Deezle, at common law, an employer has no right to refuse to accept an employers resignation. This is because the employment itself is contractual in nature and one party cannot force the other to work for him.

Your situation is rather unfortunate bearing in mind that it is a one man thing. However i woud suggest that you write formally to the company stating that you had earlier issued a letter of resignation and that despite that your salary has not been paid. Make sure your get it offically acknowledge. In this regard i would sugges that you use a courier company to have the letter deleivered. Reason is that the letter would form part of your documents in the event that you have to go to court to prove that the act of the of witholding your salary was indeed malicious. If no response is received, write a reminder, this way you keep building a solid case against the compnay.

It would be in your best interest if this issue is resolved amicably because you will always need the reference from your employer for the future. That said does not mean you have to denied what is legally us.

Been having a busy time since sanusi dropped the bomb shell.Apparently people are very scared of the EFCC in this country. Received some briefs from clients who have been invited to the EFCC office for questioning regarding the non performing loans they took. Really do feel for them though. But now i beleive the saying that one man's meat is another's poison.

Now i know not to be deceived by guys who flash cash. A friend of mine whom i thot was a lagos big boys owes one of the banks N250million. This chap lived the life of the rich and famous on a loan can u imagine. Now yawa don gas and he is in trouble. Before now, to see him i had to fix an appointment but since last week, this chappie hasnt stopped calling me to save him from the EFCC. The bank has even written a letter to the UK and Yankee embassies that he is owing them money.

At least the good side of all this is that w lawyers get to make some good dough thru recovery or defending the loan defaulters. Either way we are in.

Been off for a while, been chasing money about the town and trying to expand the office. Meeeeeeeen this country hard. I provide my own light, water, house, security and even road. Then wot the heck is the govt doing. Mt yara-do-nothing is jsut a lame duck president watching our country distingrate. I tire.

Works been great, but the hardest part is getting clients to pay. Most of the clients are my freinds so they play the paddy paddy card when it comes to making payments.

Meanwhile, where is cristalz?

Hi there everybody, long time,

Been on a rollercoaster in the past few weeks.

Where shld i start from,

My crazy driver is still misbehaving. Gave him moeny to get a house, he got it but came back to tell me its too far and that i shld buy him a bike to commute to and from work. Tollu guess your are right about the guy. I don tire for the guy. I have given him till the end of this month to either shape up or ship out.

Being an employer of labour is sure not easy. You get to deal with all sorts of issues your staff are going thru. rom their marital to domestic and religious. I get to hear all sorts.

Leased a house in Ikoyi for a foreign client of mine. the Landlord acted as the lawyer that prepapred the agreement, sole agent and property manager and collected all fees in this regard. can u imagine.

On the whole, life's been good making new clients and of course u know wha comes with it. At least now i can get my life back after another dismal season by Arsenal occassioned by Wenger's questionable selection policies

To all the new folks otuwe, T cann et al i say welcome and to all d oldies TKB, jarus, Mr crackles, cristalz, ajanlekoko keep the thread alive.

As it turned out, ‘A’s cousin was never appointed. Meanwhile, ‘B’ was desirous of collecting the balance of the cost of hire from ‘A’ who refused to pay.

Adeola advertised in the local newspaper that he inted to sell his DATSUN STANZA car for $100,000 or nearest offer. On Monday at 8 am Tunji telephone Adeola offering to pay $80,000, Adeola replied that he will only accept $95,000 wherein Tunji accepted to pay $95,000 “subject to inspection of the car”. Inspection was fixed for 4pm that same Monday. At 10:45am, Gboye call on adeola and offer $95,000 which Adeola accepted. Gboye paid and drove the car away. When Tunji called and discover that the car has been sold, he became angry and threatened to sue for breach of contract.
Advise him.

The case in the house is that the transformer is bad and cost of replacement is about 2m. PHCN officials dont even send. Men i am tired of this country.Living and running a buz in this country is a chore.

Yes Seun has the right and power to ban anyone on Nairaland in his absolute discretion and he does not have to give a reason for it. My assertion is based on the content inscribed on the 3rd to the last line of this page if you scroll to the end of the page.

"Nairaland is owned by Oluwaseun Osewa".

Being the owner he has absolute rights to control who writes and what is written on the site.

hi,
i have an insurance savings policy plan with insurance company xyz in Nigeria. this policy was billed to run for 5 years at 10% interst per annum. at about 2 years of the tenor i decided to terminate the policy. truly in their policy contract note they did talk about partial withdrawal by the middle of the programme but at the point of my request for termination; my account officer brings up a totally new scenario - that i would forfeit 35% of my total savings, this is excluding the interest which i have already forfeited. suddenly it looks as if they borrowed me the money rather than i was savings with them. he said its called 'ex-gratia' but sincerely that clause was not written in the policy. he brought a note for me to acknowledge and accept which i refuse to do. while i am willing to forfeit up to 10% of my savings because i am liquidating before time; i think its unfair to lose 35% of my own money simply because i called for it earlier when i would also be losing the interest earned already. its like i have been working for them. my question is what can i do - obviously they have been getting away with it before now. when i was marketed i was made to believe that should the unforeseen happen and i need to terminate the investment; i would forfeit my interest and an administration costs portion would be taken from the principal savings which although was unwritten; i guessed should not be more than 10%. having invested the money for 2 years, do i still have to bear a loss of 35%?. i assure you its not stated in their policy that termination before expiration of 5 years would be subject to any ex-gratia. kindly advise . thanks. i am made to understand that unless i accept the calculations; i would not be paid so i am being held hostage. i tried to negotiate that if i pay up the monthly premiuns to make it up to what it should be for 3-4 years, can i then get at least 90% of my investmetn but the answer is no. thanks. peaceland
You are perfectly in order to refuse signing the note. It is extortion on the part of the insurance company. 35% is rather excessive and exploitative. You should insist on the terms of the policy and nothing else. I would advise that you write to the MD of the company stating your position. Where you get no response you can take it further by getting a lawyer to write to the company and demand payment of your funds. From the look of things you might have to file an action in court to secure the release of your funds, if all other avenues for recovery fail.

Pls, what ur advice on this case; I ve worked for 3yrs with a company in Lagos, I was told to sign a bond for 5 yrs for a one week technical training in lagos on the day of the Training. I tried rejecting the bond but I was made to understand that it was compulsory. The alternative was to Resign and based on the present economic condition that is not the best tin to do. I cant stay with this company for another five years because their staff welfare package isnt very good. I have been applying to other jobs all the same. I intend to leave the Job without resigning If I find an alternative.

the penality for breakage of the bond is 5million Naira and a 3months notice must be given to the company before you leave.
so what do u think is the best legal way to leave?

I would need you to provide futher details in order to properly advise on this. Was any provision regarding the training and fidelity bond mentioned in your contract of employment at the time you joined the company? What is the length of notice stipulated in your contract of employment. In this regard, there is a need to peruse your contract of employment and the fidelity bond you signed.

Kindly advise on what my wife can do on this issue. She did he ND programme in Estate Management at Osun State College of Technology over ten years ago. Upon completion of the course she was given a Statement of Result (To Whom it May Concern) stating her grade and duly signed and stamped by the School Authority.
The issue however is that when she needed to obtain her transcript from the institution, they now came up with another story that she had reference in 2 courses thereby they couldn't release the transcript.
Please advise on the necessary step that could be taken as she was not aware of such during her studentship and even at the point of releasing of her statement of result (even in which she was graded by the school authority)

The certificate issued by an educational institution to a student remains the property of that institution and can be withdrawn at any time where it is discovered that it was issued by mistake or obtained by fraud. It also follows that where it was issued by mistake the student to which it was issued is entitled to compensation by the educational body because such a student would suffer inconveneince and embarrassment resulting from the withdrawal.

In this case i would advise that your wife goes to her former school and demands for the re-computation of all her results while a student. It may just turn out that the school was wrong. Your wife should also consider leveraging on any relationship she has with a person of authority in the school to help push her case forward.

Been off the thread for a while. Much as happened but to cap it all ita about my driver again. B4 una talk let me give u gist.

2wks ago driver didnt come as usual to pick me. Drove myself to the office and he came in later red eyed. asked my guy wetin happen said, landlord had sent him packing and that he had no where to stay. My 1st instincts were to sack him but reason prevailed. So finally decided to get him a house. Paid for it. The lease agreement for the crib is in the name of my Firm. That way he messes up he is outta job and on the streets. Driver with official residence. Icing on the cake is that he came in last week and said maybe i shld consider getting him an official okada too. I almost passed out. Truth is that i have tolerated him this long cos he is very good at his job and also very smart.

Worked from home this week cos Ac in my office just packed up. fixed it today though.On Tuesday i watched the best match of a lifetime Liverpool v Chelsea, dont support either teams anyways.

Weekend is here looking forward to having my boys thrash Chelsea in the Fa cup semis.

No spicy007 it is not to early to make one. The minimum legal age is 18yrs. The main advantage of having a Will is that one gets to control what happens to his/her properties from the grave. The snag here is that you are still single. If you make a Will now it becomes automatically revoked once you get married by virtue of Section 18 of the Wills Act.

I am impressed by your decision! My question is, I have a current account with Diamond Bank; and I'm out of the country for now. Several times I hve had to send them mails requesting for username and password to operate my account online or probably that they send update of my account (statement), unfortunately, afer so many months, I was forwarded a pdf statent whihc I would not open, and nothing since then. It's so frustrating and am loosing my mind to it; it's a small amount but my sweat! and that's my frustration!

Your option is to take the copies to the institutions that issued the certificates and have them certified. But in doing that you also have to consider the time and expenses of carrying it out.

Were the certificates obtained here in Nigeria or in the UK?

My suggestion is that you make a formal complaint to the authorities highlighting the non provision of study materials and how it is hampering your studies. As per the time of lectures you need to be more specific. Is it from 9am-12noon or btwn 9 and 13 hours? Keep me updated on the outcome of your report to the authorities.

Any one can undertake the certification of your documents. Where you do not have the original copies, you can proceed to where you obtained them and have the photocopies certified but where you have the originals, you proceed to a court with the originals of the documents to get the photocopies certified. Kindly furnish more details on the type of documents.

This is a classic case of battery to which the victim is entitled to damages. The gentleman involved can retain the services of a lawyer to help pursue his claim in court. The difficulty in this case however will be identifying the culprits whom i am sure would have absconded. The recent case of the battering of Ms Uzoma Okere is still fresh in our memories. Till date nothing as been done to the so called Naval ratings who manhandled her. That's the country we live in, very unfortunate though.

Since there was no progress with my son's potty training i decided to take it to another level.

I noticed that he imitates most things i do so i decided to pee in his potty in his presence and now anytime he wants to pee he goes to get his potty. Well we havent gotten him to do number 2 in the potty yet. I am thinking we just might have to take the same route again.

Have a property along that route also on the same side of Edidot college infact about 3 houses away, bought from Omonile 4 years back but proceeded to put up a structure immediately before any harrassment. Mine is free from acquisition though.

Depends on your location. There is a recent publication with regards to properties in that area by the Lagos State Government regarding those under acquisition. If i remember properly it has do with properties further down the road on the left side after Spot one.

Hope you executed a Deed of Assignment when you bought yours cos the omoniles around that area are very dubious?
