Travel / Re: US Visa Refusal Under 214(B) by Kettlecorn: 4:30am On May 25, 2021 |
Paaigba: 214b denial means you did not convince the VO that you will return to your home country after visiting the US. Very generic. But here is something specific that caught my attention that could be a contributing factor. "I received a memo from my office that the offices will be closed because of the Second wave of the pandemic and stated further that we're expected to stay at home and work from home until further notice. So this 19 weeks is a one off" The possible inference to be drawn from this statement is that you stayed and worked remotely from the US. In general, US tax law states that income from abroad of more than $3000 per year counts as US income (which means that taxes need to be paid in the US). With a B1/B2 visa, you are not allowed to have a US income. I think it all depends on the VO. Some may let it slide, others may not. 3 Likes |

Belle35: Let me try to shed more light on the birthing issue as you seem to be missing an important point that was mentioned by the poster you seem to have an issue with. The problem may not be ensuring that you paid all your bills. It could also be that you were charged a subsidized amount. It's typically the fact that hospitals in the US at that time provided discounts to cash paying customers which brought the price down significantly below what the embassy considers market rate. The inference they are making (right or wrong) is that non cash paying customers (insurance and the taxpayer/Medicaid) are subsidizing cash paying non citizen patients. The way around this is to bring your proof of payment showing that you paid "market rate". In addition, there were some hospitals that the embassy knows for doing this, such that once they see receipts from these hospitals, it becomes an uphill battle to overcome. I recall there were one or two in Texas. BTW, just curious about this. If you gave birth in 2012 and travelled on the same visa in 2018, it implies that you probably got a multiple entry visa in 2012 close to the time you traveled. Did you disclose that you were travelling for birthing purposes/you were pregnant with intention to give birth in the US at the time of the visa interview and at point of entry? How long did you say you were staying at POE vs how long did you actually stay? Note that it could be problematic if for example you said you were staying 2 weeks and stamped in for 6 months then stayed past the 2 weeks you stated at POE. Consistency/honesty is key. The interviewer has all that info on their computers. These are all issues that sometimes haunt folks at renewal. 9 Likes |

omoluka: I can't find any stats on recent issuance rates/ refusal rates but they issued just over 1,110 b1/b2 visas in February 2021. In Feb 2020, they issued about 4,500 and 8,500 in Feb 2019. The 2021 lower number most likely has to do with covid restrictions but there is a definite declining trend in numbers over the years. The adjusted refusal rate for 2019 was 67% which equates to a 33% issuance rate. |

OP, listen carefully O! This is how poverty in retirement gets perpetuated from one generation to another. This may sound harsh but it's the naked truth. Your mother did not plan for her retirement that's why she's in this situation. Many in her generation fell into that trap relying on their children for retirement becaue they did not not recognize that times were changing fast and did not realize that their children will move far away from home to wherever they can earn a better living. Our forefathers lived like that in the past because people lived all their lives in the village and farmed for a living so the entire extended family was around to take care of the elderly folks. But times have changed. Do not make the same mistake and be a burden to your own children in their retirement. You can break the cycle now. I'm sure you're smart enough not to quit your job and go back to the village. Like many have said, bring your mum to where you are and take care of her with help from your siblings or hire a caretaker to look after her in the village. Insist on your siblings chipping in too becasue the finances you should be saving for your own retirement years is what you will be expending taking care of her. Are you married or have children? How can you move back to the village if you have children and jeopardize their future? 7 Likes |

radautoworks: You're most welcome. I like that you're trying to do things right and you do come across as a person of integrity, so I'd just encourage that you just do you and not let your experience with any one person influence/change you or the way you respond to situations. Someone put it this way. A gentle man holds the chair out for a lady, not because she's a lady, but because he's a gentleman. Regardless of how bitter the experience is, maintain your standards and be who you are. I think your first inclination was the right one and actually is who you are deep down. radautoworks: Just curious, but have you investigated what it would cost to get the software update at the dealer? You could do this and provide the information to the customer as a measure of goodwill. If it's a non significant cost (although nothing dealer related is), you may even decide to eat the cost One other thing since you are undoubtedly following a US shop template and setting up best practices. I think you should consider hiring a good service advisor who has experience in customer relations and has technical knowledge to interface with customers and explain stuff in layman terms. This position also serves as quality control for repair plans. Best practice has found that actively working techs are not the best interface with customers, besides, their time is money. It also helps that the customer has only one point of contact/the same point of contact throughout their experience at your shop. Wishing you the best as you build your business in our difficult Nigerian environment. 8 Likes |

radautoworks: @radautoworks. I have a lot of respect for what you're doing in such a difficult environment and doff my hat to you. But I do think you are missing a few key points in this situation. In general, when a customer brings a car to a repair shop, the usual process is that the shop takes a look at the car, makes a diagnosis and comes up with a repair plan to fix the issues then presents a price quote to the customer. So far, it appears that the correct diagnosis/repair plan to fix the critical issues was done after a price quote was given. Your guys jumped the gun on this. I will provide one example out of the many that are apparent here. The check engine light. I don't believe your guys knew how to fix this until after the fact. How do you explain away that the customer was not told that it would require a "dealer only option" software update before the check engine light can be rectified at the time of the quote? All along, his expectation was that the quote you provided will fix this. If you knew, you should have told him and should have even included the cost as a separate line item in the quote to have this update done by your guys taking it to the dealer. Same thing with the oxygen sensor. Why has this just come up now after he was given a long list of parts to buy? If the diagnosis was correct, it should have been included in the price list/quote from the start. My humble suggestion is this. You're a professional shop. Have your guys take as much time as needed to do a proper diagnosis and provide a detailed repair plan and quote to the customer. Charge for diagnosis time. If the customer does not want to proceed, you still get paid for your time. If the customer proceeds, then you have an obligation to eat whatever costs that are incurred for an inaccurate diagnosis as goodwill to maintain a good reputation. 23 Likes |

fkj950ax: In this case, it may be be his "Achilles heel" if care is not taken. What was the outcome of the UK application? If denied....hmmmm. What information was filled out in that application. If there are any big inconsistencies, for example if he said he was married in that one with kids and not married and no kids in this one, it may lead to sinking this application. I would advise that he review that application and be aware of the information provided there before proceeding with this one especially if the UK visa was denied. |

1) too many people are applying for US visas (no embassy can handle the sheer volume of Nigerians seeking US visas); I touched on this briefly before. The statistics show that this statement is inaccurate. China and India process much higher volumes of applicants than Nigeria yet they don't experience the issues we see in Nigeria. In a good year, they issue approximately 100 thousand Non immigrant visas in Nigeria, 800 thousand in India and 1.2 million plus in China. Refusal rates are somewhat similar in Nigeria and India. Data from February 2021 shows they issued approximately 1,400 NIVs in Nigeria and almost 30 thousand in India. |

TWoods: The wahala I am referring to is all the issues relating to getting an interview date, dates going out 2 years at the present, payment expiring before your date arrives, lack of clear information, tech issues etc. These are process issues that our authorities need to lean on the embassy to resolve. Go to India and see how things are run smoothly there. They process 10 times the number of applications that are done in Nigeria without all the silly issues we experience. Information is readily available and accessible by phone calls and email as opposed to guesswork and word of mouth here in Nigeria. The Indian gobernment does not play, neither should ours. 7 Likes 1 Share |

TheGreatIYANU: Oga, there is no guesswork involved here. The requirements are clearly stated on their website + what's in the email. First, Readers can infer that OP is currrently not in the UK. They said he can apply after he has been there for 12 months, but note that the 12 months starts from the date of application which means the 12 months immediately preceding the application date. Does not count if he had spent 18 months in the U.K. at some other time. He obviously had not been in the UK for 12 months preceding his original application that's why they said he can apply again if he can find his way to the UK and stay for 12 months. In addition, there is an immigration requirement which appears is the real issue they are skirting around. If you are a Commonwealth citizen or a foreign national, you must be resident in the UK free of restrictions and with indefinite leave to remain in the UK. Devil is in the details. I spent less than 5 minutes on the website to understand the requirements. I suggest anyone trying to unravel the situation do so too. 3 Likes |

Are they not aware of all the wahala that Nigerians go through at these embassies? Is it not their job to summon the foreign ambassadors and complain about these issues and demand that they treat us better? We Nigerians attach a lot of useless sentiment to both good and bad traditions. A tradition is a set of practices that a group of people have accepted and decided to practice. Tradition started one day. You too can start a new tradition today and it may become the norm 10, 20, 100 years from now. As long as you are not doing anything illegal, you are free to start your own tradition. Black smoke form the exhaust usually means that your car is burning too much fuel. First thing to check is your air filter, make sure it is not clogged. Injectors or turbo if equipped could also be the issue. There are other big causes but start from these simple ones. |

Nnatuu: Bros, the right thing to do at that point would have been to contact the embassy and inform them that you have recently gotten admission and would like to change your application from B to F status visa. Alternatively you should have mentioned at the time of interview that your intentions have changed and you will be applying for an F1 visa as you recently got admission. They probably would not have issued you the B visa, but noted you as being truthful and honest which would be impactful on your next application. At the time of your B1 interview, you withheld information that you already knew and this is as bad as being untruthful in their view. 1 Like |

For example, even if she was stamped in for 6 months after saying she will stay 2 weeks, the 2 weeks is still on record and is the truth hurdle test. Due to our reputation, there is very little benefit of doubt given to inconsistencies in our narratives. She should recollect what she told the POE officer and figure it out from there. |

adanny01: So far, that is still a valid statement. It could be the PCV valve, valve guides, rings or even something else. I have seen a transmission fluid leak cause blue smoke. All of these can be replaced/rectified without a need to replace the engine. Only Radautoworks have physically seen the engine and have provided a diagnosis, so we should give them the benefit of the doubt especially since they have provided a guarantee which they are honoring. At this point, we should leave this be and allow things to follow its logical path. 3 Likes |

@Crocif; I have been in your shoes in the past and know how you feel. I think what you need right now are just some basic tips to help you understand what is going on with your car. @Kelvin30286063 does have some good points about having some basic knowledge of what is going on so let me help you address the main issue; blue smoke on startup. This is an indication of oil leaking past valve guide seals if only on startup, but it may be that you do not notice it when car is running. Here is a simple test you can do along with your wife to narrow down the potential cause. Have your wife stand behind the car and watch the exhaust. Put car in neutral and rev up to 3.5-4k rpm for a few seconds then back off the throttle. If you get blue smoke only when you back off the throttle, your valve guide seals are potentially leaking. If you get blue smoke continuously as you rev the engine, your rings are potentially leaking. The reason for this distinction is that when you back off the throttle, you create a high vacuum on the intake side and it sucks oil past the guides. Another simple thing to check is your PCV valve. If it is stuck closed, crankcase pressure builds up and the results are often smoking. There is a simple cheap DIY tool you can use to look through your sparkplug hole. Its called a wifi enabled endoscope. I have used it in the past to see if oil or moisture is pooled up on top the cylinder and asses their condition. The cost to remedy each of these causes is on a wide spectrum with replacing the PCV valve being the cheapest, followed by valve guide seals and finally rings at the top. This is why I said in another post that this should be the primary thing that should have asked to be diagnosed, estimated and repaired before anything else. One more thing which I mentioned before. The crankshaft rear seal leak is a big important job. A catastrophic failure here will lead to rapid oil loss and complete damage to your engine. This may be why you are getting a low oil level light if its leaking rapidly. 5 Likes |

radautoworks: Yes, I did watch the video and that's why I was bit further confused. I may be mistaken but I didn't really hear anything that addressed issues directly related to blue smoke on startup or the potential magnitude of that issue. He did talk about lots of codes maybe related, I don't know, including TPMS which I thought . The one big issue that was mentioned in the video that was leaking is the rear main seal which in itself is a big job due to the location. These two issues are enough to condemn a car in my opinion . But you're the expert who has physically seen the car and I'm just an arm chair wannabe technician giving vague diagnosis over the internet, so I humbly defer to your expertise. I do commend you for standing by your work by offering a warranty on labor. It is common practice in developed countries but unfortunately unusual in our dear Nigeria. 1 Like |

I'm a bit confused after reading the synopsis of work done vs the complaints the OP has. Looks like his principal complaints are twofold. First, the blue smoke from exhaust on startup and second, the Christmas Lights on the dashboard. Below is what he said was done on the car. I do not see any of these addressing any of those 2 issues, unless there is more detail under #1. Everything that has been done is straight R&R, nothing really technically challenging. The R&R stuff, although being the easiest to resolve should have been tackled last after figuring out the real major stuff. 1) Engine tune-up: a combination of services 2) Remove and replace steering rack, pinion assembly and tie rod 3) Remove and replace control arms (both) 4) Remove and replace rear axle 5) Remove and replace front CV axle 6) Remove and replace oil sump 7) Materials required In my mind, the real question here is an issue of how the repairs were prioritized. I would have started with the #1 priority thing to resolve which is the blue smoke from the engine. They should have figured out what was causing this and if it can be cost effectively repaired. If the remedy will cost more than the car is worth and or if the owner is unwilling to spend that amount, the other issues would be a moot point. The logical thing to do would then be to cut your losses, dump the car with full disclosure and move on. Too late for that now. If the blue smoke remedy ends up being a new engine or internal engine work, the OP will end up spending much more than that car is worth at this point. Having said that, I also think opening up a thread on the issue is a bit premature being that OP was asked to bring the car back and told that a warranty is in effect. 5 Likes 2 Shares |
