The Supreme Court has invalidated the local government elections conducted by the Rivers State Independent Electoral Commission (RSIEC) on October 5, 2024, citing significant breaches of the Electoral Act.

Delivering the judgment, Justice Jamilu Tukur ruled that the election was null and void due to a lack of substantial compliance with electoral laws and guidelines. According to the court, RSIEC failed to adhere to proper procedures, particularly by continuing voter registration after officially announcing the election date.

Justice Tukur emphasized that the electoral commission’s actions violated Section 150 of the Electoral Act, which outlines the necessary procedures for conducting local government elections.

The court further noted that the hurried process leading up to the election compromised its credibility, rendering the entire exercise unlawful.

Defection: Court Urged to Declare Ned Nwoko’s Seat Vacant, Order By-Election

In a significant political development, a lawsuit has been filed seeking the removal of Hon. Ned Nwoko from his position as the representative of Delta North Senatorial District in the National Assembly. The suit, brought before the Federal High Court in Abuja, contends that Nwoko's recent defection from the People's Democratic Party (PDP) to the All Progressives Congress (APC) constitutes a breach of his electoral mandate.




The plaintiff, a concerned constituent and member of the PDP, argues that Nwoko's defection violates Section 68(1)(g) of the Nigerian Constitution, which stipulates that a lawmaker's seat should be declared vacant if they defect from the party under which they were elected, unless there is a division within the party. The suit asserts that no such division exists within the PDP, rendering Nwoko's defection unconstitutional.

The plaintiff is requesting the court to declare Nwoko's seat vacant and to mandate the Independent National Electoral Commission (INEC) to conduct a by-election to fill the vacancy. The suit also seeks an injunction to prevent Nwoko from further parading himself as the senator representing Delta North pending the resolution of the case.

Hon. Ned Nwoko, a prominent businessman and politician, was elected to the Senate under the PDP banner in the 2023 general elections. His defection to the APC has sparked debates about the legality and morality of elected officials switching parties without relinquishing their seats.

As of now, Nwoko has not publicly responded to the lawsuit. The case is scheduled for hearing in the coming weeks, and its outcome could set a significant precedent regarding party defections and the sanctity of electoral mandates in Nigeria's political landscape.
