Under the English common law received into Nigeria by the Supreme Court ordinance of 1914 and Interpretations Act in section 45, Bukola Dakolo would have no case because of the common law doctrine of Res gestae which rendered Criminal cases useless if the evidence was not contemporaneous in time and place.
The law is dynamic and evolves to serve situations like this, thus the enactment of the Nigerian Evidence Act which renders the rules of common law void when it is inconsistent with the provisions of the Evidence Act.
Section 4 of the Evidence Act, 2011, attached below provides to the effect that evidence which occurred at a different time and place related to the fact in issue is relevant and therefore admissible in court.
Thus, the provisions of that section when read in Pari materia with sections 5-10 of the Evidence Act, makes circumstantial and character evidence admissible in court.
This is not an American Legal movie where videos (documentary evidence as defined by section 258 of the Evidence Act) and forensic evidence are required. According to the acclaimed victims story, her brother went to make trouble at the residence of the alleged predator when he became aware and there was settlement. That very act and testimony of witnesses of that act and the terms of settlement after the victim's brother's action, at about that period is enough if corroborated as circumstantial and character evidence to prove the case. |

Daboomb: Most comments, like yours, which seek that INEC produce "an election result Server", are laden with too much EMOTION and devoid of "legal" basis (No pun intended). Why do l say that? The matter is in a Court of LAW and as such, issues have to be debated in its LEGALITY. What do l mean?
- Do you agree that there is a subsisting LAW (Electoral Act), which forbids the transmission of results ELECTRONICALLY.
- Do you agree that there was a PROPOSED Amendment to that Law (Electoral Act) but the amendment was not signed into law? ...and therefore it is still illegal to transmit elections result electronically.
- Yes, money was approved to buy Electronic equipments (in anticipation of the President signing the amendment into law), including Servers and they were bought, the Question is: WAS the SERVER USED in the election?
- Another question is: Would it be legal if it were used in the election? Would it not invalidate (legally) the winner of the election, bearing in mind that the law PROHIBITS the trasnmission of result electronically?

Your last question (#5) is what l sought to answer in detail because all the previous four are mere "historical facts" which does not affect the decision of INEC not to break the law (by deciding not to use a SERVER to transmit election results).....hence the need for the results to be announced manually/verbally by INEC returning officers.
So you see why l say that we have to separate "emotions" from the application of the law.....the law may be an ass but it is still the law. What we "wish" to happen in this matter, is borne out of our emotions but what will happen, is borne out of the "electoral LAW".

I would have allowed this to pass as a commentary on the general state of our education, but for the second item on the write-up.
The op stated that the graduates from private universities are better than those from the federal universities. I beg to disagree. While, there has been a general degradation in our educational system in Nigeria, I still maintained that the Federal Universities are by far better than the private ones in Nigeria of today.
This may be because of my area and industry as a whole but my experience is at complete variance with what the op said. I do sit on the interview panel for my company once in a while, as a technical assessor for engineering recruits, but that is not the only source of my assertion.
I am a member of the society of petroleum engineers and we have two major competitions, the PETROBOWL and PETROQUIZ that we organize for the various universities in Nigeria. The winner in Nigeria normally goes ahead to represent Nigeria at the international competition normally during the ATCE outside Nigeria (mostly in US).
The competition has always been won by Federal Universities, in fact Uniben has won the international competition before and that was the only time a Nigerian university won it.
We also use to assess the petroleum engineering departments of universities in Nigeria and I can tell you that the private universities have a long way to go to catch up with the Federal ones.
Now, that leaves the state owned universities in between. Many are useless and are just universities in name and a few are good.
Yet, no Nigerian University is where they are meant to be in the comity of schools on the world stage. |

This only means that the transmitted results are based on the signed paper copies. The ones signed by party agents still remain the original. Hence a copy can not supersede or invalidate an original. If there is any discrepancies, the original must be resorted to. It would have even been better to transmit a Scanned PDF copy of the original, like that, it will be as good as the original. As it is now, due to the electoral act and the previous judgement of the Supreme Court on electronic election, the only acceptable result is the original hardcopy as announced by INEC. The Supreme Court have ruled electronic voting illegal in The case of Dakuku Peterside and APC vs Wike, PDP and INEC. INEC server and website results can never be admitted against what was signed by all party reps and declared.
Lagos 2003 governorship election is a precedence. Funsho Williams was declared on the INEC site and even accessible by all on the net. But Tinubu was returned as the winner by all returning officers and declared winner by INEC.
Funsho Williams lost the case at the tribunal.
This is a similar case and the hard paper results will surely win over the frivolous server. |

Only returned figures matters in our Electoral system. That is why INEC is in a fix with Okorocha now. In 2003 Lagos governorship election, INEC website shows Funsho William of PDP as the winner (was actually hacked), yet on ground counting, ACN's Tinubu was announced by returning officer based on physical votes counted.
The Website was not even corrected until after several days.
PDP lost at the tribunal because there is no vote counting online or on servers. NO E-VOTING in Naija. |

Makinde is a contractor to NNPC and IOCs. He has never completed any of the projects awarded to him, some as far back as 2008. All his projects have severed one set back or the other. Maner have accrued VOs more than 50% of original value.
