Politics › Re: Ghanaian Government Apologises After Demolition Of Nigerian Building In Accra by Just30: 1:06pm On Jun 23, 2020
No one is twisting anything

we are just correcting the false narration you guys are putting up there.

simple question, Was the Nigerian Embassy demolished?
Was the Nigeria Embassy premise entered into?

The Chiefs cant go to the government since the government was not the owner of the land and wasn't the encroacher.

They went to the Nigerian Government and told them to stop encroaching on their lands on several occasions.
As a government of Nigeria, what would you do when such letters are written to you concerning illegality?

Yes, a chief can pull down the Government of Ghana property when it encroaches on their land and the government of Ghana will have no say because the land does not belong to the government. Property right

The Ghanaian Government will not even watch for it to get that far and they will resolve it and make payment for the property.

Why didn't the Nigerian Government go to the Chiefs to resolve it on several occasions that they were written to?
why did they watch for it to get this far?
babytoun:
oga you are working very hard to twist this and it won't work ..

I was listening to cityfm yesterday and they clearly stated the articles of diplomacy that have been breached ..

if there was any problem with the land the chief should have deferred to the govt of Ghana to handle the matter...if it was legal demolition it should have been done in broad daylight with visible police protection ..not armed faceless men at night..

Can a chief in Ghana pull-down govt structure even if there is a dispute without consequences?

Don't come here twisting simple logic...the memo from the foreign ministry is a damage limitation measure becuase this action has caused to serious shock in the diplomatic community in Ghana ...

Even the America embassy will not dare to encroach on lands that does not belong to them.

Which other Embassy in Ghana have you ever heard to have encroached on lands.

You can check on how the American Embassy acquired new lands in Accra, The first consulted the Ghanaian Government of their intention before they went to the Chiefs to negotiate the acquisition.
DexterousOne:
So if the American embassy was standing on that land

Will anyone have had the guts to go there to bulldoze it?

Ghanaians eh
You people undecided

Dont worry
When the consequence of this begin to unfold

Make una no cry
Politics › Re: Ghanaian Monarch On Demolition: Nigeria Wanted To Take Our Land Forcibly by Just30: 12:45pm On Jun 23, 2020
It was the Nigerian High commission who claim that their property was demolished by an individual and the media picked it up from there.

The diplomatic space of Nigeria was not invaded.

The Chief has more power than the government when it comes to land.
Why should he seek government help because they have a land issue with another person, when all Authority regarding lands is in their hand?

The Nigerian High Commission was invited by an entire Paramoncy with the same status as the embassy and they decided not to show up on several occasions despite the fact that it was explained that they were committing an illegality by encroaching on the land.

If you know how lands are administered in Ghana, you will know that no wrong has been committed yet aside from the encroachment.
Johnsghana:
Please follow the story well... Initially they said the land belonged to a private individual, now when it snow-balled into an international incident for Ghana they brought a Chief to start telling stories.

This is an act of war.. an invasion of the diplomatic space of another country on any territory which is sovereign territory by UN laws is considered an act of war.

Ghana has been brewing for a confrontation with Nigeria for a while and I know it because they are beginning to eye all the Nigerian investments in Ghana. They want to take over all of our assets in Ghana. Nigerian govt should not let this go if not other smaller countries will follow suit.

Even if the Chief's story were true... Why couldn't he invite his govt to intervene considering that he is dealing with the govt of another nation? And if the Ghanaian govt was invited, why didn't they resolve before now?

I don't how you can't see all the shades of what is wrong with this issue!

if what u meant by contention is land dispute between two owners then I wonder if u read d story at all
yes i read the story

For a land to be in dispute, there must be 2 ownership claims and that is not the case here

Those are the facts

Lets wait for the investigation then

No the premise of the Nigerian High commission was not breached since their premise is well defined by the land boundaries recognised by law as theirs by Ghanaian law and under the Vienna Convention.

The new property is not in the boundary of the Vienna Convention
babytoun:
Let me ask you clearly was the premises of the Nigerian High commision breached ?
Politics › Re: Ghanaian Government Apologises After Demolition Of Nigerian Building In Accra by Just30: 10:51am On Jun 23, 2020
I can say yes, the building was being erected without permit because, to be issued a permit, You have to show ownership of the land with documents from Lands Commission.
And there is no ownership record by the commission of the said parcel of land at the lands commission in Accra.
babytoun:
Ghana govt statutorily owns 20% of all lands in Ghana

you are missing the point...even if what you are saying is true ...my question is what is the procedure for seeking redress if there is land ownership dispute with a diplomatic mission?

If there is any problem at all with the said land it should be between the govt of Ghana and the traditional ruler ...Nigerian High commision will not just start building on a piece of land without the Govt of Ghana giving it's consent ...

Are we saying the building was being erected without permit ?
Politics › Re: Ghanaian Government Apologises After Demolition Of Nigerian Building In Accra by Just30: 10:48am On Jun 23, 2020
And Paramount Authorities own as much as 60% while the remaining 20% are family lands.

The said land in question is a stool land and has not been acquired by the High Commission, so i wonder why they will go and build on it.

1. The land ownership is not in dispute, because the ownership is strictly not in dispute, the procedure for addressing that is usually a warning and an invitation by the stool after which they can go ahead and demolish if the person has not been on the said land for more than 5 years.

The diplomatic mission sits on a different parcel of land and their diplomatic cover does not extend to the land in question because it is not part of the original land given to them by the Ghanaian government under signatory by the same traditional council.

2. It cannot be between the government of Ghana and the Traditional Council because the government of Ghana has already done it part with the traditional council and given the Nigerian High Commission a huge land. Any other acquisition that the Commission need to make after that is strictly between them and the owners of the land. OR the commission could have asked for help from the Ghanaian Government to reach out to the Osu Traditional Council if it wanted to acquire the land in question since, according to the Vienna Convention, A diplomatic mission can only acquire additional residency with the permission of the host country.

The property was not illegally bulldozed,

The ownership of the land is not in contention.
If the land ownership was in contention or the Nigerian High Commission had been on it for more than 5 years, then they would have needed court permission before they bulldoze it.
topboss:
THE GOOD PEOPLE OF NIGERIA EXPECT THIS WARRANT CHIEF TO BE ARRESTED AS PARTY TO THE UNLAWFUL DEMOLITION OF PROPERTY BELONGING TO THE NIGERIAN HIGH COMMISSION IN GHANA.

GHANA IS A COUNTRY OF LAW AND ORDER AS THEY SAY, SO UNLAWFUL DEMOLITION OF STRUCTURES WITHOUT ADHERENCE TO DUE ROCESS OR RULE OF LAW SHOULD ATTRACT PENALTY.

XENOPHOBIA IS NOT AN EXCUSE TO COMMIT CRIME.

U CANNOT TAKE THE LAW INTO YOUR HANDS AND USE THE NATIONALITY OF THE OTHER PARTY AS JUSTIFICATION FOR YOUR CRIME.

IF WE ALLOW THIS, TOMORROW THEY WILL KILL A HUMAN BEING AND SAY IT IS NIGERIAN.

GHANIANS ARE CRIMINALLY MINDED PEOPLE, THEY RENT SHOP AND SELL LAND TO NIGERIANS AND THEN GO BACK TO TAKE IT, SAYING THE PEOPLE ARE NIGERIANS, AFTER COLLECTING MONEY.

THEY WILL NEVER REFUND THE MONEY THEY COLLECTED AND INFACT, YOUR GOODS IN THE SHOP WILL BE LOCKED AND THEY EXPECT U TO LEAVE THE COUNTRY.

THIS IS CRIMINAL BEHAVIOUR.
Politics › Re: Ghanaian Government Apologises After Demolition Of Nigerian Building In Accra by Just30: 10:21am On Jun 23, 2020
According to several rulings from the High Courts in Ghana on land issues where the ownership of the land is not in contention, The traditional Council are in their rights to bulldoze the said property after several warnings and invitations.

The Traditional Council is a custodian of all stool lands
babytoun:
[s][/s]

you are still not making sense..and working too hard to defend this illegality and assault.

you are asking us to wait for the outcome of an investigation while you already KNOW that encroachment by the Nigerian high commision will be established . This is why I have little confidence in any kind of investigation by the Ghanaian govt ...if this act can be done on a property just 10 minutes from the force headquarters ..

In the lengthy explanation of the traditional ruler there was no talk of approaching the courts before you even think of getting a judgement ...his statement seem to suggest that the High commision had a deal with the govt while the land actually belongs to the traditional stool and since invitations to negotiate with them failed they took the laws in their hands and did the "needful.

And if they have court papers to demolish why did they go there by 10pm on Friday with faceless armed men ?

Even traditional lands in Ghana need court approval to bring down structures ..the fact that some illegality has been happening does not make it the law of the land...mind you I stay and work in Accra here ..and this is the position of respected unbiased journalists here in Accra..

The memo from the Ghana government states clearly that the premises of the Nigerian High commision was breached which clearly is against the the articles of the Vienna convention and it is regrettable...whatever conclusions you make of this is your business

.

In Ghana, political heads are subjects to paramount Authorities when it comes to land issue.

Even the Ghanaian government seeks permission from traditional authorities before building on their lands.
babytoun:
And where did you get this from ?

The Nigerian High commision is a guest of the Government of Ghana and a super guest for that matter as per diplomatic standards..

If any person or traditional ruler has a problem of land ownership with the commision that has to be channelled through the foreign affairs office of the govt of Ghana ...not jumping the gun to come destroy the property with armed men at 10pm ..

The govt of Ghana has to handle this very seriously becuase in a way while it is an insult to Nigeria...it is also an insult to the govt of Ghana that individuals in the country can do this to diplomats without deferring to the it.
