N3TRAL: The injunction is an interlocutory decision, it subsists pending the determination of the suit to protect the res.
In simpler terms, the injunction will be binding on the parties until the Supreme Court decides on the matter.
For instance, If a State Government wants to demolish a building and the owner gets an injunction from a high court of the state to prevent the demolition, the injunction will last until the high court decides whether the Government has the right to demolish the building or not because if the Government destroys the building before the judgement of the court, the government will not be able to rebuild the exact building if the court rules in favour of the owner of the building.
The central bank of Nigeria and the FG will not be able to repair the damages that will occur because of the rejection of old naira notes if the judgment favours the State Governors at the end. The injunction will therefore subsist till the matter is determined.
If judgment is given in 2030, That's when the injunction will elapse  Waoh...Thank you for this...CBN has been cornered. |
