Isn't your first sentence the shame? Of course it is. I've not seen anyone saying he's not qualified. But for God's sake you can't be sitting as governor of CBN and contesting for president. Firstly, by Instituting the case alone and the manner he has surreptitiously taken this case has made Godwin Emefiele lose every credibility, that is if he had any.

Section 84(12) & its wahala. Every person in the Federal Executive arm is a political appointee excepting the President & his Vice.

In Oni v Fayemi, the Appeal Court ruled that while the Ministers are Public Officers, they are not employed in the Public Service of the Federation. The determination of Emefiele or any other public Officer will rest on the nature of their appointment.

3 types of employment are recognised in Nigeria;
A. Employment at will or servant holding an office at pleasure of employer, i.e. Master and servant relationship.

B. Employment by written contract of employment;

C. Employment which is governed by statute;

Ministers fall under Section A. (Their position isn't tenured and they can be fired at any time by the President without recourse to anything or anybody).

The CBN been a legislation of the National Assembly falls under C.
This is an employment with statutory flavour. The employment or termination is protected by statute or laid down regulations and it is usually tenured. However, the SC has said many times that employment with a Statutory body is not automatically clothed with statutory flavour but will be determined by the contractual terms between employer & employee in the letter of employment.

To have a statutory flavour, the appointment and removal of the employee must be defined in the enabling statute so that a valid determination of such employment is predicated upon the satisfaction of the statutory provisions. What it means literally is that: If the Senate does not support the President according to the CBN Act, the Governor will be reinstated if the President touches him.

I believe it is clear from the Act on screenshot below that Emefiele is employed in the Service of The Federation and should leave there 30 days before the date of election.

The question: Should The date of the election be 30 days to the Primary election or 30 days to the general election. A question for another day.

It's not a bad idea though, the whole arrangement is to reduce the number of aspirants that will go into the primary election proper. The party knows their serious contenders. I said here before that there's no way the Apc can conduct primary for 25 aspirants. The others are just donors at best. Even the pdp have reduced theirs to just Atiku, Wike and saraki according to a report this morning, but I don't know their own mechanism that will be used to weed out the other 12 aspirants.

For me I think Apc should reduce theirs to just Amaechi, Tinubu and Osinbajo for the primary proper.

We did not have the details of the meeting and my ground right from day one has been stated in my previous posts, 'the meeting shouldn't be about imposition of consensual candidate, most especially if it was Tinubu'...we both know Yorubas whip sentiments unnecessarily.

They can even auto-suggest that Tinubu and Osinbajo are not in good terms, thereby making osinbajo to apologise to Tinubu...you will understand what I'm saying very well if you are conversant with Yoruba culture

They even stylishly suggest or propose consensus and if Osinbajo or someone else declines on a lone train, they can easily blackmail such person emotionally hiding under the pretense that 'yoruba elders' are appealing to him but he's objecting the collective appeal of the Yoruba elders - we both know how their Amala politics goes.

Thank God they didn't come through all those channels and vices to distract Osinbajo (because up till now, I've not gotten the essence of the meeting).....

But all in all, they should just forget about playing all those old tricks and support the chosen candidate as may be necessary after the primaries.

Mw, note, Osinbajo is not a coward nor fearful of any one, he just needs to apply wisdom in anything he does, he gets briefs often more than you and I.

The quality of briefs he gets and the source can make or mar him. People like Kayode Ajulo should not be allowed in that capacity. I've watched him a couple of times on TV. He's too combative, aggressive and confrontational for my liking. It's not yet Apc vs pdp, this is yet a family contest and whoever wins it,can not win the general election alone.

Ajulo ran to the press to say he already has the communique of the said meeting, that it was to use the presence of the VP and others to adopt Tinubu as the consensus candidate from the zone. Why lie shamelessly? Just say you don't have the agenda of the meeting, simple!

I commend the south west Apc leaders for that meeting because it helped to douse tension. You can observe that the animosity has reduced amongst the various camps since then. It was almost boiling over.

The 3points made at the meeting were :

South west united to produce next president

All southwest Apc members are free to contest and must mind their use of language in the process.

The whole of southwest must unite for whoever becomes the candidate eventually.

By the way the VP took my advice because he consulted me. You can ask him. Lol.....
