We can't ascertain which Open Bidding method they employed from the news, just pointed out the scenario under NCB. The process is an open process, so if the company submitted financial bids, most likely they have passed technical evaluation. That's the first thing to look at during the bidding process for works of this magnitude. The naming is part of the job description of the Evaluation team, when applying domestic preference. Also, I understand them quoting the lowest price during financial bids doesn't translate to 'lowest responsive bid', but they cited infractions and other offences which are serious offences against public procurement.

Malami as the Minister of Justice and AGF is a member of the National Council on Public Procurement according to the PPA 2007 (though not inaugurated inline with PPA 2007), now you see it ain't solely political but inline with the Act. So he has got influence there, the council supercedes the BPP(the public face of procurement in the country)!
