Masterclass32: Unless Nigeria has the equivalent of our Second Amendment, I can only assume the Judge will deny the bail application. These lawyers are dolts, they basically admitted that their client is guilty. I can't believe the incompetence! In the United States -for example- we have the right to bear arms, form militias and fight the government if it ever becomes tyrannical ; I doubt Nigeria has such a law enshrined in its constitution. Nnamdi Kanu's lawyers should come up with better defenses. He is a very serious flight risk and no court serious about its business would risk releasing him even under stringent conditions. I doubt Nigeria has ankle-monitoring technology for its pre-trial defendants. And lets even assume house arrest---with armed guards--- can be arranged, where could be deemed reasonably safe enough for the Security Officers to be able to discharge their duties without fear of harassment or harm from his supporters? And lets even further assume something of that nature could be arranged (House arrest + armed guards) who gets to bear the guaranteed enormous cost of ensuring all the parties involved's safety? Taxpayers? The Government? Nnamdi Kanu? Because here in the United States, those arrested for minor crimes and placed on ankle-monitoring Pre-Trial Home Detention, are usually made to bear the monetary cost of the government having to take special measures to ensure their presence in Court till the conclusion of their case. Assuming he was charged in Britain for the same crime does he think he would have gotten bail? Because I can guarantee you that here in the United States, a U.S born citizen charged with a similar crime would kiss his freedom goodbye for at least a few decades from the very moment he was handcuffed in that hotel he was nabbed in. EgunMogaji: Because Justice Binta Nyako obviously doesn't know what she's doing. She made a very, very, disappointing decision when she ruled how they should be handled henceforth. It appears she doesn't understand the gravity of the case before her. She even went as far as calling it a "common criminal case"; I wonder what she will deem a serious criminal case. Maybe, if Nuclear weapons were involved. I suspect she's only softening him up for the sentence she will hit him with if he's found guilty. Nigeria is a joke! Like I have said severally in other threads, when transporting criminal defendants; 1. You handcuff them being their backs. 2. You secure the perimeter of/and the venue where they will be tried. 3. Unauthorized personnel will not be allowed within 50-100 ft of the defendants. Anyone that violates this will be immediately arrested. Lethal force will be applicable if the Court officer deems it necessary to protect himself, the defendant, or those around his immediate vicinity. 4. Transporting/Court/Security guards will be armed. 5. A secure entrance built away from the view of the public---- and accessible ONLY BY PROPERLY TRAINED AND VETTED AUTHORIZED SECURITY PERSONNEL--- should, henceforth, be included in the building plans for future courts. This/These entrance(s) will be used in transporting criminal defendants in and out of court from the jails/prisons/pre-trial centers where they are housed (when in Government custody) pending conclusion of their case. This will avert and totally prevent the kind of uncivilized madness that we all just witnessed in the above video. It will also serve to protect the Defendant while in Government custody. Furthermore, it can also serve as an emergency exit in a situation where fast, swift and discreet evacuation is needed to be carried out on court premises. The Prison Boss needs to be fired and the officers that allowed all that chaos happen in the middle of a public street--- IN A CASE INVOLVING SOMEONE THAT WAS CALLING FOR WAR AND TOTAL CARNAGE--- be reprimanded, retrained, and relieved from "Transportation". It is quite clear that of the lot, only one of them seemed trained to the fact that the continuance of the interview could lead to grave consequences. Africa and Africans are a big joke! I just watched the video again till the very end. How is Nnamdi Kanu allowed to take a sip from a bottle of water handed to him by one of his supporters? What if it was poisoned? Is the Nigerian Government that stu*pid to not realize that to some Mr.Kanu is worth more dead than alive? Why can't Africans ever think proactively or preemptively? What anyone needs to do is get close enough to Kanu under the pretense of being a trusted supporter, spike his drink or stick him with a needle and watch him die when he gets back to his cell which will then automatically make Biafran agitation go into full-blown crazy-mode. What if Mr. Kanu is slipped a weapon which he can later use to aid his escape from prison? What if he's slipped a master-key for locks and handcuffs? bashydemy: Hes a joker! In Federal Court, here in the United States (which Mr.Kanu wants his trial emulated after) recording devices are not allowed in the court room. No phones, no cameras, no tape recorders. Nothing! So, here, if Mr.Kanu started to rant--- even after the Judge told him to stop being unruly--- U.S Marshals would have jumped on his back and broken an arm before you can say "Jack Robinson". Have you ever seen the kind of big, burly white boys we use as Marshals out here? Mr,Kanu would not dare try that nonsense. A 6'5, 265lbs all-muscle red haired farm boy from some backwater county somewhere in Kentucky would've gladly tossed him around like a rag doll the moment he opened his mouth to utter his first words. Furthermore,since he clearly appears to be unstable, his case would be postponed at least another 6-8 months so that a full and complete mental evaluation could be conducted on him to determine if he is fit to stand trial. . The Court would also most likely order that, for his safety, Mr.Kanu be kept in Solitary Confinement (23 hours/day) and away from General Population Inmates. He, however, would be allowed an hour a day--ALONE--- for recreation and exercise (under the supervision of prison officials). All this will be done because his utterances and actions have shown him to be a very dangerous person who is prone to violent and irrational outbursts , and who (from his past and present words) won't hesitate to carry out his vows if he felt he could get away with it. Then, next time he was being brought to court, Mr.Kanu (if he continues being violent after the evaluation and prescribed medications) would be wheeled into court handcuffed to his chair with a mask-muffler over his mouth to dissuade him from further disrupting court proceedings. We don't waste time Judging you in absentia. We will make sure you witness your own trial and conviction so you don't come tomorrow on Appeal claiming you were denied your right to Justice. Finally, as I understand it, the Nigerian Government is not pushing for a "secret trial" as falsely claimed by Mr.Kanu. They are requesting that the identities of the witnesses be shielded. While it is true Mr.Kanu has the right to cross examine his accusers, it is also true that he doesn't have the right to demand that their faces and identities be revealed to the public. This even so because Mr.Kanu has severally shown himself to be a very violent man with an almost fanatical following by a very enormous amount of people especially from his ethnic group. So, it would not be outlandish for the court to fear for the safety of the witnesses were Mr.Kanu to call for retribution against them; ESPECIALLY if the witness(es) is/are [a] member(s) of his own ethnic group. For this reason, to safeguard Mr.Kanu's fundamental right to question and cross-examine his accusers the Court could accommodate his rights and "needs" , by : A. Having an "in-camera" proceeding witnessed by both Defense and Prosecuting counsels (under the eyes of a very few select number of vetted security officers who will be there to protect all parties) where Mr.Kanu's team would be allowed to view Pictures and names or the witnesses to be called against the Defendant. The Defense would not be allowed to leave with any of this evidence . Also Mr.Kanu will not be allowed to attend this proceeding; that is what he has lawyers for. B. If the above is out of the question, then the court can order that the courtroom be renovated in such a way that the witness boxl be shielded from the public, but viewable by the defense and prosecution. It would obviously take time to generate the needed funds for a new witness-box with screening away from the public to be constructed so for that reason it wouldnt be unreasonable for the case to be postponed another 8-10 months to accommodate Mr.Kanu's demands. There are so many ways to skin a cat. This is a case which, out here, would not see the light of day for at least another 4-5years owing to its enormity and severity. Nnamdi Kanu should be thanking his God he's not getting the American treatment there in Nigeria. He's joking if he thinks he's going home sooner than a decade from now. And thats how its played all over the world. He's lucky he's pulling those antics in unruly Nigeria. 8 Likes 6 Shares |

This is what you get when you don't separate an allegedly dangerous Defendant from the spectators gallery, don't handcuff him behind his back to show him and the public the enormity of his alleged offenses (and to protect him from the public), or allow his supporters get close to him.
