See what I found:

1. Position does not qualify for category

This is most common with cases filed in the EB-2 category. As a reminder, a position qualifies for EB-2 if it is one that requires a Master’s degree or a Bachelor’s degree plus five years of progressive experience as a minimum for entry into the profession. A Master’s degree means a U.S. Master’s degree or the foreign equivalent of a U.S. Master’s degree. A Bachelor’s degree means a U.S. Bachelor’s degree or the foreign equivalent of a U.S. Bachelor’s degree. Nothing less will qualify for EB-2.

The adjudicating officer must first determine whether the position as described on the labor certification qualifies for the EB-2 category. This is where the drafting of the labor certification can make or break an EB-2 case. If a labor certification application states that a position requires a Bachelor’s degree and that the employer will accept a three-year bachelor’s degree to meet this requirement, the position described on the labor certification is not an EB-2 position. The employer will accept something less than a U.S. bachelor’s degree, which is a four-year degree. The case would be denied on the grounds that minimum requirements for the position are less than a bachelor’s degree and “do not support 2nd preference classification.” The exact wording of the minimum requirements of the position should be carefully considered prior to beginning the labor certification in order to ensure that the position will qualify for the intended category at the I-140 stage.

2. The Beneficiary does not qualify the position

The adjudicating officer must determine whether the sponsored employee meets the minimum requirements stated on the labor certification. If the position the worker is being sponsored for requires experience, the worker must document that he or she met that experience requirement as of the priority date (i.e. the date the labor certification was filed). This is usually done by submitting experience letters from former employers. Sometimes, USCIS may deny on the grounds that there is not sufficient documentation to establish that the experience requirement has been met, such as where an experience letter could not be provided or is not detailed enough. Or, USCIS may deny on the grounds that the experience was gained with the sponsoring employerin a substantially similar position and therefore cannot be counted to meet the experience requirement.

The adjudicating officer will also look at the education requirement for the position as described on the labor certification to decide whether the sponsored worker qualifies for the position. The sponsored worker must have the right degree and in the right field of study. If the field of study is not exactly matching what was stated on the labor certification (for example the worker has an MBA but the labor certification requires a Masters in Computer Science), the I-140 could be denied unless an argument can be made that the worker’s field of study is closely related to the requirement. Also, the length of the degree programs will be looked at. A Master’s degree usually means that the worker must have six years of study. A Bachelor’s degree usually means that the worker must have four years of study. A three-year bachelor’s degree can often cause a denial if not handled carefully during the planning phase.

3. Ability to Pay

Title 8 of the Code of Federal Regulations, at part 204.5(g)(2) states:

Any petition filed by or for an employment-based immigrant which requires an offer of employment must be accompanied by evidence that the prospective United States employer has the ability to pay the proffered wage. The petitioner must demonstrate this ability at the time the priority date is established and continuing until the beneficiary obtains lawful permanent residence. Evidence of this ability shall be either in the form of copies of annual reports, federal tax returns, or audited financial

The following information and documents are typically reviewed by the adjudicating officer: priority date, proffered wage, company tax return and employee W-2 for each year plus the employee’s most recent pay statement showing the year-to-date pay received. If the salary that has been paid to the sponsored worker is less than the proffered wage stated on the labor certification, a Request for Evidence is usually issued and can lead to a denial if the company’s net income is not sufficient. The best way to avoid a denial on this issue is to ensure that the salary being paid meets or exceeds the proffered wage on the labor certification starting from the day the labor certification is filed.

Hopefully these points will help you be on the lookout for pitfalls in your own process so that you can avoid a denial at this stage.

Hie dear,
I am in the same stuation ,but l am with OGP ,what happened to your 1-140 did you reapply, mine got denied last friday and we are reapplying. Please let me know how you handled it ,its frustrating but the problem lies with USCIS not us we will conquer, please email me coz a problem shared is a problem solved.

Sorry for the news of the denial. I pray it ends well for you. This denial is becoming rampant these days and has nothing to do with the agents per sé. It happens to everyone of them sponsoring Nurses. Avant, Ppusa,OGP etc.
Please if anyone has gone through this denial and later got approved, please kindly share your experience, as you will be helping a lot of colleague waiting in queue for refiling.
All the best this year.

Oga, injury to the femoral artery will lead to excessive bleeding....progress to shock... Then cardiac arrest if not reversed. This won't wait for 10 days to happen.
The major cause of death in this case is most likely infection (Sepsis/Septicemia).
Nerve injury is another thing entirely.

Her nclex might play a role in canada but the problem with Canada's process is the verification of educational credentials. If she has a diploma RN den forget canada because in canada u must be a BSN holder to get the RN status. Even those who have the BSN Rn, the odds are not in favour of foreign trained nurses here in canada esp if education wasn't in the Philippines or India.....we tend to see more of those BSN scale through. Plus the process is damn expensive.
I would suggest you hook up with these agencies or get a visit visa and go and survey the terrain In US urself.

You're correct. But I still want to know how the US nclex will help, other than that she's now used to the structure and expectations in a CAT exam + knowledge of content.

I don't know how it works...i would like to know if it is possible to use US NCLEX. Now my wife is in Dubai working as a nurse but would like to know if her NCLEX can be used in Canada and how to go about it. As well as if there are companies that can process it for her to work in Canada

Alright, it's clear now. Just know that Canada and US routes are totally different. Canada is not subject to the US in anyway. So, she can not work with a US licence, in Canada. She needs to go through Canada process separately. Even within US, you may not be able to work in other states , unless you register by endorsement or your state of registration and the state you plan to work are compact states. So you see, US licence is not a federal licence, it is state controlled but federally regulated. Hope this helps. Others can shed more lights.

Nothing wrong with not knowing, but if you don't know, keep quiet, read, research before blowing hot.

Thanks alot everyone, av tried to explain that I have my own career path and all but it's all falling on deaf ears. I conclude I wnt go back to her anymore, if she needs it really badly she should get one of her children to go for it

Will you work for her facility after graduating? Does she want you to study and then she uses your licence to practice? How exactly will she benefit from your Nursing degree?
If you go ahead to study Nursing, on graduating, you will never want to trade your certificate or licence for anything (and this will cause a bigger problem). Think well and only study it for yourself. Whatever you do, avoid crime and don't be an accessory. All the best

I am an Avant RN. I can relate to your concerns and know many people that are facing the same challenges that you are going through now.
This is not specific to Nigerians or Avant. There are still a few persons whose petitions were approved. I guess USCIS do what they like.
Like others have told you, do not give up. Keep your dreams alive. I also want to add that you have to be very patient (I know how hard it is). Trust the process and trust Avant. They have your interest at heart and would not want to lose their investments. From what I have heard, they will resume filing from January.
The process may take a little longer but it will surely come through. It took 9 years from when I passed CGFNS to get here.
My favorite quote to all facing this situation is "in this process, patience is a virtue". Relax, my friend . Your time will come.

I applied with a nursing diploma (doubly qualified) with about 6 years continuous clinical experience. I don't think the i-140 has got anything to do with whether an application is filed with a nigerian nursing degree or diploma. The important thing is that i have an active US RN license with supposedly a job offer and evidence that employer can pay.

I am wont to know if this recent development is peculiar to AVANTS or other agencies are affected. Any info with respect to this would be appreciated.

Thanks for your kind words.

There may be information Avant won't like to share with you, if it has to do with their operations. Like someone said, the worst is that you sign up with another employer, don't give up. It is not your fault, it is USCIS. If it were your fault, Avant would've come up with it in their email to you.
Also, I think there are different USCIS offices across the US (talking of leadership, according to Avant) , they may later file for you in another nearby USCIS office where they have jurisdiction.

Hello, great minds!

These questions are for all that have successfully gone past cgfns credentialing stage.

1.) The combined results I'm currently using are not from the secondary school I attended. Reason being that, I had a deficiency in a subject in my secondary school NECO exams. I took two other WAEC external exams which gave me the grades that I needed in all my relevant subjects. Since I can't combine both NECO and WAEC, hence, the need to abandon my secondary school NECO result. I am now at the cgfns stage, the question is, what do I fill for my secondary school records? I don't feel comfortable filling my secondary school since I have no result to submit from there except my testimonial. And if I have to use the two later results, how do I fill the school since one of the exams was WAEC externals. I only had a centre where I wrote the exams. Please what do I do next? An urgent and sincere response will be highly appreciated.

2.) For all that experienced one delay or the other at the cgfns credentialing stage (sorry about that). Kindly tell us what we need to do or not to do (the 'dos' and the 'don'ts') at this stage in order to avoid your mistakes and errors that led to the delay. Note, the errors/mistakes may not even be your own making, may be from the SON/NMCN. Kindly tell us what we need to do right in order not to be a victim of avoidable errors and delays.

Thank you

1. Fill in and Use the result of the school you finished from. Send the result complimenting your grade along, both will be received and kept in your record.

2. Use dhl/FedEx to send your documents. Get the 2 numbers to call Cgfns when necessary. Your civil documents are very important, no alterations.
Others can contribute from their experience.

I don't believe this girl's story joo
You said u were awake for 3 good hours
Kilode!!!
Í sure know since your surgery ended to be an exploratory laparotomy, you will be intubated...
Infact, the fact that you were given muscle relaxants already shows that you are intubated
Besides muscle relaxants wear off within minutes and which needs to be top up as the case may be.
Finally, the fact that you are feeling pain will bring about some changes in your physiology which we reflect on the monitor... Also, there is high tendency of tearing if you were actually feeling pain

So wat are you saying

I'm also wondering... The blood pressure and pulse will be high, tearing etc. An average muscle relaxant lasts 20-40 minutes. Maybe there was poor monitoring. Analgesics are supposed to be repeated or combined. Anaesthesia+analgesia+relaxant. Relaxant will call for intubation and controlled ventilation. The story may not be complete until we hear from the anaesthetist.

Watch out for tribalist

What has the appointment of Nigerians in the US got to do with tribalism. Youths need to grow up and face the daily reality of what is truly obtained in their neighborhood. Except for the criminals and troublemakers, most Nigerians home and abroad live in peace wherever they find themselves, irrespective of tribe.

Try to go through this thread, a lot of vital info about CES by CGFNS. Also your ability to practice after CES , Nclex pass etc. May depend on your immigration status. What type of visa you're holding, will you need adjustment of status ( if not on immigrant visa), will you need to come home for consular processing. Those are the things to consider as you start the process.
