The Oyo State governor, Seyi Makinde, has won at the polling units of his biggest contenders in the governorship election – Teslim Folarin of the All Progressives Congress and Adebayo Adelabu of Accord Party. Makinde polled 196 at Idi Ose, Ona Ara Local Government Area to defeat Folarin at his polling unit. Folarin polled 89 votes while Adelabu polled 6 votes. Makinde of the Peoples Democratic Party also polled 60 to defeat Adelabu of Accord Party, who scored 38 at polling unit 10, Ward 9 in the Ibadan South East Local Government area of the state. Folarin had 22 votes. Meanwhile, Governor Makinde won his polling unit for his party. Makinde voted at Ward 11, Unit 01, Abayomi Iwo Road in the Ibadan North East Local Government Area. The PDP got 174 votes while the APC scored 28, Accord Party scored five, and Labour Party got three votes. Sir, what do you make of this administration’s established propensity to always put the cart before the horse, in making major polices that should be backed by law. What is becoming the norm at the federal and state level is, pronounce the policy first, then scramble around for the enabling law? The nation was under all manners of military dictators for close to three decades. Even though civil rule was restored 21 years ago, the leading characters in the democratic structures are either former military rulers or those who had served under them. In fact, there was a time the President, the mnister of defence, minister of police affairs, national security adviser, chief of staff and chairman of the ruling political party were all retired generals. So, the civilian government was a quasi military regime. Even though the number of former military rulers has been reduced the mindset of the political and security chiefs has not changed. Public officers are still sacked with immediate effect while people are detained for months or years without trial. The Buhari administration has never hidden its disdain for the rule of law. In some interviews President Buhari has expressed frustration with the slow speed or the accountability prerequisite of a democratic dispensation. The regime has openly justified disobedience of court orders under the pretext of defending national security. It does not seem to appreciate that the security of the State is maintained under the rule of law. Even when the regime was compelled to release Omoyele Sowore and retired Colonel Sambo Dasuki from illegal custody last December based on court orders. it came out to say that it was an act of compassion or generosity. With such praetorian mindset the regime does not consider the legal implications of its actions and policies. Since the dramatis personae in power believe in the rule of might, the government is bound to take decisions without the backing of the law. We are ruled by individuals who believe in the rule of rulers and not in the rule of law. You no longer sue government for illegality and unconstitutionality of actions, with the same frequency of the past, unlike your mentor, late Gani Fawehinmi, who didn’t stop taking government to court until his death. You appear to have mellowed into advocacy and jurisprudential guidance. Why? I am afraid your information is not correct. Recently, a bunch of paid lumpen elements staged a protest against me in Abuja for purportedly using the courts to blackmail the federal government. Can you believe that? The fact is that due to increasing wave of official impunity of the government, I have filed more cases in court than ever before. Unlike in those days when all our public interest litigation cases were dismissed for want of locus standi the situation has changed due to our persistence and doggedness. We have recorded some huge success in using the instrumentality of the law to challenge official impunity in the country. For instance, our law firm won the case over the right of every child to free and compulsory basic education at the expense of the State. We have won the case to have the People’s Bank restored. We have won the case that stopped a contractor from collecting cerpac fees from all expatriates in Nigeria. We have won the case against the regulation banning police women from marrying suitors of their choice without written permission of a commissioner of police. We won the case against obtaining police permit for rallies and demonstrations by aggrieved citizens and groups. At the same time we have lost many cases while others are pending in courts. One of the cases which we lost at the federal high court has to do with the right of Nigerians to basic health. The case was struck out due to lack of locus standi. We are pursuing the appeal in view of the threat posed to the health of all citizens by the coronavirus pandemic. In many instances, our public comments and those of others have forced governments to reverse certain illegal policies and unpopular programmes. In such circumstances, we have refrained from going to court. I am sure that is what you mean by saying that I have resorted to advocacy and jurisprudential guidance. The presidency of Major General Muhammadu Buhari rarely yields to advocacy and plea, which possibly explains the refusal to withdraw soldiers from COVID-19 regulations enforcement duties despite the killing of innocent Nigerians with their guns. How does one tune the ears of a government like this to the voice of reason? Whenever the people have persisted in their demand or agitation the regime has been forced to change its position. For instance, the regime had supported the State Security Service in the illegal incarceration of Mr. Omoyele Sowore. But when the demand for his release in and outside the court was intensified the regime caved in and released him. Colonel Sambo Dasuki, who had been held for four years was also released. Even with respect to the coronavirus pandemic the regime had said that President Buhari would not address the nation. But when the demand continued the President had to make a broadcast. The soldiers will be withdrawn from the streets if the pressure is mounted on the regime. While Covid 19 has claimed 6 lives the securify forces have killed 13 people. But for the lockdown I would have rushed to court. I am sure you would recall that I got the federal high court to restrain the armed forces from subjecting Nigerians to the so called positive identification parade last year. Your regular interventions in public matters suggest two things: it is either the government operators are naive in the matter of constitutional democracy or they just want to be deliberately unconstitutional in their ways. Are dangerous precedents not being set sir and is this not a pointer to the quality of men being elected into public offices? I have found that many actions of governments are not borne out of mischief. They are based on sheer ignorance. You may call it political naivety. That is what is playing out in the United States where President Donald Trump exhibits such degree of ignorance mixed with arrogance. Contrary to the Linconian definition of democracy as a government of the people by the people and for the people, bourgeois democracy is generally a government of oligarchs or cabals. The crisis of governance is more problematic in a country like Nigeria where democratic structures are weak and the people are not conscious of their rights. With respect, we are largely ruled by ignorance and incompetence. And you know that power mongers who are ignorant are incompetent. Hence they resort to impunity. That is what leads to corrupt practices in the criminal diversion of public funds, rigging of elections and setting up of a government without regard, in utter breach of constitutional or statutory guidelines. No regime can change the status quo without involving the people in governance. The West, particularly, America, returned a damning verdict on the 2019 poll, indicting the military heavily. Since this administration appears to always step out of line in the matter of military deployment, what are those concrete steps, in definite terms, that could be taken by stakeholders before a degeneration would lead to a catastrophe? The West should not be the barometer for measuring credible elections in Nigeria. Many local organisations have meticulously exposed the monumental fraud that was perpetrated during the 2019 general election. The most disturbing aspect of the fraud was the use of armed soldiers by the ruling party to intimidate voters. Under the Jonathan administration, the APC filed three cases against the use of soldiers in elections. The APC won the three cases. Little did we know that the APC was looking for power to use armed soldiers to rig elections like the PDP for whom an election was a do or die affair. The dangerous trend is going to continue unless the Electoral Offences Tribunal is set up to deal with the riggers and manipulators of elections. More importantly, politics has to be redefined so that political parties can be positioned to serve the interests of the people. Right now, politics has become a cheap avenue for self enrichment and self aggrandisement. It has nothing to do with public service. Have you seen enough transparency in the distribution of palliative at the federal and state levels, particularly the open money-sharing venture of agents of the central government? The federal, state and local governments were not prepared for the kind of emergency that the nation is going through. The mechanism put in place for reaching out to the people under the Special Adviser on Social Investment, Mrs Maryann Uwais, has been abandoned by those who wanted to abolish the programme. The cash transfer policy of the federal government was ridiculed by the media, neoliberal ideologues in the government and the private sector people. Some of the business tycoons who are indebted to the Asset Management Corporation of Nigeria (AMCON) to the tune of over N5 trillion have questioned why a loan of N10,000 should be given out to a rural person. Those who ran commercial banks aground and plunged the country to toxic debts conspired to scrap the People’s Bank. Even though the federal high court has ordered the federal government to restore the bank the neoliberal handlers of the economy have continued to frustrate the revival of the bank. But the same people are now contributing to the fund being packaged by the federal government to cushion the negative impact of the coronavirus pandemic on the poor and vulnerable segment of the society. Having abandoned the people the governments cannot effectively manage the palliative. Oyo State governor, Engr Seyi Makinde has said that the state doesn't need to go the Lagos, Ogun, Osun and Ekiti way on total lockdown before the spread of coronavirus can be curbed. Makinde said during a phone call conversation to a popular radio station in Ibadan on Tuesday. The governor who reiterated that everything that can be done to prevent the spread of Covid-19 in Oyo State is on the table, that the government will continue to assess the situation and take additional measures where necessary. Quoting the governor verbatim, he said "Yes, Lagos can be on lockdown, Ogun can be on lockdown, Oyo State, yes, people have been saying have a total lockdown and then I have been asking them questions. What will be the benefits here? Are there alternative courses of action for us to take? If you ask people not to come out, you lock down the market places, there are people who what they sell today - the profit from today’s activities is what they will eat tomorrow. There are plenty of people like that within our environment. So, are there alternatives available to us? Can we do selective lockdowns? That’s why I imposed the curfew. "I think, everything is on the table but it has to follow a logical pattern and it will need the input of experts. We are not just going to lockdown because everyone is looking down. "I have been watching CNN and the most successful place right now in containing this is the Czech Republic. And one of the things they brought out is that they made a law that if you must leave your house, you must wear a mask. It may be that route for us to go. I have asked them to start evaluating that. If we must make that law and say everybody that must go out must wear a mask, then, how about those who cannot afford it. Can we make masks locally? Can we get our artisans and our tailors to commit to that with the government supporting? Zero deaths, zero hospitalisations, zero intubations DOCTOR Zev Zelenko is a doctor in New York who just wrote an open letter to President Trump and medical professionals around the world alerting them to a possible solution to the coronavirus. Zelenko says he has been treating patients with a drug cocktail and has seen some promising results. Specifically, he is claiming he has seen “zero deaths, zero hospitalizations, and zero intubations.” Remember, always talk to your doctor before you do anything. Zelenko wrote: To all medical professionals around the world: My name is Dr Zev Zelenko and I practice medicine in Monroe, NY. For the last 16 years, I have cared for approximately 75% of the adult population of Kiryas Joel, which is a very close-knit community of approximately 35,000 people in which the infection spread rapidly and unchecked prior to the imposition of social distancing. ALSO READ: COVID-19: US denies moves to recruit foreign professional medics As of today, my team has tested approximately 200 people from this community for Covid-19, and 65 per cent of the results have been positive. If extrapolated to the entire community, that means more than 20,000 people are infected at the present time. Of this group, I estimate that there are 1500 patients who are in the high-risk category (i.e. >60, immunocompromised, comorbidities, etc). Given the urgency of the situation, I developed the following treatment protocol in the pre-hospital setting and have seen only positive results: Any patient with shortness of breath regardless of age is treated. Any patient in the high-risk category even with just mild symptoms is treated. Young, healthy and low-risk patients even with symptoms are not treated (unless their circumstances change and they fall into category 1 or 2). My out-patient treatment regimen is as follows: Hydroxychloroquine 200mg twice a day for 5 days; Azithromycin 500mg once a day for 5 days; Zinc sulfate 220mg once a day for 5 days. The rationale for my treatment plan is as follows. I combined the data available from China and South Korea with the recent study published from France (sites available on request). We know that hydroxychloroquine helps Zinc enter the cell. We know that Zinc slows viral replication within the cell. Regarding the use of azithromycin, I postulate it prevents secondary bacterial infections. These three drugs are well known and usually well-tolerated, hence the risk to the patient is low. Since last Thursday, my team has treated approximately 350 patients in Kiryas Joel and another 150 patients in other areas of New York with the above regimen. Of this group and the information provided to me by affiliated medical teams, we have had ZERO deaths, ZERO hospitalizations, and ZERO intubations. In addition, I have not heard of any negative side effects other than approximately 10% of patients with temporary nausea and diarrhoea. In sum, my urgent recommendation is to initiate treatment in the outpatient setting as soon as possible in accordance with the above. Based on my direct experience, it prevents acute respiratory distress syndrome (ARDS), prevents the need for hospitalization and saves lives. Two Senior Advocates of Nigeria (SANs) Chief Mike Ozekhome and Mr. Femi Falana have disagreed sharply over lawyers’ reaction to the removal of immediate past Chief Justice of Nigeria (CJN) Justice Walter Onnoghen (rtd). Both men spoke during the ongoing Rule of Law Session of the 5th Nigerian Bar Association (NBA) Annual General Conference (AGC) at the Eko Hotel and Suites in Lagos. Ozekhome berated lawyers for not pouring out on the streets and shutting down government to protest Onnoghen’s prosecution and conviction by the Code of Conduct Tribunal (CCT). According to him, this was what lawyers in Pakistan did when former President Pervez Musharaf “unlawfully” removed the country’s Chief Justice. READ ALSO: IBA president to launch working group at NBA conference But Ozekhome received a sharp reply from Falana who reminded him that the Pakistani CJ was not unlawfully removed under a cloud of having unexplained wealth, just like Onnoghen. Julius Maada Bio, the president of Sierra Leone, has terminated the appointment of his chief of protocol (SCOP), Fatmata Kargbo, after she went to the Synagogue Church of All Nations (SCOAN) owned by Nigerian clergyman, TB Joshua, to testify of how God has favoured her. Kargbo was featured on Emmanuel TV owned by TB Joshua, testifying of how God favored her with her recent appointment as an aide to the president and how she has been able to complete her new house which she abandoned for many years. Showing photos of the luxury mansion she recently completed, Kargbo told the congregation that her story is now different. “I want to thank God for blessing me with this job as SCOP to the president of Sierra Leone, ambassador at large and the blessings that come with it. If you look closely at this picture you will see the luxurious house God has blessed me with. I was living in a single room apartment. But my story is now different,” Her testimony which was intended to show how good God is, sparked an outrage in Sierra Leone. President Bio was forced to terminate her appointment and ordered the country’s Anti-Corruption Commission (ACC) to invetigate her finances to ascertain the source of the wealth with which she managed to put up the structure within such a short time. A letter sent to Kargbo by the AAC says it will be looking through her previous asset declarations in line with Sierra Leone’s anti-graft law that requires public officials to declare their assets three months into office and three months after leaving. “The Anti-Corruption Commission has opened an official investigation into the conduct of the official and her testimony. We will also look at her source of wealth in acquiring her house and other properties. The Ekiti State chapter of a socio-political organization, Afenifere Renewal Group, ARG, has criticized Governor Ayo Fayose, for his appearance at the Federal High Court in Abuja in solidarity with the leader of the Indigenous People of Biafra, IPOB, Nnamdi Kanu, saying he has brought “governance to a ridiculous level” This is even as the governor has defended his action, saying he was at the court on Tuesday to demonstrate his belief that there should be justice for all irrespective of where they come from. The pan-Yoruba group also described the governor’s action as “assaulting the sensibilities of the Yoruba nation.” The Ekiti State Coordinator of the ARG, Bunmi Awotiku, said in a statement on Wednesday, that although Mr. Fayose enjoys constitutional immunity and fundamental human rights, the governor was abusing the rights. “Despite receipts of monthly statutory federal allocation, budget support funds, bailout funds running into billions of Naira, Ekiti workers are under the yoke of non-receipt of their monthly salaries and allowances,” he said. “The pensioners are not faring better; this is a governor displaying executive rascality all over Ekiti State and beyond. “He has brought governance to a ridiculous level. He can be excused for his own style of leadership and manner of delivery but there are well designed standards for the office which he occupies but which he brings to ridicule. “His recent solidarity visit to Nnamdi Kanu who has insulted and hold the Yoruba nation with disrespect is an executive rascality taken too far. Notwithstanding the political motive, his solidarity is an insult and affront to the true Omo Oduduwas at home and Diaspora. “Ekiti State chapter of Afenifere Renewal Group implores him (Fayose) to carry out his assignment with the fear of God and respect to the needs and yearnings of Ekiti people. We take exception to his determination to rubbish our valued heritage.” Mr. Awotiku noted that the ARG desired Mr. Fayose to face governance in Ekiti State, bring smiles to the faces of government workers both in the state and local governments, and make pensioners happy so they can enjoy the fruits of their labour. “This political rascality and razzmatazz must stop,” the statement added. Another pan-Yoruba youth group, known as the Progressive Youth League, PYL, has also knocked the governor “for abandoning serious business of governance in his home state to run a comedy show in faraway Abuja in a matter that does not concern him.” The State Coordinator of PYL, Adeoye Aribasoye, said the action of Mr. Fayose showed that he was idle and did not understand the seriousness of the business of governance. He said a lot of issues requiring the governor’s attention had been abandoned for a “needless trip to Abuja at the expense of tax payers.” He advised Mr. Fayose to resign from office if he is no longer interested in governing the people of the state, saying the office of governor was not meant for a person who cannot differentiate between serious issues and inanities. “Fayose’s action of going to the court in Abuja to show support for Kanu has nothing to do with the welfare of the people of Ekiti,” Mr. Aribasoye said. “It appears the man is not ready to provide governance for the people of Ekiti and we are calling on him to resign honourably. “There are many problems back home needing his attention; workers are owed arrears of salaries, institutions are owed subventions, there is infrastructural deficit and people are groaning under a harsh economic climate. “All these need urgent solutions and not junketing to Abuja for a needless showmanship, shadow boxing and grandstanding.” Reacting to criticisms on Wednesday, Mr. Fayose, while appearing on AIT, Abuja, said he would also be attending the trials of former National Security Adviser, Sambo Dasuki), and the leader of the Islamic Movement of Nigeria, Ibrahim El-Zakzaky. He said he would never support a situation where court orders, rulings and judgments were disregarded by the government. “The Federal Government are the ones making Kanu a hero. Anywhere in the world, agitation is normal. In the United Kingdom, there is agitation in Northern Ireland, even, United Kingdom itself is agitating in Europe,” he said. “Let people agitate for whatever reason as long as it is constitutional. I am not in support of the breakup of Nigeria. But when court grants bail to people, release them and allow them to attend their trials from home. “I have no personal relationship with Kanu but I have been consistent in drawing attention of Nigerians to the trend of not regarding court orders and rulings by the present Federal Government. “I am from the North, East, West and South of this country. I am a complete and detribalised Nigerian. I will attend the trial of Dasuki and El-Zakzaky too. Courts in the land and even ECOWAS Court directed that Dasuki be released but the government has refused to heed the call.” Asked if he was not playing with danger by associating with somebody charged with treason, Mr. Fayose said no court in the land had convicted Mr. Kanu or anybody of treason, adding that allegation would remain an allegation until a court established the facts.
