The Nigeria Drug Law Enforcement Agency has said it is keeping tabs on more celebrities in Nollywood and the music industry for drug trafficking, abuse and links with drug cartels. The agency said the move became necessary, following its investigation into the activities of controversial actress and singer, Tonto Dikeh, for possible consumption of hard drugs. Dikeh had on June 28, 2013, posted photographs of a wrap of hemp and grains of the weed formed into the letters, ‘Happy birthday POKO.’ She also posted a photograph of herself with the inscription, ‘Mi smoke ganja mi smoke weed while my haterz smoke ma gossip.’ In an interview with our correspondent on Friday, the Head, Public Affairs, NDLEA, Mr. Mitchell Ofoyeju, saidthat Nollywood stars had been prosecuted for drug-related offences. He said, “We are beaming our searchlight on more celebrities with regard to drug trafficking and abuse. “The arrest and conviction of Nollywood stars, Hassanat Akinwande, popularly known as Wunmi, and Tochi Uche have clearly shown that some members in the sector are vulnerable and susceptible to manipulation by drug cartels. “We have a responsibility to investigate and identify anyone involved in drug trafficking and use. We are deeply concerned, when such personalities are linked with drugs because of their large number of fans.” Ofoyeju said the implication of having celebrities dealing in hard drugs was that their fans might like to act like their role models. He added that the improper conduct of a celebrity might have “ripple effects” on their followers. “This will not be treated with kid gloves. It is counterproductive to the country’s drug abuse prevention campaign. Any breach of the NDLEA Act will not be condoned,” he stated. The NDLEA spokesman said sniffer dogs had been instrumental to major drug seizures in the country. “The heroin hidden inside woollen rug carpets imported from Pakistan was detected by the sniffer dogs. The dogs help to detect drugs that ordinarily are difficult to uncover, using normal search techniques,” he said. He further said the agency had not recorded any drug seizure on private jets, adding, “We are taking measures to ensure that drug trafficking cartels do not use such jets.” NDLEA, which said it would investigate Dikeh, had hinted that the actress and singer risked a minimum of 15 years in jail for allegedly encouraging the consumption of hemp. Nigerians have besieged various YouTube channels to catch a glimpse of what transpired on the floor of the Rivers State House of Assembly when the lawmakers were embroiled in a fight. Five members of the House opposed to Governor Rotimi Amaechi had engaged about 13 of their colleagues in a fight shortly after the pro-governor lawmakers resisted their move to impeach the Speaker of the House of Assembly, Mr. Otelemaba Amachree. In the mayhem, the Leader of the House, Mr. Chidi Lloyd; Michael Chinda and Martins Amahule sustained serious injuries. As at the time of filing this report, three major video clips of the incident had gone viral on YouTube with many users of the social network sharing the video on their respective channels. On the YouTube channel of SaharaTV, for instance, the video had attracted over 43,000 views when our correspondent visited. On another YouTube channel belonging to Israel Ibeleme, 6,777 people had viewed the video, with many of them describing the development as shameful and embarrassing in the comments they dropped after watching it. Many of them stressed that it was unfortunate that the lawmakers were fighting over personal interests adding that it would have been a lot better, if the energy wasted in the brawl had been channeled into fighting for the progress and development of the country. On the YouTube channel of SaharaTV, one Michael Eseigbe, who observed one of the lawmakers shouting “Arrow Mates”, described him as a cultist. According to him, the chant he screamed was a slang expression used by a cult group known as “Supreme Viking confraternity.” Eseigbe said, “Did any one hear the lawmaker screaming Arrow Mates? That is the chant of a cult group known as the “Supreme Viking confraternity” and we call him a honourable member? “This is why we will never achieve anything in this country when power have been given to cultists who terrorised their mates back in school and have now brought that wayward life to bear on our socio-political sphere. What a travesty!’’ Another visitor to the YouTube channel, with the name Besty Large, called for the immediate removal of those lawmakers chanting the slogan. Large adds, “It’s a big disgrace to note that a Nigerian lawmaker will be chanting ‘Aro Mate.” If this man shouting that slogan is not brought to book, that means there is no law in Nigeria. He is promoting cult activities. How can a cult member fight for justice? “This man must be removed as a lawmaker. It’s a big shame and disgrace to a system of government in the country. The man is a member of the Viking confratanity). They are the ones who use Aro mate. The laws of the land forbid members of the legislature and executive arm from belonging to any cult group.’’ But as many Nigerians condemned the lawmakers for the brawl, others called on Nigerians to vote for responsible politicians to pilot the affairs of various arms and tiers of government. A visitor to one of the YouTube channels, who identified himself simply as Magic, said it was not enough to condemn the act but that the ultimate power belongs to the electorate to vote irresponsible leaders out of office. Magic stated, “We come here to condemn this shameful act but by next election we would not come out and vote for the right people. It’s high time we rose up to our civic duties of voting for the right people. “It’s about time we took our rights to vote seriously so that we do not face such embarrassments again. If not, this will just be a tip of the iceberg.’’ Corroborating Magic’s position, another commentator, Mayaki, encouraged youths to come out enmasse and contest elective positions to bring about change in the Nigerian polity. Mayaki says, “Why we leave our future in the hands of these hooligans is beyond me. Seventy per cent of this country’s population is under 35 (67% under 25)! “We are not too young to claim control of our destiny, after all, we cannot claim that the wisdom and maturity that comes with old age makes our politicians deserving of their positions.” A cross section of those who dropped comments on various YouTube channels also called for the meting out of appropriate sanctions on the policemen who joined in the fracas as well as those who failed to intervene during the crisis. James Cliif noted, “The Commissioner of Police in Rivers State (Mr. Joseph Mbu) should be dealt with for the failure to arrest that cultist who claim to be an honourable member of that House of Assembly. The Federal High Court, Abuja, has set 20 September for judgment in a suit filed by the Delta State Government against the Federal Government over ownership of $15 million (N2.4 billion). The money is alleged to be bribe offered former Chairman of the Economic and Financial Crimes Commission (EFCC), Nuhu Ribadu, by convicted former Delta governor, James Ibori. Justice Gabriel Kolawole gave the date on Wednesday after counsel to the parties adopted their addresses. The respondents in the suit are the Economic and Financial Crimes Commission (EFCC) and Central Bank of Nigeria. Justice Kolawole said the parties had 21 days within which to file the addresses while the plaintiff (Delta State Government) had another 14 days to respond to issues bordering on point of law. “In the circumstance, therefore, the judgment is reserved for September 20,’’ he said. The Delta State government had approached the court to claim ownership of the $15 million. Adopting his address, Charles Ajuyah, the Attorney General of Delta, submitted that the idle money belonged to the state. He said the state had sought the return of the money because “Ibori took the money from the coffers of the state government, while serving as governor of the state.’’ Mr. Ajuyah argued that the plaintiff had reflected, in its affidavit, possible sources where the money could have been taken from. “My Lord, the money belongs to Delta government; the state still pays Ibori pension for serving the state in the capacity of governor. “He took the money while serving as governor of the state. “My Lord, precedence has been set by the decisions of several courts at various times when monies recovered from former governors of Plateau and Bayelsa states, Joshua Dariye and D.S.P Alameseigha, were repatriated to the respective states. “In fact, the EFCC and the Federal Government are not in court to claim the money because the respondents are aware that the money belongs to Ibori and by extension, Delta. “My Lord, we are taken aback that the money, which is a source of controversy, was not listed as exhibit and placed before the court,’’ he said. In adopting his address, Rotimi Jacob, the counsel to the EFCC, said the plaintiff failed to trace the source of the money to the state. Mr Jacob submitted that the allusion made to the recovered Plateau and Bayelsa states’ stolen monies by Mr Ajuyah was wrong, because the two states were able to convince the court and the sources of those monies were traced. “In the case of Delta, no convincing traces have either been captured in their affidavit or orally presented before the court. “It is our conviction that the plaintiff has no proof of ownership and therefore must be denied access to the money. “It will interest the court to note that the office of the Attorney General of Delta, sometime in 2008, barred the EFCC from investigating the accounting records of the state by an order of court. “The state government has not complained of any missing money just as it has failed to prosecute the former governor for embezzlement of state funds. “It will be recalled that the plaintiff did transferred the sum of N50 million meant for the building of a four bedroom duplex for the office of the governor to Ibori’s account abroad in 2008. “Similar budget was proposed and approved for the same project in 2009 and the money sent to the ex-governor to prosecute his money laundering case in the UK. “The state does not qualify to access this money as a similar episode may play out. Arguing on a point of law, Mr. Ajuyah urged the court to dismiss the argument canvassed by counsel to the EFCC, saying that Delta had the powers to “deploy its resources to the benefit of the indigenes of the state.’’ “The EFCC and the Federal Government cannot claim ownership of the money; the money belongs to Delta and we humbly urge the court to grant us access,’’ he said. As the House of Representatives’ Committee on the review of the 1999 Constitution submitted its report Thursday, it has emerged that the proposed six-year single term for the president and governors may have been killed. The Senate Committee on the Constitution Review chaired by Deputy Senate President Ike Ekweremadu had proposed the six-year single term for both the president and governors, but left the commencement date of the proposal, if approved, in abeyance. But in contrast, the House Special Ad hoc Committee on Constitution Review chaired by Deputy Speaker Emeka Ihedioha threw its weight behind the retention of the present four-year two terms for both the president and governors in the constitution. For a proposal to be listed in the final bill for constitution amendment, both chambers must agree to it. When listed, two-thirds of all the members of each chamber of the National Assembly must vote for the amendment backed by two-thirds of the state houses of assembly and assented to by the president before such an amendment can become law. The six-year single term proposal has begun to generate controversy as the Senate gears up to begin debate on the report of the Ekweremadu committee. Even at the level of the committee, the recommendation and its take-off point, if approved, had emerged contentious. Opinions were divided over whether President Goodluck Jonathan and the first term governors warming up to contest the 2015 election should have their present tenures extended to six year and barred from contesting in 2015 or 2019 should be the take-off point. The controversy had started to engender echoes of the tenure debate that led to the outright killing of the Ibrahim Mantu Constitution Review committee in 2007 because of its provision of Third term for President Olusegun Obasanjo. The Senate and House Constitution Review Committees, however, agreed on a number of proposals, which included fiscal autonomy for local councils and state houses of assembly, removal of immunity on criminal matters for president and governors, separation of the office of the Accountant-general of the Federation from that of office of Accountant-general of the Federal Government and exclusion of the President’s assent in constitution amendment. Following the House report, which THISDAY obtained, both review committees are also in synch in respect of their recommendations on creation of new states, as they failed to recommend the creation of any new state in spite of overwhelming requests for the creation of additional states both committees received. Submitting the House committee report, Ihedioha had said the entire report was a reflection of members bills referred to the committee after the second reading and results of the Peoples’ Public Sessions on the Review of the Constitution. House Speaker Aminu Waziri Tambuwal who received the report during plenary session said the leadership of the chamber would consult with members for possible consideration of the report before they embark on recess in a fortnight. Other highlights of the House report include the recommendation on independent candidacy in future elections and the one seeking to bar unelected local government chairmen from getting funding from government purse. For instance, in Section 7 of the report, the Committee relied on the recommendation of the people’s public sessions, which clearly underscored the need to grant independence and autonomy for local government councils and give the councils their deserved role as catalysts for development at the grassroots level. Accordingly, the committee created a fixed uniform term of four years for local government councils and prescribed denial of appropriation to council’s chairmen that are not democratically elected. The Coordinating Minister of the economy and Finance, Dr Ngozi Okonjo-Iweala has insisted that the nation’s economy is stable despite some reports which quoted her saying that the economy will crash if the 2013 Appropriation Act is not amended by the National Assembly. Dr Okonjo-Iweala who spoke at a news conference in Abuja on Wednesdaystated that “I never said the economy was going to shut down” but warned that with the lingering cntroversy over the appropriation act might make paying salaries impossible for the federal government by December. “What I said was that we will not be able pay salaries” due to the controversy trailing the 2013 Appropriation Act she explained and appealed to media organisations to avoid casting sensational headlines capable of heating up the polity. An online news platform had alleged that the Mminister told her colleagues at the 50th meeting of the 15-member Federal Government Economic Implementation Team, that the Nigerian economy is shaky despite the official fundamentals and that drastic steps are needed to save it from collapse. Quoting a source in the Presiodency, the webiste alleged that the Minister painted a gloomy picture of the economy and hinted that there was an urgent need for “stringent budgetary measures” to arrest the downward slide. While addressing journalists on the federal government’s one billion Eurobond, the Minister of Finance and the Director-General of the Budget Office said that the oversubscription to the bond by foreign investors signifies that the Nigerian economy remains stable despite recent challenges. The National President of the Academic Staff Union of Universities (ASUU), Nasir Issa-Fagee has said that the union embarked on the current strike because the Federal Government has only implemented two of the nine issues agreed on since 2009. Mr Issa-Fagee, who was a guest on Channels Television’s breakfast programme, Sunrise Daily, said the government did nothing about the agreement until the union went on strike in 2012. “On 2nd February 2012, the union decided to suspend that strike on the understanding that the Memorandum of Understanding that we signed with the government will be fully implemented within the shortest possible time,” he said. According to Mr Issa-Fagee, the only two items of the agreement that have been implemented are the review of the retirement age of Professors from 65 to 70 and the reinstatement of prematurely dissolved Governing Councils. “The other issue that mostly has to do with adequate funding for the system for revitalizing of Nigerian Universities have not been met by government,” he said. Peoples Democratic Party leadership has asked Governor Rotimi Amaechi of Rivers State not to leave the party. It noted that with the ongoing reconciliation in the party, there was no need for any of its aggrieved members to defect to another party. The party’s acting National Publicity Secretary, Mr. Tony Okeke, stated this in Abuja on Monday. Okeke was responding to a threat by Amaechi that he could defect to another party if the PDP no longer wanted to accommodate him. But Okeke, who spoke to one of our correspondents on Monday, said, “There is no need for him (Amaechi) or anyone to leave the party. The reconciliation efforts going on in the party now are all encompassing and we are very positive and hopeful and because of this, there is no need for anyone to leave the party, not even now or in the future.” The PDP, which suspended Amaechi from the party on May 27, set up a committee to investigate the anti-party activities accusations levelled against him. Meanwhile, a former Deputy Speaker of the House of Representatives, Mr. Austin Opara, has dismissed Amaechi’s claim that he made him (Opara) a principal officer of the House of Representatives. Opara, who spoke with journalists in Abuja, also said it was wrong for the governor to tag him a betrayer. He wondered how Amaechi, as the then Speaker of the Rivers State House of Assembly, could have influenced his emergence as a principal officer of the House of Representatives, when he was not even a member of the National Assembly. He said, “The process of electing the presiding officers of the House of Representatives is well known. It is through election on the floor of the House. “Since the office of the Deputy Speaker of the House of Representatives was zoned to the South- South, I spoke to all the governors from the zone and my state governor. How did Amaechi make me the Deputy Speaker?” Also, a member of the House of Representatives, Mr. Dakuku Peterside, has warned that the PDP will lose the 2015 election if it fails to reconcile its aggrieved members and resolve the crisis rocking it. Peterside, who represents Opobo/Nkoro/Andoni Federal Constituency, stated that without reconciling members of the party, it would be difficult for it to win the next general elections in the country. The lawmaker said the PDP was currently in disarray, adding that any political party in such a situation would not win any election. Peterside, who is the Chairman, House Committee on Petroleum Downstream, said though Amaechi was still in the PDP, he would not hesitate to leave the party if the governor decides to defect to another party. The court of appeal sitting in Akure, the Ondo State Capital on Monday upheld the re-election of Governor Olusegun Mimiko. The court dismissed the petitions of the candidates of the Action Congress of Nigeria (ACN) and the Peoples Democratic Party (PDP) in the October 20, 2012 governorship election, on the basis that they lack merit. In a unanimous judgement, the Appellate court ruled that the appellants were unable to prove how injections into the voters’ register affected the governorship election result. The PDP candidate, Olusola Oke and his ACN counterpart, Oluwarotimi Akeredolu, had in different appeals challenged the ruling of the Justice Andovar Kaka’an-led tribunal. The tribunal had in its judgment struck out the petitions of the two candidates over their failure to prove their cases before it. Dissatisfied with the ruling, Messrs Oke and Akeredolu approached the appellate court to seek redress and overturn the decision of the tribunal. When the parties appeared before the five-man panel last Tuesday, Mr Akeredolu’s lead counsel, Akinlolu Olujimi had urged the court to uphold the appeal, arguing that the tribunal erred by dismissing the petition without considering the merit. In the same vein, counsel for the PDP candidate, Nathaniel Oke had said the Independent National Electoral Commission (INEC) violated electoral laws on the voters’ registers hence the need for the appellate court to grant his prayers and give him judgment. However, Mr Mimiko’s lead counsel, Wole Olanipekun, in his submission, told the court that “the appellant adumbrations had clearly showed the futility of the appeal.” Relying on Section 19 and 20 of the Electoral Act 2010, he said the tribunal was right in its judgment that the opening of the soft copy of the voters’ register issued by INEC at its Stakeholders Meeting on 28th September, 2012 was a pre-election matter. The federal government has said that Edo State governor, Adams Oshiomhole, did not act outside his constitutional jurisdiction in the execution of four death row inmates in the state. The reaction by the federal government is sequel to the Monday execution of Osaremwinda Aigbuohian, Daniel Nsofor, and two others in Edo State, a situation that generated both local and international criticisms. Speaking with journalists in Abuja during the stakeholders consultative forum on the 2nd cycle of Nigeria’s Universal Periodic Review, the Minister of Foreign Affairs, Olugbenga Ashiru, said that the constitution and the criminal code were handed over to Nigeria during the colonial administration. He emphasised that the constitution remained the guiding principle to the nation, saying Nigeria should not shy away to what is right according to the dictates of the constitution “In Edo state, what happened recently has nothing to do with the federal government. We have a constitution where the states are autonomous. “Don’t forget the constitution was followed by review but the criminal code that we are using was handed over to us by the colonial powers and it is when the constitution is reviewed that the status quo will be reviewed. “So, there are areas where governors have authorities and in this case, that was what happened in Edo State where the governor exercised the constitutional provision to sign the execution that is there. “I think the governor of Edo State, acted within his constitutional power. “So, don’t shy away to what we believed is right and what we believe is in the constitution. We have a constitution and it is our constitution that will guide us. When we look around, it is our constitution that will guide us,” Ashiru said. Former governor of Ekiti State, Engineer Segun Oni is not yet off the hook as the state government has reiterated its plan to probe him over alleged malpractices that rocked his administration. This is contrary to reports in some national dailies yesterday that the incumbent governor, Dr Kayode Fayemi has jettison the idea of probing him. The Commissioner for Information and Civic Orientation, Mr. Tayo Ekundayo, who gave the clarification yesterday in his office, said there was misperception of his earlier statement made during the village square meeting on Thursday at Efon. He noted that the Ekiti government is determined to probe the Oni’s administration on N2.2 billion Micro-credit Fund, N6.6 billion Ado –Ifaki dualisation project and N700 million spent in purchasing 600 cows for Ikun Dairy Farm during his aborted tenure. The commissioner emphasised that Governor Fayemi’s administration believes in transparency and accountability, saying, “This government will not gloss over the gargantuan corruption allegedly committed through micro-credit scheme, Ikun Dairy Farm contract and other fraud that were allegedly perpetrated under Segun Oni-led administration. A total of 22.5 million euro has been recovered by the Federal Government from the confiscation on money laundered by General Sani Abacha. Speaking at the ministerial platform in Abuja, the Minister of Justice, Mohammed Adoke said a total of 175 million euro was also recovered from the family of the late head of state following a confiscation order by the Supreme Court of Liechtenstein. Mr Adoke listed measures taken by the federal government to reform the nation’s criminal justice system. General Abacha had ruled Nigeria as a military Head of State between November 17, 1993 and June 8, 1998, when he died suddenly of a heart attack. As a result, General Abdulsalami Abubakar became the head of state and within a short time, he re-established democracy in Nigeria, arranging for general elections that resulted in the emergence of Olusegun Obasanjo assuming the presidency as the democratically elected leader of the country in 1999. Before Mr Obasanjo took office, Mr Abubakar’s government had delivered a clear message that the late Abacha had looted huge sums, and they had to be restored. Members of the Abacha family and some of their accomplice then ‘voluntarily’ returned about $1 billion to the Federal Government. In 2002, the Obasanjo administration tentatively came to an agreement with the Abacha family to return another $1 billion out of the $1.1 billion that had been identified, traced and frozen, with the quid pro quo that the Abachas would be allowed to keep balance that had been assessed not to be of criminal origin. The arrangement was not well received by the masses. Although the proposal caused a massive outcry for seeming to reward the theft of public funds, it was subsequently rejected by the late dictator’s son, Mohammed Abacha, who continued to maintain that all the assets in question were legitimately acquired. The highest sum that had in the past been traced to the family ranged from $3 billion to $5 billion, which includes money allegedly derived from misappropriation of funds from the Central Bank of Nigeria, bribes received from multi-nationals, among others. The Swiss government last December said that it has so far returned to Nigeria the sum of $700 million stolen by the late dictator and deposited in several Swiss banks. In addition to freezing about $640 million, the Swiss judicial authorities handling the case have also indicted Mohammed Abacha and Atiku Bagudu under Swiss legislation regarding money laundering, fraud and taking part in a criminal organisation. The House on Wednesday took this position after considering a constitutional point of order which observed that the document as presented is not recognized by the 1999 Constitution. According to the lawmakers, Section 81 of the Constitution only recognises an amendment to an appropriation only through a Supplementary Appropriation Act. The bill was unanimously rejected and the President was advised to present a proper bill. This is coming despite a plea by the Presidency that the lawmakers should pass the bill. Worried over the delay in concluding work on the grey areas in the 2013 Budget, the Presidency had on Monday asked the National Assembly to expedite action on the document. Briefing journalists in Abuja, the Special Adviser to the President on National Assembly matters, Joy Emordi urged lawmakers to give the Petroleum Industry Bill accelerated consideration to help facilitate the federal government’s plan of repositioning the oil and gas sector. Yesterday’s meeting was the first to be convened by Amaechi since his re-election as chairman of the Forum of 36 states governors in a controversial election. Speculation was rife yesterday that the meeting was postponed in deference to President Goodluck Jonathan who had also fixed a dinner with the 36 governors for yesterday night. Daily Sun checks however revealed that some of the governors in the Amaechi camp insisted that the meeting must hold in order not to give impression to the Jonah Jang led faction of the Forum that the Amaechi group has no followers. Further checks revealed that besides governor Amaechi five PDP governors also honoured his invitation for the meeting. The list include the Chairman of Northern states Governors Forum and Niger State Governor, Babangida Aliyu, his Jigawa and Kano states counterpart, Sule Lamido and Rabiu Kwankwaso and governors Murtala Nyako and Dr. Aliyu Magatakarda Wamakko of Adamawa and Sokoto states. Others in attendance were governors of Lagos, Ogun, Ekiti, Zamfara, Edo, Nasarawa and Imo states. The governors of Osun and Borno were represented by their deputies. The meeting lasted for 45 minutes before the governors rose to proceed to the Presidential Villa for the dinner appointment with President Jonathan. There was no communique at the end of the meeting. Chairman of the Forum, Rotimi Amaechi told journalists that the meeting was cut short to meet up with dinner appointment with President Jonathan. “There was no meeting, we decided to differ to the president. We agreed that the President of the Federal Republic of Nigeria and that as compatriots and as governors of different states, we must honour and respect the president and having invited us to a dinner, we decided to go for the dinner.” On when the meeting would be re-convened, Amaechi said, “the next meeting will be at the next National Economic Council, NEC meeting.” Ekiti State Governor, Dr Kayode Fayemi, however, gave indication that they might still reconvene yesterday night. “We are going to the Villa to honour Mr. President invitation to a dinner. If the dinner ends in good time, we would be back for our meeting. If it stretches much longer than we anticipate, we would sit with the President.” The Forum of 36 states governors had since been polarised into two camps following the rejection of the Forum election held on 24th May, 2013, where the Rivers State governor polled 19 votes, as against his rival, Jonah Jang of Plateau State who scored 16 votes. The Jang faction which has Ondo State Governor, Segun Mimmiko as deputy chairman had since vowed not to recognise Governor Amaechi’s leadership of the Forum as it claimed that the chairman of the Forum had always emerged through consensus, not election.
