But it's already been settled in United States v. Jesus-Casteneda, 705 F.3d 1117 (9th Cir. Jan. 30, 2013) (No. 11-10397) where the court ruled that : the issue of "first impression" concerning whether a confidential informant wearing a disguise (including “a wig, sunglasses, and mustache" ) during his testimony violated the defendant's Confrontation Clause and Due Process rights; few cases have considered the issue; circuit concludes that there "was no violation of the Confrontation Clause" based on witness safety concerns "and any due process violation was harmless," . I think the Judge in the Dasuki case erred as a matter of law, but different strokes for different folks, I guess. |

Below is a link and video to one of such testimonies where an informant and former member of the KKK for the U.S Government testified before Congress. His identity was known before hand and we all knew his name, but he was allowed to wear the mask to conceal his identity for those (majority of the rest of the world) who didn't previously know what he looked like . And after his testimony he was taken into the Federal Witness protection program, relocated, and given a new identity. It is not unusual for witnesses to be masked or hidden from public view when the defendant is someone as powerful as Dasuki and they fear retribution . It is sometimes done here even during Congressional Testimonies of Government informants/witnesses. What the Prosecutor need to instill in the heads of the witnesses is that if they for whatever reason get on the stand, under oath, and give alternate/false testimony than what they have previously provided the Government they will be charged with perjury and obstruction of Justice. The first person to get on the stand and chicken out should be made a good example of and hit with the stiffest sentence available under the law for perjury. In the interim, the Government should promise - and fulfill it's promise- to protect its witnesses with adequate security for upwards of a year or two and also relocate them anywhere in the country they wish to go,complete with new identities if they so wish (or deem it necessary). They should also be compensated financially. Anything other than full assurance of protection from the Government and they run the risk of blowing their own case if the witnesses get on the stand and choke when they remember how powerful and dangerous Colonel Dasuki is; capable of eliminating them from the face of the earth if he so wishes if he ever becomes a free man. |

Does Nigeria have any policy concerning how it handles the detention and Transportation of suspected criminals in its custody? I really doubt it does. Otherwise, Mr.Fani-Kayode will not be allowed such freedom as to get that close to anyone who is not part of his defense team. For example, what if this emotionally distraught woman attempted to break him out? What if she passed him a knife or handcuff key for future use? Nigerian security operatives need to do better. He was meant to be handcuffed, hands behind his back, and distanced from any non-member of his legal team. |
