Just curious, how do courts in developed countries handle the issue motion upon motion from defense lawyers to stall a case?
We don't entertain it, period! We throw it out IMMEDIATELY!!! Besides, if a lawyer tries it he risks getting sanctioned, losing his license, and disbarred. No lawyer out here is that foo*lish. You can't waste the time of the court or disrespect the Judge if you don't want your "life" to come to a screeching halt. Nigerian society just seems to have a problem with following rules, law and order.

Well, sensible people know the life expectancy of Nigerians is very low. Added to that is the stressful society, deplorable health facilities, dirty environments and other issues that ensure people don't live long. Getting to age 50 in Nigeria is like getting to age 85 in Western Societies.

x9ja1960:
I am not a lawyer but from a layman's perspective Mr. Joseph Dauda's request is not unreasonable. Why charge a man on same issues in two different courts? What is wrong in consolidating them into one, wouldn't it in fact save us the time and resources Justice Yusuf is complaining about? Except there is something else behind this whole drama...I don't see what the fuss is all about especially if the prosecutors are certain of their facts to nail the guy! In my opinion, having two identical cases running at the same time is fishy.
That is why you're a lay man. I do not know the rules on Jurisdiction in Nigeria, but this tactic is the best to keep bad men like Dasuki and co off the streets for a very long time. What you should be asking yourself is : Is it unconstitutional to charge him in two different courts? If it isn't, then what's the fuss? Personally, I feel the cases should be consolidated if they are in the same district. But, thinking from a Prosecutorial standpoint: If we are truly trying to send a message--- and we know the potential sentence upon conviction (based on current law) will not be a deterrent for future offenders--- then, yes, in order to get maximum consecutive sentences that'll make others think twice before carrying out such dastardly acts like Dasuki is accused of,we will ensure that he is tried in different court rooms. All these Defense lawyers are doing is making things harder for their clients if they are before upright and strict Judges who have no time for games. Let me tell you a story.

When I was a AUSA in D.C, this notorious Cocaine trafficker --- nice guy when you talked to him--- had investigations on him all over the country. Since we already had first dibs , other Jurisdictions (eager to close their investigations) were in favor of sending whatever evidence they had on him to me in lieu of transferring the case over for prosecution. At first I was interested, and I was even willing to cut him a break if he would plead out to 15yrs (instead of the mandatory life he would get if he lost at trial). Everything was looking like it would go that route, until his lawyer found a technicality that could have the whole case thrown out if care was not taken. All of a sudden this formerly "humble" drug lord did a turn around, and (along with his lawyer) became the biggest douchebags I had ever come across; blowing kisses to his supporters when he thought the Judge wasn't looking, smirking, laughing, sarcastic and personal insults from his lawyer etc All because he thought he was walking out of the courtroom at the end of proceedings. At this point the case had already been on for almost 4yrs. So, what did I do? I called the other Jurisdictions and told them I had no interest in their case and if they wanted justice then they'd have to get him themselves.

Eventually, the Judge ruled in his favor on the technicality and Sentenced him to "Time Served". As this man walked past me---thinking he was now a free man---he called me names and even threatened to come "see" me once he was free. I smiled because I knew he wasn't going anywhere.

As soon as the Judge hit the gavel setting him free from his court room, U.S Marshals stepped up and handcuffed the brute: he had warrants from 2 other Federal Districts. The Grand Juries had sealed indictments against him. Today, he's serving two life+15yr sentences.

Col. Dasuki can rot in jail if it'll bring sanity back to the system.

Bro, I have just one question for you, and the question is, come 2019 if president Buhari is defected would he concede defect? I doubt it!
Buhari is more Democratic than GEJ. He went to court everytime he "lost" (even though the world knew he was cheated and the elections were rigged against him each time).

Good luck Jonathan on the other hand tried EVERYTHING within his power to stay on as President. From trying to change the Constitution to set the path for life-time Presidency just three weeks after being sworn in, to bribing Politicians, local tribal Chiefs, and arming warlords during election season. GEJ was determined to burn the country but for the warnings from Western Countries.

You can try to distort history all you want, but some of us will never forget what a evil and deceitful man he truly was.
PoliticsRe: Judge Lambasts Dasuki’s Lawyer, Accuses Him Of Employing Delay Tactics by ISpiksDaTroof: 4:17am On Jun 07, 2016
kahal29:
Justice Hussein Baba Yusuf of an Abuja High Court and former President of the Nigerian Bar Association (NBA) Mr. Joseph Dauda SAN and counsel to former National Security Adviser, Col. Sambo Dasuki (rtd), monday engaged in uncomplimentary verbal exchange in the open court over the trial of Dasuki for alleged diversion of $2.1billion arms fund diversion.

The trial slated for monday could not however go ahead as senior lawyers present in court persuaded the judge to adjourn the trial to calm down the frayed nerves.

Dasuki through Dauda had filed a new application to consolidate the charges against him in two Abuja High Courts.

He claimed that the charges in the two courts constituted abuse of court process because they have same facts and figure and that he would be prejudiced if the two courts try him simultaneously.
However, immediately Daudu introduced the motion, Justice Baba Yusuf became angry and challenged him on what his client would suffer should the two courts go ahead with the trial.

The judge lambasted Daudu for employing delay tactics to shield Dasuki from trial, insisting that the tactic would not work in his own court.

Daudu’s insistence that the motion be determined one way or the other before the trial would begin further provoked the judge who vowed not to give any indulgence to Daudu or move to delay the trial.

“If you think the mission of this new motion is to delay the trial, I can assure you that it has already failed. I know your antecedents in this type of cases, filing frivolous, baseless and un-warranted motions to frustrate the court and trial of your client.

“I know the next motion you will file will be to ask me to withdraw or disqualify myself from this case, I will not succumb to your old fashion of doing things. It will not work in my court.

“I have over-indulged you and I am ready to go ahead with this trial today. I cannot be coming here to waste my time, I have granted you enough respect, this application is a disrespect to me.

“I have known you for certain things, if you have a court where people will dance to your tune, go to that court. I am not ready to dance to your tune.

“You are here with a dishonest motive as far as this motion is concern. The whole target is to frustrate the trial, but you will fail.

Tension rose to the peak when counsel to the federal government Mr. Rotimi Jacobs (SAN) announced to the court the he respected Daudu a lot as a senior colleague, a role model and former NBA President and ended up describing Daudu’s action with the motion as very unfortunate.

Attempt by Daudu to complain of insult from Jacobs to the Judge was rebuffed when Justice Baba Yusuf said “for your information a junior counsel can advise a senior one and that is my position.

“I have been accommodating all sort of nonsense, yet you are not ready to respect me. You are disgracing me as one who does not know what he is doing here.

“You are subjecting me and this court to public disgrace. When you come to court people are watching and we must behave, that is my advice for you.
Now this is what you call a Judge!!!

Kudos.

what's the correlation between your question and the topic at hand ? That aside is/was Gej expected to build houses for everybody in Otueke just because he's from that community ? Did Obj and Yar'Adua do so for their own communities ? Have you ever been to Bayelsa state in the first place or any swampy community in the Niger Delta ? It's bad to make fun of people just because they're not as privileged as you and yes I've slept in a "batcha" (that's what they're called) before
You're Nigerian, so I kinda expect Logic to be far from you, so I'll break it down.

The correlation is that I think it is ignorant of you to try to justify that disgraceful eyesore as something "constructed by private individuals along the route to their houses" as if they makes it okay. Then you want to tell me you've slept in one before. That wasn't my question. My question was: would you love to LIVE in one of those unelectrified water shacks? How you guys justify idi*ocy and mediocrity is just beyond me.

I don't know what your past Presidents did for their home communities, maybe as a young Nigerian you should get up off you butt and instead of coming online promoting silliness go do your own research and come provide us the answers?

Yes, I do believe GEJ shouldve built houses for his State residents. He had the funds, Nigeria had the funds, but instead he chose to split the monies with his cronies. Bayelsa is smaller than most counties here so there's no reason why it wasn't made into a first class city.

And yes, I have been to that area of Nigeria before. What on earth does that have to do with anything?

P.S: I understand English is not your first language, but can you please show where I made fun of the people that live in those shacks? Or is this just the typical Nigerian way of falsely whipping up sentiments when the facts are not on your side?

What the op posted there is called a "monkey bridge" and it's common all over Bayelsa state because of the massive sand filling necessary between roads and peoples houses due to the swampy/marshy nature of the terrain. It's always constructed by private individuals along the route to their houses and so I don't know what the sad op has to gain by lying that it's Gej who constructed this particular one or any other one for that matter. The op is obviously one of those people who blames Gej for their not having sense (i.e. mumurity) so I urge fellow reasonable Nigerians to forgive him.
Really?! Did you see the houses in the background? Would you like to live in one of those?
