nation’s security and national interest. “Our apex court has had cause to adopt a position on this issue in this regard and it is now a matter of judicial recognition that; where national security and public interest are threatened or there is a likelihood of their being threatened, the individual rights of those allegedly responsible must take second place, in favour of the greater good of society”, President Buhari said. Buhari urged lawyers to join his administration in achieving the core objective of enhancing Nigeria’s business environment and promoting social justice by promoting respect for the Rule of Law; contributing to the law reform process and putting national interest and professional ethics above self in the conduct of their business. The President recalled the challenges faced by his administration since its inception in 2015 and efforts being made to put the country on a better footing. “Let me assure you of the resolve of this administration to promote measures that will achieve a vibrant economy under which the practice of law will thrive. “Through fiscal discipline, good housekeeping, we navigated the difficult days of economic transformation at the beginning of this Government in 2015 and have now come to improving economic indices, including the consistent increase in our foreign reserves; thirteen straight months of decreasing inflation; the expansion of social safety nets programmes as well as the blockages of historical drain pipes in our national treasury, all within the context of the Economic Recovery and Growth Plan. “ It is equally significant to emphasise that our willingness to hold persons accountable for offences against society, through the judicial process, will equally transform the future of public service in Nigeria in a positive manner. He urged lawyers to uphold and improve the sanctity and integrity of Nigeria’s judicial and electoral institutions which play a fundamental role in the sustenance and growth of our democracy. “While we have made appreciable progress in several sectors, including public awareness of the need to challenge the corrupt and the brazen in our midst, we have also learnt useful lessons on the dynamism of our society. However, elements within every society, including some lawyers, can equally become unduly resistant to change, even where it is proven that such change is to serve the interest of the larger society. At worst, corruption fights back. “As we gradually move into another season of intense political activities preparatory to the 2019 General Elections, I enjoin you to remember that by reason of your profession, you all have a responsibility to work for national cohesion and unity through your speeches and public positions and most importantly in your advocacy in court. “In the context of opinions and narratives about our past and present political and socio-economic experience, you cannot afford to jettison rational and proper analysis of issues in a manner which builds, rather than destroys the nation. I also urge you to work to uphold and improve the sanctity and integrity of our judicial and electoral institutions which play a fundamental role in the sustenance and growth of our democracy. “However, let me remind you all, my dear compatriots, that the law can only be optimally practiced in a Nigeria that is safe, secure and prosperous”, he said. The Chief Justice of Nigeria (CJN), Justice Walter Onnoghen said the members of the legal profession had always waited for the NBA annual general conference as it served as intellectual compass for the members. He said the choice of President Nana Akufo-Addo of Ghana as the main speaker for this year’s conference and other notable local and internal resource persons spoke volume to how NBA had expanded the frontier of the conference. “President Nana Akufo-Addo is a vibrant Legal Practitioner of many decades and has championed the cause of human rights for many years before becoming a president. “He therefore reserves the right to speak to the theme, and it is our hope that the conference would come out with salient outcomes that would enrich our association and country’’, CJN said. On the forthcoming general election, Onnoghen said democracy provides citizens the freedom to decide who govern them. “The significance of the ballot for sustaining democracy must be protected by all and sundry. “The electoral members must be thought to conduct themselves in the most acceptable manner. “In the event of election disputes, the judiciary must be prepared to play its role with substantial credibility’’, Onnoghen said. On the attempt to introduce flexibility in filing of appeals at the Supreme Court, the CJN said the deadline for the Nigeria Legal E-mailing System would soon be activated. According to him, the system is deployed to end paper filing of processes in the apex court. He however, advised the lower court across the country to adopt similar measure to forestall the present cumbersome nature of filing processes in courts. The Attorney-General of the Federation (AGF), Mr Abubakar Malami (SAN) described the NBA as a premium association that had assisted the country in various spheres. Malami also said the association was an agent of transformation and positive change, adding that this year’s conference had shown the mileage the association could cover. He said the country’s journey toward ensuring supremacy of laws was still in order, adding that the government had in the last three year strengthened the country’s prosecutorial agencies to perform better. On his part, Mr Abubakar Mahmoud, outgoing President of the NBA, said the association had in the last two years embarked on programmes to build the confidence of the public on the profession. Mahmoud said the association was interested in the growth of the country, adding however that such growth could be stiffened if rule of law was not in place. He said the choice of the conference theme was deliberate, adding that it was intended to cure the widespread disconnect and weakness in most of the country’s institutions. On security, the NBA president said the association has had on the spot assessments of situations in the North East, Kaduna, Zamfara, and Benue. He said the Federal Government must increase its visibility in those trouble spots to abate the ongoing killings by hoodlums. Mahmoud further said that the practice where those state governments used their allocations to fund federal security agents must be discouraged as according to him, the practice is draining state funds. Mahmoud said the three -day conference would address Climate Change, Human Rights, Equality/Justice, Rule of Law, Security, Conflict Resolution as well as Innovation in Technology. As the country prepares for the 2019 elections, the Muslim Rights Concern (MURIC) has urged Nigerians to reject politicians who are against the anti-corruption stance of the present administration, describing them as those “who have been feeling the pinch since the Buhari administration took over and closed the corruption tap”. In a statement entitled ‘2019: Intensify Voters Awareness Campaign’, Professor Ishaq Akintola, the Director of MURIC, urged Nigerians to “open their eyes very wide” and vote for those seen clearly to be fighting corruption, describing them as “the politicians who can bring back the glory of this country”. The statement read in part: “The jackals are gathering. Political demagogues are using rhetoric to deceive Nigerians. Most of the messages being passed across suffer from poverty of ideals and desertification of principles. Apart from anti-corruption, all other messages lack ideological identity. Nigerians are being hoodwinked. How are they going to pick the right candidates from 91 political parties? What is the difference between party ‘A’ and party ‘B’? “One of the calamities which have struck the Nigerian political arena is the unbridled proliferation of parties. It is a crazy rat race and politicians have resorted to the use of deceit. Those who brought Nigeria to its knees and turned it to a beggar nation are claiming to be its saviours. They want to use that claim as an excuse to come back. Those who robbed Nigeria silly are claiming to be our messiahs. “Nigerians must open their eyes very wide. Those who deserve our votes are those that we see clearly that they are fighting corruption. These are the politicians who can bring back the glory of this country. Vote for candidates who are likely to liberate you, your children and the future generation of Nigerians from the shackles of backwardness, poverty and bad governance.” He urged Nigerians to reject politicians who promote the concept of “stomach infrastructure”, as well as those whose flamboyant lifestyles could not be accounted for. He said: “Vote for politicians who promote austere living. Shun those who are extravagant and flamboyant. Avoid those who amass wealth. Ignore those who hobnob with past rulers who were known to be corrupt. “In like manner, we charge Nigerians to reject politicians who propose stomach infrastructure. They are political parasites bent on defrauding the hoi polloi. Avoid stinkingly rich politicians whose source of wealth cannot be ascertained. Ritual killing is in their character and they will not hesitate to sell Nigeria to their herbalists and marabouts. Beware of legislators who are in the habit of delaying the budget, demanding bribe before confirming appointees and retarding Nigeria’s progress generally. Their eyes are on super-jumbo salaries from 2019-2023 and the resultant [impoverishment] of the proletariat for another four years. “2019 is going to be a straight fight between corrupt politicians on one side and anti-corruption politicians on the other. Those who benefited from corruption in the past, but who have been feeling the pinch since the Buhari administration took over and closed the corruption tap from which free money was flowing will be on the side of corrupt politicians. Patriotic citizens and anti-corruption activists who want Nigeria to rise again will be on the side of anti-corruption politicians. Dino Melaye, the senator representing Kogi West at the National Assembly, has accused the Nigeria Police Force of conniving with the Kogi State Government to kill him. According to him, the plan was to find him "culpable [of] homicide and illegal possession of [firearms]". He said it would be the sixth time the Police would arraign him. In two tweets via his handle on Monday, Melaye also noted that the plan to "accuse" him of lies is "ridiculous". Rich men love women with small breasts, the poor love those with big bust, study says. There has always been the wonder of whether men prefer bigger breasted women, or women with a smaller chest. And as it turns out, it all comes down to how much money they earn! Two studies dating back several years have finally shed some light on the question, pointing out some surprising factors Psychologists Viren Swami and Martin Tovée conducted a study which investigated whether men’s access to resources would influence their preferences for breast size in women. They carried out two experiments in which they tested whether men who lack material goods would find larger breasts more desirable than men who do have material goods. For the first experiment, they explored the relationship between financial security and men’s preferences in breast size. They recruited 266 men from three parts of Malaysia that varied in socioeconomic status – low, medium and high. Each participant was shown animated female figures, each varying in breast size. They then rated them out of five for physical attractiveness. And it turned out, men with a lower socioeconomic status found larger breasts more appealing than those with a higher socio-economic status. They then compared breast size ratings in a second experiment which reflected upon the evolutionary perspective of breast size – being that it is a signal of a woman’s ability to bear and nurture a child. But this time, they did it based on a full stomach. They used 66 hungry male university students, and 55 with satisfied appetites to test whether the security of food had an effect on their preferences, participating as they either entered or exited their campus cafeteria between 6pm and 7pm. They also only used white males for this study, as ethnicity is known to influence breast size preferences. Again, they were shown five women with varying sized breasts. "Rotimi Akeredolu, Governor of Ondo State, has told staff of a private radio station, Adaba 88.9 FM, in Akure, to ask their ‘oga’ to construct the road that leads to the station. Akeredolu, apparently referring to Bola Tinubu, who allegedly owns the radio station, said the station management could use the influence of its owner to ensure that the road is repaired. He spoke at the dinner and award night to mark the station’s 10th anniversary, held at Bash Event Centre, Akure, on Friday. Adaba 88.9 FM is a subsidiary of TVC communications, which has headquarters in Lagos. According to Akeredolu, there was a time the road to the station was "so bad" that the Ondo State Government had to intervene, by grading it to become motorable. He said: "The moment everybody sees Television Continental (TVC) and Adaba FM, they all know who the parents are, but I will not say more than that. So, if we have these two big organisations and we all know who their parents are, it could be a form of Corporate Social Responsibility if they can help them build their road. "We are not seeing much here in Ondo State, but a lot is being done in many places. The road to TVC in Lagos was built by him. So, you can help us tell your Oga that this road is not too long for him to do in Ondo State. Or am I lying? No. It is not too long for him to construct. "It would not even take weeks to complete it, because they have all the machinery in Lagos to do it and they will make the road a better one. So, what we can do, we would do; what we cannot do, we would not do. "The United States says corruption is being perpetrated as a result of the “failure” of President Muhammadu Buhari’s administration to implement laws against such practices. In its 2017 Human Rights Report, it said numerous cases of corruption were evident across all levels of government. It added that while the government took steps to investigate alleged human abuses, “impunity remained widespread at all levels of government.” “Although the law provides criminal penalties for conviction of official corruption, the government did not implement the law effectively, and officials frequently engaged in corrupt practices with impunity. Massive, widespread, and pervasive corruption affected all levels of government and the security services,” it said. “The constitution provides immunity from civil and criminal prosecution for the president, vice president, governors, and deputy governors while in office.” The report added that while prosecuting corruption charges, the Economic and Financial Crimes Commission (EFCC) failed to follow due process. It cited the case of Sambo Dasuki, former national security adviser, who has been in custody of the Department of State Services (DSS) since 2015, despite court orders demanding his release. It listed the most significant human rights issues during the year to include: “Extrajudicial and arbitrary killings; disappearances and arbitrary detentions; torture, particularly in detention facilities, including sexual exploitation and abuse; use of children by some security elements, looting, and destruction of property; civilian detentions in military facilities, often based on flimsy evidence.” Also included are “denial of fair public trial; executive influence on the judiciary; infringement on citizens’ privacy rights; restrictions on freedoms of speech, press, assembly, and movement; official corruption; lack of accountability in cases involving violence against women and children; trafficking in persons; and early and forced marriages.” ‘JUDICIARY FACING INTIMIDATION FROM EXECTUIVE’ The US also frowned at the judicial system in the country which it said was compromised during the period. It said while there were avoidable delays in court processes, the executive and legislative arms of government continued to interfere with the judiciary. “Although the constitution and law provide for an independent judiciary, the judicial branch remained susceptible to pressure from the executive and legislative branches. Political leaders influenced the judiciary, particularly at the state and local levels,” it added. “Understaffing, underfunding, inefficiency, and corruption prevented the judiciary from functioning adequately. Judges frequently failed to appear for trials. “In addition, the salaries of court officials were low, and they often lacked proper equipment and training.
