John Yusuf, the pension thief who five years ago, was given a slap on the wrist by Justice Abubakar Talba of the Federal Capital Territory High Court, for stealing N32.8billion police pension money, has finally gotten his deserved sanctions. John Yusuf The Court of Appeal Abuja Division on Wednesday jailed him six years and also asked him to refund N22.9billion. Justice Talba had sentenced him to two years in jail, with the option of paying a fine of N750,000. The judgment triggered national outrage. The ruling by the appellate court was the climax of the appeal by the Economic and Financial Crimes Commission which on April 26, 2013 approached the appellate court to set aside the judgment of the lower court. The five grounds of the appeal, bordered on the exercise of discretion of the Judge in imposing sentence on the respondent who pleaded guilty to the three count charge, in which he admitted converting an aggregate sum of over N24 billion of Police Pension fund into his personal use. The EFCC asked the Appeal Court to decide “whether the trial judge exercised his discretion judicially and judiciously when having convicted the respondent of a three count charge of conversion of over N3billion contrary to section 309 of the Penal Code, His Lordship imposed two years imprisonment with an option of fine of N250, 000 on each of the three counts”. Yusuf’s lawyers on 10 June 2015 raised a preliminary objection on the competence of the appeal for which they argued that the notice of appeal was filed outside the mandatory 90 days and therefore in contravention of s. 24(2)(b) of the Court of Appeal Act, 2010 (as Amended) and therefore urged the Court to dismiss the appeal. The Justices of the Court of Appeal, dismissed the preliminary objection on the grounds that; “Having considered the computation of time volunteered by both parties, the question to be answered was whether the day the Judgment of the trial court was delivered was to be inclusive in the computation of the mandatory 90 days for which a notice of appeal was to be filed? “That the day the Judgment of the trial court was delivered being the 28 January, 2013, was not to be included in the computation of the 90 days. “That since the day of the Judgment is not included, the 90 days starts running from the 29 January, 2013 and the 90 day will fall on a Sunday. “That by virtue of s. 15(2) of the Interpretation Act CAP 123, where the last day is a holiday, the counting shall continue until the end of the next following day which is not a holiday. “That since the 90th day was a Sunday and by virtue of s. 15 (5) of Interpretation Act, a Sunday is a holiday, the next day which the notice of appeal was filed is within time, hence the appeal is competent and is therefore allowed”. Ruling on the substantive matter, the Justices of the Court of Appeal held unanimously that the three counts involving the respondent (Counts 17, 18 and 19) clearly stated the amounts for which the appellant alleged that the respondent converted for his personal use. That the respondent pleaded guilty to the three counts and thereby admitted to the conversion of an aggregate sum of about N24billion to his personal use. The judges ruled that the sentence of the trial court, does not serve as deterrence to both the convict and others. Consequently, they ruled that the sentence is “hereby quashed and deserves to be reviewed as follows: *on Counts 17, the Respondent is hereby sentenced to two years imprisonment with an addition of fine of N20billion Naira; *on Counts 18, the Respondent is hereby sentenced to two years imprisonment with an addition of fine of 1.4billion Naira; *on counts 19, the Respondent is hereby sentenced to two years imprisonment with an addition of fine of 1.5billion Naira”. The prison sentence will run consecutively and the fine is to be cumulative. In a related development, the Supreme Court on March 9 dismissed the appeal by Onyia Ifeanyi, seeking to upturn his conviction and sentence to 7 years imprisonment on November 28, 2013 by the Federal High Court Enugu presided over by Justice M.L. Shuaibu ( as he then was) for the offence of obtaining by false pretence and being in possession of documents containing false pretence. Dissatisfied with his conviction, the appellant had lodged an appeal against it at the Enugu Division of the Court of Appeal, which affirmed the decision of the trial court. Still not satisfied with the decision of the appellate court, the convict proceeded to the Supreme Court. The Federal High Court in Lagos has sentenced former Independent National Electoral Commission (INEC) Administrative Secretary in Kwara State, Christian Nwosu and Tijani Bashir to seven years in jail. A High Court of the Federal Capital Territory has sentenced a former Taraba State governor, Jolly Nyame, to 14 years in prison without an option of fine. Mr Nyame was found guilty of 27 out of 41 counts of alleged diversion of public funds while he served as governor of Taraba State. He was charged by the Economic and Financial Crimes Commission (EFCC) for allegedly diverting N1.64 billion while he served as governor between 1999 to 2007. The judge sentenced the defendant to four different terms in prison, after finding him guilty of receiving gratification, obtaining public funds without due consideration, criminal breach of trust and gratification. The various sentences include a time of prison for two, five, seven and 14 years respectively. The judge Adebukola Banjoko however noted that the terms are expected to run concurrently, meaning he would serve 14 years in jail unless the conviction is upturned by a higher court. In the lengthy judgement that lasted over four hours, the judge narrated how several witnesses brought to court by both parties corroborated the allegation of fraud against the defendant. The EFCC presented various witnesses who alluded to the fact that Mr Nyame approved the diversion of various funds amounting to over N345 million to a company, Saman global, within five weeks in 2005, among other allegations. The Federal Executive Council on Wednesday approved N64.108bn for additional work on the Lagos-Ibadan Expressway. The additional work will be done on Section I of the road from Lagos to the Sagamu interchange. The Minister of Power, Works and Housing, Babatunde Fashola, disclosed this to State House correspondents at the end of a meeting of the council presided over by President Muhammadu Buhari at the Presidential Villa, Abuja. Fashola said the additional work would cover pedestrian bridges as well as toll plazas for that section in order to accommodate the changing nature of the road. He stated, “The council approved additional work on Section 1 of the Lagos-Ibadan Expressway. The council approved additional work on over 43.6 kilometres for N64.108bn, which cover pedestrian bridges and toll plazas for that section so as to accommodate the changing nature of that road. “Since its conception, so many new structures: religious institutions, factories, universities and increased human activities, have come up along that road. “The inherited design didn’t provide for these at all. The additional work is also to modify the quality of bitumen, polymer modified bitumen, in order to deal with the heavy cargo that passes through that road. “The first section is handled by Julius Berger. The second section under RCC, which covers over 80 kilometres, will come to council to incorporate similar work, including drainage work when we finish the procurement.” Fashola added that the council approved the award of the Subaila-Falala-Bini-Baku-Bauchi Road that connects Kano and Bauchi states for N4.578bn. The Minister of State for Agriculture, Heneiken Lokpobiri, said the council approved new 10 rice mills for the country at a cost of N10.7bn. He listed the states where the mills would be located as Kebbi, Zamfara, Benue, Kogi, Bayelsa, Anambra, Kaduna, Niger, Ogun and Bauchi. Each of the mills, according to him, will have the capacity to produce 100 tonnes of rice per day, and the private sector would manage them. Lokpobiri said, “Today, FEC approved the establishment of 10 very large rice mills to enhance the milling capacity of the rice value chain in the country. “Few years ago, it was reported that this country needed a minimum of 100 large mills. As of today, we have about 21, but the Federal Government, in its wisdom, decided that today we should approve the establishment of 10 new rice mills at the total cost of N10.7bn. He said the cost of the mills would be paid back within a given timeframe as would be agreed between the Bank of Agriculture and the rice mills. “The states will be 10. Nigeria, over 30 states are growing rice; in today’s memo, the 10 rice mills will be located across the six geopolitical zones in Kebbi, Zamfara, Benue, Kogi, Bayelsa, Anambra, Kaduna, Niger, Ogun and Bauchi states. “The capacity of the rice mills is 100 tonnes per day each.” The Senior Special Assistant to the President on Media and Publicity, Garba Shehu, disclosed that N10bn was approved to fight erosion in the country. He also said that $460m was approved to facilitate the usage of new buildings at airports. The Minister of Health, Prof. Isaac Adewole, said FEC also approved the licensing agreement between the National Institute for Pharmaceutical Research and Development and May and Baker Plc. This, he said, was in respect of scaling up commercialisation and marketing of Niprisan, a potent anti-sickle cell drug, for use in Nigeria. The minister explained, “As you might be aware, sickle cell disease is a common problem, particularly among blacks in Africa, South East Asia and Latin America, and it is estimated that about 25 per cent of Nigerians carry the sickle cell gene and over two million people have sickle cell anaemia, that is having the two genes combined. “And for many of them, when they are under stress, they take ill; what happens is invariably they develop severe bone crisis, they develop infection and some of them will die from this.” He added, “This drug was first used in Oyo State over 20 years ago and NAPRED conducted clinical trials to ensure that we are able to document that it was safe and efficacious, and the drug was licensed at an international organisation, which went into bankruptcy. “What we have done is to reactivate the product and it will now be marketed in Nigeria through this agreement, and we believe that the marketing and production in Nigeria will bring a lot of comfort to millions of Nigerians who are infected with the sickle cell gene.” Adewole said the council also approved the construction of a trauma centre at Federal Medical Centre, Owerri at the cost of N840.8m. He said the centre would be completed in 48 weeks. The minister said, “We expect that it will serve as a first-class centre of care for accident and trauma cases along the Port Harcourt, Owerri and Enugu axis, and will really change the dynamics of care in these areas. “The approval of Naprisan is coming on the eve of an approval granted by government for us to establish a department of traditional medicine in the Federal Ministry of Health. “This will be the first time that this will happen and that department will really provide us the leeway to research into many of our traditional products, and the first mandate of this department will be to look into the cure for malaria in our forest.” . |

I really want this present administration to live up to the change initiative they promise by looking into the big scam and corruption going on at the immigration office. They are really giving this administration a very bad outlook with the exorbitant charges in their office. if you intend doing your registration online you will not get your passport in three mounts since you refuse to come to their office to bribe them. Furthermore, charges ranges from 30-35k instead of the official fee of 8,500 for 30 pages for new passport and 65 k for loss passport. House we need to wage an online war against them. Operation say no to bribery and corruption must start from the Nigerian Immigration Service. |

Is it with my name or her fathers name. 2 If am to use her fathers surname as the level of registering for WES at what point are we going to indicate that the surname has changed in our quest for EE 3 Does professional certification add points eg CIPM, ICAN etc. |
