Under the English common law received into Nigeria by the Supreme Court ordinance of 1914 and Interpretations Act in section 45, Bukola Dakolo would have no case because of the common law doctrine of Res gestae which rendered Criminal cases useless if the evidence was not contemporaneous in time and place.

The law is dynamic and evolves to serve situations like this, thus the enactment of the Nigerian Evidence Act which renders the rules of common law void when it is inconsistent with the provisions of the Evidence Act.

Section 4 of the Evidence Act, 2011, attached below provides to the effect that evidence which occurred at a different time and place related to the fact in issue is relevant and therefore admissible in court.

Why do l say that?
The matter is in a Court of LAW and as such, issues have to be debated in its LEGALITY.
What do l mean?

- Do you agree that there is a subsisting LAW (Electoral Act), which forbids the transmission of results ELECTRONICALLY.

- Do you agree that there was a PROPOSED Amendment to that Law (Electoral Act) but the amendment was not signed into law? ...and therefore it is still illegal to transmit elections result electronically.

- Yes, money was approved to buy Electronic equipments (in anticipation of the President signing the amendment into law), including Servers and they were bought, the Question is: WAS the SERVER USED in the election?

- Another question is: Would it be legal if it were used in the election? Would it not invalidate (legally) the winner of the election, bearing in mind that the law PROHIBITS the trasnmission of result electronically?

- Are you aware that INEC Chair announced ON NATIONAL TV before the election that they have become aware that a particular party (PDP) has hired and commissioned HACKERS, to infiltrate into INEC Servers (hoping it it will used), to manipulate results in their favor....... and as such, INEC has stopped the 'legal and physical' pursuit of transmitting Results electronically?

- Are you aware that in legal parlance, "you cannot build something on nothing" (in layman's term) and if the LAW (Electoral Act) has PROHIBITTED something, it remains prohibitted and all actions emanating from it remains Null and Void?

-Are you aware that the law does not assist the indolent and as such, the Courts cannot help anyone (Political party or its Candidate), in any endeavor that seeks to FLOUT the LAW?
- Are you aware that asking INEC to bring out "The Server it used for transmitting Election result" is tantamount to asking INEC to break the Law (Electoral Act) in its pursuit of validating its election Complaints?
Which Court will grant such wish or even if the Court does grant such wish, INEC will simply respond that such Server does not exist as it would amount to breaking the law ......and the Court cannot compel INEC to break the law?

Your last question (#5) is what l sought to answer in detail because all the previous four are mere "historical facts" which does not affect the decision of INEC not to break the law (by deciding not to use a SERVER to transmit election results).....hence the need for the results to be announced manually/verbally by INEC returning officers.

So you see why l say that we have to separate "emotions" from the application of the law.....the law may be an ass but it is still the law.
What we "wish" to happen in this matter, is borne out of our emotions but what will happen, is borne out of the "electoral LAW".

1. Afonja was the traitor of the Yoruba nation and not the Fulanis. The Fulanis only allied with him and he even tried to renege on his agreement with them.! It was Afonja that betrayed Aole the King of the then OYO EMPIRE.

2. His father, Fani Power, is known traitor of the Yorubas during the first republic and it was in fact his father that led the troop to the Ooni and Akintola's house leading to the death of the then Primier of the Western region.

3. Akintola was the traitor and betrayer of his agreement with Action Group. He led to the first imbroglio in the western region of then. The famous word "Akintola Taku" comes to mind. He led to the temporary removal of the then governor, King Adesoji Aderemi, of the western region.

4. Awolowo was not betrayed by any Fulani man. otherwise mention the name of such. It was in fact Nnamdi Azikiwe that betrayed Awolowo, by going secretly to renege on their agreement to form a coalition against the north for him to get the powerless position of the ceremonial president then. While he knows the position of Prime minister holds virtually all the political powers. and Awolowo in turn played into Akintola's hand by trying to take back the position of premier from him after handing it over to him. Akintola has no choice then than to align with who ever can help him to hold on to power.

5. Civil war era has no betrayer of Awolowo, in fact the president during civil war era was not even a Fulani man. Gowon is a Christian plateau man. An Awolowo was one of the revered leaders of the Federal Government during this period. He was in charge of the finance ministry. and he was a key strategist to the so called Hausa-Fulani ruling team. Even though like I said, the president then was not even a Fulani nor an Hausa man.

6. Chief MKO Abiola was betrayed by many people and no Fulani man was among the prominent ones. IBB, Kingibe, Tony Anenih, OBJ (who said he is not the messiah) were all not Fulani men.

7. Chief Bola Ige was never betrayed by any Fulani man.! If there was anyone that betrayed him, it would be OBJ. I would have allowed this to pass as a commentary on the general state of our education, but for the second item on the write-up.

The op stated that the graduates from private universities are better than those from the federal universities. I beg to disagree. While, there has been a general degradation in our educational system in Nigeria, I still maintained that the Federal Universities are by far better than the private ones in Nigeria of today.

This may be because of my area and industry as a whole but my experience is at complete variance with what the op said. I do sit on the interview panel for my company once in a while, as a technical assessor for engineering recruits, but that is not the only source of my assertion.

I am a member of the society of petroleum engineers and we have two major competitions, the PETROBOWL and PETROQUIZ that we organize for the various universities in Nigeria. The winner in Nigeria normally goes ahead to represent Nigeria at the international competition normally during the ATCE outside Nigeria (mostly in US).

The competition has always been won by Federal Universities, in fact Uniben has won the international competition before and that was the only time a Nigerian university won it.


We also use to assess the petroleum engineering departments of universities in Nigeria and I can tell you that the private universities have a long way to go to catch up with the Federal ones.


Now, that leaves the state owned universities in between. Many are useless and are just universities in name and a few are good.


Yet, no Nigerian University is where they are meant to be in the comity of schools on the world stage.

Did Onnoghen win or lose the case at the Appeal court?

This only means that the transmitted results are based on the signed paper copies. The ones signed by party agents still remain the original.
Hence a copy can not supersede or invalidate an original. If there is any discrepancies, the original must be resorted to.
It would have even been better to transmit a Scanned PDF copy of the original, like that, it will be as good as the original.
As it is now, due to the electoral act and the previous judgement of the Supreme Court on electronic election, the only acceptable result is the original hardcopy as announced by INEC.

The Supreme Court have ruled electronic voting illegal in The case of Dakuku Peterside and APC vs Wike, PDP and INEC.
The same Supreme Court can not accept electronic result now after discarding same in Wike’s case of 2015 election.

INEC server and website results can never be admitted against what was signed by all party reps and declared.

Lagos 2003 governorship election is a precedence. Funsho Williams was declared on the INEC site and even accessible by all on the net. But Tinubu was returned as the winner by all returning officers and declared winner by INEC.

Funsho Williams lost the case at the tribunal.

This is a similar case and the hard paper results will surely win over the frivolous server.

This is not true. The companies are not Miles away.
Bonny Town is sand witched by SPDC's Bonny Terminal and the NLNG plant. Both companies have always responded to calls from Bonny and Finima Town.
The SPDC Gate is in fact inside Bonny town.

I still remember the 2003 election in Lagos where on the INEC server PDP won as displayed on its website.

In fact Funso Williams and PDP were already jubilant but at the INEC collation center in front of the whole world Tinubu was declared the winner.

After few days INEC corrected its server.
All is now history

Makinde is a contractor to NNPC and IOCs.
He has never completed any of the projects awarded to him, some as far back as 2008.
All his projects have severed one set back or the other. Maner have accrued VOs more than 50% of original value.
