This is my humble reasoning on this issue and please do not attempt to insult me, as I have a right to reason and I ain't quoting you.

The AGF might say what he said because he has to be in the good book of his masters...however, in doing this, he may have misled INEC who is supposed to be independent both in its decision making and actions.
What I see here is that after this unfortunate event, INEC should have made a pronouncement but they remained silence until the AGF spoke. Meaning, they were not sure of what to do, as such need the guidance of AGF and not necessarily their legal team(I might be wrong). As such, they are now seen to be partisan. I felt they should have gone to the court for immediate interpretation cum judicial pronouncement on a matter as this'd which the 2 constitution they are guided with had not envisaged and as such never spoke on.

This case should not be compared with Amaechi's even though it looks so close. The 2 events here are very different. What might make them seem close is the fact that the party is often accepted to be the one that wins and not the individual. But, I'll say that different strokes shouldn't be use for different folks on similar/almost similar scenarios; a case at hand is Gombe election petition tribunal which gave PDP victory to APC on account that PDP primary was not witness by INEC, rather than give PDP a chance to conduct a fresh primary, just as the are giving APC now in Kogi. Smh for Nigeria shaa.
I will want to ask some of us, if they would have voted for APC if Tinubu was its flagbearer (no pun intended). I believe party is a platform, but it is the individual that we all voted for, as such I believe also we will never vote for a party who doesn't present a candidate, even if INEC allows them to stand in for election, reason being that we may not like who they will bring up later...

As for Kogi, with the inconclusive result thus announced, APC/late Audu led and it is understandable when APC insist on substituting its dead candidate. But, would that person be who the Kogians actually would have voted for? A question that begs an answer from Kogians. Well, however it turns out, I feel APC will still win even with a re-run, because the citizens are tired of Wada's method of governance

I just feel that the supreme court may overturn this case or probably uphold it, as they are judges that know better than I do, especially if they are nonpartisan.

You have a very Good Point but you need to understand something that we are not the same in our way of thinking , Some voted for Party while some voted for personalty for example during 2015 general Election in my Area after voting for Buahri i voted for all others APC Candidates without even know their Names that means i voted for PARTY not the Candidates , another example When Governor Fayose left PDP to contest as Senatorial candidate under LP he didn't win despite his Popularity but he came back to PDP and win the Governorship Election that means no matter how Popular you may be Party is still play some Major role , Agbaje would have won in Lagos if he came out under APC because Lagosians didn't vote for Ambode instead they voted for APC.

You know what , PDP will just be wasting their time by going to Court in regards of anything APC Does because at the end of the day APC will still win because it either the Courts rules that APC does not have Power to substitutes candidates again which means his Deputy automatically becomes a Governor or the court might rule that Audu Runner up in the Primaries election should have been his replacement which still means APC still Win so whatever arguments PDP may table in court the judgement will still go in APC way unless you want courts to declared the total Elections invalid because one of the candidate in election dies after casting his vote.

The ball is in APC's court. They have two options left for them. It's either they fill the space with the candidate second in position to Audu at the party primaries or with Abiodun Faleke who is already a joint contestant with Audu for the people's mandate. The mandate primarily belongs to the party and the Party has the sole decision to chose who to give it to among its eligible members.

Only two APC's members are eligible in the circumstance at hand to fill in the vacuum. It's either a party member who contested in the party primaries that produced Audu in the first place, in which case the candidate that came closest to Audu in votes then may most likely fit in, or the candidate in joint contest with him for the party's mandate in the Guber elections, which is still ongoing. As it is now, the APC maintains the right to chose from either of them as there is no law that specifically states they must consider previous party primaries to chose the candidate to fill Audu's position in the circumstance.
God Bless you for this Wonderful comments but please i need you to help me out with this issue because am totally confused here though am not a Law student but i have little knowledge about Law...........Does any of our Constitution both electorate act and 1999 constitution mandated a Political Party to choose a runner up to the Winner of any Primaries in case of any Substitution like this occur or does it just Mandated Political Party to choose whoever they want the reasons for asking now is because the person that came second in that Primaries is Yayale Bello and his not from Igala and according to the Popular saying in Kogi now those Igalas still want an igala man to replace audu but if APC went ahead to choose an igala man who does not participate in the Primaries or participated but does not come second don't u think Yayale Bello might head to court to seek court interpretation on the issue and if the Party also decide to elevate his deputy to that Post don't u think one one of those that contested the primaries might head to court as well and arguer that Faleke never contested party Primaries but as it stand now my only suggestion is for APC to arrange another Primaries only if the Law allow it.

Mr Man i don't care if you from Igala or Agatu , one thing you need to understand is that the only affected areal where election was not head have about 49,000 registered Voters and only about 25,000 collected PVC so if the whole 25,000 with PVC Voted for PDP , APC will still win remember they already leading with 41,000 votes already.

Thank You for your Wonderful Comments that is the reason why there wont be total cancellation of the the election, in fact INEC Errand by Law to have Declared APC Winner because total accreditation Voters from the Local government where election was not held is about 25,000 voters which is less than what APC was leading with so i guess INEC played a foul Game there which APC might decide to approach court of Law with.

In as much as I desire for a Nigeria where a female will be elected as a governor, but as a lawyer this judgement should be overturned on appeal. Reason being that neither INEC nor the Tribunal has the jurisdiction to decide on intra party activities, I.e whether or not the candidate was validly nominated by the party he or she represents.

I don't want to know whether Saraki is guilty or not, but the CCT is really stting a bad precedent and I congratulate the SANs for having the courage to walk out on him. We need to preserve the sanctity and independence of the Jusdiciary.

Why is the CCT in a hurry to proceed to trial? Even a first year Law student knows that the right thing to do is for the CCT to suspend actions during the pendency of the matter at the apex Court. I am sure their Lordships at the Supreme Court are very angry with the CCT for such disposition, but if they come down hard on Justice Umar, the public(who are ignorant of the law) will say the Justices of the Supreme Court had been compromised.

Can you now see how external influence impedes the wheel of Justice?

What a corrupt government,what an irrational president, what a foolish and illiterate president is presiding over the affairs of federal republic of Nigeria. Sorry Nigeria you are in for a goose chase, u brought calamity upon yourself, now you have to live with it.
You either ignorant or you don't know what you are saying , What stops his People from going to Court or when does PMB become a court of Law to convict Ameachi , am not a supporter of Ameachi but if PMB has been using all the petition written against all Ministers Nominee then no one will be screen , my only advice for you is that you can relocate to Niger Republic or Togo if you tired of this Government or better still learn how to live with it for the next 8yrs if not double or triple.

Abia state with two slots, that's supposed to be an error I suppose. Besides, where does Ogbonaya onu hails from. perhaps Barth Nnaji wants to correct his resignation under Goodluck Jonathan or he forgot something on the seat. Anyway It's the competence that matters at the end of the day.
