The PEPC has upheld argument by President Muhammadu Buhari that it lacked the jurisdiction to entertain allegation of corrupt practices and voters’ inducement raised against Vice President Yemi Osinbajo in the petition by Atiku Abubakar and the PDP.

In its 5th ruling of the day, the court equally upheld the argument by Buhari’s legal team, led by Wole Olanipekun (SAN) that it was wrong for the petitioners to raise such grievous allegation against Osinbajo without joining him as a party in the petition to enable him defend himself against the allegation.

The petitioners had, in the petition, alleged that Osinbajo engaged in voters inducement by spending funds not appropriated for by the National Assembly or approved, in the pretext of Trader Moni and other social intervention programmes of the government.
In its ruling, the court said the non-joinder of persons against whom grievous criminal allegations were made in the petition, including Osinbajo, is a denial of their rights to fair hearing.
The court rejected the petitioners’ claim that the persons against whom the allegations were made are agents of the respondents, particularly 2nd and 3rd respondents (Buhari and APC) and held that there is no vicarious liability in criminal law, noting that anyone, who violates the law should carry his/her cross.
The court proceeded to strike out, from the petition, paragraphs containing the said offending criminal allegations, particularly paragraphs 368, 369, 370, 371, 372 containing the petitioners’ allegations of corrupt practices against Osinbajo, in which they accused him of allegedly inducing voters with government funds, not appropriated or approved.
PEPC’s Presiding Justice, Justice Mohammed Garba said he agreed with the argument by applicant “that this court lacked the powers to try allegation of spending of government’s money not appropriated for or approved.”

The PEPC has acceded to the request by President Muhamadu Buari for the striking out of a witness statement written by former Aviation Minister, Osita Chidoka, in support of the petition by Atiku Abubakar and the PDP.

Chidoka served as the National Collation Officer of the PDP during the last presidential election and testified as a star witness for the petitioner.

The leadership of the Movement for the Actualization of Sovereign State Of Biafra (MASSOB) on Monday said the approval of international airport by President Mohammadu Buhari for the governor of Ebonyi State, David Umahi, is a distraction to Ndigbo.

The group made this known through a press statement signed by the National Director Of Information, MASSOB, Comrade Edeson Samuel and forwarded to DAILY POST in Abakaliki, the capital of Ebonyi State.

The statement reads in part: “Ndigbo should rise and reject the systematic, organized and subjective plan to frustrate our people in every segment of our lives.

“The closure of Akanu Ibiam international Airport, Enugu without any budget or time frame on when and how the repair and rehabilitation will be done is another damnable and smearing slap on Ndigbo.

“The president Mohammad Buhari led APC federal government is very biased and partial against Ndigbo. Buhari has no regards for Ndigbo. MASSOB view the approval of Abakaliki international Airport as nothing but to divert the attention of Ndigbo with his divide and rule syndrome.

“Though MASSOB thinks that the approval of Abakaliki International airport that is about 30 kilometres away from Enugu International airport as an infrastructural development that will boost economic growth and development of Igbo land if it is done in good fate.

“Still MASSOB will never cover up an intelligence report from Biafra Intelligence Agency (BIA) from insiders of Nigeria government on how President Buhari is using the governor of Ebonyi state, Engr David Umahi to destabilise Igbo land.

“It is clear that the Ebonyi state government has been working for President Buhari because of the agreement they reached before the 2019 general election that he will back Engr David Umahi’s presidential ambition in 2023.
“How can the governor of Ebonyi state visit President Buhari and minister of Aviation at Aso villa concerning security challenges in Southeast and the closure of Akanu Ibiam International airport, Enugu. A day after, President Buhari’s federal government announced the approval of Abakaliki International airport in the same south-east while the existing one in Enugu was closed down just to punish Ndigbo.

“The information reaching MASSOB also made it clear that the plan of Engr David Umahi and President Buhari is to return Akanu Ibiam International Airport to local airport with a mockery state and subsisting it with the so-called Abakaliki International airport which may not be complicated in the next ten years. This divisive syndromes of both external and internal enemies of Ndigbo must stop now.

“South East governors forum and other relevant political leaders of Igbo land must as a matter of urgency sit up and be effective in discharging of their duties as a body.



“How can only Engr David Umahi alone visit Mr President and Aviation minister on such matter of Igbo interest without his colleagues and other stakeholders of Igbo land? Ndigbo and our interest is too big for one man to represent in such high and sensitive matters” they group stated.

In a swift reaction, the Senior Assistant to Ebonyi state governor on internal security and utility of Ebonyi North, Hon. Ben Nwosu, dismissed as wrong insinuations of some persons that Ebonyi state was not ripe for an international airport, described such thinking as primitive and uncivilized.

“The international airport to be built by the administration of Governor David Umahi remains the best thing that could happen to the people of Ebonyi state. Since 2015 when governor Umahi assumed office as the governor of Ebonyi state, he has bequeathed a legacy that surpassed the previous two administrations.

“The international airport to be built by our indefatigable governor is a legacy that would stand the test of time. Anybody who is against the project is of course against the development of Ebonyi state and the generation yet unborn.

“That we have an international airport at Enugu does not in any way translate to development in Ebonyi state. With the completion of the airport before the expiration of the incumbent administration, Ebonyi state will become a cynosure that people from other states would continue to emulate. So like I said earlier, any Ebonyi citizen kicking against the international airport is not wishing the people of the state good” he stated

The Chief Justice of Nigeria, Justice Tanko Muhammad, has been operating from his Chambers, instead of his designated office, since January 2019, when he became the Acting CJN.
He continues to operate from ‘Chambers 1’, his old office as a Justice of the Supreme Court, despite his swearing-in by President Muhammadu Buhari as the Substantive CJN, on July 24.
Journalists visited the CJN’s wing at the sprawling Supreme Court Complex, and found out the place has been deserted since Justice Muhammad assumed office as the Acting CJN, on January 25, 2019.

President Buhari swore-in Justice Muhammad as the Acting CJN on the same day he controversially suspended the immediate-past CJN, Justice Walter Onnoghen, based on an exparte order of the Code of Conduct Tribunal, CCT, that has been discredited by the Court of Appeal.
The Police, on January 28, 2019, the first work day after Onnoghen’s suspension, sealed off the CJN’s office and other adjoining ones, ejecting administrative staff.
The move was seen as pre-empting any possibility of Onnoghen accessing the office after his suspension.
Justice Muhammad continued to operate from his Chambers as the Acting CJN, even after his first three months of acting was renewed for another three months by the National Judicial Council, upon Buhari’s request in April.
He has remained in his Chambers after his  inauguration as the substantive CJN, on July 24, 2019.

The Chairman of Nigeria Governors Forum and Ekiti State Governor, Dr Kayode Fayemi, has said that there was no evidence that a building existed on a disputed land in Rainbow Town, Port Harcourt.

Fayemi’s remark is coming on the heels of claims that a mosque built on the disputed land was demolished by the Rivers State Government.

The Ekiti State governor during a joint assessment of the land with his counterpart from Rivers State, Chief Nyesom Wike, on Sunday, said, “With what I have seen, I cannot see any evidence of any building that has been demolished here. From what I have seen here, I think it is a storm in a tea cup,” the NGF chairman added.

The Peoples Democratic Party (PDP) has reviewed the video of the media interview by the Minister for Information and Culture, Alhaji Lai Mohammed, and surmised that President Muhammadu Buhari should save the judiciary and the nation further troubles by immediately throwing in the towel and vacating the presidential seat following the official admission that he (Buhari) does not possess a WAEC certificate, contrary to his claims and disposition before the law.

Our party mocks the Buhari Presidency for pushing out the video wherein the Minister pleaded with Nigerians to pardon President Buhari over his false WAEC certificate claims.

PDP notes the deliberate ploy of Alhaji Lai Mohammed to appeal to sentiments, seeing that Mr. President had failed to defend himself before the Presidential petition tribunal.

The party berates the Buhari Presidency for believing that in pushing the video into the public space, it could influence the mind of the tribunal to bend the law after solid evidence have been presented before it against President Buhari.

The PDP holds that the pronouncement and appeal for pardon issued by the government’s spokesperson, who is also a lawyer, is a direct guilt plea, which cannot save President Buhari from the course of justice in this matter.

From the official pronouncement by the Minister on a national television, it is no longer in dispute before all Nigerians that President Buhari does not possess the educational certificate he claimed in the affidavit he deposed to in his Presidential nomination form.

In this latest shenanigan, President Buhari and his handlers ought to have known that the law, which the judiciary is bound to uphold, is a respecter of no man.

The PDP reminds President Buhari of how his Presidency vehemently applied the law in similar circumstance to remove a head of an arm of government; a situation, which renders his plea for pardon a complete nullity before the law.

The PDP holds that if President Buhari indeed seeks for pardon from Nigerians, he should do the needful by toeing the path of honour and vacating the Presidential seat without further delay.

It is disheartening that President Buhari and his All Progressives Congress (APC) would put our nation through the troubles of legal hassles when they knew all the while that they were building something on nothing.

The PDP therefore urges the Judiciary to consider the evidence before it and rescue our nation by expediting its verdict to point to nothing other than the justice of the matter in the Presidential election petition.

Following the xenophobic attacks on Nigerians and Nigerian businesses in South Africa, the Oodua Youth Coalition, OYC, has given South African-owned companies and businesses seven days ultimatum to leave Nigeria.

In a statement made available to Us which was signed by the group’s President, Oluyi Akintade Tayo, the refusal of those concerned to yield to the notice to quit will spell doom.

While expressing disappointment over the attitude of South Africans against Nigerians living and working in South Africa, particularly what it described as the continued silence of the South African government over the development, the group stressed that during the apartheid era, which was the trying time of the rainbow country, Nigeria stood solidly with them.

The statement reads, “Oodua Youth Coalition (OYC), the foremost youth group in Nigeria projecting and protecting the Yoruba nation in the country, is saddened and angered that South Africans, supported by the country’s authorities, is coordinating the looting and burning of Nigerian businesses and maiming and killing of our brothers and fathers in the land.

“It is unfortunate that South Africa, who under the apartheid regime had the support and solidarity of Nigerians and the government while the white supremacists reigned supreme, is now turning around to inflict physical and psychological pains and injuries on the people whose parents committed a large part of salaries and earnings and commonwealth to end the apartheid reign.

“The video in circulation wherein Mr. Bongani Mkongi, the South African Deputy Police Minister, defended the attacks on Nigerians and other Africans confirmed our earlier fear and doubt on the culpability of the South African authorities. It is baffling that the country whose former leader, late Nelson Mandela recognised the efforts of Nigeria in enthroning South African led government is forcefully and shamefully ejecting other Africans mostly Nigerians from the country.

“We have condoned the excesses of these South Africans whose businesses have been thriving in Nigeria without any form of physical and psychological attack. For months, the coalition has written several letters to the South African consulate in Nigeria requesting for meetings to chart a way forward and find a lasting solution(s) to these barbaric, unfortunate incidents yet have been ignored or met a brick wall.

“OYC, after an emergency meeting, has concluded plans to, as a matter of urgency, attack all South African businesses and facilities spread across Nigeria especially in the Southwest region of the country. DSTV, MTN, SHOPRITE, STANBIC IBTC, and other outlets are our targets.
“We, therefore, give these South African businesses a maximum of seven days to leave Nigeria or forget them as our coalition, with other groups and comrades across the land, will attack and burn them to ashes,” the statement read.

The PDP expresses shock at the abduction and condemned it as cowardly and reprehensible.

The party describes the abduction of the Youth Leader as a national challenge and a direct attack on the body of the nation’s youth population, which he symbolizes. It cautioned that the development is capable of aggravating the already tensed security situation in the country if not confronted with corresponding security response.

Moreover, the party is particularly worried about the safety and lives of the Youth Leader and his staff, who was also abducted by the gunmen.

The PDP therefore charges the top command of the Police, the DSS and the military to step into the issue with full force to ensure the immediate release of the Youth Leader as well as track down those behind the dastardly act.

The PDP notes that Hon. Udeh-Okoye has always been at the forefront in efforts towards the development and wellbeing of the youth across the nation and urged the security forces to leave no stone unturned to secure his release.

The party laments the pervading insecurity in the nation and urges the Security authorities not to relent in their efforts and sacrifices in combating acts of terrorism and violence against innocent citizens.

The PDP appreciates the outpouring of concerns from well-meaning Nigerians over the development, even as it urges its teeming members and supporters, particularly the youth, to remain calm as the security forces up their rescue efforts

South Africa’s president, Cyril Ramphosa has finally issued a statement on the ongoing escalated attack on Nigerians in South Africa.

The president in a video shared via his official twitter account says he condemns the violence that has been spreading around a number of provinces in the strongest terms.

He says he is convening a meeting of ministers in the security cluster today to ensure they keep close eyes on the violence and find ways of stopping them.

He says, ”The people of our country want to live in harmony; whatever concerns or grievances we may have, we need to handle them in a democratic way. There can be no justification for any South African to attack people from other countries.
