Consequent upon the rising incidents of bomb explosion in the country, Lagos State Governor Babatunde Raji Fashola Thursday issued a 14-day ultimatum to effect removal of all abandoned vehicles within the state secretariat and other strategic government premises.

Fashola’s directive was contained in a circular signed by the state Head of Service, Prince Adesegun Ogunlewe, thereby prohibiting incessant parking of vehicles at government premises over the weekend and abandoned vehicles, which it said, posed security risk.

According to the circular, in consideration of the recent spate of bombing and threats to public infrastructure, there is need to re-emphasise and sensitise public servants on security consciousness. Suffice to say that, the report emanating from the routine patrol of the Old and New.

The circular said the Rapid Response Squad (RRS) had indicated that some members of staff, their relations and friends “have cultivated the habit of tuning the secretariat into a garage for parking their vehicles, particularly during the weekends and public holidays. All these, if unchecked may serve as safe havens for evil minded people.


“In the same vein, it has also been reported that different categories of vehicles mentioned have been found to be abandoned at various car parks within the old and new secretariat. These vehicles constitute public nuisance within the environment. Hence, there is need to curb this practice for security purposes.

“Also, there are private owned vehicles that carry Lagos State Government official plate number. This is indeed a serious criminal act. It is disheartening that some public servants engage in this act which causes embarrassment to the state government when such vehicles are involved in traffic offences.

“Faulty government vehicles, some with government plate numbers and some without, but with the inscription of names of ministries, parastatals and departments that own them are usually found abandoned within the Old and New Secretariat complex. Consequent upon the foregoing, it is hereby re-emphasised that officers should desist from affixing government plate numbers to their private vehicles.

“Furthermore, MDAs are hereby advised to repair faulty vehicles or forward the list of such vehicles to the Public Service Office for consideration for boarding or assigning them to other agencies that can properly maintain them and put them to beneficial use,” he said.


Continuing, he said the: “Abandonment of unserviceable vehicles within secretariat, either during the week days, weekends or public holidays will no longer be tolerated. MDAs and individuals are hereby given a 14-day ultimatum to remove all abandoned unserviceable vehicles from the secretariat complex. At the end of this ultimatum, such vehicles will be towed away by security personnel.”

The circular further stated that all government officials coming into the secretariat during public holidays and weekends should henceforth be introduced and be identified in writing with a photocopy of identity card of the recipient affixed to the letter.

The circular also urged members of the State Executive Council (SEC) and permanent secretaries to identify themselves at the gate as most security men at the gate might not be able to identify them due to frequent change of portfolios.

Second son of the late business mogul and politician, Chief MKO Abiola, Deji, who is standing trial before an Ikeja High Court on a one-count charge bordering on stealing by fraudulent conversion, has opted for an out-of- court settlement with the Economic and Financial Crimes Commission (EFCC).

When the case came up yesterday before Justice Adeniyi Onigbanjo, Deji’s lawyer, Mr. Jimoh Lasisi (SAN), expressed shock that the prosecution was not in court and informed the court that his client had reached an agreement with the anti-graft agency.

“I am surprised that the prosecution is not in court today. There are moves to settle the matter out of court which almost got finalised yesterday but for some reasons we could not conclude,” he said.

Lasisi thereby applied for a date to enable the parties finalise the settlement, which, according to him, was almost concluded.

Onigbanjo who earlier stated that there was a pending application before the court, endorsed his application and fixed December 1 for mention of the suit. Deji was alleged to have on May 24, 2008 collected N35.5 million from one Mr. Jide Jose, under the pretext of importing printing machines from Switzerland.

The agency had alleged that he collected N35.5 million from Mr. Jide Jose on May 24, 2008 after promising to supply him printing machines from Switzerland but never imported or supplied the machines, but converted the money to his personal use.

The alleged offence contravenes Section 390 (7) of the Criminal Code Law, Cap C17, Laws of Lagos State, 2003.
Abiola had pleaded not guilty to the charge and was granted bail.

Justice Mojisola Dada of a Lagos High Court has fixed January 30, 2012 to deliver judgment in a criminal suit instituted against the former Chief Security Officer (CSO) to the late General Sani Abacha, Major Hamza Al-Mustapha, and Alhaji Lateef Shofolahan over the assassination of Alhaja Kudirat Abiola.

Adopting his 112-page written address dated September 16, 2011, the defence counsel, Mr. Olalekan Ojo, told the court that there was nothing unlawful in what Al-Mustapha did when he (Al-Mustapha) learnt that the property of Abacha was to be burnt and sent Rabo Lawal to find out and contact other security agencies in Lagos State to protect the property.

He submitted that the case was just one of the four legal suits filed by the Lagos State Government against some members of the Nigerian Army and the Police that served during the regime of Abacha as head of state.

He stated that the same star witnesses were used by the prosecution, namely Sgt Banabas Jabilla aka Rogers and Abdul Mohammed (aka Katako), adding that the court, including the Court of Appeal, had declared that they were not credible witnesses.

He submitted that the defendants had identified five issues for determination, namely:

• whether or not PW2 (Sgt Banabas Jabilla aka Rogers) and PW3 (Abdul Mohammed (aka Katako) who are the star witnesses for the prosecution are credible and reliable witnesses whose evidences are to be accepted and relied upon by the court having regard to their contradiction in their evidence as well as inconsistencies between their testimonies.

• what is the evidential value of the extra-judicial statements made by defendants and the extent they can be used by the court in the determination of the suit?

• what is the evidential value of the testimony of PW4 (DCP Yusuf) who did not conclude his evidence-in-chief and who could not be cross-examined by the defence before the case of the prosecution was closed?

• whether or not the prosecution has proved beyond reasonable doubt the count of conspiracy to murder late Kudirat Abiola having regard to the quantity and quality of the evidence adduced by the prosecution.

• whether or not the prosecution has proved beyond reasonable doubt count of that any of the defendants killed Alhaja Kudirat Abiola on June 4, 1996 having regard to the totality of the evidence before the court.


Ojo submitted that “where there are contradictions in the evidence of a witness, the court should not attach any credibility to such evidence. The court should indeed reject it and declare it unreliable. We have attacked the credibility of Sgt Jabila aka Sgt Rogers on two grounds, in that he gave two inconsistent evidence in court. During cross examination, he started to sing different song and refuted his evidence in chief.”

He stated that some powerful individuals who wanted Al-Mustapha punished should be satisfied that 13 years in prison were enough punishment for whatever wrong he might have done to them.

Ojo further submitted that both Rogers and Katako gave conflicting statements when they refuted their evidence-in-chief that they were told to lie against the defendants, adding that these contradictions had rendered their testimonies irredeemably bad and should not be relied upon by the court.

He reminded the court that on June 4, 1996 when Abiola was assassinated, Sgt Rogers told the court that he was at Abuja, while Katako also said he was in his village, Azare, in Bauchi State.

Ojo maintained that having regard to the totality of the evidence before the court, it could not be said that the prosecution had proved its case beyond reasonable doubt.


He added that the proper decision the court should make was to acquit and discharge the defendants.
In the case of the 2nd defendant, he said: “Even without the 2nd defendant requesting the investigating officer to either produce a person from the household of Chief MKO Abiola to confirm whether he had ever worked as protocol officer or in any capacity in that household but they never did.”

He added that the 2nd defendant admitted that he worked for Hope 93 and that after the organisation was disbanded, he went to his private business, adding that the allegation filed against him came almost two years after he left Hope 93.

He said there was nothing placed before the court to show that there was conspiracy or murder charge.
“Where the totality of the evidence is consisting of both innocence and guilt; where there is a 50/50 chance, the court of law would not take that as prove beyond reasonable doubt,” he stated.

He urged the court to dispense justice without fear or favour saying: “We know your lordship will not convict any Nigeria on the bases of conjecture, rumour or hatred. I urged the court to acquit and discharge the defendants.”

In his reply, the Solicitor General of Lagos State, Lawal Pedro, told the court Sgt Roger (PW2) had earlier told the court how he killed late Kudirat, adding that there was circumstantial evidence that linked the two defendants with the prosecution witnesses.

He submitted that each of the defendants might not have shot Abiola or be present at the time she was shot yet, they could be found guilty for her murder.
Pedro submitted that it was the information provided by the 2nd defendant that enabled them to trace and shoot her.

He argued that there was a meeting of the minds between Rogers, Katako and the defendants and urged the court to take judicial notice of the reign of terror that pervaded the country when Abacha was the head of state.

He further urged the court to take judicial notice of the extra-judicial statements made by Al-Mustapha and Shofolahan, adding that these showed evidence of motive to murder Kudirat.

He urged the court to hold that the prosecution had proved the case of conspiracy and murder against the defendant and convict them accordingly.

Nigerians are used to worrying about such amenities like bad roads, light, water, security, poor salary, poor health services among others. NOW, football has joined to their worries.

The low level that Nigerian football has played itself into can better be imagined. Confederation of African Football, CAF, yesterday shortlisted players for the 2011 CAF African Footballer of the Year Award with no Nigerian named. They are not to blame. No Nigerian player merits to be named.

The award has eluded Nigerian players in the past 10 years. Nwankwo Kanu won it last in 2000.

But a Nigerian, Kalu Uche of Enyimba, got listed in the home-based players also called Caf African Player of the Year.

Interestingly, however, three Ivoriens – Yaya Toure of Mancity, Didier Drogba of Chelsea and Gervinho of Arsenal were named in the tent ative list. Ghana also got its full honours with Asamoah Gyan of UAE side, Al Ain, Andre Ayew of Marseille and Kevin Prince-Boatengof AC Milan.

Ubiquitous Samuel Etoó Fils of Cameroon and Anzhi was also named.

Others named for the award are Morocco’s Adel Taarabt, Moussa Sow of Senegal and Mali’s Seydou Keita.

The Ivorian trio and their counterparts from Ghana were nominated for helping their countries qualify for the 2012 Africa Cup of Nations without a defeat.

Sow, who won the French Ligue 1’s top scorer award in May, was rewarded for helping Senegal return to Africa’s flagship competition, the Africa Cup of Nations, after edging past favourites Cameroon.

Eto’o, who won the award for the fourth time last year, was named despite failing to help his club and country to achieve anything significant this year.

The list will be whittled down to three before the winner in named in December.

The winner will be decided by votes from coaches of all the African senior national teams.

The awards ceremony will be held in Accra on 22 December.

Meanwhile two Tunisian players were named in the Best African Player on the Continent category.

Oussama Darragi and Youssef Msakni, who play for Esperance, were shortlisted for helping their club to reach the final of the African Champions League.

Zimbabwean striker Edward Sadomba was also nominated in this category for his contribution to Sudanese side Al Hilal who reached the semi-final of the Champions League.

It will be the third time the Ghanaian capital will be hosting the annual event after 2006 and 2009.
